Project Summary: 
 
1. 
The applicant is requesting a special use permit (SUP) for an equestrian event facility with an RV 
Park in the Rural-43 zoning district. The Maricopa County Zoning Ordinance (MCZO) under 
Articles 1301.1.11 (Special Uses) describes the following: “Land use involving large assemblage 
of people” and Article 1301.1.17 “Travel Trailer of recreation vehicle (RV) parks,”. The subject site 
is comprised of 74.62 acres and is located approximately 500 feet west of the SWC of Pete Road 
and Eagle Eye Road in the Aguila area.  
 
2. 
The subject site abuts scattered residential and vacant lots to the east, north, west, and south. 
The vacant property to the west recently received a recommendation of approval by the Planning 
and Zoning Commission for the 140.55 acre Ben Jordan Acre Preliminary Plat consisting of 45 
residential lots and 7 tracts directly west of the subject site (S2022008). Approximately 560 acres 
surrounding the subject site to the north, west, and south are owned by the same owner of this 
application. 
 
3. 
The development of the equestrian event facility would be known as Gambler’s Row. The facility 
would consist of two 34,000 square foot outdoor arenas, one 34,000 indoor arena, cattle holding 
pens, cattle sorting pens, public parking, areas for retail and concession vendors, and public 
restrooms. The applicant states the equine events would occur seasonally between the months 
of October and March during the daylight hours. The outdoor arenas are proposed to have lighting 
that will be in compliance to Section 1112 of the MCZO and speakers that will be pointed in a 
southerly direction towards vacant land.

The indoor arena would include four separate 4,900 square foot pens, a 1,600 square foot hay 
shed, and 1,600 square foot shop. The two outdoor arenas would each include four, 4,800 square 
foot pends, two, 1,600 square foot holding pens, six sorting and shipping pens, one announcer 
booth, and concession stands that will be prefabricated shipping containers.

In addition, the applicant is also proposing two RV parks within Gambler’s ROW, West RV Park 
and East RV Park, that will consist of a 140 total spaces, with three comfort stations. The RV 
parks will be operated as part of the equestrian facility for event participants. The proposed 
comfort stations will include restrooms, showers, and laundry facilities that will only be exclusive 
for the RV park resident. Horse stalls are proposed to be located east of the RV parks for residents 
to rent for their horses.

The applicant is proposing a total of 298 parking spaces for participants and spectators on the 
eastern portion of the subject site with 13 ADA parking spaces near the indoor arena. In addition 
to the RV, additional parking spaces will be provided within each individual RV stall for resident’s 
individual vehicle. Access to the site is proposed along Gambler’s Way on the south portion of the 
site for participants and spectators. Another access point is proposed on the west side of the site 
for RV’s, hay and cattle trucks.

Public Participation Summary:

The applicant met the minimum ordinance requirements for outreach with the posting of the 
property and notification to all property owners of record within 300 feet of the subject site. In 
addition, the applicant held a neighborhood meeting February 2, 2023, inviting 114 property 
owners that live in the subdivision north of the site and within the split lots. 
 
12. 
The applicant states in their citizen participation report that a notice inviting property owners was 
mailed January 26, 2023. The neighborhood meeting was held at the Aguila Fire Station with 40 
attendees and was approximately one-a-half hour in length. During the meeting the applicant 
answered questions and addressed concerns raised by the attendees. The main issues that were 
brought up during the meeting were drainage, manure disposal, lighting, sound from speakers, 
policing, horse riding, and dust. The applicant states in their citizen participation report that they 
acknowledge and discussed solutions to each concern as follows:  
 
a. Drainage: Citizens raised the concern regarding drainage ponding north of the subject site, 
the applicant assured them that they would be in compliance to the County’s polices 
regarding the amount of flow that would be coming from the subject site. 
 
b. Manure Disposal: Citizens raised concerns regarding the disposal of manure. The 
applicant assured them that the manure from arenas, holding pens, sorting pens, and 
horse stall would be removed daily and placed in dumpsters that will be hauled to the farm 
and dumped on a weekly basis. 
 
c. Light/Sound: Citizens raised concerns regarding lights facing their home and the noise 
that will be caused during the events. The applicant assured them that lights will be in 
compliance to MCZO and would only be on during the events and amplified 
announcements would be very minimal with the speakers facing downwards so the noise 
does not travel. 
 
d. Policing: Citizen raised concerns regarding having police present during the events. The 
applicant assured them that security would be provided during event days. 
 
e. Horse Riding: Citizens raised concerns with off-site horse riding within the air park to the 
north and suggested the applicant propose signs along Pete Road restricting horse riding 
in that area. The applicant agreed to put up signs.  
 
f. Dust: Citizens raised concerns with dust being a health concern to the surrounding 
citizens. The applicants informed them that dust would be mitigated by water trucks 
watering the site to contain any dust from being picked up into the air.

The property owner initially requested a continuance from a September 14th Planning and Zoning 
Commission hearing to a November 2nd hearing in order to conduct additional public outreach 
since staff received 11 letters of opposition and a petition of opposition with 73 signatures. The 
letters of opposition stated concerns regarding the use not being appropriate for a residential 
area due to dust, noise and traffic the use will attract to the subject site.

The applicant held an additional neighborhood meeting on September 25, 2023 inviting the 
community of Aguila, including residents of nearby towns and close neighbors. Per the applicants’ 
citizen participation results, the meeting was approximately 1½ hours with approximately 76 
attendees. The applicant prepared a brochure that provided citizens with the project background 
and answers to the concerns that have been brought up by neighbors. The applicant also reached 
out to citizens that are highly opposed to the project, and the applicant states they were able to 
answer all their questions and that many of the citizens that opposed the project had no issues. 
Staff has not received recalls to any of the received opposition. The applicant has made no 
additional changes to their project due to the additional public outreach results.

Since the September 14th continuance, staff has received an additional 92 letters of opposition, 
staff notes most of the letters are duplicates, with 78 surrounding property owners being in 
opposition. Additionally, the applicant provided staff a total of 437 letters of support and staff 
has received an additional 11 letters of support, most of them being duplicates as well, with 177 
property owners being the total in support.

Staff Analysis:

Staff notes the proposed equestrian event facility with an RV park is a high-intensity, large-scale 
use which is appropriate for this location and the proposed conditions could make the site work 
with the surrounding residential/rural neighborhood.  
 
18. 
There is no condition regarding noise, but the applicant states in their proposal that amplified 
noise will be kept to a minimum with the speakers facing downward. Staff did recommend an 8-
foot CMU wall around the site to serve as a buffer, but the applicant rejected the recommendation 
due to them providing approximately a quarter mile buffer of vacant land surrounding the site. 
Staff acknowledges the site is abutting a right-of-way (Eagle Eye Road) on the eastern boundary, 
and on the west boundary the site is abutting a future subdivision that was recently approved in 
the Preliminary Plat phase (case no. S2022008). The applicant currently owns the subdivision to

the west, and they have indicated they anticipate the future property owners within the subdivision 
will use the subject site. 
 
19. 
Staff had initially proposed a condition to only allow three (3) events per month, but the applicant 
rejected the recommendation due to the possibility of a negative economic impact to the project. 
Staff worked with the applicant and condition this SUP to only allow a maximum of 80 events per 
year. Each event would be subject to the hours of 8:00 a.m. to 10:00 p.m., with lights being 
required to be off by 11:00 p.m. for safety. 
 
20. 
Staff notes that support letters were provided within the 300’ buffer, but the applicant of this SUP 
owns approximately 461.24 acres near and surrounding the site that is including within the 300’ 
buffer. Staff recognizes the applicants’ additional efforts to reach out to surrounding property 
owners, but no additional measures have been proposed to meet the concerns provided by the 
neighbors to overturn any opposition. Due to the significant opposition received from properties 
near the subject site, staff cannot support the SUP and recommends denial due to the concerns 
brought up by the neighbors.  
 
21. 
Staff notes the concerns for dust. The Air Pollution Control Regulations Rule 310.01 was adopted 
January 27, 2010 and is regulated and enforced by MCAQ. Rule 310.01 covers “non-traditional 
dust generating activities, including livestock activities. The purpose of Rule 310.01 states: 
 
 
To minimize the amount of fugitive dust entrained into the ambient air from non-traditional 
sources of fugitive dust by requiring measures to prevent, reduce, or mitigate fugitive dust 
emissions.  
 
216. Livestock Activities: Any activity directly related to feeding animals, displaying animals,    
racing animals, exercising animals, and/or for any other such activity including, but not 
limited to, livestock arenas, horse arenas, feed lots, and residential activities related to 
feeding or raising animals. 
 
22. 
Staff notes the concerns for noise disturbance. The Noise Ordinance (P-23) was adopted 
February 15, 2006 and is regulated and enforced by MCSO. The purpose of P-23 states: 
 
At and above certain levels, noise is detrimental to the health and welfare of Maricopa County 
citizens. Therefore, Maricopa County has determined that it is in the best interest of its citizens 
to control noise in a manner which promotes commerce; the use, value, and enjoyment of 
property; sleep and repose; and environmental quality. Therefore, it is hereby declared to be 
the policy of Maricopa County to prohibit excessive, unnecessary, disruptive, and annoying 
noises from all sources. The noise ordinance applies to properties within unincorporated 
Maricopa County.  
 
V. Public Disturbances  
 
A.  It shall be unlawful for any person to cause, or for any person in possession of property 
to allow to originate from the property, any noise which disturbs the peace or quiet of any 
neighborhood if such noise can be heard from within closed residential structures 
located within 500 feet of the boundary of the property from which such noise emanates. 
This subsection shall not apply to noise produced in the normal conduct of business 
provided that such noise occurs within the normal and customary hours for the conduct 
of such business, which is based on the normal and customary hours of operation of

similar, existing businesses, and the operation is legally conducted within the scope of 
all ordinances, laws, and statutes of Maricopa County and the State of Arizona. 
 
 
Recommendation: 
 
23. 
For the reasons outline in this report, staff recommends denial of Z2022171 due to the level of 
community opposition. 
 
24. 
However, if the Commission chooses to adopt a motion to recommend approval of Z2022171, 
staff offers the following conditions ‘a’ – ‘k’ 
 
 
a. 
Development of the site shall be in substantial conformance with the site plan entitled 
“Gambler’s Row“, consisting of nine full-size sheet, dated March 7, 2023, and stamped 
received April 13, 2023, except as modified by the following conditions. Staff may 
determine slight refinements to remain in substantial conformance with the approved site 
plan. Minor and major amendments to the site plan will be determined in accordance with 
Chapter 3 of the Maricopa County Zoning Ordinance. 
 
b. 
Development of the site shall be in substantial conformance with the narrative report 
entitled “Narrative Report for Gambler’s Row”, consisting of sixteen pages, dated March 6, 
2023, and stamped received March 22, 2023, except as modified by the following 
conditions. 
 
c. 
A 6 foot solid CMU wall shall be provided along the east property line to serve as screening 
from the development.  
 
d. 
The following Planning Engineering conditions shall apply: 
 
1. 
Engineering review of planning and/or zoning cases is for conceptual design only. 
All development and engineering design shall be in conformance with Section 
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; 
and current engineering policies, standards and best practices at the time of 
application for construction. 
 
2. 
Based on the conceptual design nature of the information submitted, changes to 
the site layout may be necessitated by the final engineering design of the site’s 
drainage infrastructure. 
 
3. 
Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with 
the application for Building Permits. 
 
e. 
This special use permit is valid for a period of ten (10) years and shall expire on December 
6, 2033, or upon the termination of the use for a period of 90 or more days, whichever 
occurs first. All site improvements associated with the special use permit shall be 
removed within 90 days of such expiration or termination of use.  
 
f. 
The number of events shall not exceed a 80 per year.

g. 
Operation hours for events shall only be from 8:00 a.m. to 10:00 p.m. 
 
h. 
All outdoor lighting shall be in conformance with the provisions of Section 1112 of the 
Zoning Ordinance and shall be placed so as to reflect light away from any adjoining rural 
or residential zoning district. Parking lot lighting and related facility lighting shall be shut 
off by 11:00 p.m. 
 
i. 
Noncompliance with any Maricopa County regulation or ordinance shall be grounds for 
initiating revocation of this SUP as set forth in the Maricopa County Zoning Ordinance.  
 
j. 
The property owner/s and their successors waive claim for diminution in value if the 
County takes action to rescind approval due to noncompliance with conditions. 
 
k. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, and at the 
time of expiration of the Special Use Permit, the property shall revert to the zoning that 
existed on the date of application.  It is, therefore, stipulated and agreed that either 
revocation due to the failure to comply with any conditions, or the expiration of the Special 
Use Permit, does not reduce any rights that existed on the date of application to use, 
divide, sell or possess the property and that there would be no diminution in value of the 
property from the value it held on the date of application due to such revocation or 
expiration of the Special Use Permit.  The Special Use Permit enhances the value of the 
property above its value as of the date the Special Use Permit is granted and reverting to 
the prior zoning results in the same value of the property as if the Special Use Permit had 
never been granted.

GAMBLER’S ROW 
1 PURPOSE OF REQUEST 
Wickenburg is about 25 miles east of the subject project.  Wickenburg advertises itself 
as the team roping capital of the world.  They may be right.  Thousands of people travel to 
Wickenburg during the winter season to participate in team roping events.  The owner wishes 
to construct a facility for equine events that require cattle such as team roping, cutting, 
working cow horse and others as well as a RV Park.  The proposed name of the facility is 
Gambler’s Row. 
2 LOCATION 
Gambler’s Row proposed location will be adjacent to the west side of Eagle Eye Rd. 
about 1,485 feet south of the intersection of Pete Road and Eagle Eye Road in Section 34, 
Township 7N, Range 9W.  It will occupy APN 506-06-061B and a portion of the south half of APN 
506-06-061A which will require an interior lot line adjustment.  The proposed Gambler’s Row is 
also located east of and adjacent to a proposed 45 lot subdivision being developed by the 
owner of Gambler’s Row under subdivision case number S2022008. 
3 PROJECT DESCRIPTION 
Gambler’s Row will consist of two outdoor arenas, one indoor arena, cattle holding 
pens, cattle sorting pens, parking areas, areas for retail and concession vendors, public 
restrooms, RV parks, RV park comfort stations, RV park office, horse stalls, facility shop and hay 
storage.  The RV Park will be owned and operated by the owner of Gambler’s Row.  Gambler’s 
Row will see seasonal usage.  The season starts in October and ends in March.  Events are 
planned for daylight hours.  On occasions, due to participants beyond expectation, events may

last into the evening hours.  That is why the outdoor arenas have lighting.  The Maricopa County 
outdoor noise regulations will be followed.  Also, all PA system speakers will be pointed in a 
southerly direction toward vacant land. 
3.1  
 
 RV Park 
Two RV Parks are proposed for Gambler’s Row referred to as the West RV Park 
and the East RV Park.  The West RV Park consists of 95 spaces and two comfort 
stations.  The East RV Park consists of 45 spaces and one comfort station.  The 
RV Parks will be owned and operated by the owner of Gambler’s Row as a part 
of the equine event facility.  The comfort stations will contain restrooms, 
showers and laundry facilities.  The comfort stations are for the exclusive use 
of the RV Park residents.  They are not public restrooms.  All of the spaces are 
pull-throughs and angled at 45° to all streets.  The RV Park interior streets are 
all one way with proposed construction matching paragraph 11.0 below.  A 
check in booth / office is also provided.  See the table below for estimated 
occupancy.  The RV Park is for event participants.  The lower summer season 
occupancy corresponds with the lower number of events as shown in the 
indoor arena event table in Paragraph 3.2 and a lower number of participants 
per event.

Horse stalls are proposed for rent by RV Park residents and horse 
owners from off site.  Each stall will be provided with a water supply.  See 
the site plan for the water system layout.

Proposed events require cattle.  The cattle will require turn out 
pens, holding pens, sorting pens, sorting/feeding alley and shipping pens 
which are all provided on the site plan.

Hay storage for cattle feeding and purchase by horse stall 
renters is provided.

An area is provided south of the east outdoor arena for trailers 
owned by retail vendors and concessioners.  Water and power will be 
provided for these trailers which do not belong to the Gamblers Row owner 
and will be hauled in and out for events.

Public Restrooms are proposed for the two outdoor arenas and 
the indoor arena. The proposed restrooms for the outdoor arenas will be 
pre-fabricated using 40' by 8' shipping containers, shipped to the site and

5 LIGHTING 
Exterior lighting will consist of stadium type lighting for the outdoor arenas and wall 
mounted lighting on the exterior of the indoor arena.  All will be LED’s purchased and installed 
in accordance with the Maricopa County Zoning Ordinance Section 1112.  Exterior lighting will 
face away from residential areas.

6 SIGNAGE 
One sign is proposed at the main entrance which is from a new street called Gambler’s 
Way.  This sign will conform to Section 1402 of the Maricopa County Zoning Ordinance. 
7 DEVELOPMENT SCHEDULE 
Construction of Phase 1 of the facility is planned to start in the Fall of 2023 and be 
completed in the Spring of 2024.  Construction of Phase 2 is planned to start in the Spring of 
2024 and be completed in the Fall of 2024. 
8 MANURE HANDLING 
Manure in horse stalls will be removed daily, deposited in dumpsters and hauled to a 
local farm for fertilizer.  Manure in the cattle sorting pens will be removed after each event, 
deposited in dumpsters and hauled to a local farm for fertilizer.  The density of the cattle in the 
holding pens will preclude manure removal.  The size and number of dumpsters will be 
selected for weekly hauling and dumping. 
9 DUST CONTROL 
Two, 4,000 gallon water trucks will be used to constantly water all interior streets, RV 
parks and parking areas on event days.  Prior to each event day, 1,100 gallons of water per acre 
will be applied to these areas.  On other non-event days, water will be applied to these areas 
as needed.

10 RELATIONSHIP TO SURROUNDING PROPERTIES 
This proposed project is adjacent to and west of Eagle Eye Road about 1,485 feet south 
of Pete Road.  The property to the north between this project and Pete Road (506-06-061A) 
belongs to the owner of this project, is zoned RU-43 and is un-developed and vacant.  The 
property to the south (506-06-059A) belongs to the owner of this project, is zoned RU-43 and is 
undeveloped and vacant.  The property to the west (506-06-060) belongs to the owner of this 
project, is zoned RU-43 and is undeveloped and vacant.  The owner of this project proposes to 
develop a 45 lot subdivision on this property under subdivision case number S2022008.  The 
property to the east, on the east side of Eagle Eye road (506-06-062) is zoned RU-43 and is 
undeveloped and vacant. 
11 CIRCULATION SYSTEMS 
11.1 A separate Traffic Impact Analysis (TIA) was prepared for the facility and the 
proposed 45 lot subdivision to the west of and adjacent to the facility.  The TIA 
is enclosed with the SUP application package. 
11.2 The proposed construction of interior streets is compacted native material 
overlain with 1.0” of 3/4" minus crushed rock.  The proposed drainage channel 
crossings are at grade crossings.  There will be more horse traffic on the interior 
streets than vehicle traffic.  The proposed street construction will be far less 
conducive to legs injuries than pavement.  In addition to the pickups hauling 
horses and cars with spectators traveling to and from events, there will be

separate entrance for these rigs is provided on the west side of Gambler’s Row.  
At the peak of the season there will be 2.0 hay trucks and 1.0 cattle trucks 
entering and leaving per week. 
11.3 The main access to the site is on the south side of the east parking lot from a 
new street called Gambler’s Way.  Access to the site by hay and cattle truck is 
on the west side, north of the RV Park from 519th Avenue.  There are no interior 
rights-of-way.  
12 PARKING 
The event that will draw the most participants will be team roping.  The largest event is 
expected to consist of 1,050 teams.  Article 1102.1 of the Ordinance requires one parking space 
per 200 square feet of floor area.  There is no floor area since the indoor arena is an arena for 
equine event use.  There will be bleachers measuring 20 ft by 200 ft at each arena.  3 arenas * 
20 ft * 200 ft is 12,000 square feet.  At one parking space per 200 square feet, 60 parking spaces 
would be required.  298 parking spaces are being provided because parking is needed for 
participants more than spectators.  Rancho Rio, a similar facility in Wickenburg, has the largest 
events with the most participants.  It has two outdoor arenas and six total acres of parking.  
Gambler’s Row will have three arenas and 15 acres of parking.  Parking spaces are restricted to 
event participants and spectators.  There is no public parking.  Sheet 2 of the plans shows the 
layout of the RV spaces with one vehicle parking space per RV space.

14 PUBLIC UTILITIES AND SERVICES 
14.1 
The potable water provider is Aguila Water Services, Inc. (AWS), a 
private water company regulated by the Corporation Commission.  AWS has a 
main of various sizes under Pete Road from Eagle Eye Road approximately 
3,900 feet west.  The largest pipe size in the main is 4 inch.  It is proposed that 
the entire main be converted to 4 inch pipe and extended along Pete Road to 
the Northwest corner of Section 34.

The owner of Gambler’s Row is developing a proposed 45 lot 
subdivision west of and adjacent to Gambler’s Row under subdivision case

number S2022008.  It is proposed that the re-built main under Pete Road feed 
a new water storage tank located on the south side of Pete Road within the 
subdivision as part of a satellite system that will serve the subdivision and 
Gambler’s Row.  The storage tank will discharge, through pressure pumps, to 
mains flowing south within the subdivision to a main within the Section 34 
east-west mid-section line road, Gambler’s Way, which will feed Gambler’s Row 
to the east. 
14.3 
There are no wastewater treatment facilities within 30 miles of the 
subject project.  Wastewater collection, treatment and disposal will be by on 
site systems. 
14.4 
There will be up to 820 head of horses and cattle housed at Gambler’s 
Row.  In addition, Gambler’s Row will consume up to 31,000 gallons of water 
per day for dust control.  This water is not required to be potable.  A separate 
water system, not connected to the potable system, will be constructed to fill 
these water needs.  The system will include a well, water storage, pressure 
pumps and a water distribution system. 
14.5 
The Aguila Volunteer Fire Department provides local fire protection.  
Gambler’s Row will provide fire hydrants, water mains, water storage and 
pressure pumps in accordance with their requirements.

Electricity will be provided by Arizona Public Service.

Project Summary: 
The proposed single family home development and event center is located 
near the southwest corner of Pete Rd and Eagle Eye Rd in unincorporated 
Maricopa County. 
The proposed equine event center is planned to consist of two (2) event 
buildings, three (3) arenas, restaurant, retail store, and RV park with 
additional parking for event days.  The site proposes new private roadways 
providing access to the event center.  
The proposed residential development is planned to consist of 48 single-
family homes over 115 acres.  The site proposes a total of three (3) 
driveways, two (2) new driveways on Pete Rd and one (1) new driveway on a 
new private road. 
Per the TIS, the trip generation is based on ITE LUC code 220 – Single 
Family Detached Housing.  Without an appropriate ITE LUC code for an event 
center, various calculations were used from similar studies.  Upon opening in 
2023, with maximum event volume, the combined sites are anticipated to 
generate 1,830 total daily trips with 367 AM peak hour trips and 248 PM peak 
hour trips. 
Review Comments: 
The south bound right turn deceleration lane, as identified in the study on 
Eagle Eye Rd with minimum storage of 160 feet, is acceptable to MCDOT. 
The classification of Eagle Eye Rd is principal arterial roadway.  As part of 
half-street improvements, dedicate a minimum 65’ ROW to MCDOT along site 
frontage of Eagle Eye Rd.   
As the new interior roadways will remain private, MCDOT has no further 
comment on this matter.

At point C, the specific energy is a minimum and the stage is at critical depth. When the depth of 
flow is greater than the critical depth, the velocity of flow is less than the critical velocity and the 
flow is subcritical. When the depth of flow is less than the critical depth, the flow is supercritical. 
Inspection of the energy curve in the vicinity of critical depth reveals that a small change in the 
energy will result in a relatively large change in the depth of flow. For this reason, it is strongly 
recommended that flow depths producing Froude numbers between 0.87 and 1.13 be avoided. 
The Froude Number limit for all types of channel linings is F,.-:; 0.86. For concrete and shotcrete 
lined channels, the additional range of 1.13-:;, F,.-:;, 2.0 is allowed. F,. should not fall between 0.86

Due to safety concerns resulting from

Water and sewer services information is Aguila  Water  Services,  Inc. water and no 
sewer disposal service information. MCESD has concerns, ATC (Well site Water 
distribution lines, Water storage tank, Booster pump station) must be obtained prior 
to final plat approval.  Please contact the Water/Wastewater Treatment

For any food service operations occurring on site, where food is offered, sold, or

Project Summary: 
The proposed single family home development and event center is located 
near the southwest corner of Pete Rd and Eagle Eye Rd in unincorporated 
Maricopa County. 
The proposed equine event center is planned to consist of two (2) event 
buildings, three (3) arenas, restaurant, retail store, and RV park with 
additional parking for event days.  The site proposes new private roadways 
providing access to the event center.  
The proposed residential development is planned to consist of 48 single-
family homes over 115 acres.  The site proposes a total of three (3) 
driveways, two (2) new driveways on Pete Rd and one (1) new driveway on a 
new private road. 
Per the TIS, the trip generation is based on ITE LUC code 220 – Single 
Family Detached Housing.  Without an appropriate ITE LUC code for an event 
center, various calculations were used from similar studies.  Upon opening in 
2023, with maximum event volume, the combined sites are anticipated to 
generate 1,830 total daily trips with 367 AM peak hour trips and 248 PM peak 
hour trips. 
Review Comments: 
The south bound right turn deceleration lane, as identified in the study on 
Eagle Eye Rd with minimum storage of 160 feet, is acceptable to MCDOT. 
The classification of Eagle Eye Rd is principal arterial roadway.  As part of 
half-street improvements, dedicate a minimum 65’ ROW to MCDOT along site 
frontage of Eagle Eye Rd.   
As the new interior roadways will remain private, MCDOT has no further 
comment on this matter.

Gambler’s Row Equine Facility   
   
As a property owner less than 100 feet from the above proposed project, my wife and I strongly 
SUPPORT this project. I am the owner of APN506-06-074B in the Eagle Roost Air Park.  I am an 
active commercial pilot with over 45 years of flight experience, and a certified flight instructor.  We are not in 
any way affiliated with the proposed development.  
  
We own the first property in Eagle Roost that would be affected by this facility by wind, odor, dust or 
drainage. We are satisfied with the Gambler’s Row plan to mitigate everything that comes with the 
development. We do not feel that this project will be detrimental in any way to our property or our flying 
lifestyle.   
  
Planes, by their very nature, disrupt the peace and quiet of the desert.  Parties claiming that an equestrian 
facility will disrupt their environment need to look down their own runway. This is not a reason to deny this 
development.  
  
This facility will bring many benefits to Aguila and the surrounding area, the positive economic impact alone 
justifies this project. The total economic impact of the horse industry in the United States is $122 billion, 
creating 1.7 million jobs. About 31 percent of United States households contain a horse enthusiast.   
  
Westworld, in Scottsdale, alone brings in over $112 million into Maricopa County and provides over 1,600 
jobs. Gambler’s Row is not Westworld, but it can be a beacon of economic hope in a struggling community.  
  
The misinformation being spread by individuals to the airpark residents, is inaccurate. I would like to address 
some of the objections;  
  
#1. “It’s too dangerous to have airplanes around livestock.”  For over 45 years I have been an 
agricultural aerial applicator, a crop duster. I mention that because it does qualify me to speak on the 
interaction of airplanes and livestock since I routinely fly over them at very low levels. Stock rarely lift their 
heads from grazing. State and Federal officials even use airplanes and helicopters for doing wild game 
counts.

#2. “Gambler’s Way would be on final approach to Sampley Field.” True, GR is over a half mile from the end 
of the runway. This is a statement, not a problem.  
  
#3. “Airplanes crossing over will be approximately 500 feet above the ground at this point. Eagle Roost Airport 
is less than a mile to the East, and traffic from that airport may pass over the proposed project.” Once again, this 
is a statement, not a problem. Airpark planes pass over downtown Aguila.  
  
#4. “Lights, dust, or movement on the ground could interfere with safe aircraft operations in the air, and aircraft 
malfunctions.”  This is a scare tactic. Pilot error can create a hazard, regardless of where they are. A horse or 
cow will no more contribute to the above than a car on a dirt road.  
   
#5. Location. The cities of Scottsdale, Las Vegas, Ocala Florida, Lexington Kentucky, Palm Springs, 
Wilmington Ohio, and Wickenburg have all embraced equestrian facilities much larger than Gambler’s 
Row. The parties protesting this development have stated that it’s a fine plan, just not in their back yard. Equine 
facilities have been very beneficial for many areas, and the Aguila community deserves this opportunity.  
  
And per the other concerns;  
1. Noxious odors – our horses are within 50 feet of our house and we have no issues.   
2. Light pollution – Arenas are lit for some events, but I've found the lights to be off by 10 pm.  
3. Noise Pollution – Airplanes create noise pollution, especially WWII fighters. In the airpark CC&R’s 
property owners agree to accept that... but, yet they want to limit the rights of their neighbors. I 
don’t agree with that.  
4. Dust Pollution – Dirt airstrips, such as Sampley, can create dust pollution. Wind creates dust. We are 
confident that the water trucks will eliminate the dust issues. Competitive horse facilities are not dusty.  
5. Traffic problems –There are not “Hundreds of trucks and horse trailers” going to any one location, at 
any one time, any day, anywhere in Arizona. This is not a Super Bowl Stadium.  
  
  
This equestrian facility will provide jobs, stimulate the local economy, raise property values including those in 
the airparks, and support the struggling businesses already in the area. Let’s do the right thing and help Aguila 
grow.

  Gary Standhart here.  I suppose I am not telling you anything new, but still wanted to share my thoughts/concerns, and 
disappointment that a development like this could be allowed in this area with you, about this development going in 
south of my home at 51728 West Pete Rd.  Aguila, Az. 
   I moved here 5 years ago from Durango Colo.  I know up there the county was very concerned about conformity.  I 
don't know if that applies to Maricopa County or not, but this doesn't seem to be a conforming venture.  It's not 
agricultural, which most of the property in the area is.  It is mostly commercial, which definitely isn't conforming to this 
rural setting, and the lots for the residential part of this venture are 2.5 acres each where most of the lots in the area are 
5 acres or more.  Also, I would imagine that this will just be phase one, and if allowed to continue, will just worsen the 
impact on this area. 
  And, another thing that REALLY bothers me is that this development is brought to this area by someone not from this 
area, for, in the most part, people not from this area, that are seasonal visitors for most part, against the will of many in 
this area, disrupting the lives/comforts/safety of people who are residents of this area, in many instances, for years and 
year round, who moved here for the affordability and peace and quiet that the area, up until recently offered. 
   Another issue that doesn't seem to have had the appropriate attention is the fact they are putting in some water 
retention areas that will be dual purpose for storing livestock with accumulating body waste from these animal, feces 
and urine(knowing that some will be removed, but certainly not all), and when these areas overflow from seasonal rains, 
which we know they will, much of this waste will flow downhill into neighboring yards and vegetation along.  I feel there 
are much better places for a development like this to go with all the vacant land around where they could go without a 
negative impact to anyone. 
Thanks for considering those that have been living here and enjoying this part of Maricopa County.

I forgot to also mention in my previous email to you sent just a minute 
about, but police and fire is also a big concern. If we have a medical 
emergency or a fire emergency, we are told to call the fire station directly 
as it can cause a huge delay by calling 911. We are a total volunteer fire 
station. As for police, we are serviced by Maricopa County Sheriff's 
Department. Being the furthest most part of the county, it can up to an 
hour before we get a response from police. It's just how it is in such a rural 
place. I think that should also be considered.

I am opposed to this proposed project. I have read everything that has been 
submitted to the County regarding this project and never once does it 
mention that there are two private, FAA-approved airparks right "next 
door" to this proposed project. This type of facility does not fit in with the 
surrounding area. Flight patterns go directly over the proposed facility at 
low levels due to how close it is to our take off and landing strips.  
 
I have great concern over the water. We struggle with water as it is right 
now and adding that much more to our water table will definitely put a 
burden on it. Just up the street a ways in Wenden, there is a water crisis 
going on. When you add up all the water needed for dust control, watering 
livestock, which they plan to house 830+, the RV park, vendors and 
bathrooms for the roping events, and the future homes, this is really going 
to be a strain. I'm sure the daily water usage will be over 100,000 gallons!
 
I have concern about the smell. I don't care how much someone tries to tell 
me there will be no smell, I know better. There is no way to mask that 
smell. I worry about the nitrites in the urine getting into the water table. 
This can be very hazardous. I've been told that all the waste will be 
removed every day there is an event and loaded into dumpsters. I doubt 
these dumpsters are covered. There WILL be flies. Lots and lots of flies. 
Then I wonder about the days there aren't any events. The waste will not 
be removed and if there are 830+ housed livestock, that's a lot of waste. 
One main source for nitrates in water is animal feedlots. Although this 
place is a roping arena, it will contain as much livestock as a feedlot and 
should be treated as such.

In a September 2022 letter from Maricopa County Environmental Services 
indicates that they have concerns and says they must receive ATC (well 
site water distribution lines, water storage tank, booster pump station) 
information. They also state that the number of horse stalls is a lot and 
question what the water situation is for the horses. 
 
The traffic report is flawed -- like really flawed. This was done near the 
end of May. Many residents in this area are snowbirds and are usually 
gone by May. But this area is full to the brim in what is proposed to be the 
busiest months of roping. The report is also flawed in that the speed limit 
is not accurate. Not too far down Eagle Eye Road the speed limit turns to 
40 mph and before reaching the entrances to Eagle Roost Airpark and 
Samply Airpark, it is 50 mph. Traffic report should also include vendors, 
hay trucks, cattle trucks, along with the normal rigs and spectators.  
 
The Narrative Report for Gamblers Row indicates that the largest event is 
expected to consist of 1,050 teams. A team consists of two people which 
means 2,100 just as participants. Now most of them do not travel together. 
They each bring their own truck pulling their own horse trailer. The 
parking doesn't even come close to being sufficient. 
 
Light pollution. Most of us in this community love our night skies. The 
star gazing is amazing and this will be totally ruined by arena lights. They 
say they are going to point them down, but their elevation is higher than 
both of our airparks and so that will will be right at our eye level. It will be 
a really big impact, as well as the noise. There will be much noise from 
the events, including a PA system for the announcer.  
 
Other impacts for Aguila, not just our airparks, will be the increased 
traffic, increased use of our almost nonexistent facilities (this town has one 
cafe and one gas station. There is a small mom and pop type grocery store 
and a Family Dollar. The added housing this project plans to put in cannot 
not be sustained by our current post office. All the boxes are spoken for 
(there is not mail delivery here, you have to have a p.o. box). The lack of

amenities in our small community will put a burden on Wickenburg for 
sure.   
 
I'm not the best one to describe my thoughts in words, but I hope this 
gives you some food for thought. I know these people have deep pockets 
and, unfortunately, I realize those kinds of people get what they want. But 
you must take a look at our community. Someone from the County should 
come out here and physically take a look. For so many, many reasons this 
project is not fitted for this community whatsoever.

Hello Paola, 
I am a homeowner in Aguila Arizona located in the Valley of the Eagle Airpark (Sampley's Airport),  I have recently 
become aware of the proposed project to construct an equestrian facility south of and directly next to the airpark.  I am 
in opposition to this large and intrusive project for the following reasons; 
 
1.. Aviation Concerns from low flying aircraft flying to/from Sampleys Airport   
2. Increased Traffic Problems.  There are no traffic control devices such as stop lights etc. in Aguila and the heavy 
truck/trailer and auto traffic that this facility will bring will undoubtedly create traffic problems   
3. Drainage/Run Off Pollution Concerns. Heavy rains currently cause damage to our unpaved roads and ditches, which I 
believe will be aggravated by the clearing of the land for this proposed facility. 
4. Light/Noise/Air Pollution.  We currently almost have a dark sky in Aguila and our airpark area.. Night events in the 
equestrian faciltiy will definitely detract from this quality of life. . 
5. Health Concerns due to animal waste  
6. Police Public Safety Concerns.  There is no full time police presence in Aguila

I lived in the Aguila where the Gambler’s Row is being proposed.  
I am opposed to the location in such a small community. There is not the resources nor infrastructure for such a project . 
For one, we are all on water supply only by wells . The amount of necessity could drain the local water supply .  
2) The water supply and soil could become contaminated  by such a concentration of animals and people . 3) The project 
is adjacent to two air parks.  With a concentration of people and animals , there could be complaints of air traffic and 
the attempts to decrease or possibly , the end of all traffic.  
4) With the increase of people, animals and the waste , the environment with have a significant increase of fumes, files 
and pollution.  
 
It is a poor location for such a huge development. There is not the infrastructure to accommodate such an endeavor and 
will cause local strain and drop of land value. It will increase local pollution and contamination. It will significantly 
decrease the water supply for this small but well established community.  
Please consider the difficulty that is is being proposed for the small and isolated community.

My husband and I live close to the parcel of land that is the subject of this special use permit application for an equine 
facility. We live in the private- fully paved airpark that borders on Pete Rd to the northeast of that parcel. We have lived 
here for 27 years and have always enjoyed the dark skies and quiet of this corner of Maricopa County. In fact the main 
reason we moved here was for astronomy, both as a hobby and as a business.  
 
We fear the dark skies and quiet will be encroached upon by an adjacent equine facility initially comprising 1 indoor 
arena, 2 outdoor arenas and an RV park. We also fear a big increase in traffic on Eagle Eye Rd including the small town of 
Aguila. The prevailing wind is from the southwest so whatever dust is kicked up by these activities will be sent in our 
direction.  The main source of dust would be unpaved roadways and parking areas associated with daily traffic and 
events. 
 
We would like to know if there will be any restrictions in the following areas: 
 
Dust control in outdoor arenas, roadways, and RV park 
Light emanating from arenas especially at night 
Noise control of loudspeakers in outdoor arenas 
 
We would like to be notified of any upcoming meetings, decisions and anything else relating to this application. If there

My first concerns are depleting our water resources in the area, Wenden is our neighbors to the west and the are 
already starting to have issues. 
 
Then much more traffic with increasing danger to the elderly and younger folks walking along the road, 
 
Then the idea that they are putting an equestrian facility right next to two active Airparts which is a well known conflict 
of interest followed by occupants complaining about airplane noise and wanting to bring suit against Airparts and 
pilots.  And they will be right in line with the approach/departure end of an active runway 
 
Dust from additional traffic 
 
Noise from increased populations use of OHV/Dirt bikes etc 
 
Light pollution from occupants, arenas, commercial businesses 
 
Crazy to me that they would see a need to put an equestrian facility right next to two active flying communities when 
there is so much vacant land in the areas where they could put this with no adverse effect to anyone else.

Dear Paola Jaramillo,  
 
I am writing to oppose the equestrian event facility list in case Z2022171. I am a homeowner in Samplys Airpark in Aguila 
(Assessor Parcel Number 506-06-050E) so this facility will affect me in several ways. Right now the area is peaceful. 
That’s one of the reasons I purchased this home. If the event facility comes to the area, it will no longer be peaceful 
here. Horses, vehicles, events, RV generators and numerous people will cause noise on a regular basis.   
Right now the air is clean. Another benefit of living away from a busy town/area. With an equestrian event facility right 
next door we will be affected by the smell of the horse manure, vehicles driving to and from the facility, dust, hay, straw 
and a very large fly infestation to go along with that, I would imagine.  
This is an airport. Planes will be taking off and landing over the event facility. That doesn’t seem like a good mix to me. 
Right now this area is serene and having an event facility of any kind takes that away. That affects my life on a daily basis 
and defeats the whole purpose of owning a home here.

Regarding Property owned within 300 feet of the proposed Special Use Permit Application #Z2022171 for an 
equestrian event facility with an RV Park in Rural-43 zoning district. As listed in the attached postcard we 
received from the Maricopa Planning & Zoning Commission. Site Location approximately 500' west of the SWC 
of Pete Road and Eagle Eye Road in the Aguila Area. 
 
Flip's Double Eagle LLC, hereby Protest the proposed project that is within 300 feet of our property located at: 
N 515 Ave - 5-acre parcel #506-06-066A, legal description: W2 N2 S2 SW4 NW4 Sec 26 EX W 43F RD. 
 
Our protest concerns are as follows: 
 
1. The Project will affect our ability to sell the above-mentioned property for the full market price for a 
number of reasons which are listed below. 
2. The project will bring additional dust, traffic and noise into the area. 
3. Increased traffic has the potential to increase danger to the pedestrians as well as the Air traffic in this 
area. 
4. The project puts an additional strain on our water resources for our community in the Air Park as well 
as our Wenden neighbors to the west who are already seeing the strain on their water systems.  There 
are many farms in the area that rely on the water that Wenden supplies. 
5. The equestrian facility right next to the active Air Park would put the equestrian facility right in line 
with the approach/departure end of an active FAA approved runway. The noise from the Aircraft 
could spook the livestock bring suit against the Air Park, it's residence and pilots. 
6. Light and noise pollution from the equestrian project, its occupants, arenas and commercial businesses 
will disrupt the flying lifestyle as well as the peace and quiet of the desert area that our Air Park 
currently enjoys.   
7. Increased noise from ATV's and event loudspeakers during the day and evening from this development 
will also disrupt our quality of life in the Air Park, not to mention the smell and flies that the livestock 
would bring into our community. 
Please accept this email as our registered complaint and protest of the equestrian project #Z2022171, we 
request that the Planning & Zoning Commission decline the permit also known as Gamblers Row.

  Gary Standhart here.  I suppose I am not telling you anything new, but still wanted to share my thoughts/concerns, and 
disappointment that a development like this could be allowed in this area with you, about this development going in 
south of my home at 51728 West Pete Rd.  Aguila, Az. 
   I moved here 5 years ago from Durango Colo.  I know up there the county was very concerned about conformity.  I 
don't know if that applies to Maricopa County or not, but this doesn't seem to be a conforming venture.  It's not 
agricultural, which most of the property in the area is.  It is mostly commercial, which definitely isn't conforming to this 
rural setting, and the lots for the residential part of this venture are 2.5 acres each where most of the lots in the area are 
5 acres or more.  Also, I would imagine that this will just be phase one, and if allowed to continue, will just worsen the 
impact on this area. 
  And, another thing that REALLY bothers me is that this development is brought to this area by someone not from this 
area, for, in the most part, people not from this area, that are seasonal visitors for most part, against the will of many in 
this area, disrupting the lives/comforts/safety of people who are residents of this area, in many instances, for years and 
year round, who moved here for the affordability and peace and quiet that the area, up until recently offered. 
   Another issue that doesn't seem to have had the appropriate attention is the fact they are putting in some water 
retention areas that will be dual purpose for storing livestock with accumulating body waste from these animal, feces 
and urine(knowing that some will be removed, but certainly not all), and when these areas overflow from seasonal rains, 
which we know they will, much of this waste will flow downhill into neighboring yards and vegetation along.  I feel there 
are much better places for a development like this to go with all the vacant land around where they could go without a 
negative impact to anyone.

I am opposed to this proposed project. I have read everything that has been 
submitted to the County regarding this project and never once does it 
mention that there are two private, FAA-approved airparks right "next 
door" to this proposed project. This type of facility does not fit in with the 
surrounding area. Flight patterns go directly over the proposed facility at 
low levels due to how close it is to our take off and landing strips.  
 
I have great concern over the water. We struggle with water as it is right 
now and adding that much more to our water table will definitely put a 
burden on it. Just up the street a ways in Wenden, there is a water crisis 
going on. When you add up all the water needed for dust control, watering 
livestock, which they plan to house 830+, the RV park, vendors and 
bathrooms for the roping events, and the future homes, this is really going 
to be a strain. I'm sure the daily water usage will be over 100,000 gallons!
 
I have concern about the smell. I don't care how much someone tries to tell 
me there will be no smell, I know better. There is no way to mask that 
smell. I worry about the nitrites in the urine getting into the water table. 
This can be very hazardous. I've been told that all the waste will be 
removed every day there is an event and loaded into dumpsters. I doubt 
these dumpsters are covered. There WILL be flies. Lots and lots of flies. 
Then I wonder about the days there aren't any events. The waste will not 
be removed and if there are 830+ housed livestock, that's a lot of waste. 
One main source for nitrates in water is animal feedlots. Although this 
place is a roping arena, it will contain as much livestock as a feedlot and 
should be treated as such.

In a September 2022 letter from Maricopa County Environmental Services 
indicates that they have concerns and says they must receive ATC (well 
site water distribution lines, water storage tank, booster pump station) 
information. They also state that the number of horse stalls is a lot and 
question what the water situation is for the horses. 
 
The traffic report is flawed -- like really flawed. This was done near the 
end of May. Many residents in this area are snowbirds and are usually 
gone by May. But this area is full to the brim in what is proposed to be the 
busiest months of roping. The report is also flawed in that the speed limit 
is not accurate. Not too far down Eagle Eye Road the speed limit turns to 
40 mph and before reaching the entrances to Eagle Roost Airpark and 
Samply Airpark, it is 50 mph. Traffic report should also include vendors, 
hay trucks, cattle trucks, along with the normal rigs and spectators.  
 
The Narrative Report for Gamblers Row indicates that the largest event is 
expected to consist of 1,050 teams. A team consists of two people which 
means 2,100 just as participants. Now most of them do not travel together. 
They each bring their own truck pulling their own horse trailer. The 
parking doesn't even come close to being sufficient. 
 
Light pollution. Most of us in this community love our night skies. The 
star gazing is amazing and this will be totally ruined by arena lights. They 
say they are going to point them down, but their elevation is higher than 
both of our airparks and so that will will be right at our eye level. It will be 
a really big impact, as well as the noise. There will be much noise from 
the events, including a PA system for the announcer.  
 
Other impacts for Aguila, not just our airparks, will be the increased 
traffic, increased use of our almost nonexistent facilities (this town has one 
cafe and one gas station. There is a small mom and pop type grocery store 
and a Family Dollar. The added housing this project plans to put in cannot 
not be sustained by our current post office. All the boxes are spoken for 
(there is not mail delivery here, you have to have a p.o. box). The lack of

amenities in our small community will put a burden on Wickenburg for 
sure.   
 
I'm not the best one to describe my thoughts in words, but I hope this 
gives you some food for thought. I know these people have deep pockets 
and, unfortunately, I realize those kinds of people get what they want. But 
you must take a look at our community. Someone from the County should 
come out here and physically take a look. For so many, many reasons this 
project is not fitted for this community whatsoever.

I forgot to also mention in my previous email to you sent just a minute 
about, but police and fire is also a big concern. If we have a medical 
emergency or a fire emergency, we are told to call the fire station directly 
as it can cause a huge delay by calling 911. We are a total volunteer fire 
station. As for police, we are serviced by Maricopa County Sheriff's 
Department. Being the furthest most part of the county, it can up to an 
hour before we get a response from police. It's just how it is in such a rural 
place. I think that should also be considered.

Hello Paola, 
I am a homeowner in Aguila Arizona located in the Valley of the Eagle Airpark (Sampley's Airport),  I have recently 
become aware of the proposed project to construct an equestrian facility south of and directly next to the airpark.  I am 
in opposition to this large and intrusive project for the following reasons; 
 
1.. Aviation Concerns from low flying aircraft flying to/from Sampleys Airport   
2. Increased Traffic Problems.  There are no traffic control devices such as stop lights etc. in Aguila and the heavy 
truck/trailer and auto traffic that this facility will bring will undoubtedly create traffic problems   
3. Drainage/Run Off Pollution Concerns. Heavy rains currently cause damage to our unpaved roads and ditches, which I 
believe will be aggravated by the clearing of the land for this proposed facility. 
4. Light/Noise/Air Pollution.  We currently almost have a dark sky in Aguila and our airpark area.. Night events in the 
equestrian faciltiy will definitely detract from this quality of life. . 
5. Health Concerns due to animal waste  
6. Police Public Safety Concerns.  There is no full time police presence in Aguila

I lived in the Aguila where the Gambler’s Row is being proposed.  
I am opposed to the location in such a small community. There is not the resources nor infrastructure for such a project . 
For one, we are all on water supply only by wells . The amount of necessity could drain the local water supply .  
2) The water supply and soil could become contaminated  by such a concentration of animals and people . 3) The project 
is adjacent to two air parks.  With a concentration of people and animals , there could be complaints of air traffic and 
the attempts to decrease or possibly , the end of all traffic.  
4) With the increase of people, animals and the waste , the environment with have a significant increase of fumes, files 
and pollution.  
 
It is a poor location for such a huge development. There is not the infrastructure to accommodate such an endeavor and 
will cause local strain and drop of land value. It will increase local pollution and contamination. It will significantly 
decrease the water supply for this small but well established community.  
Please consider the difficulty that is is being proposed for the small and isolated community.

My husband and I live close to the parcel of land that is the subject of this special use permit application for an equine 
facility. We live in the private- fully paved airpark that borders on Pete Rd to the northeast of that parcel. We have lived 
here for 27 years and have always enjoyed the dark skies and quiet of this corner of Maricopa County. In fact the main 
reason we moved here was for astronomy, both as a hobby and as a business.  
 
We fear the dark skies and quiet will be encroached upon by an adjacent equine facility initially comprising 1 indoor 
arena, 2 outdoor arenas and an RV park. We also fear a big increase in traffic on Eagle Eye Rd including the small town of 
Aguila. The prevailing wind is from the southwest so whatever dust is kicked up by these activities will be sent in our 
direction.  The main source of dust would be unpaved roadways and parking areas associated with daily traffic and 
events. 
 
We would like to know if there will be any restrictions in the following areas: 
 
Dust control in outdoor arenas, roadways, and RV park 
Light emanating from arenas especially at night 
Noise control of loudspeakers in outdoor arenas

Being a property owner of APN 506-06-127 in very close proximity to the proposed Gambler’s 
Row Gambler’s Row Equine Facility and RV Park. I have multiple concerns as to its effects on 
us and the whole of Aguila. 
 
1) Water pressure: There are existing issues with the water pressure. Aguila Water Services 
are having trouble keeping up with demand now. The proposed addition of 4” pipe on 
Pete Road and the addition of a storage tank and pressure pump that will be feeding 
Gambler’s Row (Narrative Report for Ben Jordan Acres Revised Jan. 23, 2023 sec. 14.1 
& 14.2) will decrease the water pressure feeding this tank & pump, and more so when an 
event is underway. 
2) Fire Department: Being a small community Aguila has a volunteer fire dept. Though they 
are fully trained they don’t have the equipment or the experience in handling a large fire 
which would be possible at the Gambler’s Row facility. 
3) Traffic: Traffic on Eagle Eye rd. leading up to and following an event will be very heavy. 
For those of us that Eagle Eye rd. is our only egress to do our daily travels it will be a 
nightmare getting onto Eagle Eye road. The hay & cattle trucks are proposed to enter the 
facility at 519th Ave. off Pete road. Pete road is an unmaintained dirt road If they do pave 
this road who will be maintaining it? 
4) Noise: From the meeting Feb. 2 at the Aguila Fire Dept. we were informed that when the 
events are finished for the day is when they will stop. If the event runs late into the night, 
the Arena’s PA and rigs leaving the event will be creating an excessive amount of noise 
with no regard to the homes where people are attempting to sleep to get their rest for the 
next day’s work. Requiring a minimal starting and maximum ending time would help 
5) Light: The light generated by the project by not only the arenas but the RV park will 
pollute the night skies and be a constant irritation to those that have southern facing 
homes. Arena lights pointing away from town and directed downward. Possibly lower 
intensity lights in RV and parking areas may help some. 
6) Drainage: The proposed reservoirs for containing the runoff and rain will change the 
natural flow of water. During Monsoon season the water is intense in its flow, the 
reservoirs can be overflowed and the water will take its own path downhill. In turn it can 
over power culverts placed on Pete rd. causing damage to existing property and making 
Pete rd. unpassable to Eagle Eye rd.

7) Livestock: There will be a large amount of cattle being penned up for days, and horses 
either staying at the facility or being transported in for the event. Even with the proposed 
cleanup won’t be able to completely get rid of the obnoxious odor and runoff into the 
reservoirs during heavy rain. 
8) Pollution:   The arenas, the commercial establishments, the RV park & the temporary 
parking areas will generate trash that is proposed to be picked up by local trash service. 
The trash that is left behind from people not disposing trash in the proper containers will 
flow or blow into Aguila. 
9) Dust: With the arenas, interior roads and parking areas not being paved there will be an 
increase in dust that will affect the surrounding homes. 
10) Air traffic: There are (2) airparks with runways in close proximity. One of which is in 
direct line of flight from the south (Sampley’s airport). This is a concern, the planes 
arriving and departing from this runway can be flying low to the ground and in case of an 
emergency have to divert course to avoid Gambler’s Row.  
 
The proposed Gambler’s Row site is not a good place to be built. It will have a negative impact 
on the entire Aguila community. Had it been cited for an area East or West of Aguila where the 
open fields of the local farms were located the impact on property and residents would be much 
smaller.

Gambler’s Row Equine Facility and RV Park 
 
As property owners less than 3,000 feet from the above proposed project, we strongly oppose this project.  
The submitted reports for “Gambler’s Row” made NO mention of the over 110 homes directly 
downhill and downwind within less than 3,000 feet of this project, in the form of TWO well 
established Residential Flight Parks with FAA Approved Runways. 
 
Gambler’s Way would be right on final approach to Samply Airport - directly south of and less than 2,800 
feet from the end of the runway. Aircraft departing to the south would fly very low over the project, at full 
power, possibly spooking horses and resulting in injury to horses or riders. Eagle Roost Airport is less than 
3,000 feet to the East, and traffic from that airport will likely pass overhead the proposed project as well.  
 
We also have other concerns – from errors and omissions in the reports given to the county to substantial 
health and safety concerns. 
 
The Traffic Report is flawed. It was done on May 21st – when virtually all our winter residents are gone. In 
addition, the traffic increase estimates will be much higher than those used, due to the incredible growth of 
our area due its popularity with horse owners. MUCH higher than 5 years ago and increasing at a much 
higher rate than suggested in the report. 
 
The stated speed limit to the project was 35 mph. This is wrong. It is at least 50 mph for at least 1/2 mile 
before the project. The amount of truck traffic traveling at higher speeds past our neighborhoods will make 
it virtually impossible for residents to safely enter the highway from their homes. 
 
The calculation for number of vehicles and parking requirements is flawed and underestimated. Comparing 
traffic at roping events with traffic at concerts is inaccurate. Small cars or SUV’s do not create the chaos 
that we already see in our area caused by large numbers of trucks with horse trailers. 
 
The Narrative Report states that the project will see seasonal usage. They also they told the public at the 
meeting held at the Aguila Fire Station that the park would only be used from October thru March – when, 
in fact, it will be open all year long. They also told the public that they had never had a roping arena before 
– when in fact they already own one in Utah – Ben Jordan Arena. 
 
When asked about noise pollution from crowds and loudspeakers, they said “that’s not going to happen.” 
When asked about dust issues, they also said “that’s not going to happen.” When asked about light 
pollution, they said, “That’s not going to happen.” It says in the report that exterior lighting will face away 
from residential areas, but on the plan, it shows lighting facing North – directly towards existing family 
homes. All the lighting in such a project will create light pollution in our area, ruining the now dark skies 
we have currently. 
 
 
It was stated that there will be up to 820 head of horses and cattle housed at the facility. This doesn’t even 
include all the transient animals! Why aren’t there any requirements for compliance with CAFO feed lots? 
It falls well within the definition of a CAFO as per Arizona Department of Environmental Services: 500

head of horses housed at least 45 days in a confined area requiring feed to be brought in for the animals. It 
will also create issues such as attracting flies and rodents to the area, and noxious odors from so many 
animals present in a confined area. 
 
 
They also made no mention of the fact that they are using the water retention drainage ponds for 
cattle pens. We have great concerns that when water overflows these ponds, it will flow right downhill to 
all our homes, creating possible health and safety issues. Regulations state that you can’t put dry wells or 
drainage ditches downhill of the manure, yet they are talking of doing just that with dry wells. 
 
They omitted all data of exactly HOW MUCH manure the facility’s animals will generate. Over 35,000 
lbs. of waste PER DAY. Even if they pick up manure daily, there will still be much manure and urine on 
the ground at any given time. You can’t pick up urine, so when it rains, it will go into the ground and flow 
downhill, onto our land and possibly into our ground water, which is where we all get our drinking water. 
This run-off will contain contaminants such as metals, pharmaceuticals, nitrates, and bacteria, especially 
harmful to the elderly – which include virtually ALL our flight park homeowners! 
 
We also have HUGE concerns about water usage. With the water crisis the state is facing – how can the 
obscene amount of over 30,000 gallons of water a day just for dust control be justified?  Not to mention the 
amount the animals will require - over 8,000 gallons per day. This will come directly from the aquifer that 
furnishes our drinking water and our farms food production. 
 
The dust coming off the roping arenas and animal pens can’t be contained either, and when moving 
downwind – will blow directly into our neighborhoods. Maricopa County Air Quality Department states 
that there can be no visible dust emissions crossing property lines. We already have dust problems from all 
the current residential roping arenas, let alone this huge commercial facility. 
 
We are concerned about public safety resulting from the addition of this many transient people to the area. 
This influx of people creates increased inherent types of problems. We are in an unincorporated area at the 
very end of Maricopa County with no local police protection whatsoever. We already suffer from up to a 
60-minute response time from Maricopa County Sherrif’s department – a department experiencing an 80 
deputy shortage at this time.  
 
We feel that this project poses a serious threat to the public health, safety, and welfare of our surrounding 
community if it were allowed to proceed.   
 
We also feel that the landowner and their representatives intentionally supplied inaccurate information and 
made material misrepresentations that would make a difference to the approval of this special use permit. 
 
We are not opposed to growth, but it should be compatible with existing surroundings. A large commercial 
enterprise such as Gambler’s Row does not fit with our surrounding properties and intended uses.  
 
Therefore, we are opposed to the construction of this facility.

Please be advised that we are opposed to this development for the following reasons.
This development is a commercial enterprise to be built in a very rural, low density, homes only area. It is not
compatible with the lifestyle of the land owners who have invested their lives and savings to live in a peaceful, non
commercial environment away from congested traffic and noise a commercial enterprise will intrude upon.
There is no evidence that this commercial enterprise is supported by Maricopa County General Plan for the area
intended.
The traffic hazard this development promises to cause is guaranteed to be incompatible with all the driveways and
easements the locals use for ingress/egress to their properties.
Eagle Eye Road has a speed limit of 35 mph from highway 60 south for several miles past the proposed
development. Heavy trucks can be witnessed on a minute by minute basis exceeding the limit by 30 to 40 miles per
hour in either direction. They use Eagle Eye road as a cutoff between I-10 and highway 60. Without  extensive
investment in turning lanes and traffic signals there will be fatalities on a regular basis if this development is
allowed to be built.
There should not be any commercial development allowed unless a 100 year water supply can be guaranteed and
there is no harm to the existing aquifer. A mixed use residential / commercial enterprise should not be exempt from
this long standing requirement for residential development. 
Any high density residential development should be required to have their own water treatment plant for sewage.
The volume of manure and urine from this development will significantly impact the ground water and the
subsequent runoff to surrounding wells since the proposed land is significantly elevated above the residential
community. This is totally unacceptable for the homeowners to cope with in the very near future.
My neighbors and I have no knowledge of how the developer plans to mitigate the effluents that will be generated
next to our properties.
From the biohazard of manure and urine to the smell of hundreds of horses and cattle, there is no plan to mitigate the
intrusion into our lifestyle.

Being a property owner of APN 506-06-127 in very close proximity to the proposed Gambler’s 
Row Gambler’s Row Equine Facility and RV Park. I have multiple concerns as to its effects on 
us and the whole of Aguila. 
 
1) Water pressure: There are existing issues with the water pressure. Aguila Water Services 
are having trouble keeping up with demand now. The proposed addition of 4” pipe on 
Pete Road and the addition of a storage tank and pressure pump that will be feeding 
Gambler’s Row (Narrative Report for Ben Jordan Acres Revised Jan. 23, 2023 sec. 14.1 
& 14.2) will decrease the water pressure feeding this tank & pump, and more so when an 
event is underway. 
2) Fire Department: Being a small community Aguila has a volunteer fire dept. Though they 
are fully trained they don’t have the equipment or the experience in handling a large fire 
which would be possible at the Gambler’s Row facility. 
3) Traffic: Traffic on Eagle Eye rd. leading up to and following an event will be very heavy. 
For those of us that Eagle Eye rd. is our only egress to do our daily travels it will be a 
nightmare getting onto Eagle Eye road. The hay & cattle trucks are proposed to enter the 
facility at 519th Ave. off Pete road. Pete road is an unmaintained dirt road If they do pave 
this road who will be maintaining it? 
4) Noise: From the meeting Feb. 2 at the Aguila Fire Dept. we were informed that when the 
events are finished for the day is when they will stop. If the event runs late into the night, 
the Arena’s PA and rigs leaving the event will be creating an excessive amount of noise 
with no regard to the homes where people are attempting to sleep to get their rest for the 
next day’s work. Requiring a minimal starting and maximum ending time would help 
5) Light: The light generated by the project by not only the arenas but the RV park will 
pollute the night skies and be a constant irritation to those that have southern facing 
homes. Arena lights pointing away from town and directed downward. Possibly lower 
intensity lights in RV and parking areas may help some. 
6) Drainage: The proposed reservoirs for containing the runoff and rain will change the 
natural flow of water. During Monsoon season the water is intense in its flow, the 
reservoirs can be overflowed and the water will take its own path downhill. In turn it can 
over power culverts placed on Pete rd. causing damage to existing property and making 
Pete rd. unpassable to Eagle Eye rd.

7) Livestock: There will be a large amount of cattle being penned up for days, and horses 
either staying at the facility or being transported in for the event. Even with the proposed 
cleanup won’t be able to completely get rid of the obnoxious odor and runoff into the 
reservoirs during heavy rain. 
8) Pollution:   The arenas, the commercial establishments, the RV park & the temporary 
parking areas will generate trash that is proposed to be picked up by local trash service. 
The trash that is left behind from people not disposing trash in the proper containers will 
flow or blow into Aguila. 
9) Dust: With the arenas, interior roads and parking areas not being paved there will be an 
increase in dust that will affect the surrounding homes. 
10) Air traffic: There are (2) airparks with runways in close proximity. One of which is in 
direct line of flight from the south (Sampley’s airport). This is a concern, the planes 
arriving and departing from this runway can be flying low to the ground and in case of an 
emergency have to divert course to avoid Gambler’s Row.  
 
The proposed Gambler’s Row site is not a good place to be built. It will have a negative impact 
on the entire Aguila community. Had it been cited for an area East or West of Aguila where the 
open fields of the local farms were located the impact on property and residents would be much 
smaller.

As a property owner less than 1/2 mile from the above proposed project, I strongly oppose this project.   
  
This facility will generate noxious odors, a huge number of flies, dust, noise day and night, significant traffic 
problems, contaminated drainage, huge demands on an already taxed water system, and light pollution (our 
subdivisions are "dark sky" communities - with the Milky Way visible every night),  
 
The narrative report for Ben Jordan Acres made NO mention of the almost 100 homes within a mile of this 
project. In addition, there are TWO well established FAA Approved Airport Runways within one mile of the 
project.   
 
There are hundreds of thousands of acres along Highway 60 between Wickenburg and Wenden that are far 
more suitable for this type of development, and would have little to no impact on established residential areas.  
  
We are quite certain that none of the County Supervisors would want this facility in their back-yard.  
 
Thank you in advance for your consideration in this matter. We are extremely hopeful that this project will

We are opposed to this proposed development for many reasons. 
 
The proposed project area is a very rural, low density, and non commercial. The intrusion of such a high 
impact operation would be devastating to the current and past life styles for which the area has been famous. 
It has drawn residents from all over our country. It would destroy everything which caused it to be a magnet 
for those wishing a quiet and peaceful home. The primitive and historic back country would be inundated by 
many more vehicles, people and horses than it has ever known to the detriment of local flora and fauna. 
The sheer size and density of the operation would insure noise, dust, and light pollution uncommon  to this 
area not just during daylight hours but long into and throughout the night. The impact, in just a few short 
years, would be far greater than has been seen in well over a hundred! Imagine how such a sudden event 
could undue even the best planned community never mind such a rural place as this. 
The odors from such a concentration of activity would also accompany damage to the fragile aquifer from 
animal waste. It would be like putting a " feed lot " into the midst of a residential area like Sun City West! 
There would be unimaginable harm not only to local wells but would also place a great strain on the local 
operating water company in Aguila which supplies the majority of my neighbors needs. Along with this 
concern is the obvious increase in our water rates as the small, local water company must build out 
infrastructure to service this project as has been proposed. 
The traffic generated by so much additional use would be unmanageable without extensive road build out and 
traffic control not only on Eagle Eye Road but on U.S. 60 as well. The access into and out of Aguila would be a 
nightmare. Add in the heavy truck traffic and increasing use of U.S. 60 as an I-10 alternate as well as heavy 
truck use of Eagle Eye Rd. as a shortcut to I-10, the result would be incredibly dangerous to all! 
You must also factor in that this development is literally next to and below the low flight paths of two FAA 
approved airfields. Placing so many  livestock and people within yards of aircraft could be a danger to those on 
the ground as well as being a hindrance to safe aircraft operations.  
We also believe that our property values will be adversely effected with literally no foreseeable benefit other 
than for the developer. The entire scenario offers little benefit for the Aguila community. 
We're confident that after a careful review, Maricopa County will agree that this entire project fails it's citizens
in every significant way.
