The proposed zone change is to facilitate a trucking terminal that
will be used by a single company. The requested zone change with
overlay includes a POD for the proposed trucking terminal. The
proposed Ind-3 IUPD zoning is consistent with land use patterns in
the area as similar uses are present east and west of the subject
site. There was no public comment submitted on the case. There
are no outstanding concerns from reviewing agencies.

On 7/25/24, the Commission voted 6-0 to adopt a motion
recommending the Board of Supervisors approve Z2022166
subject to conditions ‘a’ – ‘g’:
a.
A Plan of Development is approved subject to site plan entitled “MIST Trucking Terminal”
consisting of 1 full-size sheet, dated May 20, 2024, and stamped received May 21, 2024.
The Plan of Development may be amended administratively under separate application
pursuant to compliance with Maricopa County zoning regulations. Staff may determine
slight refinements to remain in substantial conformance with the approved site
plan. Minor and major amendments to the site plan will be determined in accordance with
Chapter 3 of the Maricopa County Zoning Ordinance.
b.
Development of the site shall be in substantial conformance with the narrative report
entitled “MIST Trucking Terminal”, consisting of 3 pages, dated May 20, 2024, and
stamped received May 21, 2024, except as modified by the following conditions.

c.
The following IND-3 IUPD standards shall apply:
1. The IUPD overlay shall limit uses on the site to trucking terminal with ancillary uses.
d.
The following Planning Engineering conditions shall apply:
1. Engineering review of planning and/or zoning cases is for conceptual design only. All
development and engineering design shall be in conformance with Section 1205 of the
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards and best practices at the time of application for
construction.
2. Based on the conceptual design nature of the information submitted, changes to the site
layout may be necessitated by the final engineering design of the site’s drainage
infrastructure.
3. Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with the
application for Building Permits
4. Maximum grades for fill slopes shall be 3:1 and 2:1 for cut slopes. Slopes in excess of
those specified shall require a geotechnical stability analysis.
5. Minimum Top of berm width is 8-ft.
6. The subject site is located within the County’s Urbanized Area. A Storm Water
Pollution Prevention Permit (SWPPP) from the County will be required prior to
issuance of any construction permits. The SWPP permit review will be completed at
the time of the building permit stage. The applicant will need to submit for the SWPP
permit separate from the Building permit.
e.
Prior to issuance of initial building permit, written confirmation will be required from the
emergency fire protection authority that the facility has been designed in accordance with
their regulations and requirements, and that emergency fire protection service will be
provided to the facility. Prior to issuance of the certificate of occupancy, local fire
protection jurisdiction review and approval will be required.
f.
Evidence of a recorded SVT easement on the eastern side of the driveway must be
provided prior to issuance of any grading or construction permits on site.
g.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. In the event of the failure to comply with any condition, the property
may be considered for reversion to the zoning that existed on the date of application per
Maricopa County Zoning Ordinance requirements. It is, therefore, stipulated and agreed
that revocation due to the failure to comply with any conditions, does not reduce any rights
that existed on the date of application to use, divide, sell or possess the property and that
there would be no diminution in value of the property from the value it held on the date of
application due to such revocation of the zone change. The zone change enhances the
value of the property above its value as of the date the zone change is granted and
reverting to the prior zoning results in the same value of the property as if the zone change
had never been granted.

Project Summary:
1.
The proposed zone change to IND-3 IUPD with POD is to support the development of a trucking
terminal with an office/maintenance building. The site will be operated by a single company and
will consist mostly of a paved parking area for bobtail truck parking as well as 20 standard parking
stalls for employees’ personal vehicles. In addition to the paved area the site will have a single
10,000 sq. ft. building that will serve as both an office for the company as well as a maintenance
shop for the trucks. Screening will be provided via a six-foot block wall. The site will have access
from Southern Ave. The driveway is located against the eastern lot line and does not leave
enough room for the required sight visibility triangle (SVT) to the east. As such, the applicant
states that they are working on an SVT easement agreement with the property owner to the east
to satisfy the SVT requirement.

The subject site had no recent history prior to pursuit of this entitlement request. The initial
preapplication meeting, PA2021047, was held on February 23, 2021. Formal submittal for the
zone change with overlay request was on September 1, 2022. The technical advisory committee
meeting was scheduled for November 1, 2022, however the applicant declined to attend, which
contributed to subsequent disjointed submittals and a prolonged review process.

Plan PHX 2015 General Plan (adopted April 2018): The City of Phoenix General Plan designates
the subject area for small lot single family residential development of five to ten dwelling units
per acre. Staff notes that this would equate to 27 to 54 units on the subject property.
Public Participation Summary:

Per the citizen participation summary submitted by the applicant all minimum statutory
requirements have been met. The applicant posted the site with two signs compliant with posting
requirements and sent mailed notice via USPS to all property owners and homeowner’s
associations within 300’ of the subject site as well as all interested parties. Staff notes that the
applicant did report an error on their part with the initial mailed notification. The applicant was
transparent and honest with staff on the issue and was cooperative in getting it resolved. Per
staff recommendation, the applicant requested a continuance to the case so that mailed
notification may go out to meet the statutory requirement. The applicant has reported no
response outreach efforts. Additionally, staff has not received any public comment on this matter
as of publication of this report.

Staff Analysis:

Staff notes that the proposed zone change to IND-3 IUPD for a trucking terminal matches the
predominate land uses that exist in the area west of 67th Ave. and between Southern Ave. and the
river. Notably the property to the east is utilized as a very similar trucking terminal to the one
proposed for the site and the property to the west is used for truck trailer storage which is also of
similar intensity to the proposed site. Staff notes that while most of the properties in this area
are used for industrial uses, only about half of them have proper entitlement for such uses.
Nonetheless, the sites that do have entitlement mostly are of similar IND -3 or IND-3 IUPD zoning.
Staff has some concern over the adjacent residential properties south of Southern Ave., however
staff recognizes that the proposed use is consistent with existing uses north of Southern Ave.
and feel the addition of the proposed site would bring negligible impact to the area given similar
uses exist on properties due east and due west to the subject site. Staff also concurs with the
IUPD overlay as it limits uses to just a trucking terminal and ancillary facilities. Any other use on
the site would require a major amendment to the IUPD overlay which would include the full public
hearing process.

Staff notes that the driveway to access the site is proposed in such a location that would not
leave room for the required 25’ by 25’ SVT to be located on the eastern portion of the driveway,
on the subject property. Due to the proposed use of the property staff was not comfortable with
a reduction in the required SVT. After coordination between staff and the applicant, the applicant
agreed to pursue a SVT easement agreement with the property owner to the east to satisfy the
zoning ordinance requirement for a SVT. As such, staff offers condition “f” to require an SVT
easement be recorded prior to the issuance of construction or grading permits on site.
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve Z2022166 subject to the following conditions ‘a’ – ‘g’:

Purpose of Request
Rezone from RU-43 to IND 3 IUPD to allow semi-truck terminal.
Description of Proposal
We are proposing new semi-truck terminal on an existing vacant lot. The site is currently
vacant land zoned RU-43 and we would like to request a rezone from RU-43 to IND 3
IUPD to allow a semi-truck terminal. We are proposing a private semi-truck terminal that
is company owned. Employees will be onsite to run administrative duties and company
operations including minor semi-truck vehicle maintenance in the shop within the
building or behind parking areas out of view. Any major repairs have been completed
offsite.
We are not seeking any alterations to code requirements found within IND 3 IUPD.
Our color pallet will be primarily earth tones with a combination of CMU Block and
stucco materials.
Site screening will be achieved through CMU block walls at both site perimeter walls
and parking screen walls.
Relationship to Surrounding Properties
Our proposed project is in an area that is partially undeveloped but just west of 202 loop access
adjacent to industrial uses east and west of the property. The below are the adjacent uses:

Our proposal is consistent with the existing uses to our east and west as they are
currently used for industrial uses including trucking operations, storage, and mining
operations.
We have proposed our office building and site screening with consideration to the
single-family residents to provide a buffer to our south and avoid any negative impact
to the neighborhood.

Location and Accessibility
Our project is located west of 67th Avenue and Southern Ave which provides easy
access for semi-truck traffic with access along Southern Avenue.
Circulation System
We will be providing additional right of way dedication on Southern Avenue to remain
consistent with future development plans on Southern Avenue if required. Southern Ave
will provide access to the site via a proposed driveway.
Development Schedule
The owner will proceed with all proposed improvements in two phases once permits are
available for pick up.
Phase 1- Initial phase includes all improvements included in the plan that is building,
parking and site improvements.
Phase 2 – Future parking expansion area at the site north. (Referenced on site plan.)
Summary
Our proposal is to rezone from RU-43 to IND 3 IUPD to allow the semi-truck terminal use
while maintaining true with the surrounding properties. We look forward to hearing
staff’s feedback to assist in guiding the project forward.

Engineering Review has reviewed the first plan and report routed for review on
04/09/2024, for the subject application and has the following comments:
The following stipulations will apply:
1. Engineering review of planning and/or zoning cases is for conceptual design
only. All development and engineering design shall be in conformance with
Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and
Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway
Design Manual; and current engineering policies, standards and best practices
at the time of application for construction.
2. Based on the conceptual design nature of the information submitted, changes
to the site layout may be necessitated by the final engineering design of the
site’s drainage infrastructure.
3. Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted
with the application for Building Permits
4. Maximum grades for fill slopes shall be 3:1 and 2:1 for cut slopes. Slopes in
excess of those specified shall require a geotechnical stability analysis.
5. Minimum Top of berm width is 8-ft.
6. The subject site is located within the County’s Urbanized Area. A Storm Water
Pollution Prevention Permit (SWPPP) from the County will be required prior to
issuance of any construction permits. The SWPP permit review will be
completed at the time of the building permit stage. The applicant will need to
submit for the SWPP permit separate from the Building permit.
