Approval of this item would allow for the permitting of a trash 
compaction business via Special Use Permit, Smash My Trash, on 
a Rural-43 zoned site in the Chandler Heights area. The site is 
currently subject to violation V2400016 for commercial business 
operation in a Rural zoning district without proper zoning 
entitlement. No trash compaction or trash storage would occur on-
site. No cleaning of waste-bins would occur on-site. The only use of 
the site would be the storage of trucks and cleaned garbage bins 
related to the business. There are six letters of support largely from 
the west, and three letters of opposition largely from the east. The 
support letters generally talk about the business being a good 
neighbor with little disturbance arising from site operations. The 
opposition refers to concerns over noise generated by site 
operations and traffic on the east easement leading into the subject 
and neighboring properties. The support/opposition map is 
attached. A super-majority vote has not been triggered as the total 
parcels opposed to this project is less than 14%, less than the 
required 20% for such a vote. There are no outstanding concerns 
from reviewing agencies. 
 
 
Prior to the hearing, staff and the applicant conferred on changes 
to conditions ‘j’ and ‘l’. Changes to these conditions were included 
as part of a handout memo that was presented to the commission.

Truck traffic associated with the business is limited to the 
hours between 6am and 4pm. Business operations will 
cease on the property at 5pm Monday through Friday. 
Commercial access to the site is limited to the west driveway 
unless and until documentation is provided that the 
easement along the east will permit commercial traffic.

The following Planning Engineering conditions shall apply:

the mid-section. Applicant is required to provide, at 
the applicant’s expense, an American Land Title 
Association (“ALTA”) Owner’s Policy of Title 
Insurance showing title vested in Maricopa County, 
a political subdivision of the State of Arizona. 
Dedication shall be completed prior to the issuance 
of any building permits on the site or within six (6) 
months of Board approval, whichever occurs first.

Recommendation: 
On 4/10/25 the Commission voted 6-0 (motion by Commissioner 
Leighton D4 seconded by Chairman Lindblom D1) to adopt a 
motion recommending the Board of Supervisors approve 
SU240008 subject to conditions ‘a’ - ‘o’ with modifications to 
conditions ‘j’ and ‘l’ as follows: 
 
a. 
Development of the site shall be in substantial conformance with the Site Plan entitled 
“16442 E. San Tan Blvd“, consisting of 1 full-size sheet, dated March 19, 2025 except as 
modified by the following conditions. 
 
b. 
Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Special Use Permit – Interim Industrial Narrative Report for Keith Storage Yard”, 
consisting of 6 pages, dated March 19, 2025, except as modified by the following 
conditions. 
 
c. 
This special use permit is valid for a period of 5 years and shall expire on May 7, 2030, or 
upon abandonment of the use for a period of 90 or more consecutive days, whichever 
occurs first. 
 
d. 
This SUP will only allow the additional use of the Rural 43 zoned property to park and store 
trucks and refuse bins associated with the business. The trucks and bins must be empty 
of waste and clean when stored on site. 
 
e. 
Outdoor storage is limited to empty bins only. No compacting or solid waste material is 
allowed within any bin stored on the property. No cleaning of bins will be allowed on site. 
All bins will be cleaned prior to re-storage on the lot. 
 
f. 
Per the approved narrative, the number of trucks allowed to be stored/parked on site is 
seven. Six trucks shall be parked in an enclosed garage and one in the designated parking 
space shown on the site plan. 
 
g. 
Outdoor storage and business operations are limited to the rear of the lot adjacent to and 
behind front plane of the existing residence. 
 
h. 
A minimum 6’ high screen wall is required along the lot perimeter and between the front 
area of the lot and the area of the lot designated for storage.  The screen wall must be 
solid or consist of visual obscuring material acceptable to the Maricopa County Planning 
& Development Department. The visual screening must be maintained for the duration of 
the Special Use Permit. 
 
i. 
On-site assembly of bins is limited to the installation of doors on prefabricated bins. 
 
j.

Prior to occupying the existing residence or any portion thereof for any use associated 
with the Special Use Permit, the applicant shall obtain a Building Permit to retrofit the

existing residence to meet current commercial building code requirements as applicable 
and shall obtain a Certificate of Occupancy for the retrofitted building prior to occupancy. 
 
l.

2. Parking spaces: 2 spaces for the dwelling, and 5 reg. spaces + 1 ADA space 
3. Min. Screening: All business parking shall be visually screened.  
4. Lighting: All outdoor lighting shall conform to MCZO, Sec. 1112 and shall be shielded 
so that light is directed downward below the horizontal plane at bottom of the light 
source and so that no light trespasses onto adjacent properties. 
 
n. 
Noncompliance with any of the conditions assigned to the approval of this Special Use 
Permit by the Maricopa County Board of Supervisors may be grounds for revocation in 
accordance with the requirements and procedures as set forth in the Maricopa County 
Zoning Ordinance.  
 
o. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, and at the 
time of expiration of the Special Use Permit, the property may be considered for revocation  
to the zoning that existed on the date of application.  It is, therefore, stipulated and agreed 
that either revocation due to the failure to comply with any conditions, or the expiration of 
the Special Use Permit, does not reduce any rights that existed on the date of application 
to use, divide, sell or possess the property and that there would be no diminution in value 
of the property from the value it held on the date of application due to such revocation or 
expiration of the Special Use Permit.  The Special Use Permit enhances the value of the 
property above its value as of the date the Special Use Permit is granted and reverting to 
the prior zoning results in the same value of the property as if the Special Use Permit had 
never been granted.

Project Summary: 
 
1. 
The applicant is requesting a Special Use Permit (SUP) for an interim industrial storage yard for 
vehicles and materials related to a trash compaction business, Smash My Trash. The site is 
located on the north side of San Tan Blvd. west of Recker Rd. in the Chandler Heights area. It is 
within the Town of Gilbert’s municipal planning area. The site is currently subject to violation 
V2400016 for commercial business operation in a Rural zoning district without proper zoning 
entitlement. 
 
2. 
Historic aerials indicate the parcel part of a citrus groves until the existing home was constructed 
circa 1996. An accessory garage was constructed in 2024 via permit B202401415. Shortly after 
passing a June 2024 final inspection, there was complaint of commercial vehicles being stored 
in the garage. The zoning violation was verified, and the property owner entered into a compliance 
agreement in August 2024.  Compliance will require either ceasing and desisting the use or 
obtaining approval of proper zoning entitlement and completing any associated construction 
permits. The subject case is an administrative remedy for the violation. 
 
3. 
Smash My Trash is a mobile dumpster compacting business; compaction trucks travel to 
customer locations whereupon they compact waste materials. The trucks would then take the 
empty refuse bins back to the subject site or transfer them to a different worksite. No waste 
materials are stored on site including in bins or trucks. No compaction occurs on site. No cleaning 
of trucks or waste bins occur on site. In total, seven trucks would be stored on-site, with six being 
parked in the garage and one in an outside space beside the garage. The existing residential 
structures would be utilized as office space for the business. The trucking aspect of the site 
would take place from 6:00 am to 4:00 pm weekdays while the office would remain open from 
7:00 am to 5:00 pm weekdays. Per the applicant, over a dozen community members are employed 
by the business.

Staff would note that MCZO Art, 501.2.10 allows for home-based businesses by-right in a Rural 
zoning district but the subject operation exceeds the ordinance parameters (number of 
employees on site, number of vehicles used in commerce, height of screening, etc.) thus an SUP 
is required.  
 
5. 
The site and surrounding area is zoned Rural-43 for rural residential and agricultural development. 
Home-based businesses are common occurrences in rural residential neighborhoods and there 
appear to be home-based businesses in the surrounding neighborhood.

The applicant complied with the minimum required public participation requirements per MCZO 
Section 304, including notification of property owners within 300’ of the subject site and posting 
of the site. Registered areas of interest were contacted by the applicant. As of this report, staff 
has received six letters of support and two letters of opposition, along with a letter of concern 
provided by the Town of Gilbert.

The support letters consist of several neighbors. They speak to the business generally being a 
good neighbor with little disturbance arising from site operations. A few of these letters also 
speak to approval of general improvements the applicant has undertaken for the site in 
comparison to the prior owner. 
 
13. 
The Town of Gilbert provided a letter expressing concerns regarding the proposed use. They note 
the use, as an industrial use, would not be allowed under the equivalent Town of Gilbert zoning. 
The Town notes that approving the use would cause issues if the site ever were to be annexed, 
and that the use would cause issues relating to traffic and quality-of-life for residents within the 
Town’s jurisdiction. Furthermore, staff received two opposition letters from neighbors expressing 
disturbance from noise generated by site operations and concerns with traffic.

The requested SUP would allow the property owner to park and store empty and clean trucks and 
refuse bins associated with the business. On-site assembly of bins would be limited to the 
installation of doors on prefabricated bins. To that end, staff’s recommended SUP standards 
differ from those proposed by the applicant.  All business storage should take place as far away 
from San Tan Blvd as possible limited to the rear of the lot adjacent to and behind the existing 
residence. Six trucks would need to be parked in the enclosed garage with one allowed in the 
designated parking spot as shown on the site plan. Commercial access to the site is limited to 
the west driveway unless and until documentation is provided that the easement along the east 
will permit commercial traffic. Staff would note that the current screening, consisting of a 
wrought-iron fence, would be modified to include a privacy mesh for visual screening along the 
perimeter and between the business storage in the rear of the lot and at the front of the property. 
Further, truck traffic would be limited between 6am and 4pm – all business operations would 
cease at 5pm daily. To control potential odors all trucks and bins stored on the property must be 
empty of waste and clean. The screening and limitations are intended to ensure the business 
operation remains consistent with the rural residential character of the neighborhood.

Staff notes that the applicant has applied for an Interim Industrial Use SUP rather than a Cottage 
Industry SUP. The latter category is a home-based business that requires the proprietor to reside 
on the property. However, the former by ordinance limits the SUP entitlement to a maximum of 
ten years.  If the Commission believes the SUP appropriate then you may wish to consider a 
shorter duration (staff’s suggested conditions include a five-year SUP) and/or an annual status 
report. This affords the applicant chance to prove the use can be a good neighbor prior to grant 
of any longer term zoning entitlement. 
 
 
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve SU240008 subject to the following conditions ‘a’ – ‘o’:

PURPOSE OF REQUEST 
 
This request is for a Special Use Permit (“SUP”) for an interim industrial use pursuant to 
section 1301.1.22 of the Maricopa County Zoning Ordinance at a site located at 17442 E San 
Tan Boulevard (the “Site”). An Aerial is attached as Exhibit 1. We request this SUP for interim 
industrial uses to utilize the Site for a limited-use storage yard. This Site is currently subject to 
violation V2400016. 
 
DESCRIPTION OF PROPOSAL 
 
The purpose of this request is to allow the Site to continue to be utilized as both a single- 
family residence, an office, and limited-use storage yard for a mobile (off-site) trash compacting 
service.  
 
The Site is used to park the mobile dumpster compactor and temporarily store empty 
refuse bins in specified locations until they are taken for use at a customer’s location. There 
are 7 trucks in total, six are parked in a garage at the rear of the Site and in an enclosed garage, 
and one truck is parked in a designated parking space next to the garage. Prefabricated, empty 
refuse bins are occasionally delivered to the Site as needed where the only assembly required 
is to place doors on them.  The mobile refuse compaction trucks perform their work at the 
customer’s location and not at the Site. When the customer is done using the bins at their 
location, the bins are transferred to another customer’s location or temporality returned empty 
to the Site.  No commercial refuse is compacted or stored on the Site. 
 
A mobile dumpster compactor works by compressing and compacting waste inside 
open-top dumpsters with the assistance of a large, rotating drum. Off-site mobile waste 
compaction services bring dumpster compactors to the customer’s location which allows 
compaction services to take place almost anywhere the client needs. This service can save 
customers an incredible amount of money by being able to fit more waste in the bins due to 
compaction at the location and less trips to the dump due to the larger bin size.  These services 
and cost savings are essential to many local businesses and reduce the number of trips on the 
roads. 
 
The business operations are as follows: 
• Trucks exit the property between 6:00 am and 8:00 am according to the customer’s 
needs. 
• On-Site work, when necessary, involves placing doors on the prefabricated refuse bins 
and temporarily storing them on the Site until taken to a customer’s location. 
• No operations that cause negative emissions or excessive noise occur on-site. 
• The trucks return to the Site and stored by approximately 3:00 pm in designated 
locations. 
• All business operations on the Site, except for office work that occurs inside the 
residence, cease at 4:00 pm. 
• Office operations typically occur between 7:00 am and 5:00 pm.

RELATIONSHIP TO SURROUNDING PROPERTIES 
 
The Site is approximately 1.8 acres and is zoned RU-43. To the west, north, and east of 
the Site are single-family homes zoned RU-43, several of which appear to be operating a 
business or businesses—including RV repair. To the south, across San Tan Boulevard exist more 
single-family homes zoned RU-43. This area primarily consists of single-family homes in the 
County and the Town of Gilbert’s jurisdictions. The uses conducted on this Site do not 
negatively impact surrounding properties. 
 
LOCATION AND ACCESSIBILITY 
 
The Site is accessible from San Tan Boulevard. 
 
CIRCULATION SYSTEM 
 
This Special Use Permit will not affect existing ingress and egress. 
 
DEVELOPMENT SCHEDULE 
 
No additional development is proposed. We understand that the garage needs to be re-
permitted for commercial occupancy and will begin that process upon approval of this request. 
 
COMMUNITY FACILITIES AND SERVICES 
 
The uses permitted with this SUP will not have any additional impacts on community 
facilities and services. The business operations do not and will not impact any school district, 
park, or other amenity in the area.

This SUP will have no additional impact on public utilities. The providers are as follows:

                My name is Richard W Maus.  I own and reside at 17432 E San Tan Blvd.   My property borders the full
western side of Mr. Kardasz property.  No one shares more linear boundary with him than I.  Since his arrival I
have noticed a great improvement and upgrading to the property.  The investing of attractive landscaping,
remodeling the existing house and adding a new building has given the entire lot a fresh new curb appeal which is
beautifying to our neighborhood as well as protecting all of our property values. 
                I am his closest neighbor.  As far as I can tell, no business is being conducted or transacted on his
property.  There has never been any excessively loud noises which bothered me or discernible unpleasant aromas
that offended me nor bright nighttime yard lights that irritated me.  He has shown nothing but a willingness to be
part of our growing community.  All in all, I couldn’t ask for a better neighbor.

Dear Members of the Maricopa County Zoning Board,
I am writing to express my strong opposition to the proposed zoning change/SPECIAL USE PERMIT
REQUEST for  17442 E. San Tan Boulevard. As a resident and concerned neighbor, I am deeply troubled by
the potential impacts this change will have on our neighborhood. Our community is designed to be a peaceful
residential area, not one that accommodates businesses, and I firmly believe that allowing this change would
harm the quality of life for those who call this place home.
One of my primary concerns is that the property has not been used as it was initially intended—as a storage
yard. Instead, it has been operated as a working yard for activities that are completely unsuitable for a residential
area. The property is currently used for managing and maintaining Red Box dumpsters and trash compactors,
and loud equipment is frequently operated there. With this comes the inevitable increase in noise. Our
neighborhood is known for its quiet, family-friendly atmosphere, where residents can enjoy their homes and
outdoor spaces without the disruptions that come with commercial activity. Businesses bring noise—from
increased vehicle traffic to the daily operations required to run a commercial space. Such disturbances are
entirely out of place in a residential area and would quickly erode the peace we have here.
In addition to noise, I am concerned about increased traffic. More traffic will create significant congestion and
potentially dangerous situations for our community. Our streets are not designed to handle high volumes of cars,
especially those driven by people unfamiliar with the area, and I fear for the safety of our pedestrians, children,
cyclists and animals.  Further, additional traffic inevitably brings more wear and tear on our infrastructure,
leading to future maintenance issues and additional costs to the county or taxpayers.
The approval of this zoning change also sets a concerning precedent for further development that may not align
with the character of our neighborhood. Once a commercial zoning change is allowed, it often opens the door for
additional requests. This can lead to a slippery slope, where other businesses look to capitalize on our residential
space, further eroding the unique community we have worked hard to build and maintain.
I strongly urge you to consider the long-term impacts of this decision. Our neighborhood is not equipped to
handle commercial operations, and the disruption this change would bring far outweighs any potential benefits. I

kindly request that the Board uphold the current zoning, respecting the character and integrity of our residential
community.

life and harmony in our neighborhood.

This is regarding the Special Use Permit Request for 17442 E San Tan BL, Case
SU240008.
This request is being made a little too late, as the property has been used as a
commercial business location/storage lot, since the day the new owners of
Smashtruck have purchased the property. I have attached photos I took this
afternoon.  Usually, the Smash Trucks are parked on site.  It seems they may be
trying to change the view of the property for the purpose of the application.
The research I have conducted is this type of commercial business could not be
permitted by Maricopa County Zoning for this residential R-43 Zoning District. And,
the property is not occupied by the owner of record, or any person, for that matter.
In fact, when the owners did introduce themselves, as Michael,  stated the property
was going to "be used as a temporary storage location until a storage yard was to be
located and he or his brother were going to live at the property."  
I am a neighbor who is opposed to the Special Use Permit being approved.

Dear Maricopa County Planning and Zoning Commission,
We are writing to express strong opposition to the proposed storage yard that is planned next to
our residential property. We share a property line and driveway with the property of discussion.
We have significant concerns about the impact Keith Storage Yard will have on our community/
neighborhood.
First and foremost, the introduction of an industrial storage yard in a residential /rural
neighborhood has lead to increased noise. The constant movement  and sounds of large
industrial vehicles and equipment, along with the dropping / stacking of the large red dumpster
bins is quite unsettling. We don't need to speculate as to the noise this will create- as we
already know from the movements and work they conduct there already. We cannot imagine
this continuing or becoming more frequent if this gets approved. We chose this property over 2
years ago for many reasons- none of which to be near an incoming industrial storage yard. The
Chandler Heights Citrus Irrigation District community is quite an ecclectic area of homes and
farm animals! The semi rural area is home to large residential parcels and variety of animals. 
Industrial sites and sounds isn't what we need this close to a school and quiet neighborhoods.
We don't own farm animals yet, but I know how the sounds of the booms and beeping bother
us, I cannot imagine how the animals get startled too.
Our windows shake and the very loud booms scare/ startle us. It is not a noise that can be
ignored. This noise is created by moving and stacking the large dumpster bins on their property.
We enjoyed the peace and quiet that our area provided along with the mountain views. Our
view has since been obstructed from the large building created to store the big vehicles. We
can no longer sit on our porch swing & patio and gaze at the mountain. The beeping and
booming sounds are disruptive as mentioned. 
Additionally, the presence of a storage yard can negatively affect the aesthetic appeal of the
area. Our neighborhood is known for its well-maintained homes and pleasant surroundings. The
operation of a storage yard will detract from the visual appeal of the community, potentially
lowering property values and discouraging new families from moving into the area.
We urge you to not allow the storage yard. We hope they can find a new location away from our
residential area to conduct this part of their business.  In our opinion, their request would be
better suited in an area that already has industrial business surrounding them. Not in our

community! We like to support local business, but we cannot support these changes. Protecting
the well-being and quality of life for our community members should be a priority in your
decision.

Staff agrees with the applicant to modify these conditions. Recommended changes are shown in

Truck traffic associated with the business is limited to the hours between 6am and 4pm. 
Business operations will cease on the property at 5pm Monday through Friday. 
Commercial access to the site is limited to the west driveway unless and until 
documentation is provided that the easement along the east will permit commercial 
traffic.

The following Planning Engineering conditions shall apply: 
1. 
Engineering review of planning and/or zoning cases is for conceptual design only. 
All development and engineering design shall be in conformance with Section 
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; 
and current engineering policies, standards and best practices at the time of 
application for construction. 
2. 
Based on the conceptual design nature of the information submitted, changes to 
the site layout may be necessitated by the final engineering design of the site’s 
drainage infrastructure.  
3. 
Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with 
the application for Building Permits In the event any additional buildings or site 
improvements are proposed, detailed grading and drainage plans must be 
submitted for their entitlement and permitting. 
4. 
San Tan Blvd is classified as a major collector requiring fee dedication of a 40-
foot half street from the mid-section. Applicant is required to provide, at the 
applicant’s expense, an American Land Title Association (“ALTA”) Owner’s Policy 
of Title Insurance showing title vested in Maricopa County, a political subdivision 
of the State of Arizona. Dedication shall be completed prior to the issuance of 
any building permits on the site or within six (6) months of Board approval, 
whichever occurs first. Applicant to refer to

information on the dedication process. The western driveway to San Tan Blvd. 
was permitted by MCDOT for residential use. The change in use to interim 
industrial must be evaluated by MCDOT’s Transportation Systems Management 
& Operations (TSMO) Division to determine if any access restriction(s) need to 
be implemented as a result of the change in use. The owner applicant shall 
satisfy this requirement, within six (6) months of Board action.
