Contract No. C-22-25-019-X-01 Amendment No. 1 Town of Youngtown Page 1 of 3 AMENDMENT NO. 1 TO THE INTERGOVERNMENTAL AGREEMENT BETWEEN MARICOPA COUNTY ADMINISTERED BY ITS HUMAN SERVICES DEPARTMENT AND TOWN OF YOUNGTOWN I. Maricopa County (“County”), administered by its Human Services Department, entered into a financial Intergovernmental Agreement (“Agreement”) with the Town of Youngtown (“Subrecipient”) which was fully executed on or about October 1, 2024. The purpose of the Agreement is for the Subrecipient to provide safe and level sidewalks throughout the project area by adding approximately 10,000 linear feet of sidewalks along with curb ramp replacement and retaining wall reconstruction. These activities meet CDBG program’s National Objectives as defined in 24 CFR § 570.208. The Agreement term is October 1, 2024, through September 30, 2026. Under the Agreement, the County provided $1,000,000 to the Town for work statement activities in U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) funds for Program Year 2024 Fiscal Year 2025 (PY24-FY25) under Assistance Listing Number (ALN) 14.218. The County and the Town collectively are referred to as the “Parties” and individually as the “Party.” II. The Parties now agree to modify the Agreement as authorized by Paragraph 4.0 (Amendments) of the Agreement as follows: A. The Agreement total funding amount shall hereby increase by $50,400.90 in PY24- FY25 (HUD) Community Development Block Grant (CDBG) funds under ALN 14.218. B. Revise the Agreement Amount on Page 1 to reflect a new total Agreement funding amount of $1,050,400.90. C. Revise Section 1 (General Provisions), Paragraph 46.0 (Nondiscrimination, Equal Opportunity and Equal Access), Subparagraph 46.2 in its entirety with the following: 46.2 The Subrecipient, in connection with any service or other activity under this Agreement, shall not in any way, discriminate against any person on the grounds of race, color, religion, sex, national origin, age, disability, political affiliation or belief. The Subrecipient shall include this clause in all of its Subcontracts. Refer to Paragraph 21.0, (Default and Remedies for Noncompliance). D. Revise Section 3 (Work Statement), Paragraph 5.0 (Budget), and replace it in its entirety with the following: Contract No. C-22-25-019-X-01 Amendment No. 1 Town of Youngtown Page 2 of 3 5.0 BUDGET 5.1 Activity Budget Program Year Fiscal Year Engineering, Construction, Management, and Closeout $1,050,400.90 PY2024 FY2025 Total $1,050,400.90 5.2 The County shall provide an amount not-to-exceed One Million fifty thousand four hundred and ninety cents ($1,050,400.90) subject to the terms of this Agreement and availability of funds. Funding is provided under ALN 14.218 U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) funds for Program Year 2024. This Agreement amount constitutes the County’s entire participation and obligation in the performance and completion of all work to be performed under this Agreement. III. Section II above contains all the changes to the Agreement made by this Amendment No. 1. The Agreement is amended to incorporate the changes contained in this Amendment No. 1. All other terms and conditions of the Agreement remain in full force and effect as executed by the Parties. This Amendment No.1 is subject to and incorporates the provisions of A.R.S. § 38-511. IV. The Parties have authorized the undersigned to execute this Amendment No. 1, and it shall be effective upon approval and signature by the Parties.
