To Establish Change Order 05, Bridge Deck Survey Error Re-Work 
 
Description:
On January 10, 2024, Tristar’s Lead Inspector identified an apparent error 
in the survey layout for the stay-in-place deck form and bridge deck 
overhang elevations.  Upon discovering this error, Tristar directed the 
contractor to immediately discontinue installation of additional formwork.  
At that time, stay-in-place deck forms had been installed in Span 9, with 
deck overhang forms installed in Spans 9 through 7.  Upon confirmation of 
this error, Tristar further directed the contractor to begin removing the 
previously installed stay-in-place deck forms in preparation for re-
installation based upon corrected survey layout data, along with 
adjustment of the deck overhang forms. 
 
Corrected survey layout was subsequently performed, and corrective work 
was completed on January 30, 2024.  Given time and schedule constraints, 
it was agreed that corrective work would be documented daily in 
accordance with Subsection 109.5 of the MAG Standard Specifications, 
including all labor, equipment, and materials.  Force Account detail sheets 
were prepared and signed by the inspector and foreman responsible for the 
work.  This Change Order will compensate the contractor for all costs 
associated with corrective work resulting from this survey error. 
 
Delays in controlling items of work were evaluated with the February 2024 
schedule update to determine an appropriate adjustment to the interim 
completion date specified in Change Order #3.  This evaluation documented 
a delay of 14 calendar days.  Therefore, this Change Order will amend the 
interim completion date to require opening the new bridge to one lane of 
traffic in each direction no later than June 28, 2024.  Liquidated damages of 
$3,600 per day specified in Change Order #3 remain in full force and effect 
beginning after the amended interim completion date specified above.

From time to time, MCDOT (Department of Transportation) (we, us or Company) may be 
required by law to provide to you certain written notices or disclosures. Described below are the

Getting paper copies
