CITY COUNCIL REPORT SUBJECT: Third Amendment to ASR Construction Group Cooperative Purchasing Agreement MEETING DATE: December 4, 2025 TO: Mayor and Council FROM: Jamie McCracken, Utilities Director REVIEWED: Reyes Medrano, Jr., City Manager PURPOSE: The Utilities Department is requesting approval of the Third Amendment to the Cooperative Purchasing Agreement between the City of Tolleson and ASR Construction Group LLC for Job Order Contracting (JOC) Water & Wastewater Treatment and Remote Facilities Projects. BACKGROUND: The City of Tolleson and ASR Construction Group LLC entered into a Cooperative Purchasing Agreement on October 23, 2024, based on the City of Peoria JOC No. ACON15023 for Water & Wastewater Treatment and Remote Facilities Projects. The Agreement allows the Contractor to perform job order contracting services for various Utilities Department projects. The original Agreement established a maximum annual aggregate amount of $3,000,000 per fiscal year. As documented in the Third Amendment, the City desires to increase this amount to $6,000,000 per fiscal year to support ongoing and additional Utilities infrastructure and operational needs. The Agreement remains effective through May 31, 2026. DISCUSSION: The Third Amendment modifies Paragraph 3 – Compensation to increase the annual compensation limit from $3,000,000 to $6,000,000 per fiscal year. The Utilities Department notes that this increase is necessary to move forward efficiently with upcoming priority projects, including the rehabilitation of Lift Station 20, which serves major industrial customers such as Gatorade and Kroger. Final design drawings for the rehabilitation of Lift Station 20 were recently completed, and utilizing ASR under the existing JOC contract will allow the City to complete the required work significantly faster than preparing, issuing, and evaluating a new set of bid documents. ASR is familiar with the site, with the City’s standards, and with the design engineer, Waterworks Engineering. This existing coordination will support an efficient and timely project delivery process. The Lift Station 20 rehabilitation will include concrete restoration inside the wet well, replacement of electrical and mechanical systems, installation of new piping, and the addition of new pumps and associated equipment, all of which are necessary to ensure safe and reliable operation of this critical facility. All other terms of the Agreement remain unchanged and in full force and effect. BUDGET IMPACT: Funding for services under this Agreement is budgeted in the Utilities Department’s approved fiscal year expenditures. No additional budget allocation is required beyond the authorized annual limit. RECOMMENDATION: Staff recommends approval of the Third Amendment to the Cooperative Purchasing Agreement between the City of Tolleson and ASR Construction Group LLC.
