The proposed IND-2 IUPD covers most of a one acre parcel and is
intended to accommodate an existing outdoor storage facility and
a proposed billboard. The remainder of the parcel is located within
the Rural-43 MAAMF zoning district and will require legislative
approval of a military compatibility permit (MCP) when ready for
development.
The site lies within the municipal planning area of Buckeye. The City
requested a solid screen wall along the north property line adjacent
to the freeway. The Commission recommendation requires a
minimum 6’ tall fence with screening material along both the north
and west.
There are no concerns from county review agencies.
Prior to the Commission hearing staff received three letters of
support of this request from adjacent property owners who believe
that this zone change on this site is compatible with the area. The
applicant received one email from a nearby resident who was
opposed of this request because of the potential of an increase of
truck traffic though the local streets to go this site. There was no
opposition present at the Commission hearing .

On 10/24/24, the Commission voted 7-0 to adopt a motion
recommending the Board of Supervisors approve Z2024008
subject to conditions ‘a’ – ‘l’:
a.
Development of the site shall be in substantial conformance with the Zoning Exhibit
entitled “MR Handy Trucking“, consisting of one full-size sheet, dated August 22, 2024,
and stamped received September 3, 2024, except as modified by the following conditions.
b.
Development of the site shall be in substantial conformance with the Narrative Report
entitled “MR Handy Trucking”, consisting of seven pages, dated September 3, 2024, and
stamped received September 3, 2024, except as modified by the following conditions.
c.
Any land use inside of the 65 LDN noise contours on the properties that make up this site
must remain rural until such time a Military Use Permit is approved by the Board and these
areas of the site are not part of this zone change request.
d.
The two parcels that make up this site must be combined into a single parcel with a new
APN prior to the submission of a Plan of Development or building permits for this site.
e.
Administrative approval of a Plan of Development will be required prior to approval and
issuance of construction permits to develop and establish use of the site. Prior to
issuance of a building permit, written confirmation will be required from the emergency
fire protection jurisdiction having authority that the facility has been designed in
accordance with their regulations and requirements, and that emergency fire protection
service will be provided to the facility. Prior to issuance of the certificate of occupancy,
local fire protection jurisdiction review and approval will be required.
f.
All buildings shall be subject to noise attenuation as per ARS § 28-8482(B).
g.
A plan of development and any necessary permits must be applied to address the
existing code violation on this site.
h.
The following Planning Engineering comments shall apply:
1.
Any new (or existing as the case may be) site improvements will require a Plan of
Development and Traffic Impact Study. The Plan of Development submittal would
require a Grading and Drainage Plan to show conformance to the County Drainage
Regulations. Billboards shall not require a traffic report or grading and drainage
report/plans.
2.
The site contains a small area of regulatory floodplain in the northeast corner. Any
new development/disturbance in the floodplain will require a floodplain use permit
concurrent with any building permit(s).
3.
Any additional right-of-way dedication and/or offsite improvement requirements
will be determined by MCDOT Traffic and MCDOT Permits based on the submittal
of a Traffic Impact Study/Traffic Impact Analysis.
4.
Without the submittal of a plan of development, no development approval will be
inferred by the engineering review, including, but not limited to drainage design,
access, and roadway alignments. These items will be addressed as development

plans progress and are submitted to the County for further review and/or
entitlement.
5.
Engineering review of planning and/or zoning cases is for conceptual design only.
All development and engineering design shall be in conformance with Section
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards;
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual;
and current engineering policies, standards, and best practices at the time of
application for construction.
6.
All plans and reports should be developed and formatted to document that the
project is designed to meet all County regulations, ordinances, and design
standards. It is incumbent upon the engineer to demonstrate compliance with all
regulatory requirements and County design standards.
i.
The following requested IND-2 IUPD development standards shall apply:
1.
There shall be no required side yard along the 65 LDN noise contour on this site.
2.
There shall be a minimum lot width of 25 feet adjacent to 191st Ave.
3.
There shall be no required parking for a home-based business for an outdoor
storage facility other than the required two spaces for the existing single-family
residence, except for any required ADA accessible parking.
4.
There shall be a minimum of six foot tall chain link fences with attached obscuring
materials around the perimeter of the site for screening.
5.
The use of alternative dust control measures such as asphalt millings or
decomposed granite that meets the County’s Air Quality Standards shall be used
instead of paving.
6.
The maximum height for a freeway oriented billboard shall be 60 feet measured
from the adjacent grade of the freeway.
7.
There shall be no setback from rural or residential zoning boundaries for a static,
non-illuminated or digital billboard on this site.
8.
This IUPD zoning overlay shall limit the use of the site as an outdoor storage
facility, billboard, and single-family residence until such time as the site is served
by public water and sewer system.
j.
The property owner/s and their successors waive claim for diminution in value if the
County takes action to rescind approval due to noncompliance with conditions.
k.
Noncompliance with any of the conditions assigned to the approval of this Zone Change
by the Maricopa County Board of Supervisors may be grounds for revocation in
accordance with the requirements and procedures as set forth in the Maricopa County
Zoning Ordinance.
l.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to

enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. In the event of the failure to comply with any condition, the property
shall revert to the zoning that existed on the date of application. It is, therefore, stipulated
and agreed that either revocation due to the failure to comply with any conditions, does
not reduce any rights that existed on the date of application to use, divide, sell or possess
the property and that there would be no diminution in value of the property from the value
it held on the date of application due to such revocation of the Zone Change. The Zone
Change enhances the value of the property above its value as of the date the Zone Change
is granted and reverting to the prior zoning results in the same value of the property as if
the Zone Change had never been granted.

Project Summary:
1.
The applicant on behalf of the property owner requests a zone change with overlay from Rural-43
to IND-2 IUPD on a portion of APN 502-36-049 and 502-36-002Y to accommodate an existing
outdoor storage facility and a proposed billboard. The site is located outside of the 65 Ldn noise
contour of Luke Air Force Base (LAFB). Those portions of the parcel located inside of the noise
contour will be part of a future Military Compatibility Permit (MCP). According to the applicant,
this area is not suitable for residential development due to proximity of the noise contour and the
freeway. The site contains a residence where the property owner resides and is being used as an
outdoor storage yard for shipping containers, semi-trucks, and trailers, etc. The owner plans to
add a billboard along the site’s northern boundary next to and oriented towards the freeway.
2.
The industrial rezoning will resolve a zoning violation. outdoor storage use is not permitted in the
Rural-43 zoning district. The business on the site is solely operated by the property owner with no
employees. Visitors to the site will drop off their truck, trailer, shipping container, etc.. To minimize
dust pollution the storage area has a layer of asphalt millings. The proposed billboard will be 60
feet tall with a sign face area of 672 square feet to be compatible with similar freeway oriented
billboards in the area (and consistent with ordinance standards).
3.
On November 16, 2023 the County Code Compliance Division received complaint alleging an
industrial business without proper zoning entitlement. The violation, V202302418, was verified
on December 7, 2023. A notice of violation and order to comply (NOTC) was issued to the
property owner ordering him to cease and desist or to obtain approval of proper zoning
entitlement. As of the writing of this report the property owner has not entered into a compliance
agreement nor has a civil hearing been scheduled before a hearing officer. IND-2 IUPD zoning
approval will resolve the violation.
4.
On October 16, 2023, LAFB deemed outdoor storage and billboard land uses consistent and
compatible with the military airbase operations and the high noise and accident potential zone
(UC2023028). This will be applicable to future MCP on those portions of the site located within
the Rural-43 MAAMF zoning district.
5.
Due to the unique configuration of the site and proximity to existing residences the applicant is
requesting to vary several IND-2 development standards. The requested varied standards include
min. lot width, min. side yard setback along the noise contour, min. screening, paving, and min.
billboard setbacks from residential zoning district (or from rural zoning districts with residential
use) and separation from other billboards. The applicant is requesting that the required parking
be eliminated since the business is solely operated by the property owner with no other
employees and the only visitor dropping off or picking up a container. Another request is to
eliminate the screening requirements for the outdoor storage area from rural zoned properties.
The applicant justifies this request, because a solid wall along these property boundaries would
be cost prohibited and by utilizing the existing chain link fences would keep the rural aesthetics.
Finally, the applicant is requesting several billboard development standards, and justifies this by
stating that the future billboard will be located along the freeway far from adjacent residences.
Moreover, The applicant justifies the request to a height of 60 feet is because the site is a few
feet lower than the adjacent freeway grade and the site is between two elevated freeway
intersections where visibility would be restricted to three-quarters a mile if kept at a height of 48
feet. However, there are billboards in the immediate area that appear to be at or under the height
of 48 feet. Staff argue since the site is lower in elevation than the adjacent freeway the condition
must be just a maximum height of 60 feet. The IUPD table on the next page indicates proposed
deviations from the base IND-2 zoning district.

White Tank Grand Avenue Area Plan (adopted December 6, 2023): This updated area plan
designates the site as Single Family – Rural, which denotes areas with residential density of 0-1
du/ac, agricultural uses, or natural desert.
10.
Buckeye 2040 General Plan: The general plan designates the site as Rural. This designation
denotes areas that have large-lot residential development in natural desert, agricultural, open
space areas. Development in this designation should retain the rural character of the area and
will be relatively low in density, such as one dwelling unit per acre.
Public Participation Summary:
11.
The applicant complied with the Maricopa County Citizen Review Process with the required
posting of the site and notification by first class mail to adjacent property owners within 300 feet
of the subject site and area interested parties. Signs were posted on the site in accordance with
applicable regulations. Staff received a public participation results report in accordance with
County requirements, and the applicant received an opposition e-mail from an individual who has
concerns about an increase of truck traffic in the neighborhood. To date, staff has received three
letters of support for this request who believe that this request is compatible with the surrounding
area.
Outstanding Concerns from Reviewing Agencies:

The City of Buckeye is opposed unless there is a solid screen wall along the freeway. However,
the request is to waive screening requirements along the northern site boundary adjacent to the
freeway. However, the City would be supportive if the site was screened. The property owner
believes that the construction of a solid wall along the north boundary would be cost prohibitive
and wishes to vary the screening requirements for this part of the site. The applicant, has argued
that most of the traffic traveling along the freeway elevated above the site and at a high rate of
speed would hardly notice the outdoor storage facility, thus requiring a screen wall along the
freeway frontage is not practical. Staff believes that both the City’s and applicant’s concerns can
be addressed by compromise - including a condition of approval for a minimum six foot tall fence
with screening materials (e.g. plastic slats, mesh, etc.) along the northern boundary of the site to
screen the industrial land use from the freeway.
Staff Analysis:
13.
Staff supports the request. It will be the first step to resolving a zoning violation. The zoning is
appropriate adjacent to a freeway and proximate to an area of high noise. The proximity LAFB’s
noise contour and the freeway makes single-family residential land uses less than optimal for this

area. The use of the site for limited industrial use, particularly outdoor storage with a freeway-
oriented billboard, is a reasonable land use for this site and consistent with area land use and
development patterns. The entitled industrial use should be limited until the site has access to
public sewer.
14.
The industrial use of the site adjacent to the large residential lots should also be screened.. Staff
concurs with waiving parking requirements for the home-based outdoor storage use. The few
customers visiting the site with trucks/trailers are not expected to negatively affect existing traffic
patterns. Traffic studies will be required during the administrative plan of development and/or
construction permitting of development.
Recommendation:
15.
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve Z2024008 subject to the following conditions ‘a’ – ‘l’.

Purpose of Request
This request is for a Zone Change with overlay for portions of the subject parcels APN:
502-36-049 and 502-36-002Y (the “Property”) from RU-43 to IND-2 IUPD (Intermediate
Industrial) for the approximately 1.09 gross acres. The parcels are located approximately
2,000 feet west of the Perryville Road and I-10 interchange. The parcel is split on its
eastern side by the Luke Air Force Base Compatibility Area. As such, the area outside
the Compatibility Area will be affected by the Zone Change with overlay and the area
within the Luke Air Force Base’s Compatibility area will be subject to a Military
Compatibility Permit (MCP) that may be submitted in the future. The requested change
to IND-2 IUPD will allow for industrial land uses within an area that is not suitable for
residential development (See Exhibit A: Existing Zoning and Exhibit B: Proposed
Zoning).

Description of Proposal
The Property is currently residential with a single residential dwelling on parcel 502-36-
049. The northern parcel, 502-36-002Y, is currently being used as a storage yard for the
owner’s business needs including trailers and trucks. Additionally, the owner plans to
obtain a Sign Permit to construct an off-site advertisement structure along the I-10
corridor while continuing to operate the business. The property is located in an area that
is rapidly becoming industrial and commercial, pushing the residential to more suitable
locations, away from the I-10 and Luke Air Force Base. The northern parcel directly abuts
the I-10, making residential a an unrealistic designation. Additionally, the parcel is
approximately 25 feet by 600 feet, making RU-43 or any other residential development
impossible. The sole access to the parcel is through parcel 502-36-049. Therefore,
rezoning sections in both parcels to IND-2 IUPD to accommodate an efficient industrial
use would be a better designation than RU-43. The properties in the area have recently
been rezoned from the outdated RU-43 to industrial or commercial designations. (See
Exhibit C: Context Aerial).
The Property and surrounding area’s best use would be for industrial given its proximity
and access to the I-10 and its proximity to Luke Air Force Base. The properties in the
area have access to the I-10 from both Jackrabbit Trail and Perryville Road. The Property
is just outside of the Luke Air Force Base Accident Potential Zone and bisected by the
LDN 65 Noise Contour. The constant sound of jet aircraft overhead and being adjacent
to an interstate highway makes rural residential zoning a poor fit. A better fit would be
industrial where the sound would not affect daily operations and the proximity to the
interstate is a benefit instead of a nuisance.
Because the Property is bisected by the LDN 65 Noise Contour Line, we are requesting
an Industrial Unit Plan of Development (IUPD) along with the rezone. The LDN line goes
directly through both parcels and bisects the existing house on the premise.
Additionally, the northern parcel, APN: 502-36-002Y is an unconventional shape, being
less than 25 feet wide. The current zoning code for IND-2 requires a minimum width of
60 feet. The IUPD below details the adjustment to zoning regulations.

The current owner and resident of the Property has an outdoor storage and parking
business. He would like to use the property for his business as it is in the perfect location
to do so. Due to the narrow parcel and the long frontage along the I-10, screening should
not be required. The Northern property is only 25 feet wide, leaving little room for a block
wall on either side. Requiring screening will detrimentally impact the very little utility the
site currently has. Additionally, the cost to the small business will be astronomical
compared to the benefit towards commuters passing at 65 MPH. Other RU-43 zoned
properties along the I-10 look identical to the subject Property. The Owner is simply trying
to bring his property into zoning compliance. Requiring him to construct an expensive
screening will disincentive others from doing the same. Additionally, the owner will obtain
a sign permit for an off-site advertising structure orientated along the I-10 Corridor. There
are several off-site advertising structures in the vicinity, making this additional structure
non-obtrusive and a proper fit for the area.
The small business on the property is operated solely by the Owner. As such, no
employees will be commuting to or parking within the property. Additionally, there will be
no onsite office and no customers will be visiting the property as the property itself is just
the storage area for the containers and trucks. Therefore, no parking will be required on
the property. Similarly, the Owner, in an effort to make the property more suitable for the
use, has already laid down ground asphalt millings on the property where the storage and
truck parking will occur. Due to the small size of the parcel, paving the parcel would add
little benefit to the already laid down ground asphalt millings.
Additionally, the sign setback as listed in the MCZO should be set to zero. The sign will
be located on the northern parcel, as far away from the existing residences as possible.
Because the parcel is incredibly narrow and located along an interstate, outdoor
advertising is one of the few economic values available to the property. Outdoor
advertising fits with the industrial character of the area. There is more than 300 acres of
industrially and business park zoned land within a one-half mile of the Property, making
the area more industrial than residential. This project is in line with the nature of the
surrounding industrial area. The outdoor advertising sign may be up to 60 feet in height,
matching the signs in the surrounding area and the elevation of the nearby interchange.
This parcel is located inside the Buckeye planning area that has seen several recent
annexations into the City. Eventually, this will be annexed into the City of Buckeye as
well. While the City’s general plan lists this specific property as rural, they have
designated almost the entire surrounding properties as Commercial and Employment.

Contiguous properties are zoned RU-43 and are currently single family housing.
However, the property is adjacent to the I-10 Highway with no barrier between the two.
The area has become a hotbed for industrial development.
North: I-10 Interstate Highway then zoned Industrial, Business Park in Buckeye, and RU-
43. Currently 180 acres of industrial under construction or currently built.

the southeast corner of 191st Avenue and Roosevelt Street in Buckeye.
East: RU-43 and Industrial zoned parcels in Buckeye. Currently approximately 39 acres
of industrial under construction.
West: RU-43 and Industrial zoned parcels in Buckeye. Developed as single-family homes,
gas stations, industrial equipment yards, landscape and construction supply stores.
Location, Accessibility, and Circulation
As previously described, the property is situated directly abutting the I-10. The primary
access to the Property will be Culver Street via 189th Avenue and Roosevelt Street. The
34-acre industrial site currently under construction to the west abuts 189th Avenue, Culver
Street, and Roosevelt Street. These roads will mainly be used for trucking traffic once the
construction is complete. The I-10 and Perryville Road interchange is a two-minute drive
via Culver Street to 185th Avenue to Roosevelt Street to Perryville Road.

adjacent to the Luke Compatibility Area, large Employment districts and large Business
Commerce districts. It is logical that the conversion of this property from Rural to
Employment would be encouraged.

Conclusion
The requested zone change with overlay is justified given the nearby proximity to
industrial uses, the I-10 interstate and rapidly changing character of the neighborhood.
Given this location, the Property is not suitable for rural or residential development and
should be allowed to transition to industrial. The addition of off-site advertising is
congruent with other billboards in the area. Access is ideal with the site being located
adjacent to I-10 and other industrial projects. We look forward to continuing to work with

Good morning, Martin:
As we noted when we reviewed this request previously, the property is highly visible to eastbound
traffic on I-10 and is, even in its current condition, is a visual eyesore. Based upon the narrative, the
owner does not intend to remediate this issue and it is likely that the property will take on a more
cluttered, more intense appearance in the future as the business expands. The City maintains its strong
opposition to this rezoning request unless the owner agrees to construct a screen wall of sufficient
height (At least 8’ but likely 10-12’) such that no stored materials/trailers would be visible from I-10, in
line with the expectations of Buckeye City leadership. We believe similar screening should also be
provided to protect neighboring property owners from the objectionable views, though given those
residences are in County jurisdiction, we will defer to County on how those side property lines are best
addressed.
We may be able to support reasonable phasing of the needed screening improvements and would be
happy to discuss those possibilities with the applicant if they so desire.
Please keep us updated on the project schedule, this is a request that we would be likely to attend
public hearings and oppose on the record if the screening is not resolved.

Good morning Mr. Martell,
Thank you for the opportunity to comment on the Zoning application and Military Compatible Use
permit for the proposed Shipping Container Storage & Digital Billboard. The digital billboard is
requested to be a maximum height of 65’ and 672 SF in size. Luke AFB has previously commented on
the UCCD application for this parcel and our comments are attached. The site sits on approximately 1.3-
acres and is located at 19020 W. Culver Street in unincorporated Maricopa County, AZ. The site is
located partially inside the Luke AFB 1988 65 Ldn, “high noise or accident potential zone,” as identified
by A.R.S. § 28-8461, and is within the “territory in the vicinity of a military airport,” also defined
by A.R.S. § 28-8461.
Luke AFB follows A.R.S. § 28-8481 when evaluating compatible land use within the “territory in the
vicinity of a military airport” and considers this request to be compatible and consistent with the high
noise or accident potential of a military airport or ancillary military facility and therefore will not
negatively impact Luke AFB’s flying and base operations. Due to the location within the
approach/departure path of Luke AFB, if future business operations shall include more than the storage
of shipping containers, Luke AFB respectfully requests the opportunity to review applications for new
uses. Please note that our comments regarding compatible land use are exclusive to Luke AFB
operations and not expressive of the views of the surrounding residential use parcels.
Since the development will be located within the “territory in the vicinity of a military airport,” it will be
subjected to approximately 170 over flights a day. We recommend you review the sound attenuation
requirements found in A.R.S. § 28-8482. In addition, a strong notification program on the part of the
applicant is essential to inform patrons about Luke AFB operations.

ADOT is neutral on zoning matters. As such, ADOT has no comment. ADOT reserves comment until review of
the preliminary site plans and traffic impact analysis/statement (if required) for this project. Please notify
ADOT once the project is through zoning and moving forward.
ADOT traffic engineering may offer additional comments, it is recommended that the developer ascertain if a
traffic study or permit will be necessary.

ADOT reserves the right to review any future plans, additions and/or changes to this development in regards
to any impact they may have on the State Highway System.
ADOT would like to remind the developer there is ADOT Right of Way in the area and they
must not encroach upon it without a permit. No work shall begin on ADOT right of way until
said permit is obtained.

The Maricopa County Technical Advisory Committee Meeting on Tuesday, March 19th at 8:15 a.m. to discuss the
rezoning of a 1.3-acre site from Rural-43 to C-2 CUPD for outdoor storage and a digital billboard. The case is Z2024008
– Carpenter & Rahberg Property located ½ mile NW of the NWC of Perryville Road and Roosevelt Street in the Buckeye
area.
