A RESOLUTION RESCINDING A BOARD ACTION TO DECLARE ROAD FILE NO. A538, ACOMA
ROAD FROM 184TH AVENUE TO 180TH AVENUE, INTO THE COUNTY ROAD MAINTENANCE
SYSTEM.
WHEREAS, on the 23rd day of September 2015, the Board adopted a Resolution, designated
Road File Number A538 (C-64-16-009-M-01), recorded in instrument No. 2015-0712628, declaring
Acoma Road, from 184th Avenue to 180th Avenue, a public highway in the County Highway system;
and
WHEREAS, a Map depicting the adopted resolution was recorded in instrument No. 2016-
0416370; and
WHEREAS, said road was dedicated to the public via plats of Waddell Haciendas Unit 1, in
Book 145 of Maps, Page 11, MCR and Waddell Haciendas Unit 2, in Book 158 of Maps, Page 38,
MCR; and
WHEREAS, said road was a dirt, held in trust by the County until it was brought into the
County Highway System by Road File Number A538; and
WHEREAS. The department of transportation has determined that there is an irrigation line
centered in the roadway, that 180th Avenue, 181st Avenue, 182nd Avenue, and 183rd Avenue dead ends
at Acoma Road, that there is no primary access to properties abutting Acoma Road and that the traffic
count on the dirt road does not meet the PM10 non-attainment area standards that would require the
road to be paved; and
WHEREAS, the County Engineer has determined that paving Acoma Road, from 184th Ave to
180th Ave, would not serve a public necessity, is no longer desired to be in the County Highway
System and prays the Board to rescind the action taken by the Board on the 23rd day of September
2015 (C-64-16-009-M-01); and
WHEREAS, the portion of Acoma Road to be rescinded is described as follows:

That portion of Acoma Road having a width of 40 feet and lying in Section 10 – T3N,
R2W of the Gila and Salt River Meridian, Maricopa County, Arizona, and also lying in
the Plat of Waddell Haciendas Unit 1, recorded in Book 145 of Maps, Page 11 and
Waddell Haciendas Unit 2, recorded in Book 158 of Maps, Page 38, M.C.R.; the
centerline of said portion being described as follows:
BEGINNING at a point on the centerline of said Acoma Road that is 264.84 feet west
of and perpendicular to the east line of Waddell Haciendas Unit 1, recorded in Book
145 of Maps, Page 11;
Thence Easterly along said centerline of Acoma Road to a point on the east line of
180th Avenue being the POINT OF ENDING, Containing 1.90 acres.

The roadway is known as Acoma Road from 184th Avenue to 180th Avenue, lying in
Supervisor District 4.
A map or plat showing the beginning, ending, general course and direction of the
highway is depicted in the attached Exhibit “A”, pursuant to A.R.S. § 28-6701(B); and
General Vicinity: Acoma Road from 184th Avenue to 180th Avenue.
WHEREAS, the day and hour set by the Board for a public hearing on the County Engineer’s
recommendation has arrived, and notice of the hearing has been given to the public by advertising
once a week for two consecutive weeks in the Arizona Gazette pursuant to A.R.S. § 28-6702(A)(3);
and
WHEREAS, no objections to rescinding the action taken by the Board on the 23rd day of
September 2015 (C-64-16-009-M-01) have been filed; and
WHEREAS, the Board believes that rescinding said action is in the best interests of Maricopa
County, and that said highway is no longer a public necessity and should be removed from the County
highway system; and
NOW, THEREFORE, BE IT RESOLVED that the action declaring Road File No. A538 a public
highway is hereby rescinded, as more fully set forth herein above and, that the County Engineer is
hereby directed to make a map or plat of the road and cause the same to be recorded in the Office of
the County Recorder, evidencing that the road has been removed from the County highway system
and that the right of way is held in trust by the County as dedicated.
