SALE OF TALL POT TREE AND PLANT MATERIAL
TO OTHER MUNICIPALITIES AND OTHER GOVERNMENTAL AGENCIES
Agenda:  
WHEREAS, The Flood Control District of Maricopa County (DISTRICT) was 
established in accordance with provisions of Arizona Revised Statutes Title 48, Chapter 21; 
and,
WHEREAS, the DISTRICT propagates native Sonoran Desert trees and plants in ‘tall 
pots’ that are uniquely suited for vegetation establishment and survival without the need for 
supplemental watering; and,
WHEREAS, tall pot tree and plant materials are not commercially available in Maricopa 
County; and,
WHEREAS, tall pot-grown native trees and plants provide erosion control, site 
stabilization, and site enhancements such as shade without requiring the need for permanent 
irrigation systems, and thereby conserving potable water; and,
WHEREAS, municipalities and government agencies have requested tall pot trees in 
the past from the DISTRICT. They seek to use tall pot plants for their projects to reduce 
potable water use and improve the maintenance of native plants on their projects and 
properties; and,
WHEREAS, these plants contribute to community and environmental well-being by 
offering shade, improving air quality, enhancing aesthetics, supporting habitat and 
biodiversity, and conserving natural resources.

NOW, THEREFORE, BE IT RESOLVED that the Director of the DISTRICT is authorized 
to sell tall pot tree and plant materials to municipalities and other governmental agencies 
within Maricopa County, the cost of such sale per plant being the cost determined by the 
DISTRICT to prepare, plant, grow and nurture the individual tall pot plants. The DISTRICT will 
reevaluate and update this cost on an annual basis as of January of each subsequent calendar 
year. At the time of the approval of this Resolution that cost per tall pot tree and plant is 
$50.00.
BE IT FURTHER RESOLVED that the DISTRICT will have discretion to allow 
municipalities and other governmental agencies to purchase tall pot trees and plants as 
requested, on a first-come, first-served basis and dependent upon plant availability. 
BE IT FURTHER RESOLVED that a municipality or other governmental agency shall 
submit a written request for tall pot trees and plants to the DISTRICT within 1 year and not 
less than 6 months before the desired receipt and planting of said tall pot trees and plants. 
These tall pot trees and plants may not be sold to or transferred to other entities, developers, 
non-profits, or businesses. 
BE IT FURTHER RESOLVED that all sales shall be based upon a Letter Agreement 
an example of such Letter Agreement is attached as Exhibit A.
