TO 
AGREEMENT 
BETWEEN 
MARICOPA COUNTY 
ADMINISTERED BY ITS 
HUMAN SERVICES DEPARTMENT 
AND 
TEMPE ELEMENTARY SCHOOL DISTRICT No. 3 
AND 
CITY OF TEMPE 
 
I. 
Maricopa County (“County”) administered by its Human Services Department Early 
Education Division (“Department”) and Tempe Elementary School District No. 3 of 
Maricopa County (hereinafter referred to as the “District”), and the City of Tempe 
(hereinafter referred to as the “City”), fully executed a financial Intergovernmental 
agreement (“Agreement”) on or about August 11, 2022. The purpose of the Agreement 
is to establish a collaboration between the Parties that will address expanding high-
quality pre-school in the City of Tempe and the District’s boundaries. The County will 
provide funding that will help to increase instructional annual hours for enrolled Head 
Start children. The term of the Agreement began on July 1, 2022 through June 30, 2024. 
The County, The District, and The City are referred to here as the “Parties.” 
 
II. 
The Parties fully executed Amendment No. 1 on or about January 25, 2023. The 
purpose of the Amendment was to remove paragraph 15.0 (Safeguarding of Participant 
Information) in its entirety and replace it with revised contract language. The Amendment 
also removed Paragraph 17.0 (Non-Liability) in its entirety and replaced it with revised 
contract language. 
 
III. 
The Parties fully executed Amendment No. 2 on or about February 15, 2024. The 
purpose of the Amendment was to revise Paragraph 9.1.4 (Child Development and 
Education) by adding additional subsections. The Amendment also revised Paragraph 
12.0 (Locations Where Service Will Be Provided), by updating School/Site locations. 
Amendment No. 2 further added required contract language.  
 
IV. 
The Parties agree to address the following items: 
 
A. 
Extend the Agreement termination date from July 1, 2024, through June 30, 2025 
(1st renewal option) 
 
B. 
Revise Section 6.0 (Funding) 
1. 
Removing subsection 6.2 in its entirety and replacing with the following: 
The County shall provide a not-to-exceed amount of $133,120 for the 
period of July 1, 2023, to June 30, 2024. The County shall increase 
funding by $13,832 for the period of February 1, 2024. Total funding 
availability for fiscal year 2024 shall be increased to $146,952. The 
County shall provide a not to exceed amount of $161,833 for the 
period of July 1, 2024, through June 30, 2025. 
2. 
Removing subsection 6.4 in its entirety and replacing with the following: 
Funding for this Agreement is provided by the Assistance Listing 
Number (ALN) 93.600 Head Start and Early Head Start;

C. 
Revise Section 9.0 (Responsibilities of Organizations), by removing subsection 
9.1.1.1 in its entirety and replacing with the following: 
Employ instructional staff and utilize pattern of one Teacher and two 
Teacher Assistants for each classroom; 
 
D. 
The Agreement funding amount shall be increased from $266,240 to $441,905. 
 
V. 
Section IV above contains all the changes made by this Amendment No. 3. This 
Amendment is subject to A.R.S. §38-511. All other terms and conditions of the original 
Agreement and all previously fully executed Amendments shall remain the same and in 
full force and effect as approved and amended. 
 
VI. 
The Parties have authorized the undersigned to execute this Amendment No. 3 on their 
behalf.
