Project Summary: 
 
1. 
AZ Happy Valley Royal Care, LLC is requesting a SUP for the use of their property as an assisted 
living group care facility to house sixteen patient residents.  The subject property is located in the 
Peoria area in unincorporated Maricopa County, and is designated as Rural Development Area (0-
1 d.u./acre) in the Maricopa County Vision 2030 Comprehensive Plan.  The City of Peoria General 
Plan designates the subject property’s land use as Rural Residential (0-1 d.u./acre). 
 
2. 
The subject property is approximately 0.80 acres and zoned Rural-43.  The existing residence 
currently operates as a community residence for elder care (LU20140007).  The applicant is 
requesting a SUP to increase the maximum number of residents permitted from ten to sixteen.  
Use of the property for a group care/assisted living facility with greater than ten residents requires 
either C-2 zoning or a SUP for a group care facility.  
 
3. 
The group care facility will serve elder patient residents.  There are eleven bedrooms in the home.  
Five of the bedrooms are intended house two patient residents per bedroom and another five will 
house a single patient resident.  One bedroom will be utilized as a staff bedroom. There would be 
seven staff including two night staff.  As a facility that will house patient residents, the proposed 
hours of operation are 24-hours a day and seven days a week.  Access is available to the site from 
83rd Avenue and Misty Willow Ln. Vehicles would enter through an entry-only access point from 
Misty Willow Ln. and exit through an exit-only access point onto Mariposa Grande Ln.

The lot is uniquely shaped due to the ROW and lot splitting.  Structures on the subject property 
include the existing residence.  The lot coverage for the site is approx. 30.06% or approx. 10,644 
sq. ft. which would require that 42 parking spaces be developed including three ADA spaces.  The 
applicant’s site plan proposes nine total parking spaces for the site (two existing garage spaces 
for the residence and seven defined spaces for the business including two ADA).  Staff notes that 
the site previously received legal non-conforming status for lot area due to a road widening 
project under LU20130020, and a variance (BA2014013) for lot coverage and front setbacks 
permitting a maximum lot coverage of 30.06% and two front setbacks of 85’ and 35.08’.  The 
structure conforms to lot coverage requirements, but a portion of the property wall extends 
beyond the property boundary into the right-of-way.   Additionally, the roof of the porte cochère in 
front of the residence extends into the required 85’ setback from the centerline of 83rd Avenue.  
There are two wall signs mounted on the screen wall that comply with zoning ordinance 
requirements.  All outdoor lighting would be shielded, directed downward and in conformance 
with Section 1112 of the Maricopa County Zoning Ordinance.  The perimeter of the property and 
use would be screened with a minimum 6’ screen wall.

required landscaping and parking requirements.  The requests to vary the front yard setback and 
minimum lot area are due to the building existing with these lot conditions from the roadway 
widening project and the prior LNC.  The applicant is requesting to waive required STVs as they 
are located on private roads and in compliance with the MCDOT roadway design manual.  
According to the applicant, the signage outside of the property line may be removed and relocated 
to within the property line.  As the property currently has landscaping, the applicant is also 
requesting to allow existing landscaping areas in lieu of a 5’ strip. Lastly, the applicant is 
requesting to vary parking requirements as the site is an assisted living facility with a small staff 
and residency with limited visitors.

designated as Rural Development Area (0-1 d.u./ac.).  The Rural Development Area land use 
designation encourages low-density rural residential and agricultural uses.

City of Peoria General Plan (Adopted 2020):  The Rural Residential designation identifies areas 
of large lot residential development in areas with a semi‐rural or agricultural character. The 
density ranges from 0 to 1 dwelling units per acre with lot sizes typically above 1 acre in size.  
They may have alternative or reduced streetscape standards in recognition of the desired 
character. In some areas, the land uses are predominantly agricultural and occupy large areas for 
the raising of crops, fowl and/or livestock. 
 
Public Participation Summary:

The applicant complied with the Maricopa County Citizen Review Process with the required 
posting of the site and notification by first class mail to adjacent property owners and HOA’s 
within 300’ of the subject parcel and notification to interested parties.  Two signs were posted on 
site in accordance with applicable regulations.  A public participation results report was 
submitted to staff in accordance with County requirements. Staff received no comments from 
members of the public in opposition or support to the proposal.  Staff received one neutral 
comment from an individual asking to be notified of hearing dates and staff notified the individual 
accordingly.

Staff received a no comment letter from the City of Surprise. Fire providers such as the Arizona 
Fire and Medical Authority (AFMA) and Rural-Metro Fire and Ambulance indicated that the site is 
not in either service area and that fire service would best occur through the City of Peoria.

Staff Analysis:

Staff supports the SUP request for an assisted living facility for up to sixteen residents.  While the 
proposed land use is not necessarily consistent with a rural residential land use, the existing site 
already has operated for years as a community residence of ten patient residents with no known 
impact to the community, and there is no known opposition to this request.  SUPs are appropriate 
when limited in scope and staff believes that an expansion to allow sixteen residents from ten 
will not be detrimental to surrounding neighbors or materially alter the appearance of the facility 
in its existing state.  Additionally, elder care and facilities for elder care is an important need in 
the community.

Staff finds the requests to alter development standards reasonable as the exterior of the property 
is not being altered other than to add additional parking spaces and required ADA parking spaces.  
The alterations that will occur will do so in the interior of the residence in order to accommodate 
the new residents.   
 
17. 
Staff notes that this site is a county island.  Fire service is only established at the facility due to a 
subscription with the City of Peoria.  This subscription shall be required to remain intact for the 
duration of the special use permit. 
 
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve Z2021065 subject to the following conditions ‘a’ – ‘k’:

a. 
Development of the site shall be in substantial conformance with the site plan entitled 
“Happy Valley Royal Care“, consisting of 3 full-size sheets, dated August 23, 2023, and 
stamped received August 23, 2023 except as modified by the following conditions. Staff 
may determine slight refinements to remain in substantial conformance with the approved 
site plan.  Minor and major amendments to the site plan will be determined in accordance 
with Chapter 3 of the Maricopa County Zoning Ordinance.  
 
b. 
Development of the site shall be in substantial conformance with the narrative report 
entitled “AZ Happy Valley Royal Care”, consisting of 6 pages, dated September 25, 2023, 
and stamped received October 2, 2023, except as modified by the following conditions. 
 
c. 
The following Planning Engineering conditions shall apply: 
 
1. The applicant will be responsible for coordinating with the City of Peoria to review any 
traffic impact, right-of-way dedication, permitting or roadway improvement 
requirements for 83rd Avenue in conjunction with this proposed entitlement. 
 
2. Construction of new screen/perimeter walls will require a building permit from 
Maricopa County Planning and Development. Solid walls shall contain a turned block, 
every other block, at the base course for drainage. 
 
3. All development and engineering design shall be in conformance with Section 1205 of 
the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for 
construction. 
 
d. 
The following SUP standards shall apply: 
 
1. Min. Front Yard (to centerline of 83rd Avenue) – 78’ 
2. Min. Lot Area – 34,800 sq. ft. 
3. Max. Lot Coverage – 31% 
4. Sight Visibility Triangles – 4 required SVTs waived at north and south property access 
points; however, all sight visibility triangles required of City of Peoria and/or MCDOT 
roadway standards shall be required. 
5. Signage in Right-of-Way - Existing signage may be located in the public right-of way 
(83rd Avenue) upon approval of the City of Peoria otherwise the portion of wall and 
signage within ROW shall be relocated in accordance with 1402.1.1 of the MCZO.  
6. Signage on Property - Existing signage may be located outside of the property upon 
approval of the City of Peoria otherwise the screening and signage within ROW and 
signage shall be relocated in accordance with 1402.1.2 of the MCZO. Wall signage 
may be located on the perimeter property line wall; however, all other signage shall 
conform to 1402.5.1.5 of the MCZO. 
7. Signage Identifying Care Facilities - Existing signage is permitted along the front 
perimeter wall subject to the approval of the City of Peoria otherwise the screening 
and signage within ROW and signage shall be relocated in accordance with 1402.1.2 
of the MCZO.  Wall signage may be located on the perimeter property line wall; 
however, all other signage shall conform to 1402.5.1.5 of the MCZO.

e. 
No expansions of this SUP shall be permitted to take place on the adjacent property of 
APN#201-15-030D without the submittal of a SUP major amendment.  As part of the major 
amendment, full grading and drainage fees shall be required along with grading and 
drainage plans serving both APN#201-15-030D and APN#201-15-030G.  No grading and 
drainage waivers for pre-developed sites shall be given in a further expansion of the site. 
 
f. 
All outdoor lighting shall be in accordance with Section 1112 of the Maricopa County 
Zoning Ordinance. 
 
g. 
The SUP is valid for a period of 15 years and shall expire 15 years from the date of BOS 
approval (December 6, 2038) or upon termination of the use for a period of 90 or more 
days, whichever occurs first. All site improvements associated with the special use permit 
shall be removed within 90 days of such expiration or termination of use.   
 
h. 
Prior to occupying the existing residence or any portion thereof for any use associated 
with the special use permit, the applicant shall obtain a building permit to retrofit the 
existing residence to meet current building code requirements for an Institutional 
occupancy as applicable and shall obtain a certificate of occupancy for the retrofitted 
building prior to occupancy. 
 
i. 
Noncompliance with any Maricopa County regulation shall be grounds for initiating a 
revocation of this SUP as set forth in the Maricopa County Zoning Ordinance. 
 
j. 
The property owner/s and their successors waive claim for diminution in value if the 
County takes action to rescind approval due to noncompliance with conditions. 
 
k. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, and at the 
time of expiration of the SUP, the property shall revert to the zoning that existed on the 
date of application.  It is, therefore, stipulated and agreed that either revocation due to the 
failure to comply with any conditions, or the expiration of the SUP, does not reduce any 
rights that existed on the date of application to use, divide, sell or possess the property 
and that there would be no diminution in value of the property from the value it held on the 
date of application due to such revocation or expiration of the SUP.  The SUP enhances 
the value of the property above its value as of the date the SUP is granted and reverting to 
the prior zoning results in the same value of the property as if the SUP had never been 
granted.

Purpose of Request 
The purpose of this request is to obtain a Special Use Permit to increase capacity of an existing 
assisted living facility of ten (10) residents to sixteen (16) residents at 8307 W Misty Willow Ln, 
Peoria AZ 85383. 
Existing Conditions 
The site has an existing six (6) foot screening wall made of CMU blocks on the north, west, and 
south sides of the site. The east side of the site faces N 83rd Ave, and has an existing six (6) 
foot screening fence consisting of a two (2) foot block wall with a four (4) foot iron fence above 
that.  
There are two (2) signs for the facility mounted on the east screening fence. One (1) is by the 
ingress and the other is by the egress. Both signs are identical. They display a logo, the name 
of the facility, its use, a phone number, and a website address. They are not illuminated. 
The structure is equipped with code-compliant exterior lighting at a height of seven (7) feet. 
Description of Proposal 
The project is an existing senior care facility of 7,472 livable square feet. The building has 
eleven (11) bedrooms, each with its own private bathroom. Ten (10) of the bedrooms are for 
elderly and disabled residents. The home is a 24-hour facility with five (5) total staff during the 
day and two (2) at night. The remaining bedroom is designated as a staff bedroom. The night 
shift will alternate for duty. While one (1) staff is sleeping, the other will perform the night shift 
duties. The proposed Special Use Permit for this project is to have five (5) of the bedrooms 
used as double occupancy, increasing the number of residents from ten (10) to sixteen (16). 
Nine (9) on-site parking spaces are provided, exceeding the required number of parking spaces. 
Four (4) spaces are already existing. Two (2) are the covered garage spaces, and the other two 
(2) are visitor spaces which are to receive new 4” white striping. In addition to the four (4) 
existing parking spaces, there will be a minimum of four (4) new parking spaces, two (2) of 
which will be ADA stalls. 
There will be no additional sign postings or lighting changes made. 
Relationship to Surrounding Properties 
There are vacant single family residential lots to the west and north, zoned RU-43, separated by 
a community gate. There is a single-family residential house to the south of the property, also 
zoned RU-43, separated by W Mariposa Grande Rd and a residential subdivision across N 83rd 
Ave, to the east, zoned R1-18. All of the surrounding properties are residential land use, which 
is what we are aiming for. This assisted living facility will operate as a group care facility. 
The increasing need for care for the elderly will benefit from this approval, without jeopardizing 
the residential look and feel of the property.

Location and Accessibility 
The location of the site is the southwest corner of N 83rd Ave and W Misty Willow Ln. The site is 
accessible by pedestrian and vehicle traffic from N 83rd Ave via W Misty Willow Ln by an existing 
drive entrance. 
Circulation System 
There is an entry access point on the north side of the lot from W Misty Willow Ln. There is an 
existing one-way drive aisle which exits to the south of the site onto N Mariposa Grande Rd.  
This drive aisle and circulation system can be utilized by emergency vehicles that are small 
enough to fit in the existing site conditions. Otherwise, emergency vehicles can utilize the cul-
de-sac at the end of W Misty Willow Ln to turn around and return onto N 83rd Ave. There is also 
a swing gate in the northwest corner of the property that provides access to the west side of the 
property. 
Development Schedule 
We will begin operating with the SUP once we have approval from the Board and all required 
building permits. 
Community Facilities and Services 
The school district is Peoria Unified School District. The nearest school would be Glendale 
Preparatory Academy – Great Hearts. And the nearest park would be The Meadows at Camino 
á Lago HOA Park.  
Other amenities in the vicinity include Arizona Balloon Flights and St. Haralambos Greek 
Orthodox Church.

Development Standards Modification Justifications 
1. Modify the minimum front yard setback from 40’ to 35.08’ & 78’.

Justifications: The respective variances for items 1 through 3 were approved in 2014 
when the building was built. The building, which is now in continual use/occupancy, 
exists with these lot conditions.

Justification: The sight visibility triangles at the north and south access points are to be 
waived because they are located on private roads. The required SVTs on 83rd Avenue 
are shown and in compliance with MCDOT Roadway Design Manual Figure 9.1A.

Justification: The screening wall in the southwest corner of the property exists outside of 
the property line. We will not be attempting to get approval from the City of Peoria. The

Justification: The landscaping depicted on the site plan is currently existing and exceeds 
the required 5’ depth for the majority of the parking areas. The existing landscaping is to 
remain. 
9. Waive the required 1 parking space per 250 sq. ft. of floor, and 1 parking space per 
100 sq. ft. of outdoor seating area. 
Justification: The 42 required parking spaces calculated by square footage is to be 
waived due to the assisted living usage of this site. Instead, five (5) new spaces, 
additional to the existing parking spaces, for a total of nine (9), will be sufficient. Two (2) 
of the five new spaces will be ADA stalls.

PND engineering plan review (DPR, FCD and PND Transportation) has reviewed the 3rd 
submittal of the SUP application routed for review on June 15, 2022. The project does 
not appear to include any new land disturbance or than perimeter walls, landscaping 
and signage. PND Engineering has no comments or objections subject to the following

The Maricopa County Environmental Services Department (MCESD) has reviewed 
documents received from the Maricopa County Planning and Development 
Department for the above referenced facilities. The purpose of this application is to 
obtain a Special Use Permit to increase capacity of an existing group home of 10 to a 
group home of 16 residents at 8307 W. Misty Willow Ln, Peoria AZ 85383. Water and 
Sewer information is inadequate “(and there is water and a septic tank)”, NOID  
must be obtained prior to construction plan approval. 
 
Based on the above, MCESD raised no objection to this project to the Planning & 
Development Department on June 15, 2021 and the project may proceed at this 
time subject to the following stipulations: 
 
None. 
 
It should be noted that this document does not approve the referenced project.  
Comments are provided only as advisory to Maricopa County Planning and 
Development Department to assist staff to prepare a staff report.  Other Maricopa 
County agencies may have additional requirements. Final review and approval will be 
made through Planning and Development Department procedures. Applicant may 
need to submit separate applications to the Maricopa County Environmental Services 
Department for approval of proposed facilities regulated by the Department.  Review 
of any such application will be based on regulations in force at the time of 
application.

IT IS UNDERSTOOD AND AGREED AS FOLLOWS: 
1.
Purpose: The City of Peoria, Arizona (Peoria) shall provide fire and emergency medical services to the individual
property owner signing (Signer) under the following terms and conditions. 
a.
The sole purpose of this Agreement is to provide fire and emergency medical services to individuals who, due
to their residing outside of the City of Peoria, Arizona boundaries, would not otherwise be entitled to Peoria 
services.
b.
The Parties expressly agree that this contract shall not affect the standard of care owed or 
Peoria in providing fire and emergency medical services.

Medical services provided by Peoria include those emergency medical services authorized to be provided by
emergency medical technicians and paramedics as determined by the State of Arizona. 
d.
Ambulance and/or air transportation to a medical facility is not a part of this agreement, and the subscriber will
receive a separate bill for those services rendered. 
2.
Duration/Scope: This Agreement shall run for a period of one year from the effective date, and is binding upon all
parties, and their successors in interest. 
3.
Services provided: Peoria shall provide the same level of service as provided to City residents through Peoria's
participation in the Automatic Aid Intergovernmental Agreement. 
a.
The parties agree that the City of Peoria, Arizona response may be affected by the occurrence of any presently
unforeseen circumstance, such as a major fire or several concurrent fires, or emergency, reduction in force, 
road closure or other situation in which there is a shortage of personnel or equipment. 
b.
If all fire units are busy or attending other calls or circumstances Peoria's response may be through the
Automatic Aid System from another participating jurisdiction. 
4.
Response Time: Peoria shall respond to each individual emergency call in the most responsible and expeditious
time possible in accordance with the Automatic Aid Intergovernmental Agreement. 
a.
Under the Automatic Aid Intergovernmental Agreement, Signer acknowledges that Peoria's response will be
from the closest available unit under the guidelines of the Automatic Aid Intergovernmental Agreement.

b.
Peoria and Signer acknowledge that response times are subject to variations due to existing weather
conditions, travel distances, traffic conditions, property and road identifications, lack of adequate maps and
familiarity with the out of district areas, and provisions of standard access to individual residences as defined in
Section 6.
6.
Signer Obligations:
a.
The Signer shall provide Peoria with the location information above.
b.
If the Signer leases the subject real property, the Signer shall provide a copy of this agreement, which shall be
executed by any tenant who leases said property subsequent to the execution of this Agreement. Failure to do
so shall cause Signer to indemnify and hold the City of Peoria, Arizona harmless for any and all claims asserted
by the tenant and Signer agrees to absorb all liability therein for said nondisclosure.
c.
Cancellation of a subscription will require a written notification. Refunds will be prorated by the day for those
residents who cancel the contract.
6.
Standard Access: Signer acknowledges that if their property is located on a private road that is not
Maricopa County maintained, the failure by signer to ensure that such private road is maintained may
delay response by City of Peoria, a fire equipment to reach the scenes. Further, such lack of
maintenance of private roadways is a significant factor in Peoria's ability to respond to emergency calls
within a reasonable and expeditious time.
7.
Finance: As consideration and payment for fire and emergency medical services to be provided by
Peoria, the Signer shall pay at the time of execution of this Agreement the annual subscription fee of
four hundred and fifty dollars ($450.00). Should Signer's check for the subscription fee be dishonored,
this Agreement is null and void. City shall charge a Non-sufficient funds fee for all dishonored checks.
Failure to pay the annual subscription fee on or before the expiration date of the Agreement shall
automatically terminate this Agreement.
8.
Waiver and Disclosure of Liability: In consideration for Peoria's undertaking to make all reasonable
attempts to respond to fire/emergency calls even in cases of substandard access to the scene, the
individual expressly waives claim, expressly disclaims, and holds harmless the City of Peoria, Arizona
from any and all liability against the City of Peoria, Arizona Uointly and severally) for any cause of
action, controversy or claim by the Signer, or an invitee, licensee, or other party operating Signer's real
property, arising out of a fire/emergency related incident and the City of Peoria, Arizona's response
thereto.
9.
Legal: This is the full agreement and may not be modified, except in writing signed by both Parties.
The agreement is only for the benefit of Signer and Peoria and no third parties are intended to benefit.
The Agreement shall be governed under the laws of Arizona.

Two things: 
This property is not eligible for annexation into the North County Fire & Medical District. 
However, if this property has a subscription with the Peoria Fire Department, I believe their CON does extend to that 
subscriber, so their ambulance transport services will apply to the property. I would triple check with the City of Peoria, 
but that is my understanding.

You mentioned annexation in our previous communication.  Could you describe the process for annexation into AFMA 
and would the property in the pinnacle Peoria island be eligible?  They have no ambulance service with the City of Peoria 
subscription and the County has an issue with that.  It is a group care facility SUP request. 
 
What is AFMA’s preference?  Are your service boundaries anywhere nearby?

I can weigh in on this. 
This property is in an unincorporated county island. We do not provide services to this property and cannot expand our 
services to this property because we do not have a contiguous boundary. If the property owner does not have a 
subscription with Rural Metro Fire (most do not), they will need to contact the City of Peoria Fire Department to obtain 
an annual Fire/EMS subscription. The City of Peoria does offer subscriptions to County Residents; please see the 
included link.
