CITY COUNCIL REPORT SUBJECT: Resolution No. 2593 – State of AZ (ADOT) IGA Intergovernmental Agreement MEETING DATE: January 14, 2025 TO: Mayor and Council FROM: Chris Hamilton, City Engineer REVIEWED: Reyes Medrano Jr., City Manager PURPOSE: The Development Services Department is requesting the adoption of Resolution No. 2593, approving the Intergovernmental Agreement between the City of Tolleson and the State of Arizona, acting by and through its Department of Transportation (ADOT), for the construction of a pedestrian bridge system over Van Buren Street at 96th Avenue. BACKGROUND: The City of Tolleson applied for and received Congressionally Directed Spending funds in the amount of $3.5 million to build a pedestrian bridge over Van Buren Street at approximately 96th Avenue. It is in the public interest to enhance pedestrian safety and connectivity through the construction of this Project. These funds are federal and will require that all federal guidelines are met. The funds will be sent to ADOT, and ADOT will managed and oversee the construction of the Project due to the funding. As such, the City of Tolleson finds it necessary and beneficial to authorize and execute this Agreement. DISCUSSION: The City’s role primarily focuses on design preparation, cost sharing, right-of-way compliance, and final maintenance of the Project while ensuring adherence to state and federal requirements. Council has previously approved a contract for design services related to this Project. The purpose of this IGA is to authorize the match funds as well and the Project Development Administration (PDA) cost. These cost are not covered by Federal funds and are required to be paid by the City. ADOT collects a set amount of PDA funds and then tracks the actual costs over the project life. If ADOT fees are less than the collected amount, the difference will be refunded to the City. If the cost are over, an invoice for the overage will be sent. Additionally, if the actual construction bid is above $3.5 million, the City would be responsible for the over or have to find cost savings measures. Any scope changes are also the responsibility of the City to cover. BUDGET IMPACT: The City has received Fiscal Year 2023 Highway Infrastructure Programs (HIP) Congressionally Directed Spending Projects funding for this Project, including federal aid in the amount of $3,500,000 and a City match of $256,559 as detailed in the Agreement. The City's match can be allocated to construction funding ($211,559 (5.7%)) plus PDA ($45,000). RECOMMENDATION: Staff recommends the City Council adopt Resolution No. 2593. ATTACHMENTS: 1.
