D R A F T REGULAR MEETING OF THE COMMON COUNCIL OF THE CITY OF EL MIRAGE EL MIRAGE CITY COUNCIL CHAMBERS 10000 N. EL MIRAGE ROAD 6:00 PM -TUESDAY, OCTOBER 5, 2021 Minutes 1. ROLL CALL Present: Mayor Alexis Hermosillo; Councilmember Roy Delgado; Vice Mayor Monica Dorcey; Councilmember Anita Norton (via phone); Councilmember Mike Hutchinson; Councilmember David Shapera; Councilmember Donna Winston (via phone) 2. CALL TO ORDER - The meeting was called to order at 6:00 pm. Pledge of Allegiance Moment of Silence 3. PROCLAMATION 1. Declare the month of October 2021 as Domestic Violence Awareness Month. (Police) Assistant Chief Hildebrandt read a brief statement on the impact of domestic violence on victims and abusers. The El Mirage Police Department responded to 546 domestic violence calls in 2020. Stopping domestic violence requires uncompromising accountability of offenders. Mayor Alexis Hermosillo declared the Month of October 2021 as Domestic Violence Awareness Month and encouraged citizens to support the efforts of organizations that support the victims of domestic violence. 4. CALL TO THE PUBLIC Citizens desiring to speak on any issue within the jurisdiction of the public body may do so at this time. Comments shall be limited to three (3) minutes per person and shall be addressed to the City Council as a whole. At the conclusion of the Call to the Public, individual City Council Members may (1) respond to criticism made by those who have spoken, (2) direct staff to review or follow up on the matter, and/or (3) direct that the matter be put on a future agenda. Resident Steve Gilliam thanked council and staff for their work on the traffic signal being installed at the intersection of Dysart Road and Acoma Drive. He also asked for better collaboration between the HOAs in the City and Code Enforcement. Mayor Hermosillo asked the staff to work with Mr. Gilliam to resolve any code issues. 5. CONSENT AGENDA All items listed under the Consent Agenda will be voted on with one motion. If discussion is desired regarding any Consent Agenda Item, that item will be removed from the Consent Agenda and voted on separately. 1. Consideration and action to approve the minutes of the Work Session held on Monday, September 20, 2021, and the Regular Council meeting held Tuesday, September 21, 2021. (City Clerk) 2. Consideration and action to approve the destruction of Personnel Records that have reached the end of their retention period as authorized under A.R.S. § 41-151.19. (Human Resources) 3. Consideration and action to extend the real estate contract with Phoenix West Commercial to November 2022. (Economic Development) 4. Consideration and action to approve a Final Plat for Southwest Concrete and Paving Equipment Yard for an Industrial Use located at 8686 N. El Mirage Road, El Mirage, Arizona 85335. (Development Services) 5. Consideration and action to approve the Arizona Law Enforcement Policy Manual and Daily Training Scenarios Subscription Agreement through the Police Departments Legal Service Provider Edwards & Amato, P.C. Year 1 cost of $4,900, Year 2 cost of $4,100 and $3,500 per year thereafter. (Police) 6. Consideration and action to authorize the City Manager to enter into a Professional Services Contract with Kimley-Horn and Associates to provide engineering design services for speed cushions along 119th Avenue from Myer Lane to Cactus Road in the amount not to exceed $5,700. (Development Services) 7. Consideration and action to approve a contract with Fishel company to complete capital improvement project #62227 - Collections System Replacement Program in an amount not to exceed $120,785.27 and authorize finance to make any necessary transfers. (Public Works) 8. Consideration and action to authorize City Attorney Justin Pierce to execute the One Arizona Opioid Agreement on behalf of the City of El Mirage. (Administration/Legal) 9. Consideration and action to accept a deed from Maricopa County Treasurer's Office for parcel 501-33-009W, located within the Lower El Mirage Wash between Dysart Road and the BNSF Railroad Line, and pay an offer of $500 pursuant to A.R.S. §42-18303(E) to the Maricopa County Treasurer if the offer is accepted by the Maricopa County Board of Supervisors at one of their upcoming Supervisor's meetings (anticipated in November 2021). (Administration) Vice Mayor Dorcey moved to approve consent agenda items 1-9 as presented; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 6. REGULAR AGENDA 2 Regular Meeting - Council Minutes October 5, 2021 1. Public hearing, closure of public hearing, followed by consideration and action to approve Resolution R 21-10-24 authorizing the City to submit a grant application to Maricopa County Community Development Division (MCCD) for FY2022-23 Community Development Block Grant (CDBG) funds, and execute subsequent award agreements, to purchase a new fire truck and accessories, and authorize Finance to make necessary budget transfers. (Grants/Fire) Mayor Hermosillo opened the public hearing. Grants Program Manager Dr. Autumn Grooms provided a description of the grant application to purchase a new fire truck and accessories and asked Council to authorize the application submittal. Resident Steve Gilliam asked what would happen to the old fire truck. He also asked if funding could be deviated to public health needs or some other uses. Dr. Grooms stated the City would need to research how the current fire truck was funded to determine how it can be recycled. Hearing no further questions or comments, the Mayor closed the public hearing. Councilmember Shapera, Councilmember Norton and Councilmember Delgado stated they were in favor of the application. (City Clerk) Vice Mayor Dorcey moved to approve Ordinance O21-10-11 setting forth and fixing the dates, times and location of the 2022 City Council Meetings; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 7. CITY MANAGER'S COMMENTS & SUMMARY OF CURRENT EVENTS The City Council may not act upon any matter in the City Manager's summary but may have general comment or questions. City Manager Dyches had no comments. 8. MAYOR'S COMMENTS and COUNCIL SUMMARY OF CURRENT EVENTS The Mayor and City Council may not discuss or act upon any matter in the summary unless the specific matter is properly noticed for legal action. Councilmember Delgado stated he is getting busy with the CDAC funding. Councilmember Norton stated she participated in a press conference on September 22, 2021, at the domestic violence memorial at the state capital, and she will have a booth at the Fall Harvest Festival to educate on domestic violence issues. Councilmember Winston stated she is very pleased with the installation of the traffic signal on Acoma Drive. 3 Regular Meeting - Council Minutes October 5, 2021 9. EXECUTIVE SESSION 1. Executive Session for Consultation/Discussion with Attorney for Legal Advice (A.R.S. § 38-431.03(A)(3)) a. COVID-19 Employment Policies Vice Mayor Dorcey moved to adjourn into an Executive session; seconded by Councilmember Shapera. Vote: 7 - 0 Passed - Unanimously 10.
