SONORAN EQUINE Case #: Z2023062 Supervisor District: 2 Applicant & Owner: George Everland, Everett Alan Group / Sonoran Equine, LLC Request: Special Use Permit (SUP) for a horse veterinary facility in the Rural-43 zoning district Site Location: Generally located at the NEC of Rio Verde Dr. and 144th St. in the Rio Verde area Commission Recommendation: On 5/9/24, the Commission voted 9-0 to adopt a motion recommending the Board of Supervisors approve Z2023062 subject to conditions ‘a’ – ‘i’: a. Development of the site shall be in substantial conformance with the narrative report entitled “Sonoran Equine”, consisting of 6 pages, dated January 31, 2024, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the site plan entitled “Sonoran Equine Special Use Permit “, consisting of 3 full-size sheets, received March 19, 2024, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. c. This SUP is valid for a period of 20 years and shall expire on June 1, 2044, or upon termination of the use for a period of 90 or more days, whichever occurs first. All site improvements associated with the SUP shall be removed within 90 days of such expiration or termination of use. d. Prior to or concurrent with the submittal of the initial building permit for any portion or phase of this development, a traffic impact statement must be approved by the Maricopa County Department of Transportation (MCDOT). e. Flood permits must be issued for all structures on the site prior to issuance of building permits, including for those on the agriculturally exempt portion of the site. Submittals for any building permit must include a grading and drainage plan and a drainage report. f. The following Rural-43 SUP standards shall apply: 1. Allowed uses: All uses allowed under MCZO 503.1 and MCZO 1301.1.20. 2. Rear yard (eastern line of the SUP area): 0’ required setback. 3. Paving: decomposed granite allowed to be used outside of parking spaces (MCZO 1102.7.1.) g. Noncompliance with any Maricopa County Regulation may be grounds for initiating a revocation of this SUP per the procedures set forth in the Maricopa County Zoning Ordinance. h. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. i. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the SUP, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the SUP. The SUP enhances the value of the property above its value as of the date the SUP is granted and reverting to the prior zoning results in the same value of the property as if the SUP had never been granted. WHITE BARN EVENT CENTER Title: White Barn Event Center Case #: Z2023014 Supervisor District: 1 Applicant & Owner: Rodney Jarvis / Greenfield Properties LLC Request: Special Use Permit (SUP) for a wedding venue / events center within the Rural-43 zoning district Site Location: Generally located SE of the SEC of San Tan Village Parkway & Greenfield Rd. Commission Recommendation: On 5/9/24, the Commission voted 7-1 to adopt a motion recommending the Board of Supervisors approve Z2023014 subject to conditions ‘a’ – ‘l’: a. Development of the site shall be in substantial conformance with the site plan entitled “White Barn Wedding Venue“, consisting of 8 full-size sheets, dated June 24, 2023 and stamped received October 2, 2023 except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the narrative report entitled “White Barn Events Center”, consisting of 8 pages, dated March 20, 2024 and stamped received March 20, 2024 except as modified by the following conditions. c. This special use permit shall expire on June 12, 2034, or upon termination of the use for a period of 90 or more consecutive days, whichever occurs first. All site improvements associated with the SUP shall be removed within 90 days of such expiration or termination of use. d. The project shall require a 6’ CMU wall on the north, east and south property lines for noise attenuation purposes. e. All outdoor lighting shall be shielded so that illumination does not trespass onto neighboring properties and is directed downward at a minimum 20-degree angle beneath the horizontal plane of the bottom of the shielding f. All commercial outdoor activity shall be moved indoors by 9:00 PM. g. Amplified music and dancing are prohibited in outdoor areas. Further, any amplified noise must conform to Maricopa County Noise Ordinance (P-23) that was adopted February 15, 2006 and is regulated by the MCSO. Section IV Noise: C. Radios and Sound Amplification Devices It shall be unlawful for any person to operate any radio, loudspeaker, musical instrument, or other sound producing, sound reproducing, or sound amplification equipment that emits noise that can be heard from within closed residential structures located within 500 feet of the boundary of the property from which such noise emanates. h. Prior to issuance of initial building permits, all parcels shall be combined to create a single parcel matching the SUP area. i. The following Planning Engineering conditions: 1. Unpermitted walls/fences on the subject property shall be addressed with the submittal for building permits for the site development. It shall be demonstrated that the walls/fences do not create an adverse drainage impact to the site or surrounding properties. 2. Prior to the issuance of building permits for development of the site, the owner/applicant must provide evidence that the Town of Gilbert has approved the Traffic Report. 3. Access to the site shall be via a one-way entrance (north) and one-way exit (south), or as otherwise approved by the Town of Gilbert. 4. Owner/applicant shall coordinate with the Town of Gilbert for any offsite improvements, ROW requirements and access. Provide County of TOG approved offsite improvement plans during building permit phase. 5. SWPP provided during building permit phase. 6. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 7. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by the final engineering design of the site’s drainage infrastructure. 8. Detailed Grading and Drainage (Site Infrastructure) Plans and Drainage report must be submitted with the application for Building Permits. j. Noncompliance with any of the conditions assigned to the approval of this SUP by the Maricopa County Board of Supervisors may be grounds for revocation in accordance with the requirements and procedures as set forth in the Maricopa County Zoning Ordinance. k. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the SUP, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the SUP. The SUP enhances the value of the property above its value as of the date the SUP is granted and reverting to the prior zoning results in the same value of the property as if the SUP had never been granted. l. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. 12. GRANT FROM THE DEPARTMENT OF EMERGENCY AND MILITARY AFFAIRS FOR VICTIM ADVOCACY, SERVICES, AND TRAINING Approve the application and acceptance of grant funds from the Department of Emergency and Military Affairs for the Anti-Human Trafficking Grant Fund for $457,554.22 These grant funds are intended to be used exclusively to reimburse expenditures related to human trafficking, including court advocacy, direct services for survivors, staff training, and community awareness and prevention activities. This grant agreement commences on October 1, 2022, and will terminate on June 30, 2027. The Maricopa County Attorney’s Office's indirect rate for FY24 is 20.20%; the grantor allows for up to 10% indirect cost recovery, but due to budget constraints, $13,036.85 was provided for in this award. Total grant indirect costs are estimated to be $13,036.85 recoverable, and $76,755.66 is not recoverable. This grant is a new grant for the Maricopa County Attorney’s Office and is not reoccurring. There is no expectation of continued funding. There is no match requirement. No future contributions are required with this funding. Authorize the Chairman of the Board of Supervisors, or designee, to sign all documents related to this award. This grant provides funding for a victim advocate within MCAO so they may work to ensure victims of human trafficking crimes receive the services mandated by the Arizona Constitution and the Crime Victim’s Bill of Rights and the ability to contract to provide direct victim services to human trafficking survivors and staff training to investigate and prosecute human trafficking cases effectively, and community awareness to better recognize and prevent human trafficking. The grant award is competitive, and other eligible agencies may or may not apply for funding. Funding for this agreement is provided by a Grant from the Arizona Department of Emergency and Military Affairs with funds appropriated through Arizona Revised Statutes 26-106, which established the Anti-Human Trafficking Grant Fund. House Bill 2862, Section 110 allocates funding. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. (C-19-24-118-X-00)

Decrease the expenditure appropriation in Non Departmental (D470) Non Departmental Grants Fund (249) Non Recurring Non Project (NRNP) Contingency (4711) in the line “Unassigned” by $270,825. The adjustment to Fund 782 is needed after reconciling invoices for the Maricopa County Financial System Services Consortium. The adjustment to Fund 790 is needed after reconciling invoices for grant reporting services provided by the Maricopa County School Superintendent’s Office. 15. ACCEPT TITLE II AND I-D GRANT FUNDS FROM THE ARIZONA DEPARTMENT OF EDUCATION FOR THE JUVENILE DETENTION EDUCATION PROGRAM Accept $642,479.18 in Title I-D and $4,572.91 in Title II FY2023 grant funds from the Arizona Department of Education for the juvenile detention education program. The term of this grant funding is 7/1/2022 through 7/1/2023. The purpose of these grants is to provide prevention and intervention programs for children and youth who are neglected, delinquent, or at-risk and to support effective instruction to increase student achievement. These grants help fulfill mandated services to educate children in the County’s juvenile detention center. There are no matching or ongoing cash contribution requirements; and this award is non-competitive, legislative, and formulaic. Although the School Superintendent’s Office has an approved FY2024 indirect cost rate of 1.43% (equating to $9,252.84 in calculated indirect costs), indirect costs will not be charged because the Office will be passing the grant monies on to the accommodation school through which the detention education program operates. There are no costs that will need to be absorbed by the MCSSO’s operating budget. As a result of this funding and pursuant to A.R.S. §42-17106(B), approve an adjustment to the FY2024 County School Superintendent (D370) Schools Grants Fund (715) Operating (OPER) revenues and expenditures budget in the amount of $647,052. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. This action does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. (C-37-24-022-X-00)

APPLICATION FOR FUNDING FROM THE OFFICE OF NATIONAL DRUG CONTROL POLICY (ONDCP) FOR THE HIGH INTENSITY DRUG TRAFFICKING AREA (HIDTA) PROGRAM – INITIATIVE XXXV Approve Application of $695,511 with the Office of National Drug Control Policy (ONDCP) Award Number G25SA0005A, for the High Intensity Drug Trafficking Area (HIDTA) Program. The term of this funding is January 1, 2025 to December 31, 2026. This amount represents the total FY 25/26 budget and spending ceiling for this initiative. The Maricopa County Sheriff’s Office is the Fiduciary of these funds for the County. The Maricopa County Sheriff’s Office will receive up to $555,015. The Maricopa County Attorney’s Office will receive up to $140,496. The Sheriff’s Office funding award is designated for two separate initiatives: Intelligence Initiative (HIDTAISC): $81,234 and Interdiction Initiative (MCDST): $473,781. The total indirect cost amount for these two initiatives is $148,244.51 ($21,697.60 and $126,546.91). The Sheriff Office indirect rate for FY25 is 26.71% and MCSO will not recover $148,244.51. The County Attorney’s funding award is designated for the Investigation Initiative (MISTIC) and its FY25 indirect rate is 15.53%. The total indirect cost amount for this initiative is $21,819.03 and MCAO will not recover $21,819.03. This funding supports of the Sheriff’s public safety mandate through efforts to reduce illegal drug use with the interruption of drug trafficking. The funding is recurring and has been awarded to the Sheriff’s Office for over thirteen years. There is no matching requirement and there are no future or ongoing contributions required after the grant period ends. This is a competitive award. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. AGREEMENT FOR LAW ENFORCEMENT SERVICES WITH THE TOWN OF YOUNGTOWN Approve an Agreement for Law Enforcement Services between the Town of Youngtown and Maricopa County on behalf of the Sheriff’s Office. This Agreement is effective July 1, 2024, through June 30, 2027, with one (1) automatic three-year renewal with an end date of June 30, 2030. The contract level of service for this Agreement is 1 full beat with a contract value of $1,496,657.35 for FY2025 payable in 12 equal installments. This Agreement can be terminated without cause with six (6) months written notice to other party. MCSO contracts with the Town of Youngtown for Law Enforcement Services since December 2011. This Agreement supersedes all prior Agreements. The Sheriff’s Office recovers contract law enforcement service costs using a uniform methodology for: 1) personnel including hourly pay and benefits for patrol deputies, detectives, law enforcement supervision, district clerical and dispatch. Overtime and special pay are also recovered. 2) supplies and rent including uniform allowance, ammunition costs, and District supplies and services; 3) communications and information technology including monthly radio, communications and data charges, and applicable information system licenses and maintenance; 4) vehicles and equipment including mileage and depreciation of the vehicle and its equipment to allow for future replacement; and 5) one-time equipment as applicable and approved by amendment. Costs are reviewed annually, and updated Cost Worksheets are provided to the Town by February 20 of each year for the following fiscal year. (C-50-24-188-X-00)

FUNDING FROM THE ARIZONA DEPARTMENT OF ADMINISTRATION FOR THE ARIZONA 9-1-1 PROGRAM FY2025 Approve acceptance of funding appropriation from the Arizona Department of Administration for the Arizona 9-1-1 Program of $1,023,892. The term of this funding is July 1, 2024, through June 30, 2025. This is the first time this funding has been awarded to the Sheriff’s Office and will not be re-occurring. This is a competitive grant award. There is no match requirement, or future or ongoing contributions required when the funding period ends. The projected use of these funds is for the implementation and operation of MCSO’s emergency telecommunication system. These funds are statutory (ARS § 41-704) and indirect cost recovery is not allowed. The Sheriff’s indirect cost rate for FY25 is 26.71%. The indirect cost basis is $1,023,892 with a total indirect cost amount of $273,481.55 to be absorbed by the General Fund. This funding is for a mandated function and will assist the MCSO Public Safety Answering Point (PSAP) perform activities related to implementation and operation of their emergency telecommunication system. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. 20. COMPETITION IMPRACTICABLE WITH MAGNET FORENSICS Approve an increase to the Competition Impracticable (CI) with Magnet Forensics in the amount of $86,819.65 for a total of $115, 397.75. The Office of Procurement Services approved the initial competition impracticable in the amount of $28,578.10 on August 31, 2023. MCSO needs to purchase additional licenses and pay annual renewal costs for existing licenses. MCSO originally purchased the forensic software from Magnet Forensics in 2013. This software is used during investigations to exam computers and smart phones. Since the initial purchase in 2013, MCSO requires additional licenses to keep up with investigations requiring the increased quantity of computers and smart phones that need to be examined. FY25 ADMINISTRATIVE OFFICE OF THE COURTS FAMILY COUNSELING ALLOCATION Approve the application and acceptance of grant funds from the Administrative Office of the Courts (AOC) in the amount not-to-exceed $277,917 for the purpose of Family Counseling. The grant award will begin on July 1, 2024 and ends on June 30, 2025. The Juvenile Probation Department (JPD) was awarded $276,844 in FY24. Also, approve the Board Resolution and authorize the Chairman to sign all documents related to these grant funds, as applicable. The Juvenile Probation Department indirect rate for FY24 is 24.29%. Total grant indirect costs are estimated to be $67,506 and are not recoverable. The grant does require a cash equivalent match of $69,479. The grant award is reoccurring and has been awarded to the department for over eleven years. The department has an in-kind match requirement of $69,479 during the grant award period. The grant award is a mandated function and provides a benefit to the citizens by providing family counseling services to support juveniles and intended to support their success upon release with the goal of providing behavioral change. The grant award is competitively bid and other eligible agencies may or may not bid on this grant award. If awarded, the department will absorb the costs of the grant award. Funding for this agreement is provided by a Grant from Administrative Office of the Courts (AOC). The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. Boddington Superior Court Judge Pro Tempore in accordance with Arizona Revised Statutes § 12-141. The appointment will be for the period commencing June 10, 2024 through June 30, 2024 and July 1, 2024 through June 30, 2025. In order to obtain greater flexibility in the use of Court Commissioners, the Superior Court customarily has all Court Commissioners appointed as Superior Court Judges Pro Tempore so they may, on occasion, hear contested matters. This serves the interest of judicial economy and promotes sound caseflow management. Court Commissioner Lisa C. MOA WITH CITY OF PHOENIX On March 27, 2024, the Maricopa County Board of Supervisors approved a letter of commitment for Maricopa County to join a coalition, led by the City of Phoenix, to apply for federal funding for the Phoenix-Mesa-Chandler metropolitan statistical area (MSA). On March 29, 2024, the City of Phoenix submitted the application for federal funding on behalf of the coalition. The final step of the application process is for the lead applicant (City of Phoenix) to submit a Memorandum of Agreement (MOA) signed by all coalition members, to demonstrate the other members’ commitment to the coalition. The Agreement outlines the coalition’s activities and establishes the roles and responsibilities of the Parties. The City of Phoenix and Maricopa County Air Quality Department request the Board of Supervisors approve and sign the MOA. The City of Phoenix must submit the signed MOA to the U.S. Environmental Protection Agency (EPA) by July 1, 2024, for the funding request to be considered. This Agreement shall govern the performance of the Parties from the date attested to by the City Clerk through January 31, 2030, unless earlier terminated by a Party in accordance with the terms of this Agreement. THE NINA MASON PULLIAM CHARITABLE TRUST GRANT AGREEMENT AND BUDGET ADJUSTMENT Approve the application and acceptance of grant funds from the Nina Mason Pulliam Trust Grant Agreement (the “Agreement”) in the amount not-to-exceed $75,000. The grant award begins upon approval and ends on May 31, 2025. The grant provides funding for a mandated service, which is to support lifesaving objectives at the Maricopa County Animal Care & Control. More specifically, the trust dollars will be used to expand our Foster program allowing us to create the Canine Advocate Placement Program (CAPP) focused on large dog fostering which will improve our foster program’s effectiveness. Authorize the Chairman to sign the Agreement and authorize the Animal Care and Control’s appointed authority and/or designee to electronically accept the grant through the grant portal and sign grant-related documents, such as, reporting requirements, etc., as applicable to administer the grant. In accordance with A.R.S. §42-17106(B), authorize the increase of revenue and expenditure authority in the Animal Care and Control (D790) Animal Control Grants Fund (573) Non-Recurring Non-Project (NRNP) appropriation group by $75,000 in Fiscal Year 2024. Also, authorize the Office of Budget and Finance to increase the revenue and expenditure authority in FY 2025 for the Animal Care and Control (D790) Animal Control Grants Fund (573) Non-Recurring Non-Project (NRNP) budgets by $75,000. The grant allows a 0% rate or $0 for indirect costs. The Maricopa County Department of Finance has calculated the Fiscal Year 2024 indirect cost rate at 13.62% or $10,215. The recoverable cost rates for administering this grant are $0 and the Animal Care and Control will absorb the non-recoverable indirect cost of $10,215 into the department’s operating budget over the next two fiscal years. This grant is non-recurring, and a cash or in-kind contribution is not applicable. There are no future or ongoing contributions required following the grant period. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. Funding for this agreement is provided by a grant from The Nina Mason Pulliam Charitable Trust. This request will increase the grant budget appropriation in the Animal Control Grants Fund (573) to accommodate revenues and expenditures authorized by the grant. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation and, therefore, expenditure of the funds is not prohibited by the budget law. 30. ADOPT RESOLUTION FOR THE JULY 2024 PRIMARY ELECTION The list of vote centers and emergency voting centers and their hours of operation are on file with the Clerk of the Board of Supervisors and retained in accordance with LAPR approved retention schedule and are posted on Maricopa County's Elections website. If a vote center established pursuant to this resolution becomes unavailable and there is not sufficient time for the Board of Supervisors to convene to approve an alternate location for that vote center, the Elections Director that oversees in-person voting is authorized to make changes to the approved vote center location and shall notify the public and the Board of Supervisors regarding the change as soon as practicable. The alternate vote center shall be as close in proximity to the approved vote center location as possible. The list of vote centers and emergency vote centers as of June 12, 2024, are listed in exhibits (A) and (B). The Board of Supervisors also authorized the use of drop boxes for the July 30, 2024, Primary Election. The list of drop boxes is included in exhibit (C). The drop boxes will adhere to the security requirements established in the December 2023 Arizona Secretary of State’s Elections Procedures Manual and will be used to accept early ballots dropped off by voters in their early ballot affidavit envelope. The list of drop boxes and their hours of operation will be on file with the Clerk of the Board of Supervisors and retained in accordance with LAPR approved retention schedule and are posted on Maricopa County's Elections website. If a location authorized pursuant to this resolution becomes unavailable and there is not sufficient time for the Board of Supervisors to convene to approve an alternate location, the Elections Director that oversees in-person voting is authorized to designate an alternate drop box location and shall notify the public and the Board of Supervisors of the change as soon as practicable. The alternate drop location box shall be close in proximity to the approved drop box location and adhere to the security requirements established in the December 2023 Arizona Secretary of State’s Elections Procedures Manual. APPROPRIATION ADJUSTMENT FOR GRANT FUNDING FROM ARIZONA SECRETARY OF STATE 2023 HAVA SUBGRANT Approve and authorize the Elections Department to submit an application for the 2023 Help America Vote Act (HAVA) Election sub-grant program administered by the Secretary of State, and authorize the Chairman to approve the receipt of any and all such funds awarded. The Help America Vote Act (HAVA) Election Security sub-grant addresses improvements to voting systems and voter access of which the following items were identified after the 2000 elections: provisional voting, voting information, updated and upgraded voting equipment, voter identification procedures and administrative complaint procedures. Funding from the HAVA Election Security sub-grant will aid in the department’s mandate to provide fair, safe, and secure elections. The total amount of funds requested is $618,644. The grant period will cover the periods December 30, 2022 onward until funds are spent. The grant does not allow for indirect costs for which the County is eligible. The Maricopa County Elections Department composite indirect cost rate for FY 24 is 46.71% or $288,968.67. The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect cost is $288,968.67. Non-recoverable indirect costs will be covered by the departmental general fund budget. This grant is non-competitive and does not require a match or on-going cash contributions after the grant period end date. The grant award is reoccurring and has been awarded to the department in past years. In accordance with A.R.S.42-17106(B), approve a revenue and expenditure appropriation adjustment increasing the FY 2024 Elections Department (210) Elections Grant Fund (248) Non-Recurring/Non-Project (NRNP) in the amount of $618,644. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. Maricopa County and the Elections Department are eligible to apply for and receive grant funding through various state agencies. IGA WITH THE ARIZONA HEALTH CARE COST CONTAINMENT SYSTEM FOR BEHAVIORAL HEALTH SERVICES TO THE SERIOUSLY MENTALLY ILL AND REMANDED JUVENILES Approve an Intergovernmental Agreement (IGA) between Maricopa County (the County) and the Arizona Health Care Cost Containment System (AHCCCS) which in effect extends the existing arrangement for the County's funding of behavioral health services for a term of one year from July 1, 2024 to June 30, 2025. County funding for services to the seriously mentally ill (SMI) under this IGA will be $78,174,623 for FY 2024-25. This increases the level of County funding based on an adjustment for inflation for services to the seriously mentally ill by $3,722,601 over the funding paid under the previous IGA in FY 2023-24. The FY 2024-25 IGA also includes funding for non-SMI services in the amount of $3,366,705 and substance abuse services in the amount of $1,489,871 for the one-year term which is equal to the FY 2023-24 level. The IGA will be in effect upon signature of the last party and shall remain in effect until June 30, 2025. The IGA may be amended, extended, or terminated pursuant to the IGA provisions, including a 90-day termination without cause provision. Rescind the action taken by the Board of Supervisors on May 8, 2024, which approved a financial Intergovernmental Agreement with the City of Peoria. Replace with a financial revenue Intergovernmental Agreement between the City of Peoria and Maricopa County, administered by its Human Services Department. The purpose of the Agreement is to establish a collaboration between the Parties focused on reducing homelessness in the west valley through street outreach and navigation services. The Parties shall share in the costs for outreach service delivery. The Agreement term is July 1, 2024, through June 30, 2025. The City shall provide the County with $75,000 for program activities for the Agreement term. This is a non-reoccurring Agreement that is entered by the Parties through a non-competitive process. Cash, match, or in-kind are not required. The County does not have any obligations after the Agreement term. The services provided under this Agreement are not mandated services but provide a benefit to the residents of Maricopa County by increasing the availability of outreach services to individuals and families experience homelessness. The Human Services Department provisional indirect rate for FY2024, approved by the U.S. Department of Health and Human Services is 22.2% for salaries and employee related expenses. The Agreement funds are $75,000 of which $0 is for salaries and ERE, therefore indirect costs are $0 and are not subject to indirect cost recovery. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the revenues is not prohibited by the budget law. This Agreement does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted as necessary to accommodate this Amendment through future budget reconciliation This Agreement does not impact the County General Funds. The grant award begins on 10/1/2024 and ends on 9/30/2026. Authorize the department Administrative Director to sign all documents related to the application submittal for these grant funds to include all Coverdell Statutory Certifications and Compliance with Equal Employment Opportunity Plan (EEOP) requirements certification form. Authorize the Chairman to sign all award documents for these grant funds, as applicable. The grant allows a 0% rate for indirect costs, or $0 which may be incurred by the Office of Medical Examiner or Maricopa County for the administration of this grant. The Maricopa County Department of Finance has calculated the Office of Medical Examiner's composite indirect cost rate at 20.16%, or $2,016.00. The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect cost is $2,016.00. The grant award is reoccurring and has been awarded to the department in previous years. The cash or in-kind match is not applicable. Indirect cost is $2,016.00. Future ongoing cash contributions are not required after the grant period. The SSSA allows the County to install, operate, and maintain wireless communications equipment at the AZDPS owned Towers Mountain site in accordance with Intergovernmental Agreement G-30234 (C-78-22-070-X-00) and the SSSA. The Assistant County Manager and/or the Real Estate Director for Maricopa County shall administer the SSSA. 77. SETTING OF HEARING FOR THE PROPOSED HACIENDA DEL CAMPO IRRIGATION WATER DELIVERY DISTRICT IMPACT STATEMENT 1. Pursuant to A.R.S. § 48-261 and § 48-263, set a hearing date to receive the impact statement for the proposed Hacienda Del Campo Irrigation Water Delivery District. The hearing date is set for Wednesday, June 26, 2024, at 9:30 a.m., 205 W. Jefferson, Phoenix, AZ 85003. 2. Pursuant to A.R.S. § 48-261(C), approve a bond in the amount of $250 to be filed with the Board by the persons proposing the district to cover cost incurred by the County. The Clerk of the Board of Supervisors shall post a notice of the hearing in at least three conspicuous public places in the area of the proposed district and shall publish a notice twice in a daily newspaper at least ten days before the hearing. A notice of hearing will be sent to each property owner within the proposed district boundaries. RESOLUTION FOR LEASE AND LEASE-PURCHASE BACK OF CERTAIN REAL PROPERTY, EXECUTION AND DELIVERY OF GROUND LEASE, LEASE-PURCHASE AGREEMENT, AND TRUST AGREEMENTS, AND FOR THE ISSUANCE OF TAXABLE PLEDGE REVENUE OBLIGATIONS Adopt a Resolution authorizing the Lease and Lease-Purchase back of certain real property, in order to finance a portion of the County’s unfunded liabilities with respect to the Arizona Public Safety Personnel Retirement System (PSPRS) and Correctional Officers Retirement Plan (CORP) or, to the extent not so used, to finance other projects or to pay other expenses of the County approved by the Board and to pay costs of delivery; authorizing notice to the public of the lease an lease-purchase of the property and providing for the award thereof to the highest responsible bidder; authorizing the execution and delivery of a ground lease, a lease-purchase agreement and a trust agreement and other necessary agreements, instruments and documents; approving the execution and delivery of pledge revenue obligations to provide the necessary financing therefor, with lease payments by the County to be made solely from certain pledged revenues imposed or received by the County; and authorizing other actions and matters in connection therewith. The maximum original amount of obligations expected to be issued is $180,000,000. The proceeds for this financing will be deposited into a pension fund reserve in the Pension Reserve Fund (Fund 510) and subsequently transferred to the PSPRS and CORP retirement plans, as directed by the Board and in accordance with the County’s pension funding strategy. The benefit to the County for issuing long-term debt obligations is debt payments are exempt from the ELR. The FY 2025 budget will be amended to account for the PSPRS/CORP payment, applicable debt service costs, and the anticipated cost of issuance for a total amount not to exceed $92 million. Approve a transfer of $6,000,000 from the General Fund County Improvements Fund (445) to the Pledged Revenue Debt Fund (322). In accordance with A.R.S. §42-17106(B), authorize the following amendments to the Non-Departmental (D470) budget: a) Increase the expenditure appropriation in Non Departmental (D470) Pension Reserve Fund (510) Non Recurring Non Project (NRNP) budget by $86,000,000 b) Increase the revenue appropriation in Non Departmental (D470) Pension Reserve Fund (510) Non Recurring Non Project (NRNP) budget by $180,000,000. c) Increase the expenditure appropriation in Non Departmental (D470) Pledged Revenue Debt Fund (322) Non Recurring Non Project (NRNP) budget by $6,000,000. d) Increase the revenue appropriation in Non Departmental (D470) Pledged Revenue Debt Fund (322) Non Recurring Non Project (NRNP) budget by $6,000,000. e) Increase the expenditure appropriation in Non Departmental (D470) General Fund County Improvements Fund (445) Non Recurring Non Project (NRNP) budget by $6,000,000. f) Decrease the revenue and expenditure appropriation authority in the Non Departmental (D470) Non Departmental Grant Fund (249) Non Recurring Non Project (NRNP) budget by $92,000,000. g) Offsetting revenue and expenditure adjustments in the Eliminations (D980) Eliminations Fund (900) Non Recurring Non Project (NRNP) budget by $6,000,000. 96. RESOLUTION FOR WATSON DRIVE AND BONARDEN LANE Adopt Resolution FCD 2024R001 for Watson Drive and Bonarden Lane (PROJECT), authorizing the Director of the Flood Control District of Maricopa County (DISTRICT) to include funds for Project implementation in the District’s current and future Five-Year Capital Improvement Program; to negotiate and prepare Intergovernmental Agreements for cost sharing, rights-of-way acquisition, design, construction, construction management and future operation and maintenance of the Project; to advertise, select, negotiate, and award contracts for Project engineering and construction services as appropriate. The Watson Drive and Bonarden Lane (PROJECT) area is located within the City of Tempe (CITY). Project construction is the next steps for implementing the drainage improvements for this area, with the CITY as the lead agency. The PROJECT consists of installing a 24” RCP storm drain connection along the abandoned El Paso Gasline Trail from Rural Road to Forest Avenue in order to increase the storm drain capacity and create ponding relief. The area was the subject of the Tempe Storm Drainage Management Study prepared for the CITY in June 2019. The Tempe Storm Drainage Management Study provided solutions to mitigate the flood hazards in the area of Watson Drive and Bonarden Lane. The estimated cost for this Project is $2,700,000 and the PROJECT cost will be shared between the DISTRICT and the CITY 65%/35% making the DISTRICT cost share $1,755,000.
