Agenda Item Id: 241893 Item Title MARICOPA COUNTY FY/PY 2024-2025 ANNUAL ACTION PLAN FOR HUD FUNDED ACTIVITIES AND RECEIPT OF U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FUNDS C Number: C-22-20-038-G-07 Action Requested: Approve the following items regarding the Maricopa County Annual Action Plan (AAP) for the U.S. Department of Housing and Urban Development (HUD) for funded activities for: Community Development Block Grant (CDBG); HOME Investment Partnerships Program (HOME); and Emergency Solutions Grant (ESG) Programs: Approval of this item includes: (1) Approve the submission of the Fiscal Year/Program Year (FY/PY) 2024-2025 Annual Action Plan (AAP) for the HOME Consortium and Urban County, including the HUD Contingency Plan. (2) Approve the acceptance and expenditure of CDBG, HOME, and ESG funding as listed in Attachment A by project. (3) Authorize the Chairman to: a) execute amendments to the AAP and revised Attachment A for project changes or program type as approved in Citizen Participation Plan of the County’s HUD 5-year Consolidated Plan, approved by the Board of Supervisors on May 20, 2020, C-22-20-038-G-00. b) approve the Human Services Department to submit amended AAP and Attachment A to HUD. (4) HUD notified the County of fund allocations for HUD FY/PY 2024-2025 which begins for the County on July 1, 2024. The AAP activities are based on the HUD allocations and prior year’s un-programed funds as well as the prior year’s program income. Funds will be spent over multiple years per allowable regulations and may be reallocated if necessary and with input through the Citizen Participation Plan as previously approved by the Board of Supervisors. Submittal of an AAP is a HUD requirement. (5) Approve the receipt of FY/PY 2024-2025 HUD total funds not-to-exceed amount of $8,578,807.00 allocated per program: a) $3,020,680.00 Community Development Block Grant (CDBG) b) $249,288.00 Emergency Solutions Grant (ESG) c) $5,308,839.00 HOME Investment Partnerships Program (HOME) (6) Approve expenditure of CDBG funds in the amount of $3,776,627.00 consisting of the following and listed on Attachment A: a. $3,020,680.00 HUD FY/PY 2024-2025; b. $400,234.00 previously approved funds to be reallocated c. $44,620.00 Program Income d. $311,093.00 previously approved CDBG-CV funds (7) Approve expenditures of ESG funds in the amount of $1,479,704.00 consisting of the following and listed on Attachment A: a) $249,288.00 HUD FY/PY 2024-2025 b) $1,230,416.00 anticipated Department of Economic Security - Housing Support Services. *Formal Board of Supervisors approval to be submitted once IGA is received. (8) Approve expenditures of HOME Funds in the amount of $5,803,839.00 consisting of the following and listed in Attachment A: a. $5,308,839.00 HUD FY/PY 2024-2025; b. $500,000.00 previously approved funds to be reallocated. (9) Authorize the Human Services Department Director to submit the referenced plan and sign all documents related to the grant funds. Receipt of the HUD grant funds will not impact the County General funds. The Human Services Department FY2025 approved provisional indirect cost rate is 22.2% from the U.S. Department of Health and Human Services for salaries and employee related expenses. The total grant funds are $8,578,807.00 of which $1,112,939 is for salaries and benefits (CDBG $711,734 and HOME $401,205). The total estimated indirect costs and fully recoverable are $247,073 ($158,005 for CDBG funds and $89,068 for HOME). Budget adjustments will be made when the Indirect rate costs has been fully negotiated and shall be effective as of July 1, 2024. The County receives HUD funding allocations on an annual, non-competitive basis. The services provided by the grant funds are not mandated services but are a benefit to County residents by providing funding to communities that improve infrastructure and increase affordable housing. Receipt of the grant funds do not require match funds or future or ongoing contributions at the end of the funding availability period. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. The approval of this funding does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant A.R.S. §42-17105. Approval of this item shall not impact the County General Fund. The overall grant budget will be adjusted as necessary to accommodate this grant through a future grant reconciliation. Supervisory District: All Additional Information: The Five-Year Consolidated Plan identifies housing and non-housing community development needs of low and moderate-income people in the Maricopa County service area and the Maricopa HOME Consortium; establishes goals; and describes performance measures for meeting these goals. These Plans serve as guides for the expenditure of HUD funds allocated to Maricopa County and the Maricopa HOME Consortium. The Citizen Participation Plan is a required part of the Five-Year Consolidated Plan. The Annual Action Plan identifies the specific goals and activities to be carried out within a year of the FY 2020-2025 Five-Year Consolidated Plan. The Board of Supervisors approved the Five-Year Consolidated Plan 2020-2025 and the FY/PY 2020-21 Annual Action Plan (C-22-20-038-G-00) on May 20, 2020. The Board of Supervisors approved the FY/PY 2021-22 Annual Action Plan (C-22-20-038-G-01) on April 21, 2021. The Board of Supervisors approved the FY/PY 2021-22 Annual Action Plan (C-22-20-038-G- 02) on June 9, 2021. The Board of Supervisors approved the FY/PY 2021-22 Annual Action Plan (C-22-20-038-G-03) on March 23, 2022. The Board of Supervisors approved the FY/PY 2022-23 Annual Action Plan (C-22-20-038-G-04) on June 22, 2022. The Board of Supervisors approved the FY/PY 2022-23 Annual Action Plan (C-22-20-038-G-05) on May 10, 2023.
