Project Overview 
The Maricopa County Department of Transportation (MCDOT) has requested additional 
services from Burgess & Niple, Inc. (Consultant) for TT0600 – Northern Parkway: Agua Fria 
Bridge to 103rd Ave project (Project). Additional services include new scope of work elements, 
coordination, and revisions to the existing design late in the project development process. 
Design revisions are attributed to stakeholder needs, including the Project Partners, property 
developers and utility owners. Outlined below are the primary elements: 
 
1. Additional Public Meeting Efforts (New Services) – The Consultant will provide 
additional public meeting support services. This includes: 
a. Prepare and finalize new public meeting materials. The original Scope of 
Services included minor revisions to existing materials. The Project Partners 
requested all new materials. 
b. Provide additional staff to prepare for and attend the project public meeting. 
2. Additional Investigations – The Consultant will investigate design changes based on 
Project Partners direction originating from comments received during the public 
meeting. These include: 
a. Bicycle Lane: Investigate the feasibility of installing bicycle lanes from 112th 
Avenue to 103rd Avenue. 
b. Unbalanced Lanes Section: Investigate the feasibility of an unbalanced lanes 
roadway section. 
c. Right Turn Pocket at westbound 109th Avenue: Investigate the feasibility of 
including a right-turn pocket at 109th Avenue. 
3. Right-of-Way Acquisition Support – The Consultant will provide additional coordination 
with MCRED. MCRED requests additional exhibits beyond those addressed under 
Change Order 2 as well as research and additional meeting preparation and attendance 
with owner’s legal team to achieve resolution. This includes:  
a. Circle K Development at 107th Avenue 
b. Kinder Morgan access at 109th Avenue 
4. Design Coordination and Revisions – The Consultant will conduct a concurrent project 
development and review process with the Project Partners. Due to the change to the 
fiscally constrained alternative from Change Order 2, the Project Partners and 3rd party 
stakeholders will provide additional design revisions throughout project completion. 
With the intent of meeting the obligation deadline for federal funding, an aggressive 
schedule will be implemented. This will result in design and plan set revisions occurring 
at the 95% submittal (September 2024), rolling 100% submittals (April 11, 2025, and May 
2, 2025), final sealed PS&E submittal (May 19, 2025), and Addendum submittal 
(September 2025). Primary areas that will be affected by ongoing efforts include: 
a. 107th Avenue Signal and Intersection Modifications 
b. 111th Avenue Signal and Intersection Modifications 
c. 109th Avenue to 107th Avenue Curb, Roadside and Drainage Modifications 
d. Waterline Relocation Design 
e. Driveway and Drainage Redesign West of 115th Avenue 
f. Jurisdictional Coordination for Curb Ramps

Due to when the design changes will be resolved late in the process, 95% and beyond, changes 
will have a cascading effect to the design impacting interrelated features as well as the PS&E 
package. Quality control will continue to be conducted throughout the process to maintain 
project quality and compliance with design guidelines and standards. 
 
The Derivation of Cost provided in Appendix A includes time and cost to cover both direct and 
indirect impacts associated with the requested revision.

PROJECT COORDINATION 
400.7 
95% Public Outreach Materials 
The Consultant will provide additional support for the public meeting in February 2025. The 
original scope of work assumed that all 95% Public Outreach Materials would be based upon 
the public outreach materials previously prepared for the project which included the full build. 
The 95% Public Outreach Materials were newly developed to reflect the fiscally constrained 
alternative.  
 
The Consultant will: 
 
1. Develop all new exhibits and public involvement materials at Project Partner request. 
The prior scope of work and budget includes minor revisions to existing materials. This 
will require the additional coordination efforts along with the development and review of 
all new materials. Additional materials include: 
a. Typical sections at key locations; 
b. Plan view pictures depicting the proposed improvements; 
c. Bifold project information handout; and 
d. Spanish translation of bifold project information handout. 
2. Provide additional staff to prepare for and attend the project public meeting. 
3. Facilitate two coordination pre-meetings with representatives from MCDOT and the 
Project Partners. 
SECTION 500 
UTILITIES AND RAILROAD 
500.19 
Kinder Morgan Coordination (PIG Launcher Site) 
The Consultant will coordinate with Kinder Morgan and will revise the design and PS&E 
documents to accommodate their infrastructure requirements at the pipeline inspection gauge 
(PIG) launcher site. This will occur after the Change Order 2 submittal and 95% submittal, as a 
result of Kinder Morgan’s timeline, anticipated during the development of the 100% plans, PS&E 
and addendum. Additional coordination includes resolving the right-of-way at the northeast 
corner of 109th Avenue and Northern Avenue (APN 142-73-002Q). The Consultant will 
coordinate with Kinder Morgan to obtain design vehicle information and assess site access. 
The Consultant will evaluate and redesign the driveway, sidewalk, and curb ramp design and 
related design elements and PS&E documents.   
 
The Consultant will: 
1. Prepare an exhibit to communicate the design alternatives to Kinder Morgan; 
2. Facilitate three meetings with the Project Partners, Kinder Morgan, MCDOT, MCRED, and 
Clark Hill (County Attorney) to present the design alternatives for facilities including the 
PIG launcher; and 
3. Revise the design and PS&E package based on direction received from Kinder Morgan 
and the Project Partners to facilitate Kinder Morgan signing ROW acquisition offer 
package. Additional design information provided by Kinder Morgan will include design 
vehicle and access requirements affecting the location and orientation of the driveway 
and curb ramp. Revised elements include:

These services will be provided in an expedited manner to facilitate the right-of-way clearance 
for the project.  
 
500.20 
Waterline Approval 
The original Scope of Work anticipated a submittal process through Maricopa County 
Environmental Services Division (MCESD). However, as MCDOT is the administering agency, 
ADEQ must now review and approve the waterline plans in place of MCESD. The project includes 
waterline improvement plans for both the City of Glendale and the City of Peoria, and ADEQ 
approval must be obtained separately for each City. Because the Cities are unfamiliar with the 
ADEQ approval process, they will require guidance and coordination from the Consultant. The 
Consultant will assist by coordinating with both Glendale and Peoria to submit the waterline 
designs for ADEQ approval. This support includes confirming registration or registering each 
City with ADEQ through MyDEQ, having the Cities designate the Consultant as an Approved 
Submitter on their behalf, and completing the submittals on behalf of the Project Partners. The 
process also includes an additional coordination meeting and correspondence with ADEQ staff 
to facilitate this non-standard review process, including determining applicable review fees.

TECHNICAL MEMORANDA AND REPORTS 
800.11 
Post Public Meeting Investigations 
Following the public meeting in February 2025, the Project Partners requested the Consultant 
investigate three scenarios based on comments received from the public and stakeholders. The 
Consultant will conduct coordination calls and meetings with the Project Partners to investigate 
the scenarios. The Consultant will: 
 
1. Investigate the feasibility of bicycle lanes. The investigation will include preliminary 
design and preparing an exhibit to assess the redistribution of pavement width between 
vehicular lanes and bicycle lanes. Challenges and opportunities will be identified by 
corridor segment. Impacts to the project schedule and funding risks will be investigated 
and discussed with MCDOT. 
2. Investigate the feasibility of an unbalanced section. The investigation will include 
preliminary engineering and preparing an exhibit to depict impacts of creating an 
unbalanced section. This includes consideration of right-of-way and environmental 
clearance impacts and how the unbalanced section would tie into MCDOT Project 
TT0372. The Consultant will also assess the financial impacts of creating an unbalanced 
section including updating the TT0600 and TT0372 cost estimates. Impacts to the 
project schedule and funding risks will be investigated and discussed with MCDOT.

3. Investigate the feasibility of a right-turn lane at 109th Avenue. The investigation will 
include preliminary engineering and preparing an exhibit depicting the impacts of 
including a right-turn lane at westbound 109th Avenue. Impacts will consider including 
right-of-way, utilities, sidewalk, curb ramps, and vehicular access. Coordination meetings 
will be held with the Project Partners to discuss the findings. This is an independent 
issue from the Kinder Morgan investigation at the same location but will be coordinated 
with Kinder Morgan. 
SECTION 900 
RIGHT-OF-WAY 
900.18 
Right-of-Way Acquisition Support 
Change Order 2 included a ROW basemap update, parcel tracking spreadsheet update, and four 
parcel specific exhibits. After Change Order 2, the Consultant will coordinate with MCRED to 
provide additional right-of-way and easement acquisition support. The Consultant will prepare 
two roll plots depicting new right-of-way and easements to support condemnation cases.  
 
The Consultant will assist with coordination with the parcel owner on the southwest corner of 
Northern Avenue and 107th Avenue. This includes investigating historical project decisions for 
a right turn pocket and required right-of-way, reviewing developer site plan for conflicts, 
attending coordination meetings, and revising the special provisions for site access during 
construction. Consultant will prepare for, attend, and document the following meetings to 
support the right-of-way acquisition process: 
• 
Meeting with Circle K attorney, MCDOT, and MCRED in January 2025 to discuss access 
concerns during construction 
• 
Meeting with Northern Village developer, City of Glendale, MCDOT, and MCRED in March 
2025 to discuss right-of-way set back requirements and historical project decisions 
Following the meeting, the Consultant will send summary correspondence with next steps and 
update the special provisions based on changes requested by developers.  
  
This Right-of-Way Acquisition Support services will be provided in an expedited manner to 
facilitate the right-of-way clearance for the project.

Plan Revisions 
The Consultant will coordinate, redesign, update PS&E documents post-95% submittal, and 
perform quality reviews of revised project elements. The Consultant will:

design per the City of Peoria to relocate the controller including revised traffic design 
and corridor model as well as new sidewalk, curb ramps, drainage, and grading. The
