Approval of the SUP would allow for the development of a horse
veterinary hospital to serve the Rio Verde area. Equine uses are
prevalent throughout Rio Verde, but the area lacks a dedicated
center for the treatment of horse medical issues. The applicant is
still working with MCDOT on addressing location and other issues
related to the proposed entrance to the site from 144th St. As of this
report, there are 81 letters of support and 5 letters of opposition,
two of which were neighbors in the 300’ buffer. Staff has calculated
the support and opposition received, and notes that a Super
Majority Vote has not been triggered.

Recommendation:
On 5/9/24, the Commission voted 9-0 to adopt a motion
recommending the Board of Supervisors approve Z2023062
subject to conditions ‘a’ – ‘i’:
a.
Development of the site shall be in substantial conformance with the narrative report
entitled “Sonoran Equine”, consisting of 6 pages, dated January 31, 2024, except as
modified by the following conditions.
b.
Development of the site shall be in substantial conformance with the site plan entitled
“Sonoran Equine Special Use Permit “, consisting of 3 full-size sheets, received March 19,
2024, except as modified by the following conditions. Staff may determine slight
refinements to remain in substantial conformance with the approved site plan. Minor and

major amendments to the site plan will be determined in accordance with Chapter 3 of
the Maricopa County Zoning Ordinance.
c.
This SUP is valid for a period of 20 years and shall expire on June 1, 2044, or upon
termination of the use for a period of 90 or more days, whichever occurs first. All site
improvements associated with the SUP shall be removed within 90 days of such expiration
or termination of use.
d.
Prior to or concurrent with the submittal of the initial building permit for any portion or
phase of this development, a traffic impact statement must be approved by the
Maricopa County Department of Transportation (MCDOT).
e.
Flood permits must be issued for all structures on the site prior to issuance of building
permits, including for those on the agriculturally exempt portion of the site. Submittals
for any building permit must include a grading and drainage plan and a drainage report.
f.
The following Rural-43 SUP standards shall apply:
1.
Allowed uses: All uses allowed under MCZO 503.1 and MCZO 1301.1.20.
2.
Rear yard (eastern line of the SUP area): 0’ required setback.
3.
Paving: decomposed granite allowed to be used outside of parking spaces (MCZO
1102.7.1.)
g.
Noncompliance with any Maricopa County Regulation may be grounds for initiating a
revocation of this SUP per the procedures set forth in the Maricopa County Zoning
Ordinance.
h.
The property owner/s and their successors waive claim for diminution in value if the
County takes action to rescind approval due to noncompliance with conditions.
i.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. It is, therefore, stipulated and agreed that either revocation due to
the failure to comply with any conditions, or the expiration of the SUP, does not reduce
any rights that existed on the date of application to use, divide, sell or possess the property
and that there would be no diminution in value of the property from the value it held on the
date of application due to such revocation or expiration of the SUP. The SUP enhances
the value of the property above its value as of the date the SUP is granted and reverting to
the prior zoning results in the same value of the property as if the SUP had never been
granted.

Project Summary:
1.
The applicant is proposing a twenty-year Special Use Permit (SUP) on a 1.28-acre portion of a 10-
acre parcel to develop a farm animal surgical hospital per MCZO 1301.1.20, specifically for the
treatment of horses. The site, located at the northeast corner of Rio Verde Dr and 144th St, will be
co-developed under both this proposed SUP and an agricultural exemption for a horse
boarding/breeding facility under LU20230029 that is active over the entire parcel.

The site is currently undeveloped. The applicant, an equine veterinarian, chose this location within
Rio Verde as it is closer to her client base and more appropriate for her operations compared to
her current facility at 60th St and Bell Rd in suburban Scottsdale. Equine uses are prevalent
throughout the Rio Verde area. Many parcels, including the subject parcel, maintain agricultural
exemptions for similar breeding, boarding, and training purposes of horses. If approved, the
subject facility would appear to be the first of its type in the area to serve equines.

Public Participation Summary:

The applicant complied with the Maricopa County public participation process with the required
posting of the property and notification to the adjacent property owners within 300’ of the subject
site. Staff received one letter of support from the president of a local horsing association.
Additionally, staff received a letter of opposition that was later rescinded.

Staff was also in contact with multiple residents who maintain concerns over the potential water
usage of the site. The area in which the site is located is notably part of the area of concern
regarding water issues within the Rio Verde area. The applicant has addressed this in the narrative
in which they maintain the existing well will be more than adequate to support site usage.
Outstanding Concerns from Reviewing Agencies:

Staff would note that as of the current submittal, Maricopa County Engineering has still not
formally signed off on this proposal, although they are fine with allowing this proposal to move
forward to hearings. Outstanding issues include concerns regarding site drainage due to the
presence of flood-zone near the proposed structures of agricultural exempt portion of the site,
and remaining issues with the traffic impact statement provided to the Maricopa County
Department of Transportation. These concerns have been addressed by the proposed
stipulations that would prevent permitting of the site until such approvals have been granted. It’s

important to note that these are site plan/construction permitting issues and not a concern for
the site’s zoning entitlement.
Staff Analysis:

Staff supports this request because Rio Verde, for all its equine-related facilities, lacks a formal
medical facility that would be able to provide top-line care for its horse population. There is a clear
need for such specialized treatment services. The request for a 20-year SUP is appropriate given
the costs to the applicant to develop such a service that would likely go beyond an interim use.
Staff maintains concerns regarding the water usage of the site, especially considering the recent
history of Rio Verde. However, the applicants’ assurances regarding the existing site serve to allay
that worry to some extent.
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve Z2023062 subject to the following conditions ‘a’ – ‘i’:

Engineering Review has completed the second review (EDR#4) routed for review for
the subject application and has the following comments:
DRAINAGE PLAN REVIEW /DRAINAGE REPORT
1. The G&D should have an overall plan view that shows entire parcel with
complete parcel lines so that reviewer can overlay the flood map over the G&D
plan. Property corners are used to overlay maps for review. This overall plan
should be to scale.
a. G&D should also show the limits of the floodplain. Ok to show on site
plan too but flood plain limits must be on G&D.
2. All commercial improvements require a drainage report and grading and
drainage plans. A drainage report was not provided.
a. Provide in report an exhibit w/C runoff coefficients. The covered arena
would be C=0.95. Barn C=0.95. retention basin C=0.50. Per the DSPM
Table 6.3 Rational Method C values for 100 yr storm event etc…
provide exhibit to help convey your onsite retention calcs.
b. Provide excerpts of the NOAA 14 values in report.

through 3-36”CMP below 144th street? Provide pipe culvert calcs, pipe size,
diameter, inverts, pipe profile.
5. Where is fire path? Dimension fire path width. Confirm you have provided large
enough radius for a fire truck to enter and exit site. Seek approval from
jurisdictional fire department.
6. Please see MCZO Section 1205.7.6.9. Historical flow patterns must be
maintained the entrance and exit points of each parcel must be preserved.
7. Retention basin- provide HWE, volume provided, volume required. Basins one
foot or less in depth do not need to provide feedback.
8. Provide documentation of how you will drain the retention basin within 36hrs.
Retention basins require 1’ of freeboard if greater than one foot in ponding
depth.

1. In drainage report address offsite flows. What gets to site, how does it pass

FLOOD CONTROL DISTRICT REVIEW
1. Site contains floodplain AE and will require a flood use permit during the
building permit phase. Stipulate in approvals that a FP required even for AG
exempt purposes. Any grading, fences etc.. requires a flood use permit. During
building permit phase please submit/resubmit G&Ds and drainage report.
2. All structures and electrical components in the floodplain must have FF at or
above the Regulatory Base flood elevation as determined by a Civil Engineer.
3. Structures must be setback a determined distance per SS5-96 or scour
protection provided. To be addressed in drainage report and setback placed
on plans.
4. Septic system must be shown on G&Ds and setbacks followed. Setback-
Distance-Chart-PDF (maricopa.gov). Clarification: Where is the septic for the SUP?

Per our conversation, after careful consideration and conversations with the owners and General
Contractor, I am opposed to the Sonoran Equine project for the following reasons.
£
First and foremost, this is going to decimate my and my neighbors property values and investments.£
The overall Maricopa County agg exemption, as I am told, states it will allow such a facility to be
unconcerned with excess flow and/or carcinogen buildup.£ This will add pressure the already fragile
146th and Rio Verde Road flooding during flood periods.£ This area is already a Maricopa County flood
evaluation site.£ Which makes one wonder how can residential homes lie in such an area, in this case
built prior to even the inception of such a facility? £ There is a need for sophisticated and robust catch
basins addressing excess water and carcinogen runoff created by the large area of compacting and
slope graded soil, creating acreage of a large sloped funnel accelerant of now non-permeating soil.£
This is complicated by the planned addition of numerous out buildings, covered horse holding corrals
and the defoliation of the acreage/site.£ This can foster algae and any numbers of health issues single
family surrounding residences and down flow residences are not equipped to address; which are
currently nonexistent.£

In simple words, a defoliated and heavily compacted funnel wash has been made of approx 10+ acres
of sloped land with the planned addition of a commercially concentrated horse hospital and birthing
facility for profit.£ This appears to feed into an existing 2' X 2' naturally made wash, comical in
correlation>.£ This will flood profusely and disseminate carcinogens throughout the area posing a
safety and health issue to adults and children.£ Not to mention washing out the already fragile 146th
and Rio Verde Rd.
£
Owners Ashley Alward and Jeff Rothermel of the Sonoran Equine are aware of our concerns, as well
Butch Redich, General Contractor.£ I also suggested to Butch a re-mapping of corral locations may be
best suited away from residential properties for a myriad of sound founded reasoning's shared by the
neighborhood.£ Aside from all this there is potentially noise throughout the night from an emergency
clinic with truck parking planed to the backs of the Gamble road homes, as well pharmaceutical drugs
on site and those associated precautions.£ Besides the blight of the facility there will be excessive
pressure on the 144th and Rio Verde Road which has been the site of numerous accidents, this is a
poor location for such a facility as it is planned.£

All in all this is not good for our neighborhood and will significantly downgrade our property values,
home enjoyment and desirability.

My husband John Costello III and I, Jennifer L. Costello, live at 14536 E. Desert Vista Trail. You have
already heard from my husband, and I am voicing my opinion as well that we do not want any
commercial facility to be built at 144th St. and Dynamite. The potential negative impact to our
neighborhood and home values is truly appalling. We moved to Rio Verde foothills to get away from
all the commercial zoning, and to even consider this is awful.
Plus, we do not want the down flow that will cause issues, especially during high rain. Please do not
pursue this and stop immediately.

In reviewing with our legal counsel the exisƟng Agricultural ExempƟon (AE), case LU20230029, we have
made the determinaƟon that this case was approved in-error. To be elgible for an AE, the property must
have a 4000 series property use code and must currently have an agricultural use. Assessor's Office
records indicate the property to not maintain a 4000 series property use code and is considered vacant.
Below is what was submiƩed as part of the LU applicaƟon:
Below is the current Assessor's records for the site, please note "Property Use Code" and "PU
DescripƟon":
Please refer to MCZO 1304.2 and 1304.3. The property has not been classified as an agricultural use by
the Assessor's Office and therefore, is not elgible for exempƟon and we must rescind the prior approved
LU20230029.
This would have the effect of subjecƟng prior, current, and future construcƟon on the site to Zoning
Ordinance requirements within the prior AE area, including building, zoning, and drainage permiƫng.
You may reapply for the AE on the non SUP porƟons of site when you correctly qualify. However, you
can also roll this all under the SUP for the enƟre site.
I would note that this rescinding does not affect the processing of Z2023062 except if you choose to
request the SUP over the whole site rather than just the current SUP area. We would require a precise
plan of development for the enƟre site if you wish to do this. Otherwise, the site is sƟll subject to Rural-
43 zoning requirements and you may pursue permiƫng for all proposed construcƟon under current
Ordinance requirements.
I do also wish to apologize - I understand we've gone back and forth in the last few weeks and now this
is coming up as an issue. Unfortunately, we cannot exempt any case from the statutory Ordinance

My name is Clinton Miller, 5th generation to a performance equine, rodeo
competitor and ranching family.
I personally moved to the north Scottsdale, Rio Verde area seven years ago to be
closer to and surround myself with like minded equine competitors and equine
enthusiasts.
Since my move, and having many performance horses myself in the area, there is
one thing that has been missing in the immediate area. Considering the amount of
performance equines and many disciplines, the area needs an emergency equine
veterinarian with surgical capabilities.
There have been many times an injury has occured to a horse and the owner has to
load the horse in a trailer and travel many miles to the closest vet to find out, the
horse needs surgery, therefore now having to load the horse again and travel to
surgical centers as far as Queen Creek. This has never made sense to me
considering, again, the amount of equines in the area.
I live in the area and I am FOR, the improvement and building of such facility. As I
live only a few streets away from the proposed location, I do not foresee any
issues with traffic, noise or lighting.
I believe such a facility in the area will help benefit many of the equine owners by
providing immediate care or a more timely response to care and triage than what
is being offered to most at this current time, thus giving the animal a higher
percentage of immediate comfort and treatment.

I am the ranch manager at Almosta Ranh and trainer/owner of Owen Performance Horses,
where we currently house 60+ head of high-quality performance horses. Our equine athletes
deserve the best care possible, and while we do have several fantastic vets in the area, none of
them are able to provide surgical care, which forces us to drive at least 30 minutes to the
nearest surgical center. The opportunity to have a surgical center within a stone’s throw would
be incredible for our equine community.
In Rio Verde alone, I can think of at least 10 major ranches with as many, if not more, horses
than we have. The thought of having a surgical center so close to us will, quite literally, mean
the difference between life and death for our animals in the event of a crisis or major medical
issue.

We have operated our training and currently oversee all Ranch operations at Pinnacle Ranch in Rio
Verde since 2016.
We are responsible for 80 head of horses where we breed, raise and train horses. Occasionally
there is the need for emergency veterinary care. All of the options that are available are quite a
drive from the Rio Verde area. We have loyally used Southwest Equine operated by Dr Ashley
currently located on Bell Road because of the level of care, the response and the success we have
had. This trip has been made multiple times per year, in every case it is a life-saving trip, and that
30-minute drive is tenuous and the horses life can be at risk.
The Rio Verde area is filled with both professionally managed and individual horse properties, and
having a top caliber facility right in the heart of our area will be of huge importance. The area will
benefit from another high caliber facility and under the development of General contractors Butch
Redish and Cody Halford, its sure to be well designed with great appeal from the road.

My name is Lindsey Koning, and I reside in the beautiful Rio Verde area at the
intersection of 160th and Dixileta. I have been in this area since 2011 and have
developed a deep appreciation for the local equine community. As an equine owner
myself, I was thrilled to hear about the new state-of-the-art equine facility and surgical
center, Sonoran Equine Hospital.
Rio Verde is home to some of the world's top equine trainers and horses. Having a
nearby surgical facility is not only a luxury but a necessity. It is essential to ensure that
these athletes receive the best possible care. With the new facility, we can now provide
timely assistance to our equine companions in times of emergency. Currently, the
nearest equine facility is at least 30 minutes away, which can delay emergency care and
put our horses' health at risk. If one of our horses is facing a colic episode, many horses
will not survive a 30-minute trip. This surgical facility is extremely important to our
community and our animals.
This new facility offers benefits beyond the equine community. It contributes to our local
economy by providing job opportunities to the locals. I am delighted to see such
developments in our area that not only support our local community but also contribute
to the growth and development of our region.

My name is Dr. Otto Stanislaw, I own Equine Veterinary LLC located in Scottsdale. I have been a mobile equine veterinarian
servicing our area for the past 22 years with the majority of my clientele residing in the Rio Verde Foothills. My practice is
primarily ambulatory, meaning, I provide mobile vet services and practice directly at my client’s home or barn. Much of my
care is routine; however, my business, Equine Veterinary LLC receives 1-3 emergency calls daily including weekends. Owning
and caring for horses is like human medicine in the sense that needs arise 24 hours a day 7 days a week, including holidays.
Most of the horses I care for are insured for over six figures and compete multiple times throughout the year for millions of
dollars. The care these animals receive is second to none and when an owner or a trainer needs something, timing is often of the
essence. I can say this with confidence, as I am also one of those owners who have multiple horses in training.
For the tens of thousands of horses in the Rio Verde Foothills, there are less than 10 vets who service this area. What this tells
you is the current vets are overworked and facing burnout. Over 50% of these vets are also close to retirement age. According
to American Association of Equine Practitioners there are only 3,785 equine vets in the US. It is predicted by 2025, there will
be a shortage of 15,000 Equine veterinarians. This is an alarming shortage and if steps are not taken to correct the problem the
damage to this industry may be beyond repair. One way to combat this problem is to encourage the expansion of businesses that
want to support the needs of the community.. Having a vet clinic that offers emergency care in the area will help meet the needs
of horse owners and relieve some of the strain placed on the current vets practicing. Currently the closest emergency clinic is 15
miles away. Depending on the time of day and year, it can take up to an hour to transport a horse that is already considered
critical.
To the neighbors who are within 300 feet of the property that are concerned with traffic, smell, water runoff, lights, and metal
roofs, I ask you would you rather have track homes, or another type of commercial business built? Rio Verde Foothills is a
rural desert community, having an agricultural based business that supports the community’s current needs and offers residents
of the area employment opportunities as well will only enrich the life of residents of the area.

I have lived in the Rio Verde Foothills community with my husband and two horses for over five
years. I compete at both Quarter Horse and Paint shows, and our horses are like family. Their
health and well-being are of prime importance to me. We have access to several wonderful
veterinarians in the area, but none have the capability of doing emergency surgery onsite. We
have taken our horses to Dr. Alward’s existing facility several times. It is a long way to go,
especially when it is an emergency. Dr. Alward is exceptionally skilled and compassionate. She
and her facility will be a tremendous asset to our community.
Having this facility at the intersection of Rio Verde Dr. and 144th will have minimal impact on
traffic, noise, lights, or smell to any surrounding properties. 144th is already a very heavily
traveled road and is paved. The nature of this facility ensures that it is not going to have heavy
traffic. This property could easily be a regular ranch with all of the same noise, light, smell, and
traffic concerns and no limitations.
I have worked with Cody Halford of C. Lee Construction; he has always demonstrated the

I have used Dr. Alward many times, in the last 5 years especially, for every kind of veterinary

shame if the people who do not own horse’s put a stop to the building of this facility. If
anything, ĖťϙſĖīīϙīôŜŜôIJϙťēôϙťŘÍƯĖèϠϙall the horses out here will just need to go down the street
instead of over the hill to get a vet. And it will bring a true professional to the area who has
done everything by the book to get here.

We are contacting you regarding the Equine Veterinary Facility proposed at
28403 N 144th St Scottsdale, AZ 85262. We own Elite Equine, a saltwater spa business
providing therapy to horses since 2019. We serve clients in the Rio Verde area as well as
nationally. In addition, we have reining horses in training with multiple trainers in the area
that compete across the county for six figure purses year-round who utilize veterinary care
on a regular basis.
We feel this area most certainly should have an equine veterinary facility that oƯers
routine and emergency care. We personally know that there are at least 3,000 horses in this
area based on our clients and the number of horses they have at their facilities.
While we have mobile vets servicing horses in the area, there is already a shortage
and no actual facilities oƯering routine and emergency care for equines within a 15-mile
radius. Scottsdale Equine Reproduction Center is just down the road from the proposed
facility and has been a huge benefit for us and other owners who utilize their breeding
services. Dr Longworth is nationally known and very sought out for his reproductive skills
and is not able to handle the non-breeding emergency and routine needs of the
community.
We have had emergency needs for our own horses and were unable to get a vet out
in a timely matter. Statistics provided by the American Association of Equine Practitioners
(AAEP), show a mere 5% of veterinary students choose to pursue a career in equine
practice. Combine this with the prediction from the US Census Bureau, that by 2025 there
will be a national shortage of 15,000 veterinarians. It is naïve to think our area will not be
aƯected by this. The current alternative for emergency care is taking a critically ill horse to
the next closest facility that can be 30 min-1 hour away, depending on traƯic. Hauling a
horse in 100+ degree heat in stop and go traƯic can be life threatening in some
circumstances. We have a client who physically rode in the trailer with an ill horse insured
for over $100,000 to ensure it would stay standing for the trailer ride due to the time it
would take to get to the emergency vet because of traƯic conditions.
To the neighbors who are within 300 feet of the property that are concerned with
traƯic, smell, water runoƯ, lights, and metal roofs, we ask, how many of them are horse
owners? None appear to be. If we were told there would be a vet clinic being built 300 ft
from our property, we would welcome them with open arms. The neighbors surrounding
Scottsdale Equine Reproduction Center are all horse owners and happy to have this
resource so close. These are minor concerns compared to the greater cause of saving local
horses. Grading and Drainage plans and the dark sky ordinance are just two things in place
to protect and preserve this rural area.A rural area has a low population density with a
primary industry of agriculture. Why would such an area not have said facility.

I have been a resident here for almost 10 years. We purchased it here because of all the
horse facilities and horse activity. We currently own SJ Ranch, a 20-acre training facility. We
have approximately 45 horses here.
I would love to see an equine facility in this area. Horses can get hurt or sick within minutes
and we do not have an equine center within 45 minutes. Sometimes this is a matter of life or
death for a horse. I personally have had to take some all the way to Desert Hills for treatment
and I almost lost my best horse.
I understand there are some concerns from the neighbors, and I would like to take a moment
to address that. We recently built with Cody Halford he and worked with all our neighbors to
ensure that everything went smoothly. Cody was diligent in his water runoff as well as location
of our barns, etc. We have never had a complaint about lights or anything else. The facility
that is being built will be a state-of-the-art facility and run professionally.
I cannot express enough how badly a facility is needed here. We have so many farms and
ranches and nowhere close to take our sick horses.
I understand we now have many “city people” moving out here that are not well versed in the
equine world. I appreciate that; however, the equine community is large out here as well and
we have needed such a center for quite some time.

I am in favor of adding this facility to our area. There are several local ranchers who would greatly benefit
from having an equine veterinary facility closer to us. At this point most equine facilities are 20-35
minutes away, which in an emergency it is quite the drive with a very sick horse. The facility will also
facilitate access to other routine care and it is nice to have competent veterinary care in an area that has
such a large number of horses and a demand for equine specialists. I keep 3 horses at home and I would
greatly benefit from having a clinic nearby.
I fail to see how adding another equestrian facility to our area can be of a detriment. The neighborhood is
already filled with other large equestrian facilities that could be of a bigger concern to those in the area
that do not own horses. The Rio Verde Foothills is an equestrian and working ranch area. The horses and
ranchers were here first. We are an equestrian working community. Housing developments brought to this
area are aware that horses and cattle are all around us. I also do not see how adding a clinic would affect
local traffic any more than the proposed housing development being built to the West of us. The traffic is
already here due to the development of Trilogy to the East, and will only worsen by the housing
development to the West. A small veterinary clinic will not create any more harm. Adding houses,
ranches, and a veterinary clinic to the area is going to continue, and eventually traffic access will adjust to
the demands of the area. The argument for drainage (which is strictly controlled by the county), metal
roofing, lights, and smell is pointless given that this is an area where horses are already present, and
construction inspections are regulated. If a veterinary clinic is not built, someone can build another large
horse ranch with the same proposed building style of the clinic, and it is hard to justify the arguments
brought forth against the clinic, when just down and across the street there are at least 6 large equestrian
facilities not even a mile away from the proposed site for the clinic.
I think the clinic is an added benefit to our community and a great improvement to our neighborhood. I
am in favor of adding the clinic to our neighborhood.

competition to keep the costs at a reasonable level. I beg you to approve this much
needed facility. The other option is to put 15 homes on that area and cause much more
traffic and use much more water than this one facility. It will also give us a refuge area
in case of fire they will be much more prepared for people to take their horses to be
protected and cared for properly in case of such an emergency. As of right now we have
to take the horses to cave creek rodeo grounds, and making several trips just takes to
long for most stables or owners. Please approve this facility for all of the horse
properties out in our area, it is in great need.

May I add one more thing please? I see some approvals as well disapprovals for the Sonoran Equine. The approvals I see are for the benefit
of the few who do not live next to or even in near proximity of the 144th and Rio Verde site. £It’s one thing to have a horse hospital with
disposal health issues, quite another a full breeding facility. To my point, this is great so long as it’s not next to or close to the approval
people’s home. £This is very self serving and myopic in view and locations; I.E. it’s in my neighborhood being affected, not theirs! There are
so many open sites available in the Rio Verde area that are not in direct proximity of dense 1 acre home sites!

Sonoran Equine site. The applicant will be required to obtain permits for all work on the subject site, not just the
surgical center. As it turns out, the agricultural exempƟon was approved in error, first by the Assessor's Office, then
by PND. We talked to our counsel upon discovery of the error, and they agreed we no longer have the grounds to
approve the exempƟon or have it remain acƟve. Please note that this would not prevent them from applying for such
an exempƟon in the future if certain condiƟons are met, same as any other parcel in the County. I believe it would be
a minimum of two years before they'd be able to obtain such an exempƟon, but that depends on the Assessor's
Office and how they decide to process it.

Various postings have recently come to my attention. £On Nextdoor and Facebook, the Sonoran
Equine is asking for the community to send into the county a blanket approval of the business and
site; nice for those few folks who don't live next door and faced to deal with the chaos… £There are so
many open areas in the vicinity better suited for this business, not in an area of delicate
wash’s/constant road damage from flooding (146th and Rio Verde Road, ADOT study)/dense 1 acre
residential parcels/ heavily congested with traffic (144th and Rio Verde intersection, already the site of
fatalities). This is already an area of traffic speeders, no controls and left unchecked other than 1 stop
sign on 144th entering Rio Verde Road.£

We are contacting you in regards to the Equine Veterinary Facility proposed at
28403 N 144th St
Scottsdale, AZ 85262
We have lived and worked in Rio Verde for the past 29 years. We own many performance horses
which are boarded at various ranches in the Rio Verde area. These barns are commercial in nature, just
as the proposed Surgical Center. The equine business in this area has preceded most of the residential
construction. This proposed Surgical Center will allow for the improvement of our long-standing
equine community, by supporting local business owners (horse trainers) and offering horse-owning
residents a much needed medical amenity when time is of the essence. The concerns that were
expressed by a few residents are no different than if a commercial equine barn or dozens of homes
were to be built on this property. There is no justification for denying the proposed building based on
these claims.
The contractor on this project, Cody Halford, has an extensive knowledge of Rio Verde and its
residents. We have worked with Cody on several construction projects and his excellent work is found
throughout our community. Cody has maintained a great reputation as a builder and we believe this
proposed project will be built with the same professionalism and respect for our community’s culture.
