Compliance with General 
Plan: 
The 2020 General Plan designates this area as part of The 
Commerce / Industry Park Planning Area, where the proposed 
Conditional Use Permit for an Exterior Storage and RV Sales and 
Rentals use is compatible with the General Plan.   
 
City Zoning/Land Use  
A Recreational Vehicle (RV) Sales and Services is a permitted use 
in the Commerce Park Zoning district but requires a Conditional 
Use Permit for the use of an Exterior Storage Yard to store RV’s.  
 
ARS 28-8481 Land Use 
Compatibility 
The site is located inside the Luke Air Force Base (LAFB) Noise 
Contour Zone, and inside the Military Airport Territory Area and is 
subject to review from LAFB for land use compatibility with ARS 
28-8481. See attached review letter from LAFB.  
 
Considerations: 
The applicant is requesting approval of a Conditional Use Permit 
to develop the 2.0-acre vacant parcel for an RV Sales, rental, 
storage, and service business at the southwest corner of El 
Mirage Road and Butler Drive. The intended use is for RV Sales & 
Rentals, with general maintenance and repair, and RV storage. 
There will be no wash bays, fuel dispensing, or storage of 
hazardous substances.  
 
The office will be a modular structure that will be approximately 
1200sf. The Service Building will be a prefabricated steel building 
of approximately 4400sf (110’ x 40’). It will include two service 
bays, a small office, and parts storage. 
 
City Staff Review 
Staff has reviewed the proposed zoning application and has 
no further comments but has stipulations. 
 
Stipulations: 
1. The applicant shall address all the Technical Advisory 
Committee (TAC) comments/redlines stated in the 
April 15, 2021, Memorandum with the construction and 
civil plan submittal. 
2. The right to a use and occupancy permit shall be 
contingent upon the fulfillment of all general and 
special conditions imposed by the Conditional Use 
Permit procedure.  
3. All the special conditions shall constitute restrictions 
running with the land and shall be binding upon the 
owner of the land, his or her successors or assigns.  
4. All conditions specifically stated under any conditional 
use listed in Zoning Code Chapter 154 shall apply and 
be adhered to by the owner of the land, his or her 
successors or assigns. 
5. All the special conditions shall be consented to in 
writing by the applicant.

6. The proposed Exterior Storage Yard Use shall not 
generate noise, vibrations, and odors that may 
become a nuisance to the general public. 
7. No expiration date of the Conditional Use Permit is 
being proposed by staff; however, failure to meet and 
maintain these stipulations will result in revoking the 
Conditional Use Permit. 
 
Planning Commission 
 
Staff will seek a recommendation from the Planning & Zoning 
Commission to the City Council at the May 11, 2021, Public 
Hearing.   
Council  
Staff is seeking a final action from Council at the May 18, 2021, 
Public Hearing.
