A RESOLUTION OF THE BOARD OF SUPERVISORS OF MARICOPA COUNTY, ARIZONA, DECLARING
STREETS WITHIN A SUBDIVISION TO BE NECESSARY FOR PUBLIC PURPOSES AND DECLARING
THE STREETS INTO THE COUNTY ROAD SYSTEM.
RESOLUTION OF THE MARICOPA COUNTY BOARD OF SUPERVISORS ACCEPTING STREETS IN A
SUBDIVISION PURSUANT TO A.R.S. § ARS 11-822(C)
WHEREAS, A.R.S. § 28-6701(A) authorizes a county board of supervisors to establish, alter or
abandon a highway in the county and other legal subdivisions and acquire real property for those
purposes by purchase, donation, dedication, condemnation or other lawful means; and
WHEREAS, certain streets in a subdivision are paved and maintained by the county but no record
that they have been declared into the county road system can be found; and
WHEREAS, such streets need to be declared by the Board of Supervisors to authorize expenditure
of public funds to maintain them; and
WHEREAS, pursuant to A.R.S. § 28-6701(B), the County Engineer has recommended that such
streets be established and that the Board resolve to declare them into the county road system; the legal
description is described to wit:

All streets consistent with the rights-of-way and appurtenances as depicted in “Tierra Buena”, a
subdivision recorded in Book 121 of Maps, Page 50, Maricopa County Records, lying Southwest
quarter in Section 14 – T2N, R1W, Maricopa County, Arizona;
Containing 3.0661 Acres
EXCEPT that area lying within Road File 2038 as described in Resolution recorded in Docket
8374 Page 822 and shown in Road Map Book 19 Page 77 on file with the Maricopa County
Recorder’s Office.
General Vicinity: Dysart Road and Camelback Road, lying within Supervisor District 4, in an
unincorporated area.
A plat or map of such streets is attached; and
WHEREAS, the Maricopa County Board of Supervisors has determined that the streets are
necessary to provide a public highway, are needed by the County and may be established, opened and
declared; and
WHEREAS, the day and hour set by the Board for a public hearing on the County Engineer’s
recommendation has arrived, and notice of the hearing has been given to the public by advertising once a
week for two consecutive weeks in The Arizona Gazette pursuant to A.R.S. § 28-6702(A)(3); and
WHEREAS, no objections to declaration of such highway have been filed; and
NOW, THEREFORE, BE IT RESOLVED by the Maricopa County Board of Supervisors that its
Chairman execute this Resolution evidencing the determination by the Board that the streets are necessary

to provide a public highway and are, therefore, needed by the County, and the streets are hereby
established and declared into the county road system pursuant to A.R.S. § 28-6701; and
BE IT FURTHER RESOLVED that the Clerk of the Board record this Resolution in the Office of the
Maricopa County Recorder to provide public notice of the establishment of such streets pursuant to A.R.S. §
28-6701
