A Plan of Development is approved subject to site plan entitled “EX EL LEASING SERVICES - ZONING CHANGE # Z2023017 – Site Plan” consisting of 1 full-size sheet, dated 9/25/23. The Plan of Development may be amended administratively under separate application as long as the amendment complies with the established CUPD development standards as approved by the Board of Supervisors. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. c. Development of the site shall be in substantial conformance with the narrative report entitled “EXEL Pipeline”, consisting of 5 pages, dated November 17, 2023, except as modified by the following conditions. d. Prior to issuance of initial building permits, all parcels shall be combined to create a single parcel matching the zone change area. g. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. h. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. i. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. Failure to comply with any condition may be grounds for consideration of initiating the process to revert the zoning back to the previous C-3, in accordance with Maricopa County requirements and procedures. Any action by Maricopa County to revert the zoning shall only occur following any and all required notices (including identification of the specific noncompliance issue) and cure periods and shall be subject to required public hearings before the Planning & Zoning Commission and Board of Supervisors, as set forth in the Maricopa County Zoning Ordinance. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the zone change. The zone change enhances the value of the property above its value as of the date the zone change is granted and reverting to the prior zoning results in the same value of the property as if the zone change had never been granted. Brent Freeman with Freeman Custom Homes is requesting to change the zoning on a pair of parcels from C-3 & R-4 to C-3 CUPD for the development of a plumbing supply and pipeline repair dispatch facility. The majority of the parcels are zoned C-3 with only a 10-foot strip at the southern edge being separately zoned R-4. The current application proposes to unify the parcels under consistent C-3 CUPD zoning. 2. The parcels are currently undeveloped land with remaining orchard vegetation as evident in the aerial photos. The application is proposing to develop the site with a CUPD overlay to amend development standards for ease in site layout and functionality. The approximately 2-acre site is proposing a 7,200 sq ft. building comprised of a 1,500 sq. ft. office space and a 5,700 sq. ft. workspace/ inventory warehouse. The remaining outdoor space will be utilized as outdoor storage which will only be established behind 8-foot masonry walls which are proposed to surround the development. 3. The proposed site plan includes offsite improvements such as a paved right-turn lane into the development and paving and intersection improvements to Mandarin Dr. The facility will mainly be utilized by employees of the pipeline repair company with little estimated public customer visits. Public Participation Summary: 10. The applicant sent notification letters to all parcels within 300’ of the subject parcel. The site has had 2 notification signs posted since 12/5/2023 and was updated with current public hearing information on 1/13/2024. To date, staff has not received any public support or opposition. Outstanding Concerns from Reviewing Agencies: 11. N/A Staff Analysis: 12. The applicant’s request to rezone a 10-foot strip of R-4 zoned land on the southern boundary of the property to align with the remaining existing C-3 zoning effectively is only 4% of the total site. Though undeveloped land, the site has existed as C-3 zoning since the zoning ordinance was implemented in 1969. It is staff’s assumption that the current parcel boundaries were intended to Z2023017 Page 6 of 8 follow the zoning boundary, such as is common in the area, though at some point an excess 10 feet was added to the parcel. Staff supports the zoning unification on the parcel and recognizes the applicant’s site plan layout which continues to leave the ‘R-4’ area free from any structures, pushing the site development away from the residences to the south. 13. Staff sees the use as appropriate for the location due to the limited proposed traffic and relatively minor daily impact the use will generate over other potential general commercial uses. Staff supports the CUPD overlay to amend the parking requirements as the proposed spaces (13) provide adequate parking for the provided office layout. Additionally, staff supports the proposed Plan of Development which include offsite roadway improvements to both San Tan Blvd. & Mandarin Dr. to further add to the improvement of the general area. Recommendation: 14. Staff recommends the Commission adopt a motion recommending that the Board of Supervisors approve Z2023017 subject to the following conditions ‘a’ – ‘i’: a. The parcel is currently vacant of any structures. Most of the Property is currently zoned C-3 (General Commercial), with a small portion along the southern property line (approximately 10-feet) currently zoned R-4 (Multiple Family Residential). The Property owners are seeking a special use permit to be able to use the property for a plumbing shop office and a storage for pipeline repair. The R-4 would like to be rezoned to meet the existing zoning of the entire property. We are requesting a rezone to a CUPD. Ex El Pipeline Services LLC is a plumbing contractor that has standing contracts with SRP, APS, and KinderMorgan to operate and maintain their natural gas pipeline facilities. We need offices for approximately 5 people daily, a meeting room for training and meeting purposes, a shop area to house our instruments and light equipment that is used for surveys and emergency response to leaks and other incidents. Portions of the shop will be used for storing long lead time items for regulator repair and other small parts such as gaskets, nuts and bolts, and pipe fittings. DESCRIPTION OF PROPOSAL Ex El Pipeline Services LLC proposes to build a 60' X 120' metal building on the 2 acres of property that we have acquired APN #'s 304-89-035P. The office/shop will be erected on the East side of the property and the entire 2 acres will have a masonry wall around the property (see drawing). SECTION 1 (PROPOSED BUILDING): The proposed building will be mostly a shop for the plumbing/ gas line services that Ex El provides. The building itself will be a pre-manufactured Steel building (to be designed by the manufacturer) The shop will consist of storage of various pipes, tools, and other items needed for various service calls. The building will be properly designed to store any materials or equipment considered hazardous. (Cleaning supplies, etc.) The other portion of the building will be the office area that will house the employees who work in the office during the day as well as an area for any customers that visit, which is very rare. Any materials stored here will be screened by an 8’-0” Concrete Block or brick wall, to be submitted as a separate permit. The yard will have entry from E. San Tan Blvd and exit at S. Mandarin Drive. The yard wants to be a permeable material to reduce greenhouse effects of asphalt paving. An approved dust control method will be utilized. The employee and customer parking lot areas will be paved with asphalt. The refuse will be located so that trucks can come into the yard and exit. ENVIRONMENTAL/NEIGHBORHOOD IMPACT: This property has a beautiful backdrop of San Tan Mountain and located at a centralized location for their service call regions. By being mindful of the residences across E. San Tan Blvd. HOURS OF OPERATION/EMPLOYEES: Our typical operating hours are from 7 AM to 4 PM, but as we are an emergency responder for some utilities, we will access the facility for instruments and parts when an emergency occurs. On rare occasions we may work in the office late to complete compliance reports to state and federal agencies. Typically, we will have 5 employees on site for short durations every day, we have 2 of the 5 employees on site every day with the other 3 making service calls on most days. We will have occasion for as many as 8 employees on site for training purposes, typically the training will last a few hours to possibly a full day. Customers rarely visit the shop as we usually meet on site where they are having the problems. RELATIONSHIP TO SURROUNDING PROPERTIES The office and fencing are intended to respect surrounding properties, since a lot of them are residential. The design will be basic and have smaller scale elements such as brick veneer for a variety of exterior materials. LOCATION AND ACCESSIBILITY The location of this property is in the Chandler Heights Citrus Community, along E. San Tan Blvd, at the Mandarin Drive intersection. There are a lot of commercial projects along this road and with its location between S. Power Rd. and S. Sossaman Rd., the location is close to residential areas. CIRCULATION SYSTEM The circulation system, as proposed if to have private access from E. San Tan Blvd with a drive aisle that will also connect on the South end of the property to S. Mandarin Drive. There will be two separate parking lots. One for employees (this will be located off S. Mandarin Drive and surrounded by 8’-0” block wall fencing. Parking will be provided on-site parking for employees and the occasional visitor. PROVIDED: 14 (1 ADA VAN SPACE) The yard will be used for material storage generally. Although, from time to time, work trucks may be parked in the yard overnight, behind the site fence. DEVELOPMENT SCHEDULE Once the application is submitted to Maricopa County, the owner will be sending out a letter to notify surrounding property owners of the intent for the Special Use Permit application as outlined in the Citizen Participation Plan. We anticipate that the application process will take roughly 4-6 months. The timeline for the building is roughly 20 weeks to erect the building and roughly 14 weeks to finish the interior. The rest of the site will be constructed concurrently. COMMUNITY FACILITIES AND SERVICES The Chandler Heights community is a beautiful rural area that has recently grown in its residential market. The backdrop surrounding the property is a view of San Tan Mountain and the surrounding foothills. The location is close enough to be included in the Queen Creek Police precincts that serve the area. They also have access to the Queen Creek Fire Department. The site Is easy to get to with access to Ellsworth loop that intersects with the 202 Loop. The community Is served by the Riggs Elementary school and the Willie & Coy Payne Junior High school (for both elementary and junior high school students) in the Chandler Unified School District. The nearest high school is Casteel High School. There Is a hospital, Banner Ironwood, that serves the area.
