KNOW ALL MEN BY THESE PRESENTS:
THAT WHEREAS E. Kent Debnam and Mary I. Debnam, as Trustees, or their successors in
trust, under the Debnam Living Trust, dated December 13, 2005, and any amendments
thereto hereinafter called the GRANTORS, the owner of the real property situated in Maricopa
County, Arizona, which property is set forth in instrument number 20060099745 in the official
records of Maricopa County (the “Burdened Property”), for and in consideration of the sum of
Two Thousand Four Hundred Forty-Two and No/100 Dollars ($2,442.00) and other valuable
consideration, receipt of which is hereby acknowledged, do hereby grant and convey to
MARICOPA COUNTY, a political subdivision of the State of Arizona, hereinafter called the
GRANTEE, and to its agents, successors and assigns, a Slope Easement on, over, under and across
that portion of the Burdened Property legally described on Exhibit "A-1" and depicted in Exhibit
“A-2” attached hereto (the “Easement Area”).
The GRANTEE or its agents, successors and assigns shall at all times have the right of full and
free ingress and egress to said easement for the purpose heretofore specified.
The covenants and agreements herein set forth shall éxtend and inure in favor and to the benefit
of and shall be binding on the heirs, successors in ownership and estate, assigns and lessees of
the respective parties hereto. ;
WHEREAS, the GRANTORS own the Slope Easement property and desire to grant an easement
to the County for the purpose of locating, constructing, reconstructing, repairing, and maintaining
highway construction embankment and excavation slopes:
WHEREAS, the County is desirous of obtaining a perpetual easement, over, under and across the
Slope Easement property for the purpose of locating, constructing, reconstructing; repairing, and
maintaining highway construction embankment and excavation slopes made necessary by the
construction of a County Highway.

In the event the GRANTORS OR GRANTORS:’ successor in interest shall at any time in the
future excavate or place an embankment upon the area herein described to the level of the abutting
highway elevation approved by the GRANTEE and the municipality or governing bodies having
jurisdiction over the Burdened Property, upon final approval of such embankment, the rights
granted to GRANTEE hereunder shall terminate and expire.

Salt River Meridian, Maricopa County, Arizona, described as follows:

Commencing at the Northwest corner of Lot 30 of Tonto Hills, book 93 page 5 M.C.R.
thence South 19 degrees 59 minutes 57 seconds West, 39.92 feet along the West line of said Lot 30 to
the beginning of a curve, concave Southeast, having a radius of 470.00 feet;
thence Southwesterly 120.23 feet along said West line, along the arc of said curve to the left through a
central angle of 14 degrees 39 minutes 24 seconds to the POINT OF BEGINNING;
thence North 90 degrees 00 minutes 00 seconds East, 8.30 feet;
thence South 25 degrees 36 minutes 41 seconds East, 20.30 feet;
thence South 00 degrees 00 minutes.00 seconds East, 27.99 feet;
thence South 20 degrees 36 minutes 59 seconds West, 42.20 feet;
