Project Summary: 
 
1. 
The applicant, David Hughes of EPS Group, is proposing both a zone change with overlay from 
Rural-43 to C-2 CUPD and a special use permit (SUP) to develop a combined mini-warehousing 
and RV/boat storage facility on two parcels near the intersection of S. 91st Ave. and Broadway Rd. 
The site will include a 120,000 sq. Ft. two-story storage facility fronting the parcel along Broadway 
Rd. with RV parking centrally located, and mini-storage units rounding out the parcel along the 
rear and side setbacks. Development will take place primarily on the more northern of the two 
parcels, APN 101-36-006D, with little improvements taking place on APN 101-36-006F except for 
site screening. While the parcel is adjacent to the City of Phoenix jurisdiction to the north, it is not 
expected that the applicant will choose to annex at this time. 
 
2. 
The area surrounding Broadway Rd. has historically consisted of farmland. In the recent past, 
parcels within City of Phoenix jurisdiction to the north and west of the subject parcels have been 
developed for single-family residences. It is apparent based upon site aerials that more 
development of this type will continue. It has long been expected that the proposed SR-30 will be 
routed directly south of the subject parcels. It should also be noted that SR-30, as of this staff 
report, has not been approved to construct.

The following table identifies certain base, C-2 district development standards and the 
modifications of those standards necessary to provide for the current request. These requests 
serve the purpose of both matching the standards required by the City of Phoenix for similar type 
proposals, as well as allowing for standards that would otherwise prevent development of the 
site within Maricopa County to be relaxed. All other C-2 standards remain the same.

subject site. Staff has not received any notice of opposition or support to the request.

The applicant provided comments from a pre-application meeting held with the City of Phoenix 
regarding the site. The City of Phoenix has not provided a formal comment on this submittal.

Arizona Department of Transportation reviewed the proposal due to its vicinity to the proposed 
SR-30 and had the applicant provide a traffic impact study which they approved.

Staff Analysis:

Staff supports both the proposed zoning and SUP. Generally, self-storage facilities generate 
minimal noise, small numbers of visitors, and very little traffic at any given time. For this reason, 
the proposed use is compatible with the nearby residential and rural uses to the north, east, and 
west. For similar reasons, the request to lower the required number of parking spaces and loading 
areas specific to a self-storage facility (and not for other commercial uses) is also reasonable. 
Given the operational characteristics of self-storage facilities and the low number of vehicle trips 
typically generated by such uses, it is reasonable to conclude that the number of parking and 
loading spaces required under base zoning standards far exceeds demand. In a similar vein, the 
RV storage use requested as part of the SUP would also be compatible with the requested zoning. 
Given that Broadway Rd. is under City of Phoenix jurisdiction, Staff also believes it is appropriate 
to allow for the sight visibility triangles to match City of Phoenix standards.

Staff would note that the site is mid-block whereas commercial development generally is 
preferred at major intersections. Still, due to the site use, one would expect minimal traffic to be 
generated and therefore such placement would not be as much a concern. It may also be inferred 
that infrastructure development around the site, including road improvements that would create 
intersections with Broadway Rd, would be created as part of the development of SR-30. It is widely 
expected that auto-oriented land-uses and further rezonings will become more prevalent along 
the SR-30 route. 
 
15. 
While the City of Phoenix’s Estrella Village Plan calls for the areas south of Broadway Rd in this 
area to be rural, it is clear with the potential SR-30 and with rapid development of housing in the 
vicinity that the plan itself is outdated. The remaining farmland around the subject site is likely to 
be devoted to either similar type uses, higher density residential development, or freeway oriented

commercial soon. There is no incongruence between the proposed development and future 
development within the vicinity. 
 
Recommendations: (two motions – Z2023041 & Z2023042) 
 
16. 
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve Z2023041subject to the following conditions ‘a’ – ‘g’. 
 
a. 
Development of the site shall be in substantial conformance with the site plan entitled 
“Site Plan for Broadway and 91st Avenue – RV Storage “, consisting of one full-size sheet, 
dated September 5, 2023, except as modified by the following conditions. Staff may 
determine slight refinements to remain in substantial conformance with the approved site 
plan. Minor and major amendments to the site plan will be determined in accordance with 
Chapter 3 of the Maricopa County Zoning Ordinance. 
 
b. 
Development of the site shall be in substantial conformance with the narrative report 
entitled “Project Narrative for Broadway RV Storage”, consisting of 7 pages, dated 
September 5, 2023 except as modified by the following conditions. 
 
c. 
The following CUPD overlay standards shall apply: 
 
1. Parking Spaces Required:  
i. 1 per 35 climate-controlled storage units and 1 per 250 sq. ft. of office 
use (5% of provided spaces must be ADA). 
 
2. Parking Area Dimensions 
i. 8.5’ x 18’ for standard 90-degree stalls and 12’ x 18’ with a 5’ wide 
accessible aisle for ADA stalls w/ Min. 26’ wide drive aisles. 
 
3. Sight Visibility Triangles 
No structure, landscaping, fence, wall, terrace or other obstruction to view 
in excess of two feet in height shall be placed within the triangle formed 
by measuring along street-side property line a distance of 20’ and along 
the driveway a distance of 10 and connecting the ends of the respective 
distances. 
 
d. The following engineering conditions shall apply: 
 
1. Applicant responsible to receive approval for the Traffic Impact Study from the 
City of Phoenix and for any permitting required within the City of Phoenix 
rightofway. 
 
2. Engineering review of planning and/or zoning cases is for conceptual design only. 
All development and engineering design shall be in conformance with Section 
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; 
and current engineering policies, standards and best practices at the time of 
application for construction.

3. Based on the conceptual design nature of the information submitted, changes to 
the site layout and/or a reduction in the number of spaces may be necessitated by 
the final engineering design of the site drainage infrastructure. 
 
4. Detailed Grading and Drainage Plans and Final Drainage Report must be submitted 
with the application for Building Permit. 
 
 
e. 
All outdoor lighting shall be in conformance with the provisions of Section 1112 of the 
Zoning Ordinance and shall be placed so as to reflect light away from any adjoining rural 
or residential zoning district.  
 
f. 
Administrative approval of a plan of development will be required prior to approval and 
issuance of construction permits to develop and establish use of the site. Prior to 
issuance of a building permit, written confirmation will be required from the emergency 
fire protection jurisdiction having authority that the facility has been designed in 
accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, 
local fire protection jurisdiction review and approval will be required. 
 
g. 
The property owner/s and their successors waive claim for diminution in value if the 
County takes action to rescind approval due to noncompliance with conditions. 
Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Zone Change and/or SUP as set forth in the Maricopa County Zoning 
Ordinance. 
 
17.

INTRODUCTION 
EPS Group, Inc., on behalf of 93rd Ave partners, LLC. (Owner), submits these Zone Change with Overlay and 
Special Use Permit (SUP) requests in order facilitate the development of a proposed RV and self-storage 
facility located adjacent to the City of Phoenix’s jurisdiction west of the southwest corner of 91st Avenue and 
Broadway Road.  This site is identified as Maricopa County Assessor Parcel Numbers (APNs): 101-36-006D 
and 101-36-006F. 
PURPOSE OF REQUEST 
The site currently sits on undeveloped, vacant land and is zoned RU-43. The developer is seeking to develop 
a mix of traditional storage, covered RV storage and climate controlled self-storage, which will serve the 
greater area and future residents of Maricopa County and the City of Phoenix.  In order to accommodate 
this use, the below requests are being made: 
• 
Zone Change with Overlay from Rural (RU-43) to Intermediate Commercial with a Commercial Unit 
Plan of Development Overlay (C-2 CUPD), which will allow for the proposed use and reduce the 
parking standards.  
• 
Special Use Permit to allow commercial storage of mobile homes, travel trailers, recreational 
vehicles, and boats as an approved use of the C-2 zoning district. 
DESCRIPTION OF PROPOSAL 
The proposed development will feature a 120,000 square-foot (s.f.) two-story storage facility at the north 
end of the site along Broadway Road.  The storage facility will be climate-controlled with a leasing office in 
the northeast corner of the building with tenant parking off the primary entrance into the development.  
The 2-story storage facility will have a mix of 5’ x 5’, 5’ x 10’, and 5’ x 15’ climate-controlled units accessed 
from a 25’ by 60’ covered loading area with 6 parking spaces on the south side of the building and direct 
access via roll up doors to 10’ x 10’ and 10’ x 20’ climate-controlled units as well as through the front leasing 
office area.  The storage units themselves will be accessed via internal walkway aisles and elevators to the 
second floor. 
Behind the front gate of the proposed development will also be 190 covered RV and boat storage parking 
spaces measured at 12’ by 40’ and 17’ by 40’ for ADA accessible spaces.  The perimeter of the gated area will 
have traditional roll-up storage units with 20’ deep units on the east and south sides and larger 40’ and 54’ 
deep units along the west side.  The south side of the climate-controlled storage building shall also have 
traditional roll-up storage units which will be accessed by the adjacent drive aisle.  The drive aisles within 
the gated area will be a minimum of 40’ wide to allow tenants to park adjacent to their unit to load or unload 
their vehicles. 
The developer is seeking approval of a CUPD overlay in order to modify Maricopa County parking and sight 
visibility triangle requirements to match City of Phoenix requirements.  The developer is also seeking 
approval of a Special Use Permit to allow for the commercial storage of mobile homes, travel trailers, 
recreational vehicles, and boats as an approved use of the C-2 zoning district.

Proposed Site Plan 
COMPLIANCE WITH THE CITY OF PHOENIX GENERAL PLAN 
The City of Phoenix General Plan designates the site for low-density residential.  However, this plan was 
adopted prior to finalization of the route for the future SR 30 Freeway which is directly adjacent to the south 
of this site and will take approximately 1/3 of this site for freeway right of way.  The site is adjacent to land 
uses shown in the Phoenix General Plan as 10-15 DU/acre residential to the east as well as industrial and 
commerce/business park to the south. The residential development to the west is approximately 900 feet 
away and separated from this development by another, planned traditional single story, mini storage use.  
The proposed self-storage use is compatible with these surrounding land uses and will help support the 
higher density population in the area. Current surrounding land uses include single-family residential, multi-
family residential and commercial to the north, east and west. The future SR 30 will be developed along the 
south side of the property and will be dedicated as ADOT right-of-way.

A Fact-Finding meeting was held with the City of Phoenix on January 23, 2023. While annexation wasn’t 
requested, the City Water Services Department verified and confirmed that the project may connect to the 
City’s public water and sewer system. There is an existing 12-inch DIP water main within Broadway Road as 
well as an 8-inch VCP sewer main with capacity to serve the project. Additionally, the developer will work 
with the City Streets Department to construct Broadway Road to the City of Phoenix standards. The City’s 
written confirmation has been included as a part of this request.

Deviations Requested: 
Parking Spaces Required:  Article 1102.1 of the Maricopa County Zoning Ordinance (MCZO) requires the 
minimum amount of parking spaces for a commercial and office uses to be 1 stall per 250 square feet of 
floor area.  Due to the nature of the proposed self-storage facility not being a typical commercial and 
office use, a deviation is requested to modify the required parking standards to conform with the City of 
Phoenix’s parking requirements for Mini-Warehouse Use.  Per Section 702.C of the City of Phoenix Zoning 
Ordinance, the parking requirements for a Mini-Warehouse Use is 1 space per 35 storage units.  This 
requirement shall be utilized for the storage units located inside the 2-story climate-controlled facility.  
The traditional roll-up storage located around the perimeter of the gated area shall have sufficient space 
within the minimum 40-foot wide drive aisle to accommodate any loading and unloading into those 
storage units.  The parking requirements for the administration/leasing office shall conform to the MCZO 
parking requirements for the office use. 
Required ADA accessible parking stalls shall be 1 per 25 parking spaces provided to conform to the City of 
Phoenix Zoning Ordinance. 
Parking Area Dimensions:  The proposed development requests a deviation from the minimum parking 
area dimensions required in the MCZO to conform with the parking area dimension requirements of the 
City of Phoenix Zoning Ordinance.  This deviation is requested to more closely match the City of Phoenix’s 
design standards because the project is within the City’s planning boundary and will serve its surrounding 
residents. 
Sight Visibility Triangles:  Article 1111.4.2 of the MCZO requires a 25-foot by 25-foot sight visibility triangle 
along the street-side property line and driveway where no structure, landscaping, fence, wall, or other 
obstruction to view in excess of 2 feet in height be placed within.  Due to Broadway Road being within 
City of Phoenix jurisdiction and constructed to the City’s design standards, this development proposes a 
deviation of the sight visibility triangle dimensions to match the City of Phoenix standard dimensions of 
20 feet along the side-street property line and 10 feet along the driveway.

Use Regulations:  The developer is seeking approval of a Special Use Permit to allow for the commercial 
storage of mobile homes, travel trailers, recreational vehicles, and boats as an approved use of the C-2 
zoning district.  The proposed Special Use Permit area shall encompass the covered RV and boat parking 
spaces behind the front gate of the development.  The area is approximately 4.31 acres and is shown 
below in red. 
 
Special Use Permit Area 
LOCATION & ACCESSIBILITY 
The proposed self-storage site is located along W. Broadway Road, west of 91st Avenue and is approximately 
4 miles away from the I-10 and SR 202 freeways and is directly adjacent to the approved alternative for the 
SR 30. The City of Phoenix General Plan shows that this area is designated as large lot residential, 
commercial, and high-density core surrounded by significant numbers of existing and future traditional lot 
residential and multi-family homes. This is a prime location for the proposed self-storage use, which will 
greatly serve residents in the area by providing them with a convenient and integrated location to store 
their RVs, boats, and other items. 
CIRCULATION SYSTEM 
A Traffic Impact Statement has been provided with this request. The developer will be responsible for the 
engineering and construction of the south half of W. Broadway Road per City of Phoenix standards and the 
Sunset Farms Master Streets Plan.  The Sunset Farms Master Streets Plan and the City of Phoenix Street 
Transportation Department will require the following dedications and improvements to be made for the 
south side of W. Broadway Road as part of the development of this site:

Internal circulation can be accessed by a gated entry off Broadway Road and into a 40’ wide drive that 
circulates throughout the development. This wide drive has been designed to provide visitors with 
sufficient vehicular access and wide turning movements in order to get to their designated RV/boat parking 
or storage unit space. 
DEVELOPMENT SCHEDULE 
It is anticipated that this development will be built in a single phase.  
COMMUNITY FACILITIES & SERVICES 
The site is located in the Western Maricopa Education Center (MEC) Technical School District #4, Tolleson 
Union High School District #14, and Union Elementary School District #62. Union Elementary School is 
located nearby at the northeast corner of 91st Ave and Broadway.  
 
The site borders future SR 30 ADOT right-of-way and City of Phoenix public land use area that extends all 
the way to the Salt River park and open space area. The Estrella Mountain Regional Park is also located about 
5-miles away.

discharge onsite wastewater to municipal sewerage system.

for the benefit of the applicant for MCESD permit requirements and as an advisory to Maricopa County 
Planning and Development Department. Other Maricopa County agencies may have additional

Engineering Review has reviewed the first plan and report routed for review on 
09/08/2023, for the subject application and has the following no objections provided 
the following stipulations are part of any approval:
1.
Applicant responsible to receive approval for the Traffic Impact Study from the 
City of Phoenix and for any permitting required within the City of Phoenix right-
of-way.

Engineering review of planning and/or zoning cases is for conceptual design 
only. All development and engineering design shall be in conformance with 
Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and 
Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway 
Design Manual; and current engineering policies, standards and best practices 
at the time of application for construction.

ADOT’s Regional Traffic Engineering group has reviewed your TIA/TIS and sent you a stamped acceptance.

sign (wet or digital) and date the application. All of these documents need to be submitted as one package and
emailed to CentralPermit@azdot.gov and a permit technician will be assigned to assist with reviews and
processing the permit.

ADOT would like to remind the developer there is ADOT Right of Way in the area and they
must not encroach upon it without a permit. No work shall begin on ADOT right of way until
said permit is obtained.
