AMENDMENT NO. 1 TO THE
CONTRACT
BETWEEN
MARICOPA COUNTY
ADMINISTERED BY ITS HUMAN SERVICES
DEPARTMENT
AND
THE CITY OF AVONDALE.

I.
Maricopa County (“County”) administered by its Human Services Department and the
City of Avondale (“City” or “Subrecipient”) entered into a financial agreement
(“Agreement) on or about April 12, 2023. The Agreement term is April 12, 2023,
through June 30, 2026. The purpose of the Agreement is for the Subrecipient to
construct a building for the purpose of providing bridge housing to families
experiencing homelessness. The construction of the property shall generate 6 units.
These units shall serve up to 10 families experiencing homelessness annually. The
County provided the Subrecipient with $1,700,000 in American Rescue Plan Act
(ARPA) funds under Assistance Listing Number (ALN) 21.027. The County and the
Subrecipient may be referred to individually as “Party” or collectively as “Parties.”

The Parties executed Administrative Change Order No. 1 on or about May 31, 2024.
The purpose of the Administrative Change Order was to revise the timeline of the
project. The last day of the revised schedule remained within the Agreement term.

II.
The Parties now agree to amend the Agreement as follows:

A.
The County shall provide the Subrecipient with an increase of $286,061 in
ARPA ALN 21.027 funds, revising the Agreement total amount to $1,986,061.
The additional funds will be used to improve building materials to meet
durability expectations. The durable materials will include doors, flooring,
kitchen, and bathroom finishes. Improving materials will prolong use, reduce
repair and care costs, and ensure a safe and suitable environment for families
recovering from homelessness.

B.
Revise Paragraph 6.0 (Funding), by removing in its entirety and replacing with
the following:

The County shall provide the Subrecipient with $1,986,061 in ARPA
funds under Assistance Listing Number (ALN) 21.027 provided to the
County through the U.S. Department of the Treasury.

removing Subparagraph 36.2.14 to correct a typographical error.

E.
Add the following Paragraph to the Agreement:

57.0 PROVISIONS REQUIRED BY LAW
Each and every provision of law and any clause required by law to be
in this Agreement will be read and enforced as though it were included
herein and, if through mistake or otherwise any such provision is not
inserted, or is not correctly inserted, then upon the application of either
party, this Agreement will promptly be physically amended to make
such insertion or correction.

F.
Revise Exhibit A-Statement of Work to address the following:

1.Update the County funding total in Paragraph 4.0 (Budget Sources) with the
following:

III.
Under A.R.S. §38-511, the Parties may cancel this Agreement without penalty of
further obligation within three years after execution of this Agreement if any person
significantly involved in initiating, negotiating, securing, drafting, or creating this
Agreement on behalf of the County is, at any time while this Agreement or any
extension is in effect, an employee or agent of any other party to the Agreement in
any capacity or consultant to any other party of this Agreement with respect to the
subject matter of this Agreement.

IV.
The Agreement is amended to incorporate the changes contained in this Amendment No.
1. All other terms and conditions of the Agreement remain in full force and effect as
approved, amended and executed by the Parties.

V.
The Parties have authorized the undersigned to execute this Amendment No. 1 on their
behalf.
