Purpose This policy establishes a consistent and legally compliant method for calculating overtime compensation for non-exempt employees working in two or more positions at different rates of pay within the same workweek, in accordance with the Fair Labor Standards Act (FLSA) and applicable state law. Policy When a non-exempt employee works at two or more different hourly rates within the same workweek, overtime compensation shall be calculated using a weighted average (blended) regular rate of pay. The weighted average regular rate shall be determined by dividing the employee’s total straight-time earnings for the workweek by the total number of hours worked in that workweek. Overtime compensation will be paid at one and one-half (1.5) times the employee’s weighted average regular rate of pay for all hours worked in excess of forty (40) hours in a workweek, or as otherwise required under applicable federal or state law for designated work periods. For purposes of calculating the weighted average regular rate, all forms of compensation required by law to be included in the regular rate of pay will be considered. Such compensation may include, but is not limited to: • Shift differential pay • Certification pay • Bilingual pay • On-call pay Compensation that is excluded from the regular rate under the FLSA (such as expense reimbursements or other legally excluded payments) will not be included in the calculation.
