On 10/5/23, the Commission voted 5-0 to adopt a motion
recommending the Board of Supervisors approve Z2023088
subject to conditions ‘a’ – ‘g’:
a.
Development of the site shall be in substantial conformance with the Site Plan entitled
“Delaney Substation DCRT MW Tower“, consisting of 8 full-size sheets, dated August 21,
2023, except as modified by the following conditions. Staff may determine slight
refinements to remain in substantial conformance with the approved site plan.
b.
Development of the site shall be in substantial conformance with the Narrative Report
entitled “Delaney Substation Communication Tower”, consisting of 12 pages, dated
August 22, 2023, except as modified by the following conditions.
c.
The following engineering conditions:
1.
A section line , Thomas Road, coincides with the south boundary of the parcel.
Per an approval of reduction, a 40-foot reservation will be required for Thomas
Road.
2.
A mid-section alignment is located on the eastern perimeter of the proposed

development requiring building setbacks to start from a future half street of 40-
feet per the Maricopa County Zoning and Ordinance Section 11105.
3.
All development and engineering design shall be in conformance with Section
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards;
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual;
and current engineering policies, standards and best practices at the time of
application for construction.
4.
Engineering review of planning and/or zoning cases is for conceptual design only
and does not represent final design approval nor shall it entitle applicants to
future designs that are not in conformance with Section 1205 of the Maricopa
County Zoning Ordinance and Drainage Policies and Standards; Floodplain
Regulations for Maricopa County; and the MCDOT Roadway Design Manual.
5.
Detailed Grading and Drainage Plans showing the new site improvements must
be submitted for the acquisition of building permits.
d.
Tower lighting and marking must meet all FAA regulations.
e.
This special use permit is valid for a period of 25 years and shall expire on October 18,
2048, or upon termination of the use for a period of 90 or more days, whichever occurs
first. All site improvements associated with the special use permit shall be removed within
90 days of such expiration or termination of use.
f.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. In the event of the failure to comply with any condition, and at the
time of expiration of the Special Use Permit, the property shall revert to the zoning that
existed on the date of application. It is, therefore, stipulated and agreed that either
revocation due to the failure to comply with any conditions, or the expiration of the Special
Use Permit, does not reduce any rights that existed on the date of application to use,
divide, sell or possess the property and that there would be no diminution in value of the
property from the value it held on the date of application due to such revocation or
expiration of the Special Use Permit. The Special Use Permit enhances the value of the
property above its value as of the date the Special Use Permit is granted and reverting to
the prior zoning results in the same value of the property as if the Special Use Permit had
never been granted.
g.
Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Special Use Permit as set forth in the Maricopa County Zoning
Ordinance.

Project Summary:
1.
The applicant, DCR Transmission LLC, is requesting a special use permit (SUP) on a Rural-43
zoned parcel for the use of a microwave communications tower. The subject parcel 506-31-006D
is an operating electrical power substation (known as the Delaney Substation) owned by Arizona
Public Service Company otherwise known as APS. APS created the Delaney Substation in
approximately 2010 to prepare for utility solar power generation facilities that are planned in the
immediate area. The proposed 260’ microwave communications tower will allow
communications between Delaney and other electrical substations to allow APS to better
understand the power needs and shortcomings within its electrical grid network.
2.
The proposed microwave communications tower will be comprised of 2 microwave
communications antennae. The tower is a triangular structure extending to 250’ with a 10’
lightning rod placed at the top.

Density Development Area (0-1). Utility infrastructure and substations are acceptable uses with
the rural density comprehensive plan land element.
Public Participation Summary:

The applicant notified the surrounding parcel owners of the proposal within 300’. The site has
also been posted pursuant to Maricopa County requirements. The applicant met all public
participation requirements. There has been no public comments received.
Outstanding Concerns from Reviewing Agencies:

Luke Air Force Base has reviewed the proposal noting that the tower is in the general area that it
conducts
its
training
exercises.
The
agency
reviewing
stated
the
tower
will
“not negatively impact the flying and base operations at Luke AFB”. The agency did request
additional “Aviation Obstruction Light (AOL) or Aircraft Warning Light (ACWL)” to be installed due
to height and location of the tower. The applicant has complied with the request adding an
additional light to the tower per the request.
Staff Analysis:

The immediate areas to the west and north of the subject parcel have been both rezoned and
comprehensively planned for utility scale solar generation facilities. The request for the
microwave communications facility will allow the owner, APS, to better manage its electrical
loads on transmission lines which will benefit all anyone with access to the power grid. The tower
height is requested specifically due to the technical aspects of microwave communications
needing line of sight for transmission purposes. The vast distances between the utility
substations justify the height proposed.

Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve Z2023088 subject to the following conditions ‘a’ – ‘g’.

Introduction
DCR Transmission, L.L.C. (“DCRT”), an affiliate of Lotus Infrastructure Partners, is a transmission utility in
the state of California and will be a Participating Transmission Owner under the jurisdiction of the Federal
Energy Regulatory Commission.
DCRT seeks a Special Use Permit (“SUP”) from Maricopa County for the installation of a new microwave
communication tower and associated infrastructure (“Project”) in Maricopa County, Arizona, on land leased
from Arizona Public Service Company (“APS”). This project narrative was prepared by Sargent and Lundy to
support DCRT’s SUP Application.
The tower would be built immediately adjacent to APS’s existing Delaney Substation, which is located at
45550 W Salome Highway, Tonopah, AZ, 85354. Lease negotiations are currently underway with APS, who
is aware of and supportive of DCRT’s Special Use Permit application.
Purpose of Request
The purpose of the Project is to establish the required communication between the existing Southern
California Edison (“SCE”) Colorado River Substation (“CRS”), the series compensation station (“SCS”)
associated with Ten West Link 500 kV transmission line (“Ten West Link”), the new 500 kV Cielo Azul
switchyard (“Cielo Azul” or “Switchyard”) located in La Paz County, Arizona, the Atlas Solar Project (a
renewable energy project proposing to connect to Cielo Azul) and Delaney Substation (Figure 1).
Establishing this telecommunications system will assist in satisfying the communication requirements
associated with the interconnection of the Atlas Solar Project and the new renewable energy facilities
proposing to connect to the Switchyard to the bulk transmission grid via Ten West Link. This new
communication path is required to support the System Protection and is an essential element to maintain the
reliability of the bulk transmission network serving California and Arizona.

Description of Proposal
The proposed Project would be located on the southwest corner of Delaney Substation, outside of the
existing substation fence line, as shown on the preliminary Site Plan included in this package. The parcel is
zoned Rural-43 with a land use of “Other Employment”( Maricopa County Planning and Development
Department, 2023; Maricopa Association of Governments, 2023). On Maricopa County planning documents,
the land use is listed as “Vacant/APS Substation” (Maricopa County Planning and Development Department,
2019). The proposed Project footprint has previously been disturbed and is covered with aggregate stone.
The proposed Project consists of the following:
•
A single 250-foot self-support microwave communication tower with a 10-foot lightning rod (total
height 260 feet above ground level (“agl”)).
o
The proposed microwave communication tower will have two antennas: one located at 245
feet agl and one located at 215 feet agl. Additional antennas may be added to the tower in
the future.
o
The tower will be constructed of galvanized steel, which will be grey in color and will
naturally dull over the course of a year or less as the galvanizing is exposed to natural
weathering conditions.
o
The tower will be marked/lighted in accordance with FAA Advisory circular 70/7460-1 M,
Obstruction Marking and Lighting, a med-dual system-Chapters 4, 8 (M-Dual), & 15. This
will include infrared as well as signal lighting.
•
9-foot by 19-foot communication enclosure. Shelter height will be approximately 14 feet agl. The
below details are from the Communication Shelter Specification for the Project:
o
The equipment supplied shall be of metal construction and shall be self-supporting and free
standing. All metal work shall be free from burrs and sharp edges. Elements may be
connected by bolts, thread forming screws, or welds.
o
The Communication Shelter shall be fabricated as heavy duty, fire resistant and non-
combustible construction. The shelter walls shall provide a two-hour fire rating.
•
An approximately 30 kW diesel-powered emergency generator set.
•
APS will provide station power.
•
Sign and fence details are included in the Site Plan and design drawings included in this
application.
•
There will be no landscaping – disturbed areas will be restored to be consistent with the current
land cover (gravel).
•
Access to the SUP area will be via the existing Delaney Substation driveway. APS holds an existing
right-of-way for this driveway from Arizona State Land Department.
The permanent Project footprint will be approximately 0.08 acres, which will be finished with aggregate stone
at the completion of construction. Additionally, a temporary laydown area comprising 0.34 acres will be

required during construction. Access to the Project will be via the existing access road to Delaney Substation
and a proposed shared access road along the southern edge of the substation parcel.
The project would be operational 24/7. The facility will not be manned; however, maintenance and
inspections of the proposed Project would be performed on a routine basis in accordance with industry
standards and manufacturer guidelines.
Relationship to Surrounding Properties
Existing on-site and surrounding zoning and land use is as follows (Maricopa County Planning and
Development Department, 2023; Maricopa Association of Governments, 2023):

There are no wireless communication facilities within a 1,000-foot radius of the site. The proposed Project is
consistent with the current land use at the property, which is an existing electrical substation. Access along
the Delaney Substation driveway and the Maricopa County 40’ ROW reservation will be maintained.
There are no residential uses within a mile of the proposed tower location. Based on the Maricopa County
Planning and Development PlanNet website, the nearest residences are located on land that is zoned Rural-
43 and are 1.7 miles to the northeast. The nearest residential-zoned parcels are over 3 miles to the west-
south-west. Therefore, there are no compatibility issues with setbacks from current residential uses
(Maricopa County Planning and Development Department, 2023).
In recent years, the parcels located north, west, and south of the Project have applied for amendments and
rezonings in order to allow for solar development:
•
The property to the south of the site received a Comprehensive Plan Amendment in 2011
(CPA2011012) for a solar generating facility, with a land use change from Rural Development Area
to Industrial (Figure 2)(Maricopa County Planning and Development Department, 2023).
•
The property to the north and west of the site obtained a Comprehensive Plan Amendment
(CPA2019012) in 2021 changing the land use designation in the Tonopah/Arlington Area Plan from
Rural to Utilities (Figure 2). The same property to the north and west requested, and received, a
rezoning in 2019. The zoning was changed from Rural-43 to IND-2 IUPD in order to develop a
utility-scale solar facility (rezoning case Z2019121) (Figure 3) (Maricopa County Planning and
Development Department, 2023).
The proposed Project consists of required communications infrastructure to support the interconnection of
the Atlas Solar Project and other planned renewable energy to the bulk transmission grid via the Cielo Azul
Switchyard and Ten West Link.
Taken together, the Project and Ten West Link will improve transmission system efficiency and reliability

within the fast-growing region. Additionally, they will facilitate development of new renewable energy and
energy storage resources in Arizona and California, thereby helping both states achieve their renewable
energy standards and carbon reduction goals.

Location and Accessibility
An existing APS access road that runs along the southern portion of the Delaney substation property will be
used to access the site during construction, and to access the site during operation of the facility. Access to
existing APS access roads will be via W Salome Highway, approximately 0.4 miles south-southeast of the
site. Access along these shared access roads will be preserved throughout construction and operations.
The area around the proposed communication tower will be fenced to prevent public or wildlife access. A
fence is preferred by the proponent instead of a security wall.

Construction of the tower is scheduled to commence in late 2023 and would last from one to three months.
Community Facilities and Services
Elementary School District: District 47 – Arlington Elementary School District
High School District: District 1 – Buckeye Union High School District
Public Utilities and Services
DCRT will enter into an agreement with APS to receive electrical service. Additionally, a fiber connection will
be established between the Project microwave shelter and Delaney substation. No water or sewer
connections would be built, and no garbage disposal services would be necessary. The Project is located
outside of any fire district. The Project is within District 2 of the Maricopa County Sherriff’s office.
Other Information
The facility would not serve in-person customers. There would be no food service for the proposed use.
There would be no new parking built for the project. The project is not located within any flood zones,
washes, or canals, and is on a relatively flat parcel.
A stealth design is not being considered, as it is not feasible for such a large lattice structure. There are no
trees/windmills in the vicinity for the tower to blend in with a stealth design. The tower will be consistent with
existing structures at and around the Delaney yard.

PND engineering plan review (DPR, FCD and PND Transportation) has reviewed the 2nd
submittal of the SUP application routed for review on August 25, 2023. PND Engineering has
no comments or objections subject to the following conditions:
1. A section line , Thomas Road, coincides with the south boundary of the parcel. Per an
approval of reduction, a 40-foot reservation will be required for Thomas Road.
2. A mid-section alignment is located on the eastern perimeter of the proposed
development requiring building setbacks to start from a future half street of 40-feet per
the Maricopa County Zoning and Ordinance Section 11105.
3. All development and engineering design shall be in conformance with Section 1205 of the
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards and best practices at the time of application for
construction.
4. Engineering review of planning and/or zoning cases is for conceptual design only and
does not represent final design approval nor shall it entitle applicants to future designs
that are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance
and Drainage Policies and Standards; Floodplain Regulations for Maricopa County; and
the MCDOT Roadway Design Manual.

Good afternoon Mr. Lorentzen,
Thank you for the opportunity to provide comments on the Special Use Permit for the proposed Delaney Substation
Communication Tower. The site is approximately 0.7 acres and is located at 45550 W. Salome Highway in
unincorporated Maricopa County, AZ. The developer is proposing a 250ft microwave tower with additional 10ft
lightening rod at the SW corner of the property boundary (APN: 506‐31‐006D). The parcel in the application is located
outside of the Luke AFB 1988 JLUS 65 Ldn “high noise or accident potential zone” as identified by A.R.S. § 28‐8461 and is
within the “territory in the vicinity of a military airport” defined by A.R.S. § 28‐8461.
Subject to the results of an FAA Obstruction Evaluation/Airport Airspace and Spectrum Analysis (OE/AAA), this request,
as described in the narrative, will not negatively impact the flying and base operations at Luke AFB. We do however
request the installation of an Aviation Obstruction Light (AOL) or Aircraft Warning Light (ACWL) due to its height and
location. Approved lighting includes L‐810 red lighting in accordance with AC 70/7460‐1M. Lighting will increase
operational awareness of the tower location. The night vision goggle (NVG) compliant L‐810 red light is comprised of
visible red emitters and infrared (IR) emitters for pilot safety.
Since the site will be located within the “territory in the vicinity of a military airport,” it will be subjected to
approximately 170 over flights per day. We recommend a strong notification program on part of the County to inform
the applicant about Luke AFB operations.
