prohibited by the CUPD overlay.  The completion of this entitlement 
and a subsequent POD and commercial construction permit will 
remedy an active violation on the subject parcel. There is no known 
opposition. There are no outstanding concerns from reviewing

subject to conditions ‘a’ – ‘i’:

Approval of Z2023127 shall zone APNs 300-12-018C & 300-19-922 to C-2 CUPD subject 
to the following conditions.

Development of the site shall be in substantial conformance with the narrative report 
entitled “Diversified Development – Narrative Report”, consisting of 9 pages, dated 
2/2/2024, except as modified by the following conditions. 
 
c. 
Development of the site shall be in substantial conformance with the zoning exhibit 
entitled “Stack Storage Development“, consisting of 1 full-size sheet, dated August 14, 
2023 except as modified by the following conditions. Staff may determine slight 
refinements to remain in substantial conformance with the approved site plan.  Minor and 
major amendments to the site plan will be determined in accordance with Chapter 3 of 
the Maricopa County Zoning Ordinance.

The following Planning Engineering conditions shall apply:  
 
1. Without the submittal of a precise plan of development, no development approval is 
inferred by this review, including, but not limited to number of proposed building 
lots/units, drainage design, access and roadway alignments. These items will be 
addressed as development plans progress and are submitted to the County for further 
review and/or entitlement. 
 
2. A traffic impact study must be submitted with future entitlement (POD or Preliminary 
Plat) application(s) or a TIS waiver obtained from MCDOT. 
 
3. Engineering review of re-zone cases is conceptual in nature. All development and 
engineering design shall be in conformance with Section 1205 of the Maricopa County 
Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for 
Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, 
standards and best practices at the time of application for construction. 
 
4. MCDOT Transportation stipulations: 
 
i. 
Dobbins Road is classified as a minor arterial requiring dedication of a 55- foot 
half street from the section line. 
 
ii. 
Applicant is required to provide, at the applicant’s expense, an American Land 
Title Association (“ALTA”) Owner’s Policy of Title Insurance showing title vested 
in Maricopa County, a political subdivision of the State of Arizona. 
 
iii. 
Siesta Way is classified as a local roadway requiring dedication of a 25-foot half 
street from the center line. 
 
a. It appears the current Right-of-Way is sufficient for this requirement. 
 
iv. 
Any additional dedication and offsite improvement requirements will be 
determined by MCDOT Traffic and MCDOT Permits based on the submittal of a 
TIA/TIS. 
 
v. 
The above comments do not include identification of utilities or underground 
facilities within or adjacent to the required right-of-way that may have prior rights 
and/or require relocation. 
 
 
e. 
The following C-2 CUPD standards shall apply: 
 
1. Parking Regulations: 1 space per 10,000 SF Areas within drive-aisles may count 
toward parking/loading spaces at 8’x22; per parallel parking spaces so long as

Noncompliance with any Maricopa County Regulation may be grounds for initiating a 
revocation of this zone change according to the rules and processes as set forth in the 
Maricopa County Zoning Ordinance.

Prior to issuance of initial building permits, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been designed 
in accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, 
local fire protection jurisdiction review and approval will be required. 
 
h. 
The property owner/s and their successors waive claim for diminution in value if the 
County takes action to rescind approval due to noncompliance with conditions.  
 
i. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner. The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions. Failure to comply with any condition may be grounds for 
consideration of initiating the process to revert the zoning back to the previous Rural-43, 
in accordance with Maricopa County requirements and procedures. Any action by 
Maricopa County to revert the zoning shall only occur following any and all required 
notices (including identification of the specific noncompliance issue) and cure periods 
and shall be subject to required public hearings before the Planning & Zoning Commission 
and Board of Supervisors, as set forth in the Maricopa County Zoning Ordinance. It is, 
therefore, stipulated and agreed that either revocation due to the failure to comply with 
any conditions, does not reduce any rights that existed on the date of application to use, 
divide, sell or possess the property and that there would be no diminution in value of the 
property from the value it held on the date of application due to such revocation of the 
zone change. The zone change enhances the value of the property above its value as of 
the date the zone change is granted and reverting to the prior zoning results in the same 
value of the property as if the zone change had never been granted.

Project Summary:

The applicant, Holly Keilman on behalf of Tiffany & Bosco, is proposing to rezone the subject 
parcels from Rural-43 to C-2 CUPD to facilitate the development of a self-storage facility. The site 
(parcels 300-12-018C & 300-19-922) is located northeast of the northeast corner of W. Dobbins 
Rd. and 47th Ave. The site is currently subject to violation V202000192 for a commercial scrap 
yard existing on-site without a Plan of Development (POD). Subsequently, the owner filed for two 
separate entitlements – Z2020061, a POD for “My Container Now” for the sale and storage of 
shipping containers, and Z2022088, “Laveen Courtyard Apartments”, for an apartment complex. 
In each case, staff noted the lack of proper zoning for the proposed uses. Both entitlement 
applications have now been withdrawn. Existing commercial land use of the site is in violation of 
the county’s zoning ordinance. The completion of this entitlement and a subsequent POD and 
commercial construction permitting will remedy the violation. 
 
2. 
Staff notes this rezone is not specific to a few allowed uses, but rather prohibits certain uses as 
proposed by the applicant. The site is serviced by municipal City of Phoenix water. The lack of 
water/sewer and other urban services would be inconsistent with the county comprehensive 
plan’s policy of urban services for urban development, and thus can hinder higher intensity 
development. However, the availability of some urban services in this case allows for a broader 
entitled use of the site than just the self-storage use proposed initially proposed. Staff agrees that 
most uses within the C-2 zoning district’s entitles uses are appropriate for the site except for uses 
that would generate large-scale residential or commercial use of the site, and is more in line with 
the Phoenix General Plan. Beyond disallowed uses, the other variation in zoning standards is 
regarding limiting parking requirements for the self-storage use, which staff agrees is appropriate 
given the general lack of traffic generated by self-storage facilities.

The applicant complied with the Maricopa County Public Participation Process with the required 
posting of the property and notification by first class mail to the adjacent property owners within 
300’ of the subject site and interested parties. Staff notes there was a delay with posting the signs 
after receiving notice from local residents that the site had not been posted – upon notification 
of this issue, the applicant had signs posted on the site the following day.

Staff received notice from a resident regarding the history of an existing structure on the site. The 
southernmost existing structure on APN 300-12-018C was historically the site of the Laveen 
Ginning Co., constructed c. 1925 according to the provided Historic Property Inventory Form from 
the City of Phoenix Historic Preservation Office. Staff would note that as this proposal does not 
include a Plan of Development, this building is not affected by the approval of this rezone 
proposal. Additionally, as this property would remain under the County’s jurisdiction unless 
annexed with consent of the property owner by City of Phoenix, that the provided document has 
no bearing on whether the structure is subject to additional scrutiny under the MCZO.

Staff Analysis:

Staff supports the proposed zone change as C-2 zoning, with the disallowance of several higher 
intensity uses as proposed within the overlay, is appropriate for the site. The site has access to 
water via the City of Phoenix, and it is located along Dobbins Rd. which is a minor arterial where 
commercial zoning is more appropriate. Ultimate approval of permits would alleviate the existing 
violation caused by the improper use of the site. Approval of the rezone would not imperil an 
existing historic structure and the applicant would be required to address the existing structure 
in future development of the site. 
 
Recommendation:

Purpose of Request 
 
This proposal is to rezone the subject parcel (APN’s 300-12-018C & 300-19-922), “The 
Property” from RU-43 to C-2 (Intermediate Commercial Zoning District) with a Commercial 
Unit Plan of Development (CUPD) overlay, for the entire 4.75± gross acres. The parcel is 
located on the Dobbins Road and 47th Avenue. The requested change to C-2 CUPD would 
allow for the use of self-storage but prohibit more intense uses permitted in this zone. (See 
Exhibit A: Existing Zoning and Exhibit B: Proposed Zoning).  
 
Description of Proposal 
 
The Property is currently vacant and located on west Dobbins Road and 47th Avenue and 
is comprised on two parcels, APN’s 300-12-018C and 300-19-922. (See Exhibit C: 
Context Aerial). The Property is in a prime location to attract commercial businesses to 
support the residential community within the Laveen area in the County jurisdiction and is 
being underutilized. The goal would be to erect three (3) new single-story, self-storage 
buildings with climate controlled and non-climate controlled self-storage to meet the needs 
for all residence in the area. Self-storage would be an appropriate use for the property and 
the expansion of services would be an asset to the community as there are proven benefits 
for allowing self-storage facilities in communities:

Self-storage facilities are quiet

They provide an excellent buffer between zones 
• 
They create very little traffic 
• 
They have little impact on utilities 
• 
They have no impact on schools 
• 
They provide a community service 
 
Significant policies for self-storage include but are not limited to: 
 
• 
Hours of operation are 6 AM – 9 PM, 7 days a week. Access is denied 
afterhours.  
• 
Storage customers are issued a key code that must be used to gain 
access to their room. This protects the customer’s belongings and 
decrease the ability of unauthorized access.

of the Loop 202 (South Mountain Freeway), which connects to Interstate 10 in the west

Phoenix Metro area.  
 
A conceptual site plan is included with this rezoning request. Any future commercial 
development will be in compliance with the Maricopa County Zoning Ordinance (MCZO) 
C-2 zoning district standards and regulations per Section 805 and will be in compliance 
with C-2 development standards and regulations, meeting setbacks, signage criteria, etc. 
Operational details including number of employees, hours of operation, and other 
information will be discussed when the POD is submitted in the future. The requested 
deviations from code in the CUPD would be the parking ratio requirement, due the fact that 
Maricopa County doesn’t have a parking requirement for mini warehouse/self-storage and 
use restrictions. 
 
Commercial Unit Plan of Development (CUPD) 
 
The Commercial Unit Plan of Development (CUPD) Overlay is proposed to deviate the 
MCZO standards for parking requirements. There are no parking requirements for self-
storage, and the current requirement for warehousing of 1SP for every 900 SF is much 
higher than the proposed use requires.   
 
Given the size of the site, the industrial nature of the current use our client is requesting to 
deviate from parking requirements of 1SP for every 900 SF to 4 spaces, plus one for 
manager. 
 
The proposed CUPD is requesting to have all uses that are currently permitted in the C-2 
zoning code, however we are proposing to prohibit the following uses:

Contiguous properties to the north, west, and east are zoned RU-43 and are currently 
utilized for residential homes. Dobbins Road is directly to the South of the Property acting 
as a buffer to frontage of the Property.

Location, Accessibility, and Circulation  
 
The Property is located within Maricopa County zoning jurisdiction, however it is also 
included in the City of Phoenix’s General Plan, classified as Residential 0 to 1 du / acre. 
The General Plan designation for the parcel abutting the Property to the west is Residential 
1 to 2 du / acre. The current use of this site is Phoenix Fire Department 58. This use, 
although necessary to a community generates significant noise and traffic restrictions 
affecting the neighboring residents. The General Plan designation for the parcels to the 
east are 1 to 2 du / acre. The subject Property for the proposed rezone is also designated 
in the Phoenix General Plan for Residential 0 to 1 du / acre but has operated as a low 
impact commercial use for many years. A self-storage facility is not considered a residential 
use, but it does service the people of the surrounding community. Self-storage facilities are 
quiet and will provide a good buffer between the fire station and the existing residential 
homes. Self-storage facilities generate very little traffic, and has a low impact on utilities. 
Taking into consideration the size of the Property, (4.75± acres) its impact will be similar to 
residential use with the density of 0 to 1 du / acre and/or 1 to 2 du / acre. 
 
There are numerous options for access the Property as there are arterials and alignments 
surrounding the Property. Loop 202 is less than 2± miles from the Property and feeds into 
Interstate 10, serving both east and west valley.

A Plan of Development (POD) for development of the Property will be applied subsequent 
to obtaining commercial zoning entitlement approval once specific land use(s) are 
determined. 
 
Conclusion 
 
The requested rezone to C-2 CUPD is justified given the nearby proximity to residential 
communities who utilize self-storage facilities. Most occupants of self-storage facilities live 
less than four (4) miles from the storage site. Given this location, the Property is not suitable 
for rural or large scale residential development. This use conforms with the purpose of the 
C-2 zoning district, as it is suitable to nearby properties and the site has access to a major

SIGNIFICANCE  
 
A. HISTORIC EVENTS/TRENDS 
Agriculture - Association with the cultivation of cotton in Laveen, 1913-present.  
 
 
Laveen today is known for its rural character distinguished by farmland and open spaces. This character, however, was 
based on the cultivation of cotton, beginning in the 1910s. By the time of Laveen’s founding, cotton became a booming 
local and regional industry. Cotton became so prosperous that it challenged every other production in the state. Quickly, 
Arizona became known for its superior quality cotton, a type surpassing Texan and even Egyptian Cotton. Soon, World 
War I placed an increase in the demand for cotton, especially the type farmed in the Salt River Valley, the long-staple 
Pima. During this period, Laveen’s population boomed and the community developed.  
 
Where cotton grew, ginning likely took place. As cotton became increasingly prosperous, Laveen developed the need for a 
local gin. Before 1923, farmers selling their cotton needed to travel some nine miles to a gin at 13th and Jackson Streets in 
Phoenix. Thus, in 1924, The Laveen Ginning Co., and the Anderson-Clayton company, purchased eight acres from T.C. 
McReynolds on the northwest corner of 45th Avenue and Dobbins, in the heart of Laveen’s commercial and cultural 
district. The operation of their own gin signified the prosperity Laveen cotton farmers experienced in the previous ten 
years. While King Cotton would not provide the same stability for the community in years to come, it played a crucial role 
in creating the community of Laveen.   
 
C.  
ARCHITECTURE 
 
Industry – Construction: unique type of style and materials.  
 
The Laveen Gin was the only gin within the small agrarian community of Laveen. Several gins, however, occupied the 
current site, but the existing gin is the only remaining structure of its type. In a rapidly urbanizing environment, The 
Laveen Gin represents a rare type of structure within Laveen, its surrounding communities, and the Salt River Valley.    
 
 
 
 
DESIGN 
 
Originally, the primary gin building was narrower and featured a shorter shade covering that extended to the east. About 
fifteen feet was added to the western portion of the gin, using corrugated metal with a shed roof. This was likely done 
between 1949 and 1959. Throughout the property’s existence, numerous smaller sheds have been constructed to meet the 
needs of its occupants and business. Recent owners added a longer roof, extending to the north, or rear, of the gin, for
