D R A F T REGULAR MEETING OF THE COMMON COUNCIL OF THE CITY OF EL MIRAGE EL MIRAGE CITY COUNCIL CHAMBERS 10000 N. EL MIRAGE ROAD 6:00 PM -TUESDAY, MAY 17, 2022 Minutes 1. ROLL CALL Present: Mayor Alexis Hermosillo; Councilmember Roy Delgado; Vice Mayor Monica Dorcey; Councilmember Anita Norton; Councilmember Mike Hutchinson; Councilmember David Shapera Absent: Councilmember Donna Winston 2. CALL TO ORDER - MEETING CALLED TO ORDER AT 6:00 PM Pledge of Allegiance Moment of Silence 3. PROCLAMATION 1. A proclamation to proclaim May 15 - 21, 2022 as Public Works Week in El Mirage. (Public Works) Public Works Director Nick Russo gave background information on the American Public Works Association which has endorsed National Public Works Week across North America. Thousands of municipalities in the U.S. and Canada use this week to energize and educate the public on the importance of public works to their daily lives; planning, building, managing and operating at the heart of their local communities to improve everyday quality of life. The theme for this year is "Ready and Resilient." Mayor Hermosillo declared May 15-21, 2021 National Public Works Week. 4. CALL TO THE PUBLIC Citizens desiring to speak on any issue within the jurisdiction of the public body may do so at this time. Comments shall be limited to three (3) minutes per person and shall be addressed to the City Council as a whole. At the conclusion of the Call to the Public, individual City Council Members may (1) respond to criticism made by those who have spoken, (2) direct staff to review or follow up on the matter, and/or (3) direct that the matter be put on a future agenda. There were no public comments. 5. CONSENT AGENDA All items listed under the Consent Agenda will be voted on with one motion. If discussion is desired regarding any Consent Agenda Item, that item will be removed from the Consent Agenda and voted on separately. 1. Consideration and action to approve the minutes of the Regular Council meeting held Tuesday, May 3, 2022. (City Clerk) 2. Consideration and action to approve a PSPRS funding policy for Police and Fire. (Administration) 3. Consideration and action to authorize the City Manager to enter into an Intergovernmental Agreement (IGA) with the Arizona Department of Transportation (ADOT) to install two emergency preemption (EVP) systems along Grand Avenue. (Development Services) 4. Consideration and action to increase the Banner Olive Branch FY 21-22 Purchase Order #22009 by an amount of $25,000 in order to purchase meals for senior citizens at the El Mirage Senior Center and authorize Finance to make any transfers. (Community Services) 5. Consideration and action to authorize the Finance Department to make transfers as necessary for FY2021-22 to adjust fund and department balances to comply with state law. (Finance) 6. Consideration and action to authorize the Finance Department to make budget adjustments for FY2022-23 to adjust the balance of FY21-22 carry forward projects. (Finance) Vice Mayor Dorcey moved to approve Consent Agenda items 1-6 as presented; seconded by Councilmember Shapera. Vote: 6 - 0 Passed - Unanimously 6. REGULAR AGENDA 1. Consideration and action to approve Resolution R22-05-12 adopting the City of El Mirage's Title VI Plan, Limited English Proficiency Plan, and Public Participation Plan for the purpose of complying with Federal, State and Regional transit mandates. (Community Services) Community Services Manager Dr. Autumn Grooms provided background information on the Title VI Plan, Limited English Proficiency Plan and the Public Participation Plan for transit mandates. Vice Mayor Dorcey moved to approve Resolution R22-05-12 adopting the City of El Mirage's Title VI plan, Limited English Proficiency Plan, and Public Participation Plan, as presented; seconded by Councilmember Shapera. Vote: 6 - 0 Passed - Unanimously 2. Consideration and action to hold a public hearing to permit any taxpayer to be heard in favor or against any proposed expenditure or tax levy. (Finance) Mayor Hermosillo opened the Public Hearing. Deputy City Manager Robert Nilles provided information on the Truth in Taxation legislation and Fiscal Services Administrator Macy Walker provided information on the final budget. Consideration and action to approve a motion, in accordance with Truth in Taxation legislation, to levy the increased FY2022-2023 Primary Property Tax equal to the amount of $2,716,588. (Administration) Councilmember Hutchinson stated he does not see a need to raise the levy and will not support this item. Roll Call Vote: Vice Mayor Dorcey - AYE Councilmember Delgado - AYE Councilmember Hutchinson - NAY Councilmember Norton - AYE Councilmember Shapera - AYE Mayor Hermosillo - AYE Vote: 5 - 1 Passed 4. Consideration and action to convene in a Special Meeting to determine and adopt proposed expenditure estimates pursuant to A.R.S. 42-17105. Adoption of budget. (Administration) Vice Mayor Dorcey moved to convene in a Special Meeting to determine and adopt proposed expenditure estimates pursuant to A.R.S. 42-17105, Adoption of Budget; seconded by Councilmember Shapera. Vote: 6 - 0 Passed - Unanimously 5. SPECIAL MEETING OF THE COMMON COUNCIL OF THE CITY OF EL MIRAGE EL MIRAGE CITY COUNCIL CHAMBERS 10000 N. EL MIRAGE ROAD TUESDAY, May 17, 2022 Consideration and action to finally determine and adopt the FY 2022-2023 proposed spending limitation and budget pursuant to Resolution R22-05-11. (Administration) Vice Mayor Dorcey moved to finally determine and adopt the FY2022/23 proposed spending limitation and budget pursuant to Resolution R22-05-11, as presented; seconded by Councilmember Shapera. Vote: 6 - 0 Passed - Unanimously 6. Consideration and action to close the Special Meeting and reconvene in a Regular Session. (Administration) Vice Mayor Dorcey moved to close the Special Meeting and reconvene in a Regular Session. Vote: 6 - 0 Passed - Unanimously 3 Regular Meeting - Council Minutes May 17, 2022 7. Consideration and action to approve Resolution R22-05-13 authorizing the City to enter into an IGA with the Dysart Unified School District for the provision of School Resource Officer Services. (Administration) Councilmember Hutchinson stated he spoke with the Dysart School District, and they are willing to fund a second Student Resource Officer 100%. Vice Mayor Dorcey asked if all the schools in the District were going to receive an SRO and City Manager Dyches stated they would. Councilmember Shapera stated the District should be commended for this proposal. Vice Mayor Dorcey moved to approve Resolution R22-05-13 authorizing the City to enter into an IGA with the Dysart Unified School District for the provision of School Resource Officer Services, as presented; seconded by Councilmember Shapera. Vote: 6 - 0 Passed - Unanimously 7. CITY MANAGER'S COMMENTS & SUMMARY OF CURRENT EVENTS The City Council may not act upon any matter in the City Manager's summary but may have general comment or questions. City Manager Dyches had no comments. 8. MAYOR'S COMMENTS and COUNCIL SUMMARY OF CURRENT EVENTS The Mayor and City Council may not discuss or act upon any matter in the summary unless the specific matter is properly noticed for legal action. Councilmember Hutchinson thanked the Dysart Unified School District Governing Board for their concern with Public Safety. Councilmember Norton stated she attended the WestMarc Economic Summit earlier in the day, and she was very impressed with the great opportunities that are becoming available for the West Valley. Councilmember Shapera asked if the message boards were having issues and City Manager Dyches stated she would look into it for him. Mayor Hermosillo stated she also attended the WestMarc Economic Summit and was honored to accept the Chairman Award on behalf of Economic Development Manager Tom Doyle who was unable to attend. 9.
