Comments:
Approval of this item would allow for the further development of a
wedding materials storage business located on a parcel within the
65 LDN noise contour of Luke AFB. The site is already active and is
under violation for construction without a permit of the existing
warehouse. Approval of this item and the issuance of building
permits would resolve the violation. If approved, the owners intend
on expanding the business and fully developing the site.
There was a handout memo to the Commission regarding
conditions ‘a’ and ‘e’ relating to the Perryville Rd. MCDOT has
reduced its ultimate ROW from 65’ to 55’ half-width. This allows the
applicant to retain some of the existing structures that otherwise
would have been removed for ultimate street improvements. The
updated conditions are shown in the Commission recommendation
below.
Staff received an appeal form objecting to the Commission
recommendation, and it is attached to this report. The objection
mirrors prior opposition received by staff in this case as it relates
to concerns regarding commercial operations near the existing
residential community to the west. Opposition totals one opposed.

Recommendation:
On 10/24/24, the Commission voted 7-0 to adopt a motion
recommending the Board of Supervisors approve MCP2023010
subject to conditions ‘a’ – ‘i’:
a.
Development of the site shall be in substantial conformance with the Site Plan entitled
“Krikorian Storage Buildings”, consisting of 1 full-size sheet, dated October 17, 2024, or
otherwise within 30 days of approval the applicant will provide staff an amended site plan
to show 55’ of R/W, except as modified by the following conditions. Staff may determine
slight refinements to remain in substantial conformance with the approved site plan.
Minor and major amendments to the site plan will be determined in accordance with
Chapter 3 of the Maricopa County Zoning Ordinance.
b.
Development of the site shall be in substantial conformance with the Narrative Report
entitled “Krikorian Storage Buildings”, consisting of 4 pages, dated May 22, 2024, except
as modified by the following conditions.
c.
The following Rural-43 MAAMF MCP standards shall apply:
1. Front yard (east): 20’
2. Rear yard (west): 30’
3. Side yard (north): 25’
d.
Prior to issuance of a building permit, written confirmation will be required from the
emergency fire protection jurisdiction having authority that the facility has been designed
in accordance with their regulations and requirements, and that emergency fire protection
service will be provided to the facility. Prior to issuance of the certificate of occupancy,
local fire protection jurisdiction review and approval will be required.
e.
The following Planning Engineering conditions will apply:
1.
Dedication of 55 feet of Right-of-Way along Perryville Road (0 existing) must be
dedicated to MCDOT prior to issuance of Building Permits.
2.
For dedication, the applicant is required to provide, at its expense, an American
Land Title Association (ALTA) Owner’s Policy of Title Insurance showing title
vested in Maricopa County, a political subdivision of the State of Arizona.
3.
The gate on Perryville Road must be removed and replaced with a CMU wall. This
must be identified on plans submitted for building permits and completed prior to
Final Drainage Inspection for any building permits. Direct access to Perryville Road
is prohibited.
4.
Prior to issuance of building permits, plans must clearly show how water is routed
into the provided retention basins, and how the required retention is provided.
5.
The ultimate outfall for the site must be the historic location (to the south, near the
center of the site, adjacent to Basin E). This must be shown on the plans submitted
for building permits.

6.
The site must provide a minimum of 8,831.3 cubic feet of retention. Plans
submitted for building permits must show how this volume is retained on-site.
7.
The subject premises is located within the County’s Urbanized Area and appears
as though it will disturb more than one (1) acre. A Storm Water Pollution Prevention
Permit (SWPPP), issued by the County (PND), will be required prior to issuance of
any building permits required for site development (unless less than 1 acre of
disturbance is shown on the plans submitted for building permit). See:

8.
Engineering review of planning and/or zoning cases is for conceptual design only.
All development and engineering design shall be in conformance with Section
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards;
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual;
and current engineering policies, standards and best practices at the time of
application for construction.
9.
Based on the conceptual design nature of the information submitted, changes to
the site layout may be necessitated by the final engineering design of the drainage
infrastructure.
10.
Detailed Grading and Drainage (Infrastructure) Plans must be submitted with the
application for Building Permits.
f.
All outdoor lighting shall conform to the Maricopa County Zoning Ordinance. All facility
lighting shall be completely turned off, except for security light, at the closing hours of the
facility.
g.
Noncompliance with any of the conditions assigned to the approval of this Zone Change
by the Maricopa County Board of Supervisors may be grounds for revocation in
accordance with the requirements and procedures as set forth in the Maricopa County
Zoning Ordinance.
h.
The property owner/s and their successors waive claim for diminution in value if the
County takes action to rescind approval due to noncompliance with conditions.
i.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. In the event of the failure to comply with any condition, the property
shall revert to the zoning that existed on the date of application. It is, therefore, stipulated
and agreed that either revocation due to the failure to comply with any conditions, does
not reduce any rights that existed on the date of application to use, divide, sell or possess
the property and that there would be no diminution in value of the property from the value
it held on the date of application due to such revocation of the MCP. The MCP enhances
the value of the property above its value as of the date the MCP is granted and reverting
to the prior zoning results in the same value of the property as if the MCP had never been
granted.

Project Summary:
1.
The applicant is requesting this MCP to legalize an unpermitted structure used for storing
materials used for weddings. Luke AFB originally approved the usage of this property for
warehousing under UC2016017. The owners acquired the property in January of 2017 and then
constructed the existing structure without benefit of zoning entitlement and building permits
sometime in 2021. They then began operating their current business, leading to the issuance of
violation V202202055.
2.
The site is located within a triangular sliver of land within the bounds of the 65 LDN noise contour
of Luke AFB with a residential subdivision outside of the contours about 300’ west of the subject
property. Some of this sliver area was developed with rural estates prior to the end of residential
development being permitted within the noise contours. New developments are subject to
approval by Luke AFB through the Use Compatibility and Consistency Determination (UCCD)
process.

As it stands, this application would allow the existing structure to be permitted and would
additionally allow for an expansion of site operations. Three additional buildings would be added
in future phases. These buildings would include additional warehousing, an on-site laundromat,
and an employee area. The site would operate from 9:00 am to 6:00 pm and provide employment
for up to five employees. The site would be accessed from the N. 187th Dr. cul-de-sac to the
southwest of the property rather than the Perryville Rd ROW. The owner/operators would utilize a
paved circular drive around the property to access the warehouse for storage purposes. It should
be noted that this drive is such that only smaller commercial vehicles could conceivably be able
to access the property rather than larger trucks. Additionally, the site would be encompassed by
a 6’ CMU masonry fence that would replace an existing unpermitted fence.
4.
The applicant is only requesting certain variations relating to setback requirements for the
existing structure. It is presumed future development would comply with all other requirements
for Rural-43 zoning. The front yard would be based off Perryville Rd. to the east, with the rear yard
to the west and side yards to the north and south respectively. It should be noted that in its current
location, the existing structure is 25’-8” from the northern property line. This would require an
additional variation rather than the 30’ shown in the below table.

Buckeye 2040 General Plan – Luke Compatibility Area (adopted June 7, 2022): Luke
Compatibility Area denotes the statutorily defined High Noise or Accident Potential Zones. This
designation is established in compliance with Arizona Revised Statutes (A.R.S.) §28-8461 and
A.R.S. §28-8481. Pursuant to A.R.S. §28-8481 (E) and (P) no new residential development within
the high noise and accident potential zones surrounding Luke Air Force Base as depicted on
Figure 2-3 is allowed unless the subject property had a building permit issued, had a residence
constructed, or was approved for residential development in a “development plan” prior to
December 31, 2000. Only those uses identified as consistent and compatible with the high noise
or accident potential generated by these facilities are allowed.
9.
White Tank Grand Avenue Area Plan – Military Compatible (adopted December 6, 2023):
Applicable only within ARS defined High Nose or Accident Potential Zone (HNAPZ). It includes
only those uses determined to be compatible and consistent with the HNAPZ of a military airport
or ancillary military facility.
Public Participation Summary:

The applicant complied with the Maricopa County public participation process with the required
posting of the property and the notification to the adjacent property owners within 300’ of the
subject site. Staff has received comments upon submittal from the City of Buckeye. The City
included
several
technical
comments
relating
to
the
existing
ROW,
landscaping,
water/wastewater, and to inquire about potential site annexation. Ultimately, they state that if the
site is unable to be annexed, that they “support expansion of the facility within the County as
proposed” and that the City finds it would be compatible with their general plan.
11.
Staff received opposition from a resident of the subdivision to the west who took issue with the
disturbances generated by the site’s operation. They note concerns over the lack of a building
permit for the existing structure, although staff would note that the existing violation for this site
can only be rectified via a building permit which incentivizes the owner to complete that process.

Outstanding Concerns from Reviewing Agencies:

Staff would note there remain several concerns from Planning Engineering regarding certain site
aspects of site drainage. However, they have approved this application, subject to several
conditions that would be required to be met as part of the permitting process.
Staff Analysis:
13.
Staff is approving of this proposal, noting that it is consistent with both the White Tank Grand
Avenue Area Plan and Buckeye 2040 plan for parcels within the Luke AFB noise contours. This
use appears to be of the highest and best use available to this property considering its location.
Staff believes any disruptions caused by site operations would be relatively minor considering
that it is unlikely heavy vehicles would be able to access and use the site. Finally, approval of this
item would resolve an existing violation and allow for proper building permitting to take place.
Staff has included a variation to the north setback in addition to what has been proposed by the
applicant to allow for the existing structure to be permitted in its existing location.
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve MCP2023010 subject to the following conditions ‘a’ – ‘i’:

Purpose of Request:
The purpose of this request is to obtain a Military Compatibility Permit Overlay on a site that is currently
zoned RU-43. The owner wants to operate wedding supply warehouses on this site. The site has one
existing warehouse and the owner plans to build two more warehouses in the future along with a
building housing toilets for the workers, a parking lot, and a circular drive around the site.
Note: The owner will not be annexing this property to the city of Buckeye.
Description of Proposal:
The property has on it an existing 2,526 sf metal building on a concrete slab. The use of this metal
building is as storage for a wedding decoration business. The building is used from sunrise to sunset
(9:00 a.m. to 6:00 p.m.) and the number of employees who use the building ranges from one to five. The
site is surrounded by a 6’-0” masonry fence on three sides, including the side facing Perryville Rd. The
site doesn’t currently have any designated parking spaces. The site is unpaved and is composed of
compacted dirt and vegetation. The existing building is located 41’-0” from the east property line and
25’-8” from the north property line with the patio and pedestrian entrance facing the west property
line. The building has a roll-up garage door on the north side. The building also has a covered patio
facing the west property line.
Currently the building is hooked up to Arizona water, but is not hooked up to sewer, or electrical. The
owner plans to install a septic tank and get power from APS. The building does not currently, nor will it
provide food services in the future.
The client proposes to add three additional buildings in future phases on the site to expand their
wedding decoration business. Two of these buildings will also be prefabricated metal buildings of a
similar size to the existing metal buildings on site. One of the future metal buildings will be used as a
storage space with a laundry facility and the other will just be used as a storage space. The third building
the client proposed to add to the site will comprise of toilet rooms and a breakroom. This third building
will be wood frame construction with a stucco or hardie board siding finish. The existing masonry fence
on the west side and the existing gate will be demolished. A new masonry fence will be erected to allow
a 65’-0” R.O.W. from the center of Perryville RD.

We are requesting a reduction in the front setback to
accommodate the existing building on the site, which is 40’-
0” from the front property line. The county is requiring a
20’-0” easement on the front property line and therefore
the existing building is 20’-0” from the new property line.

Relationship to Surrounding Properties:
The project site is located inside the 1988 JLUS 65 ldn, “high noise or accident potential zone” as
identified by A.R.S. 28-8461 and is within the “territory in the vicinity of a military airport” also defined
by A.R.S. 28-8461. As such the property will be subjected to approximately 170 over flights per day,
according to the Department of the Air Force Air Education and Training Command at Luke Air Force
Base. Due to the proximity to the air force base, the project site is not suited for residential use.
According to a letter from James R. Mitchell, the Director of Community Initiatives Team at Luke Air
Force Base, “this facility will not negatively impact the flying operations at Luke Air Force Base.”
Directly to the north and south of the project site are lots with a single-family home on them. To the
west of the project site is an empty lot. Further to the west of the project site is a housing development.
To the east of the project site is Perryville Rd. and to the east of Perryville Rd. is farmland. Even though
the project site is surrounded by residential uses, the area is no longer suited for residential use
according to the proximity to Luke Air Force Base. Therefore, a commercial use on this site is the best
and highest use of the land given its location.
Circulation System:
The site will be accessed from 187th Dr., the cul de sac on the southwest corner of the site. There will be
no access from Perryville Road. The current gate on the masonry fence on the east side of the property
facing Perryville Rd. will be removed and filled in.
Upon entering the site from the cul de sac, there will be a parking lot on the south side of the site and a
drive that circumambulates around the buildings on site. The client would like to have vehicular access
to load and unload materials into each of the metal buildings and the circular drive facilitates that. The
cul de sac entrance also serves as the exit. Someone can exit by backing out of the parking lot and
heading to the cul de sac or they can drive around the circular drive to exit the site.
Only pick-up trucks, cars or pick-up trucks with trailers will be utilized on this site.
Development Schedule:
Phase I will be to comply with the violation that was given by the County for an unpermitted building on
site and entails obtaining an MCP Zoning overlay on the site, getting a building permit for the existing
building, building the toilet room and break room building, and paving the south half of the site to add
parking.
Phase II will be to add the two additional metal buildings and pave the north half of the property to
complete the circular drive around the buildings.
Community Facilities and Services:
Since the client is proposing commercial use for the property, this section does not apply.

Engineering Review has reviewed the plan and report routed for review on 09/06/2024,
for the subject application and has no objections subject to the following stipulations:
1.
Dedication 55-feet of Right-of-Way along Perryville Road (15 additional feet of
subject property) must be dedicated to MCDOT prior to issuance of Building
Permits.
2.
For dedication, the applicant is required to provide, at its expense, an American
Land Title Association(“ALTA”) Owner’s Policy of Title Insurance showing title
vested in Maricopa County, a political subdivision of the State of Arizona.
3.
The gate on Perryville Road must be removed and replaced with a CMU wall.
This must be identified on plans submitted for building permits and completed
prior to Final Drainage Inspection for any building permits. Direct access to
Perryville Road is prohibited.
4.
Prior to issuance of building permits, plans must clearly show how water is
routed into the provided retention basins, and how the required retention is
provided.
5.
The ultimate outfall for the site must be the historic location (to the south, near
the center of the site, adjacent to Basin E). This must be shown on the plans
submitted for building permits.
6.
Site must provide a minimum of 8,831.3 Cubic Feet of Retention. Plans
submitted for building permits must show how this volume is retained on-site.
7.
The subject premises is located within the County’s Urbanized Area and
appears as though it will disturb more than one (1) acre. A Storm Water
Pollution Prevention Permit (SWPPP), issued by the County (PND), will be
required prior to issuance of any building permits required for site development
(unless less than 1 acre of disturbance is shown on the plans submitted for
building permit).

8.
Engineering review of planning and/or zoning cases is for conceptual design
only. All development and engineering design shall be in conformance with
Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and

Design Manual; and current engineering policies, standards and best practices
at the time of application for construction.
9.
Based on the conceptual design nature of the information submitted, changes
to the site layout may be necessitated by the final engineering design of the

Onsite Wastewater –
A Notice of Intent to Discharge application for an onsite wastewater treatment (septic)
system is required for any construction. Application must be submitted to the MCESD

Good morning, Joel:
Upon reviewing the attached items pertaining to rezoning and development of land within the City of Buckeye’s Planning Area Boundary,
Buckeye’s Planning Division has the following comments:
The City’s preference is that the property owner annex into the City of Buckeye to allow the City’s development review process to
govern the planned expansion. However, to meet AZ requirements for annexation contiguity, the annexation would need to include
property owned by separate entities to the south (to connect to the already annexed land south of Thomas Road). We would like the
owner to at least discuss annexation with his neighbors to see if that may be supported. If the neighboring owners do not support
annexation, City would support expansion of the facility within the County as proposed (though modified to address certain design
requirements of the City of Buckeye, listed below).
The existing/proposed use of the property as storage for a wedding decoration business is consistent with the Luke Compatibility Area
(LCA) land use designation applied to the property by the Buckeye General Plan. The City does not have any objection to the use,
specifically.
Dedication of additional right-of-way for Perryville Road may be required. City Traffic Engineer John Willett is CC’d and can confirm. If
additional ROW is required, no site improvements including buildings, walls/fences, paved drive aisles, parking, etc. should be
permitted in that future ROW.
A landscape setback with trees planted 20 feet on center should be provided adjacent to Perryville Road to assist in screening of the
industrial functions occurring on the site. Ideally the landscape setback will have a depth of 20 feet and be located on the outside of
the wall that encloses the property. The 20’ setback should be provided from the future property line upon dedication of any
additional ROW needed for Perryville Road.
The City does not support use of metal buildings unless building facades are constructed around the metal building to minimize the
extent of the metal that is visible from adjacent streets.
The project may be required to tie in to City of Buckeye sewer (if available in proximity to the site) as opposed to septic. Josh Ford and
Ron Moll in the Engineering Division, both CC’d, can confirm if the project will be required to tie into City sewer or not.
Police (City of Avondale) and Fire (City of Goodyear) providers listed in the narrative are incorrect.
Engineering and Traffic may have additional comments that they can provide to you directly.
I would like to attend the TAC meeting to discuss some of these items with the business owner. Please send me an invite when you’re able.

Good morning,
Thank you for contacting me about this property. I will send out to my neighbors to begin the fight
against this proposal. Joel, are you the person who will receive letters against the proposal? In reading
the list of who received the notice, I find it curious that a neighborhood 2 miles away received notice,
but the neighborhood within 100 yards did not. How can I get Litchfield Farms on the notice list? I am
not sure why Litchfield Farms was not included, but I am glad I now have the information. I know the
process for the property on 3220 N Perryville Road included a requirement for a public meeting. Will
that also happen with this property? Would it be helpful to take pictures of the building at night all lit
up, even though they say there is no electricity? It goes to show their integrity. Since this building was
put up without a permit, is there a plan to have county inspecters complete a review of the building to
bring it up to code? Also, I did not see anything about how this proposal will benefit the community.
They are proposing 3 buildings in the middle of a residential neighborhood. Also, I did not see
anything about safety measures since the risk of fire is very high. Most wedding materials are made of
paper.
