CONSULTANT SERVICES
CONTRACT NO. 2024-012
Pursuant to the provisions of the Arizona Revised Statutes § 11-201 the Maricopa County Board of
Supervisors has the authority to enter into contracts.
The Maricopa County Department of Transportation, hereinafter called the “COUNTY”, is desirous of having
certain professional services performed in connection with Contract No. 2024-012, PEORIA AVE CITRUS
RD TO SR 303 FINAL DESIGN PHASE AND POST DESIGN SERVICE, hereinafter called the “Project”,
and as more fully described in Exhibit A, Scope of Work, and in accordance with Exhibit B, Fee Proposal,
attached; and KIMLEY-HORN AND ASSOCIATES, INC. , hereinafter called “CONSULTANT”, with its
principal offices located at 7740 N. 16th Street, Suite 300, Phoenix, AZ Telephone Number: 602.944.5500,
subject to the following terms and conditions:
THEREFORE, the parties hereto mutually agree as follows:
SECTION 1 - SERVICES OF THE CONSULTANT
The CONSULTANT, under the general supervision of the COUNTY, Engineering Division Manager, shall
prepare studies, reports, surveys, plans, drawings, specifications, and cost estimates as are necessary for
the Project according to the directions and designated standards of the COUNTY, and in accordance with
Exhibit A, Scope of Work. It is understood and agreed that the COUNTY authorized representative shall be
the COUNTY Engineering Division Manager or his duly authorized representative, hereinafter called the
“Agent”. For purposes of this contract, the Agent’s duly authorized representative shall be the Project
Manager and he/she shall be the sole contact for administering this contract.
The CONSULTANT shall meet periodically with the Agent so as to keep the COUNTY informed of the
progress of the work in accordance with the schedule defined in Exhibit A, Scope of Work.
The CONSULTANT shall promptly advise the Agent of any factors which develop during the Project that
would likely result in construction or design costs in excess of budgetary constraints.
SECTION 2 - PERIOD OF SERVICE
The CONSULTANT shall complete all work in accordance with the time requirements provided in Exhibit A,
Scope of Work, within one thousand eight hundred twenty-five (1825) CALENDAR DAYS after receipt of
the Notice to Proceed. Should extension of this contract period be necessary, and any such extension(s)
continue the date of contract performance for a time period of more than one (1) year from the original date
of contract expiration, adjustment(s) of the CONSULTANT’S fee(s) may, upon agreement by both the
COUNTY and the CONSULTANT, be made in accordance with the Consumer Price Index for Urban
Consumers, Western Division, published by the U.S. Department of Labor, Bureau of Labor Statistics, using
the published edition coinciding with the initial contract expiration date. Any such fee adjustment shall only
apply to the extended contract time period.

SECTION 3 - PAYMENTS TO THE CONSULTANT
The CONSULTANT shall be paid for work under this contract a not-to-exceed amount of One Million Five
Hundred Forty Five Thousand Six Hundred Fourteen Dollars and Forty-Six Cents ($1,545,614.46) plus
a fee not-to-exceed Sixty Five Thousand Three Hundred Ninety Six Dollars and Eighty-Four Cents
($65,396.84) for optional tasks as identified below and in accordance with the Scope of Work. A written
authorization from the Agent will be required prior to initiating any optional task.

The total contract amount will not exceed One Million Six Hundred Eleven Thousand Eleven Dollars and
Thirty Cents ($1,611,011.30), plus any adjustments that have been approved in writing in accordance with
the Maricopa County Procurement Code.
The COUNTY will pay the CONSULTANT upon completion of the work as accepted by the COUNTY, except
that progress payments may be made as billed by the CONSULTANT based on approved monthly progress
reports subject to the limitations set forth in Exhibit A, Scope of Work. No retention shall be withheld from the
contract
The CONSULTANT shall provide back-up documentation with each invoice progress payment. The back-up
documentation shall clearly indicate the classification, hours worked, date, and employee’s name, including
subconsultants. All backup documentation shall include copies of any subconsultants or vendor invoices.
The Small Business Enterprise Participation Form (Attachment 1) is to be submitted with each pay
application or invoice. Any pay application or invoice without this form attached is subject to rejection as not
being a completed pay application or invoice pursuant to the terms of the contract.
The final invoice shall be paid to the CONSULTANT, as applicable, within forty-five (45) calendar days after:
A.
final completion of all work per Exhibit A, Scope of Work,
B.
acceptance of the work by the COUNTY,
C.
the COUNTY’s receipt of the fully executed “Certificate of Performance” form (Attachment 2). Any
final invoice submitted without a Certificate of Performance is subject to rejection as not being a
completed pay application or invoice pursuant to the terms of the contract.
SECTION 4 - THE COUNTY’S RESPONSIBILITIES
The COUNTY will furnish the CONSULTANT, at no cost to the CONSULTANT, the following information or
services for this Project:
A.
One copy of on-hand maps, records, survey ties, benchmarks, or other data pertinent to the Project.
This does not, however, relieve the CONSULTANT of the responsibility of searching records for
additional information, for requesting specific information, or for verification of that information

provided. The COUNTY does not warrant the accuracy or comprehensiveness of any such
information.
B.
All available information and data relative to policies, standards, criteria, and studies, etc. impacting
the Project as identified by the CONSULTANT.
C.
Available staff for consultation with the CONSULTANT during the performance of studies and plan
development in order to identify the problems, needs, and other functional aspects of the Project.
D.
Prompt examination of documents submitted by the CONSULTANT and rendering of decisions
pertaining thereto in order to avoid unreasonable delay in the progress of the work by the
CONSULTANT. The COUNTY will keep the CONSULTANT advised concerning the progress of the
COUNTY’s review of work.
SECTION 5 - AMENDMENTS
This contract may be amended by mutual agreement of the COUNTY and the CONSULTANT.
Any alteration in the Scope of Work that will result in a substantial change in the nature of the Project so as
to materially increase or decrease the contract fee will require negotiation of an amendment to the contract
to be executed by the COUNTY and the CONSULTANT. No work shall commence on the change until the
contract amendment has been approved by the COUNTY and the Agent has notified the CONSULTANT to
proceed. It is distinctly understood and agreed that no claim for extra work performed or materials furnished
by the CONSULTANT will be allowed by the COUNTY except as provided herein, nor shall the
CONSULTANT do any work or furnish any materials not covered by this agreement unless such work is first
authorized in writing by the COUNTY in accordance with the Maricopa County Procurement Code. Any such
work or materials furnished by the CONSULTANT without such written authorization first being given shall
be at CONSULTANT’s own risk, cost, and expense. The CONSULTANT hereby agrees to make no claim
for such work or materials furnished without such written authorization.
SECTION 6 - RECORDS
Records of the CONSULTANT’S expenses pertaining to this contract and records of accounts between the
COUNTY and the CONSULTANT shall be kept on a generally recognized accounting basis and shall be
available upon request to the COUNTY or its authorized representative for audit during normal business
hours.
All CONSULTANT and COUNTY procurement records shall be retained for a period of one (1) year and
disposed of in accordance with the records retention guidelines and schedules approved by the State of
Arizona Department of Library, Archives, and Public Records unless applicable Federal regulations require
a longer period of retention.
SECTION 7 - PROJECT COMPLETION
If, during the course of this contract, situations arise which prevent completion within the allotted time, the
Agent may grant an extension.

SECTION 8 - TERMINATION
The COUNTY may terminate this contract at any time upon reimbursement to the CONSULTANT of
expenses that include reasonable charges for time and material for the percentage of work satisfactorily
completed and provided to the COUNTY.
The COUNTY reserves the rights to postpone, terminate, or abandon this contract for the CONSULTANT’S
failure to complete the Project on time or failure to comply with the provisions of the contract. The COUNTY
also reserves the right to terminate any or all parts of this contract for its own convenience as the COUNTY
may determine at its sole discretion.
The COUNTY hereby gives notice that pursuant to A.R.S. § 38-511 “A” this contract may be canceled without
penalty or further obligation within three (3) years after execution if any person significantly involved in
initiating, negotiating, securing, drafting, or creating a contract on behalf of the COUNTY is, at any time while
the contract or any extension of the contract is in effect, an employee or agent of any other party to the
contract in any capacity or a CONSULTANT to any other party of the contract with respect to the subject
matter of the contract. Cancellation under this section shall be effective when written notice from the
Transportation Director is received by all of the parties to the contract. In addition, the COUNTY may recoup
any fee or commission paid or due to any person significantly involved in initiating, negotiating, securing,
drafting, or creating the contract on behalf of the COUNTY from any other party to the contract arising as a
result of the contract.
The CONSULTANT may terminate this contract in the event of nonpayment of fees as specified in SECTION
III, PAYMENTS TO THE CONSULTANT.
SECTION 9 - OWNERSHIP OF DOCUMENTS
A.
All original documents including, but not limited to studies, reports, tracings, drawings, physical and
computer models, estimates, field notes, investigations, design analysis, calculations, computer
software, and specifications, prepared in the performance of this contract are to be and remain the
property of the COUNTY and are to be delivered to the Agent before final payment is made to the
CONSULTANT. The COUNTY will not reuse, alter or modify these documents without noting such
modifications, alterations, or intent of their reuse, and will hold the CONSULTANT harmless from
any claims arising from such reuse, modifications, or alterations of the documents. The
CONSULTANT may retain reproducible copies of all such documents delivered to the COUNTY.
B.
If the CONSULTANT retains reproducible copies of all such documents delivered to the COUNTY,
the CONSULTANT may not use those documents in regard to current or future claims or litigation
against the COUNTY brought by another party or parties unless the documents are independently
produced in accordance with a court order or procedural rules and notice of such production is given
to the COUNTY immediately and prior to their production.
C.
Copies retained by the CONSULTANT, subconsultant(s), or any related entities are governed by
Arizona Law regarding the use of public records and may not be used for commercial purpose without
additional written permission from the COUNTY and the payment of all applicable fees.
D.
The COUNTY reserves the right to reuse the documents as it sees fit.

SECTION 10 - COMPLIANCE WITH LAWS
The CONSULTANT is required to comply with all Federal, State, and local laws, local ordinances and
regulations. The CONSULTANT’S signature on this contract certifies compliance with the provisions of the
I-9 requirements of the Immigration Reform and Control Act of 1986 for all personnel that the CONSULTANT
and any subconsultants employ to complete any Project. It is understood that the COUNTY shall conduct
itself in accordance with the provisions of the Maricopa County Procurement Code.
The CONSULTANT warrants that it is in compliance with A.R.S. §41-4401 and further acknowledges:
(1)
That the CONSULTANT and its subconsultants, if any, warrant their compliance with all
federal immigration laws and regulations that relate to their employees and their compliance
with A.R.S. §23-214, subsection A; after December 31, 2007, every employer, after hiring
an employee, shall verify the employment eligibility of the employee through the e-verify
program and shall keep a record of the verification for the duration of the employee’s
employment or at least three years, whichever is longer.
(2)
That a breach of a warranty under subsection 1 above, shall be deemed a material breach
of the contract that is subject to penalties up to and including termination of the contracts;
(3)
That the contracting government entity retains the legal right to inspect the papers of any
CONSULTANT or subconsultant employee who works on the contract to ensure that the
CONSULTANT or subconsultant is complying with the warranty provided under subsection
1 above and that the CONSULTANT agrees to make all papers and employment records of
said employee(s) available during normal working hours in order to facilitate such an
inspection.
(4)
That nothing herein shall make any CONSULTANT or subconsultant an agent or employee
of the contracting government entity.
CERTIFICATION REGARDING DEBARMENT AND SUSPENSION:
(1)
The undersigned (authorized official signing for the CONSULTANT) certifies to the best of
his or her knowledge and belief, that the CONSULTANT, defined as the primary participant
in accordance with 45 CFR Part 76, and its principals:
(a)
are not presently debarred, suspended, proposed for debarment, declared
ineligible, or voluntarily excluded from covered transactions by any Federal
Department or agency;
(b)
have not within a 3-year period preceding this Contract been convicted of or had a
civil judgment rendered against them for commission of fraud or a criminal offense
in connection with obtaining, attempting to obtain, or performing a public (Federal,
State or local) transaction or contract under a public transaction; violation of Federal
or State antitrust statues or commission of embezzlement, theft, forgery, bribery,
falsification or destruction of records, making false statements, or receiving stolen
property;

(c)
are not presently indicted or otherwise criminally or civilly charged by a government
entity (Federal, State or local) with commission of any of the offenses enumerated
in paragraph (2) of this certification; and
(d)
have not within a 3-year period preceding this Contract had one or more public
transaction (Federal, State or local) terminated for cause of default.
(2)
Should the CONSULTANT not be able to provide this certification, an explanation as to why
should be attached to the Contact.
(3)
The CONSULTANT agrees to include, without modification, this clause in all lower tier
covered transactions (i.e. transactions with subcontractors) and in all solicitations for lower
tier covered transactions related to this Contract.
SECTION 11 - GENERAL CONSIDERATIONS
A.
The CONSULTANT shall furnish to the COUNTY for approval, the names of its key employees, and
of its subconsultants and their key employees, to be used on this Project prior to beginning the work
under this contract. Any subsequent changes are subject to the written approval of the COUNTY.
B.
The CONSULTANT shall perform, with its own firm, work amounting to fifty percent (50%) or more
of the total amount of the contract value. Any deviation may be approved, in writing, at the discretion
of the Agent.
C.
The failure of either party to enforce any of the provisions of this contract or to require performance
of the other party of any of the provisions hereof shall not be construed to be a waiver of such
provisions, nor shall it affect the validity of this contract or any part thereof, or the right of either party
to thereafter enforce each and every provision.
D.
If the COUNTY determines that the CONSULTANT had made any errors and/or omissions (E&O) in
the work product delivered to the COUNTY under the terms of this Contract, the CONSULTANT
shall make all necessary revisions or corrections resulting from E&O without additional cost to the
COUNTY. Errors and Omissions is defined as a deviation from the standard of care on the part of a
design engineering consultant in the performance of architectural and/or engineering services under
this Contract. The COUNTY shall actively pursue the resolution of E&O’s at the lowest possible level
within a reasonable timeframe in accordance with the most current version of MCDOT’s Errors and

E.
It is mutually understood and agreed that this contract shall be governed by the laws of the State of
Arizona, both as to interpretation and performance. Any action at law, suit in equity, or judicial
proceeding for the enforcement of this contract, or any provision thereof, shall be instituted only in
the courts of the State of Arizona.
F.
When this contract requires the CONSULTANT to study specific geographic areas of Maricopa
County the CONSULTANT agrees during the term of this contract and any extensions thereof that
CONSULTANT will not perform similar services for any clients other than the COUNTY within that

specific geographic area without the written authorization and approval of the Transportation Director
of the COUNTY.
G.
The CONSULTANT agrees that it, its principals, employees, subconsultants, agents and assigns,
shall not accept employment as CONSULTANTS, expert witnesses or otherwise in any pending or
contemplated litigation against the COUNTY during the term of this contract and any extensions
thereof without the written authorization and approval of the Transportation Director of the COUNTY.
H.
The CONSULTANT agrees that it, its principals, employees, subconsultants, agents and assigns,
shall not accept employment as CONSULTANTS, expert witnesses or otherwise in any future
litigation against the COUNTY in regard to the subject matter of this contract without the written
authorization and approval of the Transportation Director of the COUNTY.
I.
It is understood that the COUNTY shall have the right to seek and obtain in any court of competent
jurisdiction an injunction to restrain a violation or alleged violation by the CONSULTANT, its
principals, employees, subconsultants, agents or assigns, of the provisions of F., G., and H. of this
section or of the provisions of B. of Section IX, and the right of action for full damages at law, in
addition to any other remedies provided by this contract. In no case shall a waiver by the COUNTY
of the right to seek relief under this provision constitute a waiver of any other or further violation.
J.
The CONSULTANT shall incorporate stormwater quality best management practices (BMPs) in the
design of the project and comply with the Maricopa County Stormwater Quality Management and
Discharge Control Regulation, the Maricopa County Drainage Policies and Standards, and the
Maricopa County Drainage Regulations, using guidance from the Maricopa County Drainage Design
Manual, Vol. III, Erosion Control.
L.
Written Certification Pursuant to A.R.S. § 35-393.01. If CONSULTANT engages in for-profit activity
and has 10 or more employees, and if this Agreement has a value of $100,000 or more,
CONSULTANT certifies it is not currently engaged in, and agrees for the duration of this Agreement
to not engage in, a boycott of goods or services from Israel. This certification does not apply to
a boycott prohibited by 50 U.S.C. § 4842 or a regulation issued pursuant to 50 U.S.C. § 4842.
SECTION 12 - SUCCESSORS AND ASSIGNS
This contract shall not be assigned by either party without prior written approval of the other except that the
CONSULTANT may use in the performance of this contract without prior approval of the COUNTY, personnel
or services of its related entities and affiliated companies as if they were an integral part of the
CONSULTANT; and it shall extend to and be binding upon the heirs, executors, administrators, successors
and assigns of the parties hereto.
SECTION 13 - NO KICK-BACK CERTIFICATION
The CONSULTANT warrants that no person has been employed or retained to solicit or secure this contract
upon any agreement or understanding for a commission, percentage, brokerage, or contingent fee; and that
no member of the Board of Supervisors or any employee of the COUNTY has any interest, financially or
otherwise, in the CONSULTANT’S firm.

For breach or violation of this warranty, the COUNTY shall have the right to annul this contract without liability,
or at its discretion, to deduct from the contract price or consideration, the full amount of such commission,
percentage, brokerage, or contingent fee.
SECTION 14 - ANTI-DISCRIMINATION PROVISION
The COUNTY will endeavor to ensure in every way possible that small business enterprises shall have every
opportunity to participate in providing professional services, purchased goods, and contractual services to
the COUNTY without being discriminated against on the grounds of race, religion, gender, age, disability, or
national origin.
The CONSULTANT agrees not to discriminate against any employee or applicant for employment because
of race, religion, gender, age, disability, or national origin, and further agrees not to engage in any unlawful
employment practices. The CONSULTANT further agrees to insert the foregoing provisions in all
subcontracts hereunder.
SECTION 15 - FORCED LABOR
By submitting a bid for this solicitation and/or entering into a contract as a result of this solicitation,
CONSULTANT agrees to comply with all applicable portions of Arizona Revised Statutes Section 35-394.
Contracting; procurement; prohibition; written certification; remedy; termination; exception; definitions.
CONSULTANT certifies that it does not currently, and agrees for the duration of the contract, that it will not
use:
A.
The forced labor of ethnic Uyghurs in the People’s Republic of China.
B.
Any goods or services produced by the forced labor of ethnic Uyghurs in the People’s Republic of
China.
C.
Any CONSULTANT, subconsultant or suppliers that use the forced labor or any good or services
produced by the forced labor of ethnic Uyghurs in the People’s Republic of China.
D.
If CONSULTANT becomes aware during the term of the agreement that CONSULTANT is not in
compliance with this paragraph, the CONSULTANT shall notify the COUNTY within five business
days after becoming aware of the noncompliance. If the CONSULTANT fails to provide a written
certification to the COUNTY that the CONSULTANT has remedied the noncompliance within 180
days after notifying the COUNTY of its noncompliance, then the agreement terminates, except that
if the agreement termination date occurs before the end of the 180-day period, the agreement
terminates on the agreement termination date.
SECTION 16 - INDEMNIFICATION
To the fullest extent permitted by law, CONSULTANT shall defend, indemnify, and hold harmless COUNTY,
its agents, representatives, officers, directors, officials, and employees from and against all claims, damages,
losses and expenses, including reasonable attorney fees and court costs, but only to the extent caused by
the negligence, reckless or intentional wrongful conduct of the consultant or others persons employed or
used by the consultant in the performance of the contract or subcontract. “Other persons employed or used”
means a subconsultant to a consultant or design professional in any tier, or any other person or entity who

performs work or design professional services, or provides labor, services, materials or equipment in
connection with the contract.
The amount and type of insurance coverage requirements set forth herein will in no way be construed as
limiting the scope of the indemnity in this paragraph. The scope of this indemnification does not extend to the
sole negligence of COUNTY.
SECTION 17 - INSURANCE REQUIREMENTS
CONSULTANT, at CONSULTANT'S own expense, shall purchase and maintain the herein stipulated
minimum insurance from a company or companies duly licensed by the State of Arizona and possessing a
current A.M. Best, Inc. rating of B++. In lieu of State of Arizona licensing, the stipulated insurance may be
purchased from a company or companies, which are authorized to do business in the State of Arizona,
provided that said insurance companies meet the approval of COUNTY. The form of any insurance policies
and forms must be acceptable to COUNTY.
All insurance required herein shall be maintained in full force and effect until all work or service required to
be performed under the terms of the Contract is satisfactorily completed and formally accepted. Failure to do
so may, at the sole discretion of COUNTY, constitute a material breach of this Contract.
CONSULTANT’S insurance shall be primary insurance as respects COUNTY, and any insurance or self-
insurance maintained by COUNTY shall not contribute to it.
Any failure to comply with the claim reporting provisions of the insurance policies or any breach of an
insurance policy warranty shall not affect the COUNTY’S right to coverage afforded under the insurance
policies.
The insurance policies may provide coverage that contains deductibles or self-insured retentions. Such
deductible and/or self-insured retentions shall not be applicable with respect to the coverage provided to
COUNTY under such policies. CONSULTANT shall be solely responsible for the deductible and/or self-
insured retention and COUNTY, at its option, may require CONSULTANT to secure payment of such
deductibles or self-insured retentions by a surety bond or an irrevocable and unconditional letter of credit.
COUNTY reserves the right to request and to receive, within 10 working days, certified copies of any or all of
the herein required insurance policies and/or endorsements. COUNTY shall not be obligated, however, to
review such policies and/or endorsements or to advise CONSULTANT of any deficiencies in such policies
and endorsements, and such receipt shall not relieve CONSULTANT from, or be deemed a waiver of
COUNTY’S right to insist on strict fulfillment of CONSULTANT’S obligations under this Contract.
The insurance policies required by this Contract, except Workers’ Compensation, and Errors and Omissions,
shall name COUNTY, its agents, representatives, officers, directors, officials and employees as Additional
Insureds.
The policies required hereunder, except Workers’ Compensation, and Errors and Omissions, shall contain a
waiver of transfer of rights of recovery (subrogation) against COUNTY, its agents, representatives, officers,
directors, officials and employees for any claims arising out of CONSULTANT’S work or service.
CONSULTANT is required to procure and maintain the following coverages indicated by a checkmark:

1.
Commercial General Liability. Commercial General Liability insurance and, if necessary,
Commercial Umbrella insurance with a limit of not less than $2,000,000 for each occurrence,
$4,000,000 Products/Completed Operations Aggregate, and $4,000,000 General Aggregate
Limit. The policy shall include coverage for bodily injury, broad form property damage,
personal injury, products and completed operations and blanket contractual coverage, and
shall not contain any provision which would serve to limit third party action over claims. There
shall be no endorsement or modification of the CGL limiting the scope of coverage for liability
arising from explosion, collapse, or underground property damage.
2.
Automobile Liability. Commercial/Business Automobile Liability insurance and, if
unnecessary, Commercial Umbrella insurance with a combined single limit for bodily injury
and property damage of not less than $2,000,000 each occurrence with respect to any of
the CONSULTANT’S owned, hired, and non-owned vehicles assigned to or used in
performance of the CONSULTANT’S work or services under this Contract.

Workers’ Compensation. Workers’ Compensation insurance to cover obligations imposed
by federal and state statutes having jurisdiction of CONSULTANT’S employees engaged in
the performance of the work or services under this Contract; and Employer’s Liability
insurance of not less than $1,000,000 for each accident, $1,000,000 disease for each
employee, and $1,000,000 disease policy limit.
CONSULTANT waives all rights against COUNTY and its agents, officers, directors and
employees for recovery of damages to the extent these damages are covered by the
Workers’ Compensation and Employer’s Liability or commercial umbrella liability insurance
obtained by CONSULTANT pursuant to this agreement.
4.
Errors and Omissions Insurance. Errors and Omissions insurance and, if necessary,
Commercial Umbrella insurance, which will insure and provide coverage for errors or
omissions of the CONSULTANT, with limits of no less than $2,000,000 for each claim.
CERTIFICATES OF INSURANCE
Prior to commencing work or services under this Contract, CONSULTANT shall furnish COUNTY with
Certificates of Insurance in a form acceptable to COUNTY, or formal endorsements as required by the
Contract in the form provided by the COUNTY, issued by CONSULTANT’S insurer(s), as evidence that
policies providing the required coverages, conditions and limits required by this Contract are in full force and
effect. Such certificates shall identify this contract number and title.
In the event any insurance policy(ies) required by this contract is (are) written on a “claims made” basis,
coverage shall extend for two years past completion and acceptance of CONSULTANT’S work or services
and as evidenced by annual Certificates of Insurance.
If a policy does expire during the life of the Contract, a renewal certificate must be sent to COUNTY fifteen
(15) days prior to the expiration date.

CANCELLATION AND EXPIRATION NOTICE
Insurance required herein shall not expire, be canceled, or materially changed without thirty (30) days prior
written notice to COUNTY.
SECTION 18 - INFLUENCE
As prescribed in MC1-1202 of the Maricopa County Procurement Code, any effort to influence an employee
or agent to breach the Maricopa County Ethical Code of Conduct or any ethical conduct, may be grounds for
Disbarment or Suspension under MC1-902.
An attempt to influence includes, but is not limited to:
1.
A Person offering or providing a gratuity, gift, tip, present, donation, money, entertainment
or educational passes or tickets, or any type valuable contribution or subsidy;
2.
That is offered or given with the intent to influence a decision, obtain a contract, garner
favorable treatment, or gain favorable consideration of any kind.
If a Person attempts to influence any employee or agent of Maricopa County, the Chief Procurement Officer,
or his designee, reserves the right to seek any remedy provided by the Maricopa County Procurement Code,
any remedy in equity or in the law, or any remedy provided by this contract.
SECTION 19 - TITLE VI
The Maricopa County Department of Transportation, in accordance with the provisions of Title VI of the Civil
Rights Act of 1964 (78 Stat. 252.42 U.S.C. §§ 2000d to 2000d-4) and the Regulations, hereby notifies all
bidders that it will affirmatively ensure that any contract entered into pursuant to this advertisement,
disadvantaged business enterprises will be afforded full and fair opportunity to submit bids in response to
this invitation and will not be discriminated against on the grounds of race, color, or national origin in
consideration for an award.
SECTION 20 - FORCE MAJEURE
Neither party shall be liable for failure of performance, nor incur any liability to the other party on account of
any loss or damage resulting from any delay or failure to perform all or any part of this contract, if such delay
or failure is caused by events, occurrences, or causes beyond the reasonable control and without negligence
of the parties. Such events, occurrences, or causes will include acts of God/nature (including fire, flood,
earthquake, storm, hurricane, or other natural disaster), war, invasion, act of foreign enemies, hostilities
(whether war is declared or not), civil war, riots, rebellion, revolution, insurrection, military or usurped power
or confiscation, terrorist activities, nationalization, government sanction, lockout, blockage, embargo, labor
dispute, strike, and interruption or failure of electricity or telecommunication service.
Each party, as applicable, shall give the other party notice of its inability to perform and particulars in
reasonable detail of the cause of the inability. Each party must use best efforts to remedy the situation and
remove, as soon as practicable, the cause of its inability to perform or comply.
The party asserting Force Majeure as a cause for non-performance shall have the burden of proving that
reasonable steps were taken to minimize delay or damages caused by foreseeable events, that all non-

excused obligations were substantially fulfilled, and that the other party was timely notified of the likelihood
or actual occurrence which would justify such an assertion, so that other prudent precautions could be

Project Overview
Project Location
The project is located along Peoria Ave between Citrus Road and Cotton Lane within unincorporated
Maricopa County, the City of Surprise, and the City of Glendale. Some improvements for striping will
take place west of Citrus Road and improvements will be made to the north south legs of each
intersection within the project limits.
Project Background
The Final Scoping and Design Report for this project was submitted June 23, 2023.
The roadway section and the Peoria/Cotton intersection were designed during the scoping phase with
agreement from City of Surprise, MCDOT, City of Glendale, and Maricopa Water District (MWD).
The project will construct roadway improvements on Peoria Avenue between Citrus Road and Cotton
Lane. The project includes underground infrastructure for future traffic signals at Peoria/Citrus and
Peoria/175th, and traffic signalization at Peoria/Cotton.
As land development is occurring in this area, project stakeholders will continue to coordinate with
developers. The agreed-upon-design will assist agency-development-reviewers in providing consistent
direction to land developers.
Between Cotton Lane and SR 303, Peoria-Avenue-north-side-drainage-improvements are anticipated to
be constructed by developers within the next two years. The drainage improvements must meet
ADOT’s first flush requirements. This project’s roadway drainage from Citrus to Cotton will connect
with development-constructed-City-of-Surprise-and-ADOT-approved-drainage-channel on the north
side of Peoria which will connect to SR 303.
With respect to access management, MCDOT and City of Surprise agree to provide full access
driveways to Peoria Avenue for most of the County residents south of Peoria Avenue.
The project is not Federally funded.
Project Purpose
The purpose of this roadway project is to address: future roadway capacity as land development occurs
along the corridor, access management, and roadway drainage connecting to the development-
constructed-City-of-Surprise-and-ADOT-approved-drainage-channel on the north side of Peoria which
will connect to SR303L. This project will complete the Final Design Phase and Post Design per the
Project Development Manual (PDM) by addressing the purpose of the project while continuing to
coordinate with City of Surprise, MWD, County Residents, City of Glendale, and Development. RDM
(Roadway Design Manual) and City of Surprise Design Standards will be used. MAG, MCDOT, and
City of Surprise Specifications will be used.
Length of Services
The estimated contract time is 38 months for design and an additional 18 months for bidding/post
services from notice to proceed based on the MCDOT provided project schedule.
The assumed effort for all tasks is shown within the attached fee estimate. As the full effort for tasks is
unknown, any efforts necessary above and beyond the estimated effort will be considered additional
services. If additional services for any task are necessary, Kimley-Horn (Consultant) will notify the
MCDOT Project Manager (Project Manager) in advance of continuing services above and beyond the
estimated effort. If a task is not specifically listed within the attached fee estimate it is excluded and not
included within this scope of services.

The Consultant shall prepare a written communication plan for coordination with the project team. The
plan will include a strategy to ensure coordination among project partners and other key stakeholders.
The communication plan will be submitted to the Project Manager for review and approval within two
weeks of the NTP. The plan shall include the following elements:

A basic list of team members is provided in the MCDOT Project Work Plan. Stakeholders from each
agency will be confirmed and added to the list upon NTP.
100.2
Kick-Off Meeting
At the beginning of the project, virtual kick-off meeting will be held and shall include the Project
Manager, the Project Team, the Design Team, and any other necessary parties. The Consultant shall
work with Project Manager and staff to schedule a project kick-off meeting following the NTP to the
Consultant. The Consultant shall be responsible for preparing the kick-off meeting agenda, sign-in
sheet, presentation, handout material, attending and facilitating the kick-off meeting, and submitting
notes of the meeting to MCDOT. MCDOT will schedule the Teams meeting and review meeting
material and notes. The Consultant shall send a meeting agenda to the Project Manager a minimum of
24-hours prior to the meeting occurrence for review. The Consultant shall prepare and send meeting
notes to the Project Manager within five (5) business days of the actual meeting occurrence for review.
The Consultant shall be responsible for distributing the meeting notes after the Project Manager’s
review and approval as deemed appropriate by the Project Manager. Meeting attendees shall have an
additional five (5) business days to comment on the submitted meeting notes, after which time the notes
will be considered final.
One virtual kick-off meeting is assumed. The estimated effort associated with meeting attendance,
preparation, and note compilation time is provided in the attached fee estimate.

100.3
Design Criteria
The Consultant will verify the 30% design provided in the Final SDR. If after careful review of the
30% design, corrections are needed, the Consultant shall notify the Project Manager of these
corrections in writing and next steps will be determined. The 30% verified design will assist agency-
development-reviewers in providing consistent direction to land developers. Corrections to the 30%
plans are not anticipated or included within this scope of services. This shall include a review of the
geotechnical, drainage and traffic reports prepared during the development of the SDR.
The Consultant shall track and update the design criteria table from the SDR provided in the Appendix
of this scope of services as needed throughout the duration of design. The Consultant will prepare and
submit a table of the design criteria and modifications established during the scoping effort from the
Final Scoping Design Report, once the 30% design verification is complete. Following the 30% design
verification, the Consultant will notify the Project Manager prior to making changes to the design
criteria and modifications. The verification of the 30% and Final SDR and the design-criteria-and-
modifications-table will be presented at a progress meeting.
100.4
Design Exceptions
Design Exceptions are anticipated on this project for the City of Surprise. Since this project will be
annexed by the City of Surprise and MWD will be designing their improvements, Design Exceptions
will not be required. MCDOT will prepare Engineering Standards Modification Request Form for City
of Surprise based off the Final SDR. Design exceptions that were noted in the SDR are listed below and
grouped by agency for reference. Design exceptions needed will be referenced in the design criteria
table as part of the 30% design verification.
MWD

Cross slope of MWD easement can exceed 2% to accommodate driveway grades across the
MWD easement.

MWD easement can be located a minimum of 7’ from back of curb.

Project Progress Meetings
The Consultant shall work with MCDOT staff to schedule and attend progress meetings during the
duration of the project prior to milestone submittals. These meetings consist of but are not limited to,
progress meetings, comment resolution meetings, and coordination meetings with the technical groups.
The Consultant shall attend and facilitate project meetings and shall be responsible for taking
attendance. The Consultant will prepare the agenda in advance for review by the Project Manager.
The attendance list shall be distributed with the meeting notes. All meeting notes shall be sent to the
Project Manager within five (5) business days of the actual meeting occurrence for review. The
Consultant shall be responsible for compiling and distributing meeting notes after the Project
Manager’s review and approval. Meeting attendees shall have an additional five (5) business days to
comment on the submitted meeting notes, after which time the notes will be considered final. The
Project Manager and the Consultant will determine when the monthly progress meetings will be held.
When there is a month with no progress or comments resolution meeting scheduled, the Consultant will
prepare an email status update for the Project Manager to review and distribute at the beginning of the
month.
The estimated effort associated with meeting attendance, preparation, and note compilation time is
provided in the attached fee estimate. The types of meetings the Consultant will attend are as follows:

The Consultant and Project Manager will have brief virtual check-in meetings prior to each milestone
submittal and send monthly progress updates as needed for the Project Manager to communicate to the
project team.
100.7
Field Walk with Project Team
The Project Team will visit the field site to acquaint key personnel with the details and features of the
project and to gather input on issues, concerns and opportunities. The field walks will be scheduled, and
the team notified at least two weeks prior to the visit. The first field walk will be held shortly after
notice to proceed as part of the 30% design verification. The second field walk will be held after the
60% Plans are complete and are in the process of review. The third field walk will be held after the
95% Plans are completed and are in the process of review. For each field walk the Consultant shall
take photos of the project site and compile the photos in a photo log that describes the location and date
of each photo. The Consultant will identify any changes from scoping conditions and provide field
notes to the Project Manager within five (5) business days for review and distribution. The Consultant
shall comply with applicable local, state and public laws for the safety and health of its employees and
sub-consultant.
The Consultant will also visit the site early in the project to document existing features such as signing
and marking placement, utility appurtenance locations and other existing conditions.

100.8
Project Administration
This task includes the administrative and coordination tasks required for coordinating the work of the
team members with MCDOT staff and other project stakeholders. This task coordinates and administers
the day-to-day operations of the project, including preparing the internal production work plan,
organizing and filing project data and communication files, responding to project correspondence
including emails, preparation of regular monthly progress reports, performance of monthly budget
updates, and schedule monitoring. The Consultant shall provide updates to the Project Manager on
the Project Schedule including identifying interrelated tasks to be completed for the project’s proposed
improvements. The Consultant shall provide updates on the project schedule before progress meetings
over the course of the project’s design duration including tasks that are falling behind and getting ahead.
This task also includes the management of sub-consultants, interfacing and communication necessary to
keep stakeholders fully and accurately informed.
The Consultant shall submit invoices for progress payments using the MCDOT payment request form.
100.9
Safety Program
When performing any fieldwork, the Consultant shall be responsible for maintaining a safety program
for its employees and subcontractors on the jobsite(s). The Consultant’s safety program shall comply
with applicable local, state and public laws for the safety and health of its employees and
subconsultants. The Consultant shall be responsible for compliance with applicable local, state and
federal laws for employees of the Consultant and its subconsultants.
100.10
Quality Assurance/Control
Within five days following notice to proceed, the Consultant shall provide to MCDOT a written
quality assurance/quality control (QA/QC) plan. The QA/QC plan shall include, at a minimum, such
elements as checklists of items to be reviewed prior to each submittal, the procedures for conducting
QA/QC activities, and the person(s) responsible for QA/QC activities at each step of project
development.
All engineering calculations submitted to MCDOT shall be complete in detail and shall be checked.
The person checking the calculations shall not be the originator and shall be equally or better qualified
than the originator. All calculation sheets shall be initialed and dated by both the originator and the
checker.
Any sub-consultant's work that is used (i.e., soils reports, survey data, civil, hydrology, hydraulics, and
structural design) shall be reviewed by the prime Consultant for compliance with this Scope of
Services, prior to submittal for review by MCDOT.
Discipline specific QA/QC is accounted for under the respective sections for each deliverable
throughout this scope of services. Time accounted for in the estimate for this section is for training
staff, auditing the process and customizing the QA/QC plan to this project.

SECTION 300 SURVEY AND MAPPING
300.1
Topographic Survey with Control and Alignment Determination
MCDOT shall provide a geometrically controlled survey, identifying section corners, quarter section
quarters, Geodetic Densification and Cadastral Survey (GDACS) control points, and other control points
that may impact the design. The MCDOT shall survey full sections within the project boundary.
MCDOT shall locate and identify all monuments within the project limits. This information will be
utilized by the Consultant as the basis for the construction centerline. The Consultant will verify all
existing and proposed construction centerlines provided in the SDR.
300.2
Topographic Survey
MCDOT will provide all topographic survey which shall conform to Section 4.5 Survey and Data
Acquisition of the MCDOT Roadway Design Manual (RDM). Mapping will utilize the MCDOT
CADD Standards Manual.
300.3
Supplemental Field Survey
The Consultant shall request supplemental survey services performed by MCDOT for features that
may have been recently constructed since the original survey or if the project scope or limits have been
increased. It is assumed that up to three supplemental field survey requests will be prepared and
submitted by the Consultant.

SECTION 400 PROJECT COORDINATION
400.1 Stakeholder Meetings
Stakeholder meetings are anticipated based on the project schedule. MCDOT will lead stakeholder
meeting coordination and the Consultant will lead comment resolution coordination after each
submittal. The meetings shall be virtual. The estimated effort associated with meeting attendance,
preparation, and note compilation time is provided in the attached fee estimate.
400.2 Public Involvement
400.2.1 Prepare for and Attend Meetings
The Consultant will support MCDOT on public outreach. The Consultant will prepare four (4) high
level exhibits (size of 2’x3’) for one planned open house format public meeting. No roll plots.
Consultant staff that can answer technical questions on drainage, traffic, roadway will attend. Project
fact sheets or handouts may be created as needed if requested. The Consultant will attend up to five
meetings with individual property owners as needed. At the conclusion of each meeting the Consultant
will provide bulleted notes via email to MCDOT.
400.3 Intergovernmental Agreements (IGA)
An Intergovernmental Agreement between Maricopa County and the City of Surprise will be executed
for this project. No other IGA’s or maintenance/access control agreements are expected for this project.
The City of Surprise will coordinate the City of Glendale 10-foot annexation strip separately from this
project. City of Surprise advised that developers will be required to construct the channel from Cotton
to ADOT’s 303 channel.
400.3.1
IGA Updates
MCDOT will lead all IGA updates. The Consultant will support MCDOT’s IGA efforts with exhibits,
estimates and coordination with City of Surprise if requested. Local agency review may require a
separate over the shoulder review meeting if comments are not submitted on time.
400.3.2
ADOT Maintenance Agreement
No design or construction will be completed east of the Cotton Lane intersection except for roadway
and drainage tie-ins to existing Peoria Avenue which will end prior to ADOT’s right-of-way. All
coordination with ADOT outside of verifying drainage tie-ins to ADOT’s Channel is to be completed by
the City of Surprise. The channel is to be constructed by developers. The plan submittals will be
provided to ADOT for review and comment with each submittal since traffic control may encroach into
ADOT’s right-of-way and access control limits.
400.3.3 Developer Agreements (Cash in Lieu)
Only one Cash in Lieu agreement is currently known near the Peoria and Citrus intersection for Zanjero
Pass. Those improvements include a portion of the future traffic signal and will be incorporated as
needed under Section 900.
400.4 Developer Coordination
The Consultant will coordinate with developers as needed throughout the design phase of this project.
An allowance for coordination time has been provided within the attached fee estimate. This time will
include but is not limited to developer meetings, design coordination, plan review, construction cost
estimates, additional survey requests for developer improvements, etc… The Consultant will alert
MCDOT Permitting and Utilities of proposed developer's utilities conflicts as needed.

SECTION 500
UTILITIES AND RAILROAD
500.1 Utility Data Acquisition
MCDOT shall be responsible for acquiring all existing utility data within the project area, including as-
built drawings, electronic maps, utility survey information, utility easements and prior rights
information. The Consultant will review the data provided to make sure it’s complete and provide
additional requests to MCDOT as needed as part of Section 200
500.2 Utility Identification
Designating and utility locating will be provided by MCDOT and submitted to the Consultant for
incorporation into the design.
The Consultant shall review the existing utility base file prepared by MCDOT against all utility as-built
information to make a complete utility base file that identifies all wet and dry above and below ground
utilities and appurtenances horizontally within the project limits. All wet utilities of 18-inch diameter or
greater will be shown at actual size in the base file.
500.3 Utility Coordination
As outlined in the following sections, the Consultant shall coordinate with the utility providers and
MCDOT.
500.3.1 Utility Coordination
The Consultant’s attached fee estimate for this project is based on MCDOT arranging and conducting
monthly utility coordination meetings for up to 24 months to facilitate identification and resolution of
conflicts based on project needs as requested by the MCDOT Utility Coordinator (Utility
Coordinator)and MCDOT. The Project Manager will be kept informed in advance of all meetings
scheduled. MCDOT will send all meeting invites. The meetings noted herein may be a combination of
regular utility coordination meetings and individual utility meetings. Formal meetings are anticipated
for utility coordination at least two times during the pre-60%, possible informal/internal teams meetings
will be held at least every other week. The Consultant will prepare agendas, meeting notes, and record
attendance for all Utility Coordination meetings. The Consultant will provide exhibits and/or a roll-plot
for Utility Coordination meetings if requested by the Utility Coordinator.
The Consultant shall work in tandem with the Utility Coordinator and Project Manager to
coordinate design and relocation plans between utility companies and developers to eliminate conflicts
between entities desiring to relocate within the same corridor.
The Consultant shall prepare miscellaneous exhibits as part of the concept and design development of
utility relocations. These exhibits may include depictions of relocation alignments, locations for
easements, locations for stubs and service requests, etc.
500.3.2 Utility Conflicts
The Consultant shall indicate potential areas of conflict between utility facilities and project
improvements. The Consultant shall work with the utility companies to mitigate conflicts. The
Consultant shall adjust project plans as much as possible to avoid utility conflicts without impacting
the needs of the project or public safety. When a property is acquired for a project, private utility issues
are resolved as part of the Right-of-Way acquisition including but not limited to power, water and sewer
connections. The Consultant will update the ROW Parcel Tracking Sheet to include utility right-of-
way issues. The Consultant shall communicate these and any private utility issues with the Utility
Coordinator. The MCDOT Right-of-Way Agent and Project Manager will be kept informed.
During the duration of the project the Consultant will develop and maintain a utility conflict and

resolution list spreadsheet and roll plot. As new conflicts arise the spreadsheet will be updated and
periodically distributed to the Project Team.
500.3.3 Utility Potholing
The Consultant shall identify the needs for utility potholing, coordinate the potholing with the utility
providers, and collect and analyze the resulting information.
Prepare Pothole List
The Consultant shall prepare a comprehensive list of all required and/or requested utility potholes
required. MCDOT will review the list of requested potholes and accept those determined to be relevant
to the project. It is assumed that one comprehensive pothole list will be prepared at the beginning of the
project for the majority of the known conflicts and that up to two additional requests will be prepared as
conflicts are identified for private utility relocations that create additional conflicts. The list prepared by
the Consultant shall include the following information in table format:

Utility provider name;
▪
Utility provider contact information;
▪
Utility conflict type (i.e. conflict with culvert, excavation, etc.);
▪
Utility type (i.e. electric, gas, water and gas, etc.); and
▪
Approximate pothole northing, easting, station, and offset.
The Utility Coordinator will submit the pothole layout exhibit to Environmental for clearance and
coordinate with MCRED for any necessary Rights of Entry (ROE).
Perform Potholes
Once the environmental clearance and right of entry have been obtained, MCDOT will coordinate with
a contractor to acquire required utility potholes and provide all pothole information to the Consultant.
Pothole data will be made available to the Consultant at least 4 weeks prior to the pre-60% plan
submittal.
Update Existing Utility Base File with Pothole Data
Once the pothole data is received the utility base files will be updated to reflect the actual location of
utilities.
Pothole data will be shown on plan and profile sheets and cross section sheets. The plans will include
elevations for all existing at grade utility facilities, together with associated pipe diameters, pipe
materials, and pipe direction. Utility crossings shall be shown at the location and elevation as obtained
from as-built drawings, interpolated from actual survey data, or as determined from potholes. The
Consultant will indicate the data source by the notation “Record Drawing” or “Pothole”, on the plans.
The horizontal location and vertical profile of each proposed utility will be shown on the roadway plans.
This includes underground and above ground utilities. Roadway profiles cross sections (where known
data is available), showing utility conflicts, will also be included. All utility elevations shall be shown in
the same datum as the roadway plans. The Utility Coordinator will work with the Consultant to
indicate ownership of each utility on the construction plans.
500.3.4 Provide Plans to Utility Companies
The Consultant shall furnish plans and copies of cross sections to the utility company upon request.
Cross section plans will be required when existing utility facilities have been installed parallel to the
roadway centerline within MCDOT’s Right-of-Way. Cross section plans shall show the location and

depth of utilities running parallel to the roadway centerline. It is assumed that distribution of these plans
will only be necessary at major milestone submittals.
Utility Plans Review
The Consultant shall work with the Utility Coordinator to send plans to the utility companies for
conflict review, receive the comments and responses, and provide MCDOT copies of all
correspondence to and from the utility companies. Utility comments and their resolutions shall be
included on the appropriate Stage Comment Resolution Form and distributed to all team members, and
utility companies, within ten (10) working days after the comment resolution meeting. Any plans or
Right-of-Way changes which may affect existing utilities, or their relocation, are to be specifically
brought to the attention of the utility. This shall include any slope adjustments, curb locations, cut/fill
changes, etc.
500.3.5 Determine Utility Relocation Right-of-Way
Based on known conflicts and estimated easement and right-of-way requirements for each utility
company, the Consultant shall inform MCDOT on or before the 30% verification if new Right-of-Way
is required which exceeds what is needed for the roadway improvements. If it is determined that the
utility companies require additional land rights beyond what is determined through the 30% verification,
the Consultant will inform MCDOT as soon as possible.
500.3.6 Utility Relocations - Private
Where utility relocations are required, the Consultant, in coordination with the utility providers and
MCDOT, shall identify potential alternatives to minimize utility conflicts. The Consultant shall notify
MCDOT promptly upon determination that relocation of a utility company facility is required. Where
the utility relocation is to be included as part of the project, and where the MCDOT contractor will
perform the work, the Consultant shall provide MCDOT with design cost details, exhibits showing the
line to be relocated and a summary of the construction costs for the work to be billed. The Consultant
shall use input and drawings supplied by the utility company to the extent possible.
Utility Relocation Costs
MCDOT will determine, by examination of prior rights documentation provided by the utility
company, the utility’s rights to occupy the area of conflict and who is responsible for the cost of the
relocation. Utilities without prior rights are responsible for cost incurred to relocate facilities. The
Utility Coordinator shall review and comment on cost estimates provided by the utility provider for
inclusion in the Utility Agreement. MCDOT will notify the utility company to relocate at its own
expense or will obtain the necessary cost estimates and prepare the necessary utility agreements to allow
for payment of utility relocation work when it is at MCDOT’s expense.
Utility Relocation Design
The utility providers will be responsible for the design of their utility’s relocation.
500.3.6.2.1 Review Design
The Consultant will review all utility relocation plans to ensure compatibility with the proposed design
plans. The Consultant will coordinate with MWD to ensure the final design and the MWD relocation
are compatible with each other throughout each submittal stage. The Consultant shall submit the
utility-company-provided Preliminary Utility Relocation Design with the 60% submittal; the Final
Utility Relocation Design with the 95% submittal incorporating comments received; and the Utility
Relocation As-built with the 100% submittal. The horizontal location and vertical profile of each
proposed utility will be shown on the roadway plans. This includes underground and above ground
utilities. Roadway profiles cross sections (where known data is available), showing utility conflicts,

Utility Coordinator will work with the roadway lead to indicate ownership of each utility on the
construction plans.
500.3.6.2.2 Update Proposed Utility Base File
Utility relocations will be shown within the final construction plans and noted as such within the utility
special provisions. The Consultant shall be responsible for ensuring that a proposed utility base file is
compiled and updated to show the relocation concepts.
500.3.6.2.3 Utility Relocation Construction
It is assumed that the dry utility companies will be responsible for performing the work associated with
the relocation of their utility facilities unless other agreements are made with MCDOT. It is also
assumed that MWD Irrigation relocations will be designed by MWD and performed by MWD’s
contractor. The Consultant will coordinate including specifications and bid items into the project under
their respective scope sections as needed. The Utility Coordinator will provide monthly updates to the
Project Manager and Consultant regarding MWD’s design schedule, relocation schedule, and
relocation estimate.
500.3.7 Utility Relocations and Upgrades - Public
It is assumed that public water and sewer lines that require relocation will be designed by the
Consultant. This service will be provided by EPS Group and is fully outlined within their attached
scope of work. Horizontal and vertical alignments are required for all proposed utilities. Coordination

Design services for upgrading existing utilities is not included within this scope of services but typical
manhole and valve adjustments on existing utility lines are anticipated and included.
500.3.8 Utility Agreements
MCDOT will review and develop all private utility agreements necessary for this project and review of
the agreements by the Consultant is not necessary.
500.3.9 Establishing Utility Service Connection
The Consultant shall support MCDOT in their efforts to establish service connections prior to
construction. Utility service connections are required to facilitate operation of lighting, signals,
Intelligent Transportation Systems, irrigation controllers, etc.
The Consultant shall provide the following information:
▪
Number of electrical (or other) services required;
▪
The required voltage/volume/pressure of each service;
▪
The load breakdown for each service;
The Consultant shall include the name and phone number of the utility contact person responsible for
arranging the new service in the Special Provisions with instruction to the Utility Coordinator to
contact the utility for scheduling the work when service is desired.
The Consultant shall place the service address on the plans adjacent to the appropriate load center
and/or meter.
The Consultant shall show the location of the utility service source so the contractor will know where
to excavate to/from.

500.4 Utility Plans
The Consultant shall be responsible for identifying and providing design and relocation plans for public
utilities within the proposed right-of-way as needed. The Consultant will also provide MCDOT a pre-
60% set of plans formatted for private utility companies to assess their conflicts and develop their own
relocation plans.
500.4.1 Utility Plan Sheets
The Consultant, in coordination with the Utility Coordinator, shall produce a Pre-60% utility specific
plan set based on the roadway plan sheets for the purpose of receiving comprehensive and competent
utility conflict reviews from the utility providers. To facilitate the best possible utility reviews, the Pre-
60% shall have the following:
•
All existing utility linework in the PDF design must be shown in their respective facility colors
•
All of the pothole information must be included in the plan, profile and cross-sections with
pertinent associated pothole metadata
•
All utility CAD linework must be drafted using correct MCDOT level naming conventions. (ie.
"BU SanSewerLine)
The Consultant shall include preliminary public utility relocation plans no later than the 60%
submittal. The public utility relocation plan sheets will identify all utilities prominently, as well as each
potential conflict point. The Utility Plan Sheets will contain the following information:

Existing utilities;
▪
Proposed utility relocations (for information only);
▪
Identification of the utility type and ownership;
▪
Proposed improvements;
▪
Potential conflict points and pothole locations;
▪
The utility identified by the pothole;
▪
Northing, Easting, Station, and Offset of each pothole location;

Elevation of all utilities located in the pothole;
▪
Identification of the party responsible for the relocation; and
▪
A legend key for any symbols used to depict utilities as needed.
Public utility plan sheets will be updated throughout the design process. As such, not all of the above
information will be included on all sheets at all times throughout the design process.
The Consultant shall include all final private utility relocation designs on the 95% submittal. The
Consultant shall include the private utility as-builts on the 100% submittal.
500.5 Utility Special Provisions
The Consultant shall prepare Utility Special Provisions for inclusion in the bid documents. The Utility
Special Provisions will include the following:

A listing of all utility providers in the area, as well as a contact person and their associated
contact information;
▪
A statement describing the status of the utility, including any relocations that have
happened or will happen;
▪
A description of the work to be performed by the utility providers prior to and during

800.1
Technical Memoranda and Reports
800.1.1
Traffic Memorandum (Addendum)
The Consultant shall prepare an addendum to the traffic study in accordance with MCDOT traffic
requirements. The traffic addendum study limits consist of Peoria Avenue, from west of Citrus Road to
SR 303L, including the north/south ramp termini. In January 2023, MCDOT completed a traffic study
that included much of the same study limits as described above – as such, this addendum will confirm
the findings and recommendations of the January 2023 traffic study, with the future traffic volumes
updated to the design year of 2050 and to account for planned developments not included in the January
2023 traffic study. Based on discussions with MCDOT, we understand the following:
•
The addendum will evaluate one traffic conditions: year 2050.
•
The addendum will account for all proposed developments within the study limits.
•
The MAG 2050 Build traffic models will be utilized to assist with the development of 2050
Build traffic volumes.
•
The addendum will not include a crash analysis or an alternatives analysis but rather will refer
the reader to the January 2023 traffic study for this information.
•
The recommended intersection geometry in the January 2023 traffic study will be confirmed
and refined as part of the addendum, but no large-scale reconfigurations (such as using a
roundabout instead of a traffic signal) will occur.
800.1.1.1
Traffic Data Collection
Field Data Services (FDS) will collect 24-hour bi-directional classification counts on a typical weekday
at the following locations along Peoria Avenue:
•
Approximately 500 feet west of Citrus Road
•
Approximately 500 feet west of 175th Avenue
•
Approximately 500 feet west of Cotton Lane
•
Approximately 500 feet west of SR 303L Northbound On/Off Ramp Termini
FDS will collect 6am-9am and 2pm-6pm turning movement counts (TMCs), separated by trucks, non-
trucks, pedestrians, and bicyclists, on a typical weekday at the following locations along Peoria Avenue:

Citrus Road
•
175th Avenue
•
Cotton Lane
•
169th Avenue
•
SR 303L Northbound On/Off Ramp Termini
•
SR 303L Southbound On/Off Ramp Termini
In addition, TMCs will similarly be collected for the same time periods at Olive Avenue/Citrus Road
and at Olive Avenue/Cotton Lane for comparison purposes with the traffic count data in the January
2023 traffic study, but these two intersections will not be included in the 2050 volume development or
the capacity analysis.

800.1.1.2
Traffic Analysis
The Consultant will coordinate with the Project Manager to obtain MAG year 2050 Build models.
Using the existing traffic volumes, the MAG model obtained, planned development information, and
2040 volumes developed in the January 2023 traffic study, the Consultant will establish year 2050
Build traffic volumes for each of the intersections within the project limits.
The Consultant will summarize the traffic volume development in an email that documents the data
collected, the process to develop 2050 volumes, and the existing and 2050 volumes. MCDOT will
approve the 2050 traffic volumes prior to Consultant conducting further traffic analysis.
The Consultant will develop 2050 SYNCHRO Build AM and PM models. The approved 2050 traffic
volumes will be utilized in the SYNCHRO models and capacity analysis will be conducted. The 2050
baseline geometry will be the recommended geometry in the January 2023 traffic study. If level of
service (LOS) D or better cannot be provided at the intersection and approach levels with the baseline
geometry, refinements will be made to the geometry such that LOS D or better can be provided with the
2050 Build volumes.
The Consultant will define the recommended lane configuration, traffic control requirements, and
storage length requirements for the 2050 Build condition. The recommendations will be summarized in
the traffic addendum.
800.1.1.3
Traffic Study Documentation
The Consultant will prepare a draft and final traffic study addendum. The addendum will document the
traffic data collected, process, analysis, results and provide recommendations for improvements. The
draft traffic addendum will be submitted to the project team for review and comment. Based on
comments received, the traffic memorandum will be finalized and signed/sealed by an engineer
registered in Arizona.
800.1.1.4
Traffic Study Coordination and Meetings
The Consultant will coordinate with the project stakeholders and attend up to three meetings in
association with the traffic study. They are defined as:
•
Meeting One – Proposed Traffic Volumes
•
Meeting Two – Traffic Analysis Results and Preliminary Recommendations
•
Meeting Three – Draft Traffic Addendum Comment Resolution
The estimated effort associated with meeting attendance, preparation, and note compilation time is
provided in the attached fee estimate.
800.1.2
Drainage Memorandum/Report
A Drainage Report was prepared with the Scoping Design Report. The Consultant’s subconsultant
EPS Group will review the existing report to identify errors and fatal flaws to discuss with MCDOT.
EPS Group will update the drainage report for any changes from the 30% to sealed including
improvements proposed/constructed by adjacent developers. The drainage report will reflect everything
on the plans. EPS Group will provide these services to evaluate, and document affects to on, and offsite
storm water flows as detailed in their attached scope of services. The Consultant will coordinate and
review the report prior to submittal to MCDOT. The report shall be submitted with the 60%, 95% and
100% submittals as needed based on updates made between submittals.

SECTION 900 PLANS, SPECIFICATIONS AND ESTIMATE
900.1 Plans
The plans assumed for this project are provided in the attached fee estimate. The plans shall be
developed following the guidelines established in the Roadway Development Manual and associated
checklists as applicable to the estimated sheets proposed within the fee estimate of this scope of
services. The Consultant shall prepare construction notes that are clearly worded, use symbols that are
consistent throughout the plan sheets, and cross reference details and other items appearing on more
than one sheet. Unless otherwise directed by the Project Manager, the Consultant will use a scale of
1” = 20’ which will result in good plan clarity. Milestone submittals shall include Pre-60% for utility
review, 60%, 95%, 100% and Sealed submittals.
Drawing Sheet size shall be 22” by 34”
The plan base map sheets are to show all topographic features and elevations within 25 feet beyond the
anticipated new right of way. The plan base map sheets are to include topographical files produced by
aerial survey when aerial survey is used.
The Consultant shall use plan symbols shown in the MAG Standard Details, the MCDOT Supplement
to the MAG Standard Details, and as shown on the MCDOT General Notes sheet unless otherwise
noted.
No plan sheets are anticipated within ADOT jurisdiction.
900.2 Specifications
The Consultant shall prepare Special Provisions for items, details, and procedures not adequately
covered by MAG and MCDOT's Supplement to MAG. The Consultant shall conform to MCDOT’s
“A Guide for the Preparation of Contract Specifications”.
The Consultant shall use MCDOT’s Guideline Special Provisions (GSP) as the primary resource when
creating project Special Provisions. Each guideline specification in the GSP contains instructions to
identify its intended use. Unusual requirements necessary for obtaining permits shall be included.
Special Provisions shall be submitted at the 60%, 95%, 100% and sealed stages for project reviews.
City of Surprise specifications necessary for construction will be referenced in the document but not
included i.e. combined into the document to ensure clarity.
Final Special Provisions shall be sealed by the Engineer in responsible charge. The Consultant shall be
responsible for incorporating any specifications provided by MCDOT technical sections. Special
Provisions shall be submitted electronically (Microsoft Word) along with hard copies as requested by
the Project Manager.
900.3 Estimates
The Consultant shall prepare estimates (cost estimates) in MCDOT’s standard format. The
Consultant shall notify the Project Manager, in writing, if there is any reason to believe the project
cannot be constructed within the allocated budget.
900.3.1 Quantities
The Consultant shall be responsible for compiling a list of all quantities that will be required during
construction of the project. The quantities shall be compiled in a list and shall be labeled using standard
MCDOT item numbers. This list of quantities shall be updated for each submittal.

900.3.2 Cost Estimate
The Consultant shall update the quantities list and cost estimate for each final design submittal starting
with the 60% submittal. The Consultant shall upload the estimate into the MCDOT Cost Estimating
Tool at each submittal starting with the 60% submittal.
900.3.3 Bid Schedule
Beginning with the 60% submittal, the Consultant shall provide a bid schedule at each submittal. The
bid schedule shall be in the same format as the cost estimate and include the full list of quantities
included in the estimate but shall have no estimate costs listed for any quantity item. Any changes made
to the quantities in the cost estimate must be reflected in the quantities in the bid schedule.
900.4 Detailed Design Assumptions
900.4.1 Roadway
•
Private property features including but not limited to walls, fences, mailboxes, landscaping,
hardscape are assumed to be handled via cash to cure through the right of way process. No
design for relocation of these features is anticipated or included within this scope of services.
•
The design as shown in the SDR has been agreed to and approved. No changes are anticipated
as part of the final design process or included within this scope of services.
•
All improvements north and east of the Cotton Lane intersection will be designed and
constructed by developers.
•
All improvements except for the south leg at the Cotton Lane intersection shall be designed to
City of Surprise standards. The south leg will be designed to MCDOT standards for all
disciplines.
900.4.2 Traffic
Signing and Pavement Markings
•
Signing plans shall be prepared by the Consultant in accordance with City of Surprise sign
standards, and the latest edition of the USDOT/FHWA Manual on Uniform Traffic Control
Devices (MUTCD). Existing signing shall be shown for a minimum of 1000 feet beyond
pavement matching locations, together with pertinent dimensions being shown.
•
The Consultant will review the 30% design and provide any comments to MCDOT
•
The Consultant will conduct a site visit to document and inventory existing signing and
marking conditions under Section 100.7.
o Existing signing will be documented through video along Peoria Avenue within the
project limits.
•
Signing and pavement marking plans will be submitted with each submittal beginning with the

Sequence of Construction and Temporary Traffic Control Plans

Starting with the pre-60% submittal, the Consultant will review and update the 100-scale SDR
Sequence of Construction plans for up to two phases of construction for the area west of Cotton
Lane and three phases of construction for the Cotton Lane intersection.
•
Starting with the 60% submittal, the Consultant will develop a Maintenance of Traffic (MOT)
design and plans.
o A draft and final pdf roll plot will be submitted to MCDOT and the City of Surprise
prior to the 60% submittal to review and provide comments. This roll plot will have
sufficient information to explain where the intended work zone is, lane configuration,
necessary traffic protection (channelizing devices or barrier), additional temporary
features needed, and temporary pavement locations.
o The Consultant will develop a rough construction schedule (total months per phase
duration).
o The Consultant will develop 40-Scale plan sheets to allow for sufficient detail to be
shown including callouts for all elements necessary to construct (Temporary striping,
temporary barrier, temporary signs, temporary pavement, completed permanent
features, etc.). The MOT plan sheets will include detailed phasing concepts at
driveways, business access, and cross streets. It is assumed there will be 3 phases of
construction for the intersection at Cotton Lane and 2 phases west of Cotton lane. These
sheets will be submitted to MCDOT and the City of Surprise to review and provide
comments to be incorporated prior to advertisement.
o The Consultant will develop a final cost estimate for temporary construction at this
level.
o Major design changes past the 60% submittal are not anticipated. A major design
change will be classified as large shifts/reconfiguration of construction phases and work
zones that were not discussed as changes to the draft roll plot. The Consultant will
notify the Project Manager prior to proceeding with any major traffic control design
change.
o The Consultant shall prepare Maintenance of Traffic special provisions that define
special construction constraints, if any, to be imposed on the construction Contractor.
•
The Consultant will coordinate with MCDOT, Surprise and Glendale regarding temporary
traffic control requirements and event requirements. The Consultant will prepare for and
attend technical group meetings under Section 100.5.
Traffic Signals
•
The Consultant will conduct a field investigation of the existing conditions and inventory
existing traffic signal equipment under Section 100.7.

The Consultant will prepare design and construction documents for new traffic signals and
underground infrastructure for future traffic signals within the project limits in conformance

Lane within the project limits up to the intersection at Peoria/Cotton and through the
Intersection at Peoria/Citrus and south on Cotton Lane to the limits of the roadway
improvements. The Consultant will prepare photometric plans per the City of Surprise
Engineering development standards-2021 edition. The Consultant will prepare street light
layout plans in accordance with the City of Surprise Street Light Design Guidelines, revised
2022. The Consultant will design the section of roadway improvements within the project limit
south of the Peoria/Cotton intersection to follow MCDOT guidelines. The photometric plans
and street light plans will be (1” =40’) and consist of the following:
o The Consultant’s street light pole locations will be based on the approved photometric
design.
o Street lighting plans will be prepared for the 60%, 95%, 100%, and sealed plan stage using
MCDOT’s sheet format.

The Consultant will perform a site visit and document visible equipment and conditions related

Utility Coordinator if any utility relocation design needs right of way, as that will impact the project
schedule.
1000.1.1 Coordination with MCRED
The Consultant shall coordinate and meet with MCRED to determine the appropriate Right-of-Way
and easement requirements for the project. The Consultant shall be responsible for determining the area
and right needed, updating a right-of-way tracking spreadsheet, preparing the meeting agenda and
exhibits, attending and facilitating the meetings, and submitting notes of the meeting to MCDOT.
During R/W acquisition the Consultant will meet with MCRED as needed. It is assumed that
acquisition process is 13 months in duration.
1000.1.2 Determine Right-of-Way and Easements
The Consultant shall determine the requirements for new Right-of-Way and easements, including, but
not limited to, new roadway Right-of-Way, slope easements, drainage easements, temporary
construction easements, and access control Right-of-Way.
1000.1.3 Submit Right-of-Way and Easement Requirements
The Consultant shall submit to MCRED, in writing, the final Right-of-Way requirements as part of the
30% design verification. No revisions or additions to the Right-of-Way requirements will be allowed
after the 30% design verification without the approval of the Project Manager. This submittal shall
include a tracking spreadsheet showing the rights to be acquired from each property as well as note any
private property impacts including private utility connections to each parcel. The Consultant will
review, prepare, maintain, and update the Parcel Tracking spreadsheet to summarize the right-of-way
information and regularly share the spreadsheet with MCRED throughout the design process. The
Consultant will incorporate right-of-way into the final design plans, specifications, and cost estimate.

Appraisals and Acquisitions
MCRED will be responsible for creating legal descriptions/exhibits and appraising the Right-of-Way
and easement areas. MCRED will be responsible for negotiating and acquiring the Right-of-Way and
easement areas. The Consultant shall provide high level supporting documents and exhibits to help
facilitate/communicate right-of-way acquisition as requested by MCDOT.

BIDDING PHASE
1300.1
Technical Assistance to Prepare Advertisement, Addenda
The Consultant shall provide technical assistance and respond to design questions during the
advertisement period of the project. The Consultant shall prepare addenda that may be required to
clarify or correct the plans or Special Provisions. This will include providing personnel and equipment
to update the project documents, which may be required due to changes in site conditions between the
completion of the plans and the bidding of the project. The Consultant shall also prepare additional
documents for alternate bids for the work or a portion thereof.
1300.2
Pre-Bid and Construction Hand Off Meetings
The Consultant shall attend a pre-bid conference for all contractors interested in bidding on the project
and shall be prepared to answer contractor’s questions.
1300.3
Bid Opening
After bid opening, the Consultant shall assist MCDOT in analyzing bids when requested to do so. The
Consultant shall also assist in evaluating bid protests as requested by the Project Manager.

POST DESIGN
1400.1
Pre-construction Conference
Once the contractor has been selected, the Consultant shall attend a conference to explain the specific
characteristics of the project, review project safety, provide construction expectations and to field any
questions from the contractor.

Requests for Information (RFI’s)
Requests for Information
The Consultant will provide technical assistance by explaining design intent and specifications to the
Contractor in response to Requests for Information (RFI’s). The estimated number of requests for
information is shown in the attached fee estimate.
Shop Drawings
The Consultant shall respond to the contractor’s shop drawings which require review relative to the
project’s construction bid documents.
Substitute Materials
The Consultant shall determine the acceptability of substitute materials and equipment proposed.
Plan Revisions
If field conditions dictate the need for the Contractor to deviate from the proposed design, the Consultant will
update the plan sheets. The effort and number of plan sheets to be updated are as shown in the attached fee
estimate.

Project Administration and Close-Out
This task includes the administrative and coordination tasks required for coordinating the work of the team
members with MCDOT staff and other project stakeholders. This task coordinates and administers the day-
to-day operations of the project, including documenting all post design requests/communications, organizing
and filing project data and communication files, preparation of regular monthly progress reports,
performance of monthly budget updates and schedule monitoring. This task also includes the management of
sub-consultants, interfacing and communication necessary to keep stakeholders fully and accurately
informed and full close-out of the project documents.

SCOPE OF SERVICES – PROJECT SPECIFIC
Project Overview
Project Location
The project is located along Peoria Avenue between Citrus Road and Cotton Lane within unincorporated
Maricopa County, the City of Surprise, and the City of Glendale.
Project Background
A Scoping and Design Report (SDR) was submitted June 23, 2023. The roadway section and the
Peoria/Cotton intersection were designed during the scoping phase with agreement from City of Surprise,
MCDOT, City of Glendale, and Maricopa Water District (MWD). The project will construct roadway
improvements on Peoria Avenue between Citrus Road and Cotton Lane. The project includes
underground infrastructure for future traffic signals at Peoria/Citrus and Peoria/175th, and traffic
signalization at Peoria/Cotton.
As land development is occurring in this area, project stakeholders will continue to coordinate with
developers. The agreed upon design will assist agency development reviewers in providing consistent
direction to land developers.
Project Purpose
The purpose of this roadway project is to address future roadway capacity as land development occurs
along the corridor, access management, and roadway drainage connecting to the development-
constructed City of Surprise and ADOT approved drainage channel on the north side of Peoria which
will connect to SR 303L. Complete the Final Design Phase per the Project Development Manual
(PDM) by addressing the purpose of the project while continuing to coordinate with City of Surprise,
MWD, County Residents, City of Glendale, and Development. RDM (Roadway Design Manual) and
City of Surprise Design Standards will be used. MAG, MCDOT, and City of Surprise Specifications
will be used.
Length of Services
The estimated contract time is 38 months for design from notice to proceed and an additional 26
months for bidding/post design services.
The assumed effort for all tasks shown within the attached fee estimate. As the full effort for this task is
unknown, any efforts necessary above and beyond the estimated effort will be considered additional
services. If additional services for this task are necessary, the Consultant will notify the Project
Manager in advance of continuing services above and beyond the estimated effort. If a task is not
specifically listed within the attached fee estimate it is excluded and not included within this scope of
services.

Technical Group Meetings (ADOT, MCDOT, Glendale, Surprise, etc.) The Consultant will
attend meetings with technical teams as estimated in the attached fee estimate.

Field Walk with Project Team
The Project Team will visit the field site to acquaint key personnel with the details and features of the
project and to gather input on issues, concerns and opportunities. The estimated effort associated with
meeting attendance and preparation time is provided in the attached fee estimate.

Project Administration
This task includes the administrative and coordination tasks required for coordinating the work of the
team members with MCDOT staff and other project stakeholders. This task coordinates and administers
the day-to-day operations of the project, including preparing the internal production work plan, organizing
and filing project data and communication files, responding to project correspondence including emails,
preparation of regular monthly progress reports, performance of monthly budget updates, and schedule
monitoring.
The Consultant shall submit invoices for progress payments using the MCDOT payment request form.

Stakeholder Meetings
The Consultant will attend stakeholder coordination meetings with the City of Surprise (1), ADOT (1),
and EPCOR (2).

UTILITIES AND RAILROAD
The MCDOT Utilities coordinator will request and distribute utility base maps (as-builts) for each
location. MCDOT will use an on-call contractor for utility designation and/or potholing as deem necessary
for alternative determination. The MCDOT utility potholing contractor will provide the utility base file in
CADD (dgn format), for use by the Consultant. MCDOT utilities will provide utility review for each
project submittal.

Utility and Railroad Conflict Identification
The Consultant will try to accommodate design recommendations to avoid and/or mitigate any utility
relocation. If during the development of the plans, the need for relocation is identified, prior rights
information will be requested for the specific utilities at the subject location by the MCDOT Utility
Coordinator. MCDOT will use an on-call contractor for utility potholing at specific locations, if
determined necessary.
The Consultant will incorporate, update and review the Utility CADD files as necessary and request
additional mapping, as needed, and will work with the MCDOT Utility Coordinator to set up any
necessary meetings with the utility Companies.

The MCDOT Utility Coordinator will work with the Consultant to:
• Send the design documents for conflict review to all the utilities within the scope of the project.
• Evaluate each design alternative for potential conflict with any utilities, including a check of the
vertical clearances for each utility.
• Coordinate with roadway and traffic staff to prepare the layout exhibit for the pothole request.
• Provide pothole layout to EPB (Environmental Program Branch) for environmental clearance
• Provide the vertical clearances between the utilities and finished grade at the area of conflicts within
the report.
• Will have in house consultant prepare preliminary private irrigation relocation design for the project
and will provide the design to the road designer to place on the paving plan sheets.
MCDOT shall provide the prior rights documentation submitted by the utility companies to the Project
Team. MCDOT shall review and confirm this documentation for prior rights with MCRED. The
Consultant shall avoid discussing opinions of prior rights validity with the utility company until the
review of prior rights status has been completed and confirmed by MCRED.
500.5
Pothole Data on Plans, Profiles and Cross-Sections
Consultant will incorporate provided pothole data on proposed pipe culvert (10) and waterline relocation
(15) profiles. The plans will include elevations for all existing at grade utility facilities, together with
associated pipe diameters, pipe materials, and pipe direction. Utility crossings shall be shown at the
location and elevation as obtained from as-built drawings, interpolated from actual survey data, or as
determined from potholes. The Consultant will indicate the data source by the notation “Record Drawing”
or “Pothole”, on the plans.

Proposed Utility Data on Plans, Profiles and Cross-Sections
Consultant will include proposed waterline relocation information on the culvert (10) cross-sections and
the new culvert information on the proposed waterline relocation profiles (15)

Utility Relocation Cost Estimates and Schedule
The Consultant will develop cost estimates related to the waterline relocation plans in Section 500.11.
500.10
Proposed Utility Data on Plans, Profiles and Cross-Sections
Horizontal and vertical alignments are required for all proposed utilities. The horizontal location and
vertical profile of each utility will be shown on the roadway plans. This includes underground and above
ground utilities. Roadway profiles cross sections (where known data is available), showing utility
conflicts, will also be included. All utility elevations shall be shown in the same datum as the roadway
plans. The utility coordinator will work with the Consultant to indicate ownership of each utility on the
construction plans.
500.11 Utility Relocation Plans
The Consultant will develop utility relocation plans for any waterline or fire hydrant relocations.
Submittal will be made to the Maricopa County Environmental Services Department (MCESD) for review
and approval.
It is anticipated that there will be up to thirteen (13) required vertical realignments of existing EPCOR
waterlines.
Utility plans shall conform to the following requirements.

The pipe wall thickness shall be shown in the profile and section views.

The Consultant shall show the top of valve box elevations and top of operating nut elevations
for all water valves on the plan view with a leader pointing to all water valves.
•
Existing utility crossings shall be shown at the location and elevation as obtained from As-
Builts, interpolated from actual survey data, or as determined from pothole explorations. The
Consultant shall indicate on the plans the data source by the notation "As-Built" or "pothole".
All elevations shall be converted to and shown using the roadway project datum.
The Consultant will help prepare an Approval to Construct (ATC) application in support of the required
waterline relocations. This will include preparation of a brief letter describing the proposed relocations
and filling out an ATC form. This fee proposal does not include a budget to create or modify water models
for the existing water distribution system. It is assumed any requests to provide water model information
as backup to an ATC application will be the responsibility of the utility company to provide. A
reimbursable allowance to cover ATC application fees has been included with this proposal.

Utility Special Provisions
The Consultant shall prepare Special Provisions related to the waterline relocation design as described
in 1100.

Utility Relocation Cost Estimates
The Consultant will develop cost estimates related to the waterline relocation plans in Section 1100.
800 TECHNICAL MEMORANDA AND REPORTS
Drainage Memorandum/Report scope of services are as described below.
800.1 Drainage Memorandum/Report
Preliminary, final, final revised (as needed) and sealed drainage memoranda will be prepared for the
proposed improvements. The Consultant will prepare a drainage report to document the drainage design
for the project. The drainage design will meet City of Surprise design standards and the report outline will
follow MCDOT standards. Exhibits that will be prepared for the drainage report include:

Existing Conditions Map
•
Proposed Onsite Drainage Sheets
The Consultant will compile all comments received into a summary of comments for and address
comments prior to the final submittal.
The drainage report shall contain an executive summary, existing conditions narrative, drainage area map
identifying drainage sub areas. and calculations for roadway runoff (rational method), flow spread, and
catch/basin culvert capacities.
Off-Site Drainage Design
This fee proposal covers a review of the approved Final Drainage Technical Memo for the Peoria Ave
Citrus Rd to SR303L Scoping Design Report, and the drainage design reports for private developments
along Peoria Avenue.
Extension of the offsite regional drainage channel from Cotton Ln to SR 303 is assumed to be handled by
ongoing commercial development projects, with private design, City approval, and private construction.
If design of the regional drainage becomes necessary with this roadway improvement project, it may be
added to the scope of services via a contract modification.

On-Site
This fee proposal covers the design and documentation of the proposed on-site drainage system from
Citrus Rd to Cotton Ln and its connection to the existing offsite regional drainage channel north of Peoria
Avenue. The drainage improvements east of Cotton Ln are assumed to be the responsibility of ongoing
private development projects. The Consultant will stay informed of ongoing development drainage
impacts to TT0576 drainage design.
The following is a list of assumptions for the drainage work for this project:
•
Existing Drainage Conditions: The Consultant shall review available drainage reports and
models. The existing conditions map will be an exhibit noting the existing drainage features.
•
Flood Zone: Flood Zone Maps will be annotated with the project limits.
•
Design Criteria: All design criteria used will be summarized in a table.
•
Design Flows: The Consultant shall delineate on-site roadway sub-basins, calculate peak flows
(rational method) and flow spread (Manning’s equation).
•
Proposed Drainage Concept: Drainage concept maps shall be created for the proposed
improvements at 20-scale that include drainage sub area boundaries and names, flow directions,
and existing/proposed drainage features.

1100 PLANS, SPECIFICATIONS AND ESTIMATE
The Consultant shall submit to MCDOT all engineering calculations. All engineering judgments and
assumptions made during the design, other than standard engineering, shall be documented and submitted.
The Consultant shall submit calculation sheets used to determine estimated quantities.
Calculations can be either hand calculations or computer-generated calculations. All hand calculations
and computer-generated calculations shall be sealed prior to submittal to MCDOT.
1100.1
Pre-60% Plans
The Consultant will prepare drainage design sheets for the pre-60% plan submittal. It is assumed there
will be up to eleven (11) pipe plan and profile sheets for the drainage improvements, and up to two (2)
additional catch basin/scupper plan and profile sheets (assume two scuppers per sheet). Initial waterline
relocation plan sheets (13) will be provided with the Pre-60% submittal.

60% Plans
The Consultant will update drainage design sheets and waterline relocation sheets referenced in section
1100.1 for the 60% plan submittal.
The Consultant shall prepare a cost estimate for the proposed drainage improvements and waterline
relocations referencing MCDOT bid-item numbers. The data will be summarized in a spreadsheet and
entered in MCDOT’s online cost estimating application for the project.
The Consultant shall prepare Draft Special Provisions for items, details, and procedures not adequately
covered by MAG and MCDOT's Supplement to MAG related to drainage and waterline relocation items
being designed by the Consultant. The Consultant shall use MCDOT’s Guideline Special Provisions
(GSP) as the primary resource when creating project Special Provisions. Each guideline specification in
the GSP contains instructions to identify its intended use. Unusual requirements necessary for obtaining

permits shall be included. ADOT, Surprise, and Glendale specifications necessary for construction will
be referenced in the document but not included i.e. combined into the document to ensure clarity.

95% Plans
The 95% plans assumed for this project are provided in the attached fee estimate.
The Consultant shall update the cost estimate spreadsheet for the proposed drainage improvements and
waterline relocations referencing MCDOT bid-item numbers. The data will also be in MCDOT’s online
cost estimating application.
The Consultant shall prepare Final Special Provisions for items, details, and procedures not adequately
covered by MAG and MCDOT's Supplement to MAG related to drainage and waterline relocation items
being designed by the Consultant.

100% Plans
The 100% plans assumed for this project are provided in the attached fee estimate.
The Consultant shall make any needed updates to the cost estimate (spreadsheet and online cost

Sealed Plans
The sealed plans assumed for this project are provided in the attached fee estimate.
Final Special Provisions shall be sealed by the Engineer in responsible charge. The Consultant shall be
responsible for incorporating any specifications provided by MCDOT technical sections. Special
Provisions shall be submitted electronically (Microsoft Word) along with hard copies as requested by the
Project Manager.

Constructability Review
The Consultant will coordinate with the County’s selected construction manager during their
constructability review. The Consultant will answer questions and coordinate plans, specifications and
estimate updates as needed.

How to contact MCDOT (Department of Transportation):
You may contact us to let us know of your changes as to how we may contact you electronically,
to request paper copies of certain information from us, and to withdraw your prior consent to
receive notices and disclosures electronically as follows:
To contact us by email send messages to: lesley.roman@maricopa.gov
To advise MCDOT (Department of Transportation) of your new email address
To let us know of a change in your email address where we should send notices and disclosures
electronically to you, you must send an email message to us at lesley.roman@maricopa.gov and
in the body of such request you must state: your previous email address, your new email
address. We do not require any other information from you to change your email address.
If you created a DocuSign account, you may update it with your new email address through your
account preferences.
To request paper copies from MCDOT (Department of Transportation)
To request delivery from us of paper copies of the notices and disclosures previously provided
by us to you electronically, you must send us an email to lesley.roman@maricopa.gov and in the
body of such request you must state your email address, full name, mailing address, and
telephone number. We will bill you for any fees at that time, if any.
To withdraw your consent with MCDOT (Department of Transportation)
To inform us that you no longer wish to receive future notices and disclosures in electronic
format you may:
i. decline to sign a document from within your signing session, and on the subsequent page,
select the check-box indicating you wish to withdraw your consent, or you may;
ii. send us an email to lesley.roman@maricopa.gov and in the body of such request you must
state your email, full name, mailing address, and telephone number. We do not need any other
information from you to withdraw consent.. The consequences of your withdrawing consent for
online documents will be that transactions may take a longer time to process..
Required hardware and software
The minimum system requirements for using the DocuSign system may change over time. The

Acknowledging your access and consent to receive and sign documents electronically
To confirm to us that you can access this information electronically, which will be similar to
other electronic notices and disclosures that we will provide to you, please confirm that you have
read this ERSD, and (i) that you are able to print on paper or electronically save this ERSD for
your future reference and access; or (ii) that you are able to email this ERSD to an email address
where you will be able to print on paper or save it for your future reference and access. Further,
if you consent to receiving notices and disclosures exclusively in electronic format as described
herein, then select the check-box next to ‘I agree to use electronic records and signatures’ before
clicking ‘CONTINUE’ within the DocuSign system.
By selecting the check-box next to ‘I agree to use electronic records and signatures’, you confirm
that:
You can access and read this Electronic Record and Signature Disclosure; and
You can print on paper this Electronic Record and Signature Disclosure, or save or send
this Electronic Record and Disclosure to a location where you can print it, for future
reference and access; and
Until or unless you notify MCDOT (Department of Transportation) as described above,
you consent to receive exclusively through electronic means all notices, disclosures,
authorizations, acknowledgements, and other documents that are required to be provided
or made available to you by MCDOT (Department of Transportation) during the course
of your relationship with MCDOT (Department of Transportation).
