Prepared by the Maricopa County Planning and Development Department

Board Hearing Date:
February 12, 2025

Case #/Title:

SU240009 – PHO RANCHOS_10

Supervisor District:
5

Applicant/Owners:
Kenneth Hale, Smartlink Group / Pierre and Deberah Duringer

Request:
Special Use Permit (SUP) for a wireless communications facility
(WCF) in the Rural-43 zoning district

Site Location:
Generally located approximately 1,900’ north of the NWC of 309th
Ave. and Yuma Rd. in the Buckeye area

Site Size:
2,500 sq. ft. of an approx. 10.9 acre site

County Island Status:
Yes (City of Buckeye)
Additional
Comments:
The proposed WCF will be an 80’ high monopole able to
accommodate multiple carriers. It will meet all required setbacks
and only requires SUP approval because the 16’+ antenna array
diameter exceeds the ordinance’s 8’ maximum. City of Buckeye
commented expressing no concern There are no outstanding
concerns from reviewing agencies.

Commission

Recommendation:
On 1/9/25, the Commission voted 5-0 (motion by Vice-Chair
Lindblom D1, seconded by Montoya D5) to adopt a motion
recommending the Board of Supervisors approve SU240009
subject to conditions ‘a’ – ‘h’:

a.
Development of the site shall be in substantial conformance with the Site Plan entitled
“PHO_Ranchos_10“, consisting of 20 full-size sheets, dated October 7, 2024, and stamped
received November 6, 2024 except as modified by the following conditions. Staff may
determine slight refinements to remain in substantial conformance with the approved site
plan. Minor and major amendments to the site plan will be determined in accordance with
Chapter 3 of the Maricopa County Zoning Ordinance.

b.
Development of the site shall be in substantial conformance with the Narrative Report
entitled “PHO RANCHOS_10 - 17003306”, consisting of 4 pages stamped received
November 6, 2024, except as modified by the following conditions.

February 12, 2025

c.
The following Planning Engineering conditions shall apply:

1.
Engineering review of planning and/or zoning cases is for conceptual design only.
All development and engineering design shall be in conformance with Section
1205 of the Maricopa County Zoning Ordinance; MCDOT Roadway Design Manual;
and current engineering policies, standards and best practices at the time of
application for construction.
2.
The proposed construction appears to meet the requirements of the Maricopa
County Zoning Ordinance Section 1205.7.7 and as such a site plan containing the
information on the attached checklist (form 718) is required.
3.
Based on the conceptual design nature of the information submitted, changes to
the site layout may be necessitated by the final design of the infrastructure.

d.
This special use permit is valid for a period of 30 years and shall expire on February 12,
2055, or upon termination of the use for a period of 90 or more days, whichever occurs
first. All site improvements associated with the special use permit shall be removed within
90 days of such expiration or termination of use.

e.
The maximum allowed antenna array diameter is 16.5’ unless an Eligible Facilities
Request under Section 6409 of the Spectrum Act.

f.
Parking for the WCF may be surfaced with decomposed granite.

g.
Noncompliance with any of the conditions assigned to the approval of this Special Use
Permit by the Maricopa County Board of Supervisors may be grounds for revocation in
accordance with the requirements and procedures as set forth in the Maricopa County
Zoning Ordinance.

h.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. In the event of the failure to comply with any condition, and at the
time of expiration of the Special Use Permit, the property shall revert to the zoning that
existed on the date of application. It is, therefore, stipulated and agreed that either
revocation due to the failure to comply with any conditions, or the expiration of the Special
Use Permit, does not reduce any rights that existed on the date of application to use,
divide, sell or possess the property and that there would be no diminution in value of the
property from the value it held on the date of application due to such revocation or
expiration of the Special Use Permit. The Special Use Permit enhances the value of the
property above its value as of the date the Special Use Permit is granted and reverting to
the prior zoning results in the same value of the property as if the Special Use Permit had
never been granted.

Project Summary:

1.
The requested SUP is to allow the development of an 80’ tall WCF. While WCFs are an allowed
use within the Rural-43 zoning designation, the applicant is seeking an antenna array with a 16’-
2” diameter, which exceeds the maximum allowed diameter width of 8’ as per MCZO article
1202.3.1.1.h. The WCF will meet a 2’:1’ (160’) setback from all lot lines, measured from the vertical
plain of the furthest extension of the antenna array, as required by MCZO article 1202.3.1.1.g.
The tower will be painted a light brown color and will be designed to facilitate colocations in the
future, however, will initially host just one carrier. The WCF will be served by a 2,500 sq. ft. lease
area which will contain ground equipment and will be screened by an 8’ high block wall. The WCF
will be located on the northeastern quadrant of the subject parcel and will be accessed via a utility
and access easement coming off 309th Ave. The access easement will be surfaced with
decomposed granite and there will be one technician parking stall provided, which will also be
surfaced with decomposed granite.

2.
The subject property does not have any recent history prior to the pursuit of the current zoning
entitlement. A preapplication meeting, PA2023164, was held on November 14, 2023. The
applicant filed for the SUP on August 13, 2024 and the Technical Advisory Committee meeting
was conducted on September 17, 2024.

SU240009
3.
Below is the proposed SUP standards table. The applicant states the increase in antenna array
diameter is necessitated by 5G wireless standards, an increase in spectrum bands utilized by
cellular companies, and the need to have more equipment on the antenna array to meet modern
network performance expectations. The reduction in parking surface material is justified by the
infrequency technicians will be at the site to service the equipment.

Public Participation Summary:

8.
The applicant met all statutory minimum requirements for public outreach. Notification mailers
were sent to all property owners within 300’ of the site and all identified parties registered as an
area of interest. Additionally, the applicant posted the site with two compliant notification signs.
The applicant reported that no response from the public was received. Similarly, staff has not
received any comment from the public on this request.

9.
Staff notes that the City of Buckeye staff provided a response to initial routing and stated that
they do not have a concern with the proposed SUP.

Outstanding Concerns from Reviewing Agencies:

10.
N/A

Staff Analysis:

11.
Staff notes that the height and setbacks of the proposed WCF meet zoning ordinance
requirements and the tower would be a by right use in the Rural–43 zoning district if it were not
for the proposed size of the antenna array. The increase in antenna array diameter is consistent
with similar SUP cases. Staff feels the proposed light brown color is appropriate for the area and
will allow the WCF to blend into the Sonoran landscape. Further, the subject site is within a
shrinking county island and current surrounding land use patterns indicate there will be an
increased need for wireless technology infrastructure in this area. As such, staff feels the
proposal is appropriate for the site and is supportive of the request.

Recommendation:

12.
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve SU240009 subject to the following conditions ‘a’ – ‘h’:

November 6, 2024, except as modified by the following conditions.

c.
The following Planning Engineering conditions shall apply:

1.
Engineering review of planning and/or zoning cases is for conceptual design only.
All development and engineering design shall be in conformance with Section
1205 of the Maricopa County Zoning Ordinance; MCDOT Roadway Design Manual;
and current engineering policies, standards and best practices at the time of
application for construction.

Site Name: PHO RANCHOS_10 - 17003306
Parcel Number: 504-61-023D
Location: S 309th AVE & NORTH OF W YUMA RD
Case #: SU240009
Purpose of Request:
Anthemnet with Verizon as the anchor tenant are requesting the County of Maricopa’s zoning approval
to install a new 80’ multi carrier cell tower in light brown color to provide wireless service to the
surrounding area. The new tower is meeting the height requirements of 80’ and is meeting 2:1 setback
from property lines.

Description of Proposal:
Anthemnet/Verizon is proposing a new 80-foot-tall monopole tower and wireless communication facility
within an 8-foot-tall CMU wall located in Maricopa County. The current parcel is raw land and
undeveloped, so no stealthing will be required. Tower is 160 feet away from all property lines to meet
the required 2:1 setback from property lines. Verizon will be the anchor tenant and the tower will be
able to facilitate additional co-location. There are no other existing WCF’s within a 1,000 feet radius. The
tower will provide cellular service for residents and businesses currently and for the future in the
surrounding area. No mature trees or cacti will be removed during construction of the WCF. Generator
will be installed but will only be used as an emergency back-up in compliance with MCZO 1202.3.1.1.g
SUP Request:
Anthemnet/Verizon is requesting a Special Use Permit to allow a new 80’ WCF, with an antenna
diameter of 16’2”” (needed for antennas to meet required separation). This SUP request will allow for a
larger antenna diameter.
SUP Request Details/Standards that need to be varied.
The WCF being proposed will require variations from the typical WCF standards outlined in MCZO 1202.
WIRELESS COMMUNICATION FACILITIES.
The applicant is requesting to vary the maximum antenna array diameter from the required 8’ up to
16’2” (MCZO Article 1202.3.1.h), due to the needed separation from all antennas being installed. The
required 8’ diameter will not allow these types of antennas to function properly as needed separation
will not be met.
The applicant is requesting to vary MCZO Article 1102.7.1 for parking to be paved. This land is
undeveloped and access road and parking will be surfaced with stabilized DG.

New Pole Setbacks:
From North Property Line: 160’
From South Property Line: 487’
From East Property Line: 462’
From West Property Line: 160’
RelaƟonship to Surrounding ProperƟes:
The proposed WCF will not alter or impact the exisƟng condiƟons on the subject property, or
surrounding properƟes, or impact traffic in the immediate area. The surrounding area is sparsely
populated with adjacent properƟes to the south and west being vacant. By adhering to the height,
setback and screening requirements we will limit the visual impact of the WFC on surrounding
properƟes.
Property to North: Maricopa County RU-43
Property to South: Maricopa County RU-43
Property to East: Buckeye CC
Property to West: Maricopa County RU-43
LocaƟon and Accessibility:
A technician vehicle may access the wireless communicaƟons facility approximately once or twice a
month, or in the event of a technical breakdown. The technician will exit I-10 at S Palo Verde Rd, then
take a right at W Yuma Rd, another right at S 309th Ave and a leŌ at property access road. This vehicle
will use the exisƟng property ingress/egress. Below are esƟmated distances from nearest municipals.
Buckeye – .25 miles East
Development Schedule:
Anthemnet/Verizon would like to commence the proposed equipment improvements as soon as all
County/State/Federal permits have been obtained. ConstrucƟon for this project is esƟmated to take 30
days to complete.
Community Facilities and Service:
The proposed equipment improvements will not alter or impact community facilities and services.
Traffic Impact:
The proposed site may be visited once or twice a month for routine maintenance, or in the event of a
breakdown, so the proposed use will not impact traffic or conditions in the area and will comply with all
local, state, and federal laws & regulations.
Public Utilities & Services:
APS is providing service and per their code the meter banks will be placed on the outside of the shelter
for safety. This WCF will not require either water or wastewater services.

Zoning: RU-43
Thank you in advance for your consideration.
