ORDINANCE NO. 1246
AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF WICKENBURG, ARIZONA, AMENDING THE TOWN OF
WICKENBURG 
CODE 
CHAPTER 
8 
BUILDING, 
ARTICLE 
8-1
BUILDING CODE, BY AMENDING SECTION 8-1-11 AMENDMENTS TO
INTERNATIONAL BUILDING CODE, RELATED TO DWELLING-
GARAGE FIRE SEPARATION; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR PENALTIES.
WHEREAS, local governments may regulate property maintenance, environmental
nuisances, and conditions of buildings and real property pursuant to the Town’s police powers and
in accordance with Arizona Revised Statutes, including A.R.S. §§ 9-240 and 9-276;
WHEREAS, the Town deems it necessary to adopt comprehensive regulations regarding
the maintenance of property to protect the health, safety, and welfare of Town residents;
WHEREAS, the Town previously adopted the International Residential Code, 2018
edition, as adopted, as published by the International Code Council;
WHEREAS, the Town now seeks to amend the International Residential Code, 2018
edition to promote public fire safety;
NOW THEREFORE, BE IT ORDAINED by the Mayor and Common Council of the
Town of Wickenburg, Arizona as follows:
Section I.  In General.
The Code of Wickenburg, Arizona, Chapter 8, Building, Article 8-1 Building Code,
Section 8-1-11 Amendments to International Building Code, by adding R302.6 Dwelling-Garage
Fire Separation to subsection 8-1-11(2), to read as follows (additions in ALL CAPS):
SECTION 8-1-11
Amendments to International Building Code.
The International Buildings Codes shall be amended as provided in paragraphs 1 through
10 herein.

2. The International Residential Code, 2018 edition, is amended as follows (deletions in
strikethrough; additions in underline):

Chapter 3, “Building Planning,” is hereby amended to read as follows:

THE GARAGE SHALL BE SEPARATED AS REQUIRED BY TABLE 302.6.
OPENINGS IN GARAGE WALLS SHALL COMPLY WITH SEECTION R302.5.
ATTACHMENT OF GYPSUM BOARD SHALL COMPLY WITH TABLE R702.3.5.
THE WALL SEPARATION PROVISIONS OF TABLE R302.6 SHALL NOT APPLY
TO GARAGE WALLS THAT ARE PERPENDICULAR TO THE ADJACENT
DWELLING UNIT WALL.

Section II.  Repeal of Conflicting Ordinance.
All ordinances and parts of ordinances in conflict with the provisions of this ordinance or
any part of the code adopted herein by reference are hereby repealed.
Section III.  Providing for Severability.
If any section, subsection, sentence, clause, phrase or portion of this Ordinance or any
part of the Code adopted herein by reference, is for any reason held to be invalid or
unconstitutional by the decision of any court of competent jurisdiction, such decision shall not
affect the validity of the remaining portions thereof.

Section IV.
Providing for Penalties.
Unless otherwise specified, any person found guilty of violating any provision of this
Ordinance shall be guilty of a class one misdemeanor pursuant to Section 1-8 of the Town Code,
and upon conviction thereof shall be punished by a fine not to exceed Two Thousand Five
Hundred Dollars ($2,500) or by imprisonment for a period not to exceed six (6) months, or both
such fine and imprisonment.  Each day that a violation continues shall be a separate offense
punishable as herein described.

Town of Wickenburg, Arizona, this 20th day of January 2026.
