INVOCATION - INVOCACIÓN Vice Chair Brophy McGee introduced Helen Purcell, former Maricopa County Recorder. Ms. Purcell offered the invocation. 3. PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA Ms. Purcell spoke briefly about the significance of the American flag and then led the Pledge of Allegiance to the flag. Vice Chair Brophy McGee spoke about the many accomplishments of Helen Purcell in Maricopa County and asked for a round of applause as a gesture of thanks for her service. Supervisor Gallardo spoke briefly about Ms. Purcell and thanked her for her service. Chairman Galvin commented on Ms. Purcell’s professionalism during her tenure serving in the Recorder’s office and echoed the views stated by Supervisor Gallardo. 4. PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL - PRESENTACIÓN DE ANIMALES DOMESTICOS POR EL DEPARTAMENTO DE CONTROL Y CUIDADO DE ANIMALES May Phan, Maricopa County Animal Care and Control, introduced Curry, a three-year- old female dog. Ms. Phan said Curry is sweet, calm, and would make a great companion animal and is available today at the West Shelter. Before moving on to the Planning and Zoning Hearings, Chairman Galvin acknowledged Supervisor Gallardo who has served 10 years on the Board of Supervisors. Supervisor Gallardo said the past 10 years have been the best of his career and he appreciated the support. Development of the site shall be in substantial conformance with the Site Plan entitled, “Site Plan” consisting of 11 full-size sheets dated October 21, 2024, and stamped received December 4, 2024, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Zone Change With Overlay from RU-43 to C-3 CUPD”, consisting of 9 pages, dated December 4, 2024 except as modified by the following conditions. c. At the time of application of the Building Permit, update the onsite drainage to include the landscape area on the property along Riggs Road. Update the retention calculations and the underground storage pipe lengths. 7. Channel grades and resultant velocities within the east channel exceed those which would allow for unlined systems. At the time of application of the Building Permit, the final design of the east channel will warrant stabilization. 8. At the time of application of the Building Permit, update the channel with freeboard per DPSM Standard 6.8.7. 9. The subject site is located within the County’s Urbanized Area. A Storm Water Pollution Prevention Permit (SWPPP) from the County will be required prior to issuance of any construction permits. This does NOT preclude the requirement to obtain a Notice of Intent to Discharge (NOID) from the State (ADEQ), as may be required. e. The following C-3 CUPD Zoning District development standards shall apply: 1. Parking - 1 per 250 sq. ft. of floor area for retail, office and commercial uses with enclosed vehicle and trailer storage areas not included in floor area calculation 2. Screening/Buffering - 8’ screen wall required along south and east property line and 3’ tall landscape screening for parking along the western side to address restrictions due to the existing drainageway 3. Landscaping - Landscaping strip waived in lieu of landscape plan 4. Sight Visibility Triangles (SVTs) – Two (2) sight visibility triangles waived along the gated emergency access on Indiana. All other required sight visibility triangles shall remain f. CUPD overlay is applied to restrict the use of the site. Until such time as the site is served by sewer, uses on the site shall only be those acceptable to the Maricopa County Environmental Services Department (MCESD) that can be accommodated by septic systems. A public water system shall be required prior to establishment of any use that requires potable water. The CUPD overlay shall prohibit the following uses: adult-oriented facilities; amusement enterprises and outdoor amusement parks; auction sales, including swap meet operations; automobile laundries; automobile repair shops and garages, including outside vehicle display and storage; automobile and golf cart sales, new and used, service and rental; bars, including retail sales of packaged goods for off-site consumption; billboards; boat sales, service and rental, including outdoor displays; bowling alleys; bus depots; circus and carnival grounds having permanent facilities; dance halls and nightclubs, including outdoor amplified music; drive-in or drive-thru restaurants and refreshment stands; drive-in or outdoor theaters; equipment rentals and sales, but not including equipment customarily used for heavy construction; frozen food lockers, including processing but not slaughtering of animals; funeral homes, mortuaries and chapels; hospitals; hospitals, clinics and kennels for animals; hotels, motels, resorts; liquor stores; lumber yards not including industrial milling or planning operations; medical marijuana dispensary facilities and/or marijuana establishment; miniature golf courses and driving ranges; mobile home, travel trailer and recreation vehicle sales and service; outdoor race tracks; parking lots and public garages, vehicle storage; permanent facilities for rodeos, auctions, swap meets, campgrounds, and sites rented for private parties; pet boarding of cats and dogs and other small animals; printing, lithography and publishing establishments; recreation centers with pool halls or billiards; stone monument sales; theaters, not drive-in or adult-oriented; trade schools; truck stops, with customary accessory facilities including but not limited to restaurant, convenience retail, motel, truck wash, and minor repair facilities but not including major repair, freight storage, freight handling, warehousing or distribution facilities; veterinary hospitals, clinics and kennels for dogs, cats and small animals; and, zoos, including the keeping of wild or exotic animals on a private or commercial basis. h. Prior to issuance of the initial building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. i. Any lighting shall be placed so as to reflect the light away from adjacent residential districts. All outdoor light fixtures shall be fully shielded and directed downward. Additionally, all interior lighting visible to the exterior of the property through windows shall also be fully- shielded and directed downward. j. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. k. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. l. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Zone Change, the property may be considered by the Board after recommendation by the Commission at a public hearing for reversion to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Zone Change, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Zone Change. The Clerk said she received 40 speaker slips for people registering in favor and do not wish to speak; four registered to speak in favor only if necessary; two registered to speak in favor; five registered to speak in opposition. Lindsay Schupe, applicant, was at the meeting and had a presentation. Chairman Galvin asked Tom Ellsworth, Director of Planning and Development, and Darren Gerard, Planning Division Manager, to come forward to give the staff presentation. Mr. Ellsworth presented the rezoning case, Z2022118. He gave an overview of the case, including location and the intended development of the land. Formal Meeting Minutes 02/26/2025 Page 10 of 59 The slide above showed a proposed landscape design and some of the commercial development ideas. Mr. Ellsworth said the purpose of the rezoning request was to facilitate the storage of recreational vehicles. He said the opposition is about the increased traffic, crime, and property values. Mr. Ellsworth said an additional condition ‘m’ might address some of the citizens’ concerns. Supervisor Stewart discussed his involvement with the citizens and applicant and said concessions could be made on both sides to come to an agreement. Lindsay Schube, applicant representative with the law firm Gammage and Burnham, came forward to present. Formal Meeting Minutes 02/26/2025 Page 11 of 59 Ms. Schube said this case involves a five-acre site on the border of the Town of Queen Creek and Maricopa County as seen on the slide above. Ms. Schube further reviewed the location of the proposed development, saying this location is ideal for a small commercial development. Formal Meeting Minutes 02/26/2025 Page 12 of 59 The above slide gave additional detail of the proposed site plan and Ms. Schube spoke briefly about the proposed main access to the development off Riggs Road and an additional access for emergency use only as seen on the diagram. Ms. Schube said the above slide showed a rendering of the center being proposed. Supervisor Stewart asked if there would be a sidewalk located on the north border of the property. Mr. Ellsworth confirmed a sidewalk would be required by Maricopa County. Formal Meeting Minutes 02/26/2025 Page 13 of 59 Ms. Schube compared the zoning regulations on the chart above. Ms. Schube commented on the flexibility of Maricopa County CUPD process that can prohibit certain business uses. This is favorable in many neighborhoods because the applicant and neighbors can work together to craft solutions that can address concerns. Formal Meeting Minutes 02/26/2025 Page 14 of 59 Ms. Schube reviewed the slides above and below regarding Response to Concerns and commented on the two-year process and all that has been accomplished. The Clerk called on the following people who spoke in opposition: Heather Ferenz, resident, said the maps do not show where all the houses are that will be impacted. She has not met anyone who is in favor. Jim McClure, resident, said he lives on the south border of the proposed business and does not think this business fits into the neighborhood. Nicole Dumke, resident, said her family and neighbors will be negatively impacted if this project goes forward. She said they do not need commercial businesses in this residential area. Ms. Dumke said she would like the agreement in writing before anything is approved. Mr. Ellsworth reviewed the process that Planning and Development follows to memorialize the agreement. Supervisor Stewart asked to have a copy of that document, and he would forward the document to Ms. Dumke. Scott Baxtor, resident, said he is in opposition to this project because his family moved into this neighborhood to get away from the noise and traffic. Supervisor Stewart asked Mr. Ellsworth to get him the traffic study done for this project. Carley Morgan, resident, said she appreciated all the cooperation that has gone on during this process. Ms. Morgan said she is not in favor of the project in their neighborhood, but all the people working together has made it easier. Neb Francois, resident, said he is very familiar with this neighborhood and retail is needed in this area. He said because of the amount of traffic in the area, this location is not well suited for residential. Ms. Schube returned to the podium and said she appreciated all the feedback and asks the Board for approval on this item. Development of the site shall be in substantial conformance with the site plan entitled “16732 E Fairview St“, consisting of 1 sheet, stamped received June 17, 2024 except as modified by the following conditions and that a except that a revised site plan shall be submitted within 60 days of Board approval that addresses all remaining MCDOT concerns. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Prior to issuance of building permits, receive approval in the form of a Roadway Design Manual Design Exception for the sight visibility triangle. The traffic report/design exception should include the most recent 5-year crash history at the Higley Rd. and Fairview St. intersection (and existing driveways) to document any safety concerns at the location. The exception request should also state if the first driveway will be locked and will not be used by the property owner thus alleviating safety issues. 9. Prior to issuance of building permit , a modified traffic study shall be submitted to and approved by both MCDOT and the Town of Gilbert. The study shall include the following: a. Show 30 required spaces inclusive of 2 ADA spaces; b. State “Vehicles shall not park on Fairview St.”; c. State that the semi-circular driveway connecting to Fairview shall not be used for event traffic circulation and that entry will be barred to that access by a locked gate; d. State that event traffic will turn right to enter and left to exit the property; and, e. State that there will be directional signs directing event attendees to turn right in to enter the venue and left out to exit onto Fairview. 10. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 11. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by the final engineering design of the site’s drainage infrastructure. 12. Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with the application for Building Permits. d. The following SUP standards shall apply: 1. Min. Screening – Adjacent to rural or residential zoning districts automobile parking shall be screened from view. A solid masonry wall, six feet in height, is required adjacent to side property lines abutting any rural or residential zoning district. There shall be no more than fifteen (15) commercial events held annually. f. Events may be held from Friday through Sunday from 8:00 a.m. to 10:00 p.m. Events shall not be held Monday through Thursday. g. Amplified music is permitted between the hours of 12:00 p.m. and 10:00 p.m. during events only. h. A traffic director shall direct traffic on-site and off-site an hour prior to an event and for an hour post event. i. All outdoor lighting shall be directed downward and shielded in accordance with Section 1112 of the Maricopa County Zoning Ordinance. j. A fair disclosure agreement and covenant, which would include the following disclosure, should be recorded as a condition of development approval: “This property, due to its proximity to Phoenix-Mesa Gateway Airport, will experience aircraft overflights, which are expected to generate noise levels that may be of concern to some individuals. The mix of aviation activities and types of aircraft expected to be located and operate at the Airport now and in the future include: scheduled and unscheduled commercial charters, commercial air carriers and commercial air cargo operations, all of which are expected to use large commercial aircraft; general aviation activity using corporate and executive jets, helicopters, and propeller aircraft; aviation flight training schools using training aircraft; and military activity using high performance military jets. The size of aircraft and frequency of use of such aircraft may change over time depending on market and technology changes. k. The SUP is valid for a period of 5 years and shall expire 5 years from the date of BOS approval. The SUP timeframe may be extended with an application for a Modification of Conditions. l. Prior to occupying the existing residence or any portion thereof for any use associated with the Special Use Permit, the applicant shall obtain a Building Permit to retrofit the existing residence to meet current commercial building code requirements as applicable and shall obtain a Certificate of Occupancy for the retrofitted building prior to occupancy. m. Noncompliance with any Maricopa County regulation shall be grounds for initiating a revocation of this SUP as set forth in the Maricopa County Zoning Ordinance. n. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. o. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy Formal Meeting Minutes 02/26/2025 Page 19 of 59 uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the SUP, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the SUP, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the SUP. The SUP enhances the value of the property above its value as of the date the SUP is granted and reverting to the prior zoning results in the same value of the property as if the SUP had never been granted. He said he is sensitive to neighborhood traffic, and he talked at length about mitigating traffic problems. Mr. Torgeson talked about being a philanthropic SUP and said most of the business is family and close friends. He said he has addressed all opposition and is willing to do what is takes to be a good neighbor. Chris Warren, resident, spoke in opposition. He stated he lives 5-6 houses down from this venue and this is not an appropriate use for this quiet neighborhood. Mr. Warren cited concerns about traffic, parking, and alcohol consumption. Supervisor Stewart commented on small business and the value for our citizens. He said he met with Commissioner Lindblom, and he understands all the concerns and believes this is a good neighbor who just wants to weave into the neighborhood. The grant originally began on July 1, 2022 and was extended to June 30, 2024. The Arizona State Department of Emergency Management is requesting the extension of the grant through March 31, 2025. The contract will provide Maricopa County with EPO administrative services for the Maricopa County Self-Insured EPO Benefits Plan, offering medical, prescription, and behavioral health benefits to approximately 3,900 of the 13,000 eligible employees and their eligible dependents. Blanca Caballero, Assistant County Manager, gave an overview of this item. Supervisor Stewart spoke and confirmed this was not linked to the Banner Health item from two weeks ago. Lauri Baroni, resident, questioned the tax-exempt status (Banner) vs the for profit status (Aetna) when combining the two. She questioned the legitimacy of these large numbers. Formal Meeting Minutes 02/26/2025 Page 40 of 59 Joe Hopf, resident, said at a previous meeting, Banner was the recipient of $400 million and now $260 million and he is asking for more transparency when the amounts are this large. Jen Pokorski, County Manager, was asked by the Chairman to delineate between the two items mentioned by the previous speakers. Ms. Pokorski said two weeks ago, the item in question was regarding the Industrial Development Authority (IDA). Emily Parrish and Charlotte Marz from Human Resources were asked to come forward to explain the item today that has to do with health insurance benefits for Maricopa County employees. Charlotte Marz, Deputy Director of Human Resources, explained that this $260 million is for administration and claims costs for employee health benefits handled by Banner/Aetna, an insurance company. Supervisor Lesko asked for a little history on this subject to bring continuity. Ms. Marz stated that there are three health plans at the County for employees. Two are being administered by United Healthcare and one is currently administered by Cigna. The contract that is on the agenda today replaces the Cigna contract. She explained the number of employees enrolled in each plan is roughly 3900 employees. Supervisor Stewart helped to clarify the difference between the item last meeting (IDA) and this item (employee benefits). Vice Chairman Brophy McGee asked if an IDA representative was available to further clarify what that agenda item covered. Julie Arvo MacKenzie, General Counsel with IDA, came forward to clarify the previous item that was $400 million of tax-exempt revenue bonds, with the borrower being Banner Health to be used for a series of capital projects. The money was borrowed from investors on a tax-exempt basis. The purpose of this grant is to provide MPox information to every patient that has a Human Immunodeficiency Virus (HIV) test in the STD clinic; as well as offering the MPox vaccination on the same day in conjunction with their current appointment. MCDPH is committed to ensuring everyone can make their own health decisions, including whether to receive a vaccine. The PO was issued by ADHS on January 3, 2025. The PO’s not-to-exceed amount is $344,528.00. The PO is reflecting an updated service range for the performance period January 01, 2023, through January 31, 2025. The original performance period was January 01, 2023, through December 31, 2023. The IGA contract term is January 01, 2023, through December 31, 2027. The grant has been awarded every year since 2023 and goes to 2027, so this is not the first time it has been awarded. It is unknown if it will be awarded again. It is non-competitive and there is no cash or in-kind match required. The Department of Health’s indirect rate for FY25 is 15.79%. Indirect costs are estimated at $46,982.44, all of which is recoverable. In compliance with the Health Services Resources Administration (HRSA) Regulations, the Board of Supervisor's Chairman is the Chief Elected Officer for the Ryan White Part A grant, which provides approximately $12 million annually for services for people living with HIV in Maricopa and Pinal County. The Board of Supervisors appoints a Planning Council to set priorities and determine resource allocations for services to be funded with these grant funds. The Planning Council must establish Bylaws to govern their activities. The Bylaws were last updated in June 2023. The Bylaws were reviewed and revised by the Planning Council's Standards and Rules (STAR) Subcommittee, with legal counsel provided by the Maricopa County Attorney's Office. He said that the provision is required by state law. Jim Prindiville, Chief Financial Officer (CFO) for the Sheriff’s Office confirmed the previous statement and added that all legal documents are reviewed by the Legal Counsel. Chairman Galvin confirmed that this provision ensures that Israel cannot be discriminated against. Luimar Garza, resident of Florida, commented on the Sheriff’s Office going outside the laws and setting up undercover operations to go after legitimate medical marijuana dispensaries. Supervisor Lesko commented on this issue of boycotting Israel and said this subject has been discussed at state and congressional levels. She said there has been legislation passed that is against boycotting Israel and Maricopa County is required to follow state laws. Vice Chairman Brophy McGee asked Mr. Liddy if prior agreements with the Sheriff’s Office are still valid. She referred to handouts she provided to “Cease and Desist” in the use of the machines. Ms. Baroni said she wants Recorder Heap’s rights restored so he can do his job. Chairman Galvin asked Ms. Pokorski to clarify what item 70 is about. Ms. Pokorski stated this item was to allocate money for an independent review of the technology and process of elections. She said Susan Adams, Director of Internal Audit, would be the point person. Ms. Adams came forward to clarify this is for an independent review of the equipment and the election process, designed to increase confidence in Elections going forward. She said there are very specific qualifications for the organization who would be consider to conduct the review. Internal Audit is being utilized to assist in the selection and support of the vendor. Ms. Adams stressed the importance of conducting elections with efficiency and according to statute. Supervisor Lesko said she was excited that the Board is voting on this today. She said she has been pushing for a comprehensive review that has been her “rally cry”. Supervisor Stewart said he was also excited to have this come forward today. He said he was in favor of shared responsibility for the elections and the importance of continued process improvement. Vice Chair Brophy McGee said thank you to Supervisor Lesko for her expertise and leadership. She said this was the most important elections initiative that the Board has going and the Board of Supervisors need to set the baseline on elections. He said it is important to do comprehensive review at this time and the review will show, perhaps, a few recommendations for improvement. Supervisor Lesko clarified that Arizona State law dictates an early voting option and the use of tabulators. Those decisions are not up to the Board of Supervisors. Chairman Galvin commented on the progress that the Board has made on this important subject. He said he is proud of how the elections have been run and the Board cannot rest on its laurels, seeking constant improvement. Officer Smitherman began his career in the Protective Services Division in 2003 and served a variety of roles including on the Security Services team as a liaison for Elections and Security Services. Ms. Pokorski outlined some of his achievements and said he was respected and a friend to all who knew him. Chairman Galvin asked for a moment of silence to honor him. Supervisor Stewart talked about attending the State of the City for Chandler and the State of the City for Queen Creek. He said both events were well attended, and he thanked those who were able to attend. He thanked the public who attends the Board meetings and give their input. Vice Chairman Brophy McGee said she attended a presentation with featured speaker, Michael DeLeon, whose presentation, Steered Straight, focused on discouraging school age kids from getting involved with drugs. She also talked briefly about a town hall meeting she attended on Emergency Preparedness. She said she participated in the Annual Phoenix Foundation Honor Run, honoring Zane Coolidge who was shot and killed in the line of duty. Supervisor Lesko said she has been meeting with constituents across District 4 which included a trip out to Lake Pleasant to see the WWII Seaplane that landed there. Permission was granted for the plane to land on the lake and to then be disassembled and sent to The Pima Air and Space Museum in Tucson. Supervisor Lesko also mentioned that she visited Luke Air Force Base along with other West Valley elected officials to learn about the importance of Luke and how vital Luke Air Force Base is to national security. Supervisor Gallardo agreed with Supervisor Lesko regarding Luke Air Force Base and the importance, and they are great partners to Maricopa County. He said this past week was great in District 5 with the popular Laveen Barbeque which is one of the largest community events. Supervisor Gallardo said he has been working with the local school districts, getting summer programs scheduled including the D-Backs Jam that will return this year. Chairman Galvin said he has traveled around District 2 and last week he attended the Arizona Alliance for Golf Water Committee meeting. Chairman Galvin said golf is an important economic driver in the valley and the Alliance takes water and water issues seriously. He said he went to the meeting of the Fountain Hills Rotary and enjoyed gathering to share ideas. Supervisor Gallardo gave a shout out to Procurement and Kevin Tyne for his recent efforts to get new vendors bidding on projects for Maricopa County. 77. Don Adams, resident, talked about a citizen’s right to sue the government when civil rights have been denied. Mr. Adams said the people are being denied the right to express grievances with the Board and thinks the people have a right to access the meetings online. Dianne Barker, resident, talked about air quality and particulate matter that is very high in Maricopa County. She said she does not see a lot of progress and would like Maricopa County to plan and follow through. Ciara Anderson, resident, and Precinct Committeeman in LD 10, said she was shocked by the actions against Recorder Heap, keeping him from doing his job. She asked for the Board to give him the Shared Service Agreement so he can get to work. Dan Schroeder, resident, talked about the problems in America that dates to 1871. He said we were turned into a corporation and have lost our civil rights. He said the US military has been involved, the stolen elections will be exposed, and the country will be returned to We the People. Stephen Wheeler, resident, talked about individual rights, the constitution and how the people have been oppressed by having public comment at the end of the meeting. First amendments rights are being violated. Joe Hopf, resident, talked about constitutional rights, and first amendment rights in particular that are being violated at the Board meetings. Patty Porter, resident, was called on but did not come forward. Roger Pickerill, resident, state committeeman for LD 22, chaplain, and Viet Nam vet said the people have a voice and want to be heard. Mr. Pickerall suggested the Public Comment be heard at the beginning of the meeting. Lezley Shepherd, resident, talked about a speaker who was denied the chance to speak. She was concerned there was no convenient handicap parking near the auditorium. She said it is a first amendment violation. LISTING AGREEMENT WITH ROI PROPERTIES, LLC Request the Board to approve and execute a Listing Agreement between the Flood Control District (District) and ROI Properties, LLC (ROI) authorizing ROI to list and market real property to the public that has been declared as excess to the needs of the District. The District is authorized to offer up to a 3% brokerage fee pursuant to Resolution 2007R012. Interested buyers procured by ROI will be required to bid at public auction pursuant to A.R.S. § 48-3603. The District utilizes its disposition program on all excess properties to evaluate them for the best potential of sales or leasing, depending on current market information. The properties would be sold at public auction with the minimum bid being market value as determined by appraisal, unless to another agency for public purposes, at market value without auction. TERM OF AGREEMENT AND CONDITIONS OF SALE: The term of this Listing Agreement (the “Agreement”) shall be from March 1, 2025 – February 28, 2026 (the “Term”) (I). The prices for which the Properties are offered shall be in accordance with A.R.S.§ 48-3603 and as set forth in Addenda issued upon the listing/broker engagement of each Property.
