RECITALS A. TRR owns certain real property legally described on Exhibit - attached hereto and incorporated herein by this reference Property B. Portions of the Property are subject to that certain Flowage Easement and Agreement for Flood Control Purposes, specifically the Designated Fringe identified as Exhibit - , recorded in the Official Records of the County at Document No. 1993-410818, ( Flood Control Fringe Easement FCD is the beneficiary of the Flood Control Fringe Easement. C. FCD has agreed to terminate portions of the Flood Control Fringe Easement and quit-claim its right, title and interest, if any, in and to portions of the TRR Property to TRR. NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the undersigned hereby state, confirm and agree as follows: AGREEMENT 1. Release and Termination of Easement. Pursuant to the Flood Control District Board of Directors Resolution 1999R016, FCD hereby terminates the portions of the Flood Control Fringe Easement described on -2 and depicted on attached hereto and incorporated herein.
