El Mirage Road EI Mirage, Arizona 85335 Re: PZ23-12-22 CUP & Site Plan Relief Request from Code § 152.030 Dear City Council, Fuel Processing Operators (Pro Petroleum) formally requests the City Council to consider relief from undergrounding of lower voltage overhead power lines in accordance with city of El Mirage Zoning Code Land Usage Volume 2 §152.030, Section E.3 General Provisions. Provision 152.030 E.3 states, “(E) Relief from undergrounding requirements may be considered, at the discretion of City Council, under the following conditions.” “(3) Exemption may be considered when high-voltage powerlines, above 13kv or similar, would remain on the poles after the undergrounding of the lower voltage lines” This request for relief is based upon the following: © APS confirmed the existing power poles along the subject property has 69kv lines per an email dated February 2, 2024 from Kurt Warnstedt, Service coordinator (see attached); and e Existing power poles and 69kv lines would be remaining after the undergrounding of the lower voltage lines per the Conditional Use Permit Narrative dated February 5, 2024. Based upon the above existing conditions and proposed Phasing schedule for the Pro Petroleum Plant expansion project, we formally request relief from conditions listed under code § 152.030 General Provisions.
