Kevin Robinson representing District 6. Councilman Robinson offered the invocation.

PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA
Councilman Robinson led the Pledge of Allegiance to the flag. 
Supervisor Gates thanked Councilman Robinson for coming and he gave a brief 
overview of Councilman Robinson’s contributions to the community including 36 years 
on the Phoenix police force and now as a councilmember. Supervisor Gates wished 
him the best.

PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL -

Kim Powell, with Maricopa County Animal Care and Control introduced Eliza, a four-
month-old puppy. Eliza is a German Shepard / Border Collie mix breed and has all the 
puppy behaviors with a lot of potential. Ms. Powell stated Eliza is at the West Shelter 
has been spayed, microchipped, and vaccinated and is ready to go home today.

the Board, read the proclamation. A copy of the proclamation is on file with the Clerk of 
the Board’s Office and retained in accordance with LAPR retention guidelines.
Melissa Steimer, Chief Executive Officer of Gabriel’s Angels, came forward to speak. 
Ms. Steimer said Gabriel’s Angels is a 23-year-old organization that operates in 
Maricopa and Pima Counties. The organization focuses on free therapy services for at-
risk kids. Ms. Steimer spoke about one of their therapy dogs that was on an euthanasia 
list, was rescued and has been a wonderful therapy dog.  She stated she was grateful

for the proclamation because she knows the value of adoption and therapy dogs in our 
society.

AQ-2022-002-RULE 245 (CONTINUOUS SOURCE EMISSION MONITORING)
Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), to 
solicit comments on the proposed revision of Maricopa County Air Pollution Control 
Regulations, Rule 245 (Continuous Source Emission Monitoring) and the associated 
proposed revision to the Arizona State Implementation Plan (SIP). Following the public 
hearing, the Board is requested to adopt the proposed amendments to the rule and to 
approve submission of the amended rule as a revision to the Arizona SIP.
The purpose of Rule 245 is to set forth continuous source emission monitoring requirements
for fossil fuel-fired steam generators, nitric acid plants, sulfuric acid plants, and fluid bed 
catalytic cracking units. Rule 245 was adopted to address Arizona SIP requirements in 40 
CFR 51.214. Per 40 CFR 51.214, each SIP must contain legally enforceable procedures to 
require stationary sources subject to emission standards as part of an applicable plan to 
install, calibrate, maintain, and operate equipment for continuously monitoring and recording 
emissions. Per Appendix P of 40 CFR 51, the requirements in 40 CFR 51.214 apply to 
owners and operators of fossil fuel-fired steam generators, nitric acid plants, sulfuric acid 
plants, and fluid bed catalytic cracking units.
The purpose of this rulemaking is to revise Rule 245 since it has not been approved into the
Arizona SIP because of rule approvability issues identified by the U.S. Environmental 
Protection Agency (EPA), such as control officer discretion. Consequently, the precursor rule
to Rule 245, Rule 41 (Monitoring) which was adopted in 1979, remains in the SIP. The 
Maricopa County Air Quality Department is proposing to revise Rule 245 to address rule 
approvability issues identified by EPA and to replace Rule 41 with the revised rule. Replacing 
Rule 41 with Rule 245 will update the SIP.

Following the public hearing, the Board is requested to adopt the proposed amendments to 
the appendix.
Appendix B is part of Maricopa County Air Quality Department’s (MCAQD’s) Title V permit 
program. It provides prospective Title V permit applicants with the filing instructions and 
standard application form. MCAQD is proposing to revise Appendix B by removing the filing
instructions and standard permit application form from the appendix. Since the adoption of 
Appendix B, improvements have been made to the Title V permit application process. The 
process has evolved by implementing an online filing platform, providing easily accessible 
permitting resources, and ensuring all application forms are fillable and compatible with the 
online platform. The current version of Appendix B is outdated and obsolete, with prospective
Title V permit applicants referring to the MCAQD website to obtain all current versions of 
application forms and instructions. While changes have been made to the Title V permit 
application process, the information required in the application remains the same to abide 
by requirements set forth in 40 CFR 70.5(c). The revision will include the addition of a 
statement providing the website link to the MCAQD webpage which includes all current Title
V permit application forms and instructions. These revisions will make it easier for the 
application form and instructions to be updated in the future without having to go through the 
rulemaking process.

AQ-2022-005-RULE 311 (PARTICULATE MATTER FROM PROCESS INDUSTRIES)
Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), to 
solicit comments on the proposed rescission of Maricopa County Air Pollution Control 
Regulations, Rule 311 (Particulate Matter from Process Industries) and the associated 
proposed rescission from the Arizona State Implementation Plan (SIP). Following the public
hearing, the Board is requested to adopt the proposed rescission of the rule and to approve 
submission of the rule rescission as a revision to the Arizona SIP.
The purpose of Rule 311 is to limit the discharge of particulate matter into the atmosphere 
by establishing emission rates based on process weight. It was originally adopted on July 
13, 1988, and the most current version was adopted in 2003. The Maricopa County Air 
Quality Department is proposing to rescind Rule 311 because it is an obsolete rule. Any
sources currently in, or planning to locate in Maricopa County with particulate matter 
emissions are, or will be regulated under other existing particulate matter rules.

solicit comments on the proposed creation of Maricopa County Air Pollution Control 
Regulations, Rule 205 (Emission Offsets Generated by Voluntary Mobile Source Emission 
Reduction Credits). Following the public hearing, the Board is requested to adopt the 
proposed rule and to approve submission of the rule as a revision to the Arizona SIP.

The purpose of this rulemaking is to create a new economic development rule to meet the 
federal New Source Review (NSR) offset requirements in the Clean Air Act for mobile source
emission reduction credits (MERCs). Currently, insufficient emission reduction credits exist 
in the Arizona Emissions Bank to permit large new or existing modified projects. This rule 
will, through voluntary fleet vehicle replacement or retrofit, allow for the generation, 
certification, and use of MERCs as federal NSR emission offsets. In providing a mechanism
for the voluntary generation of MERCs, Maricopa County will continue to move towards 
attainment of the national ambient air quality standards while still allowing for industrial 
growth.

10.
REASONABLY AVAILABLE CONTROL TECHNOLOGY STATE IMPLEMENTATION 
PLAN FOR THE 2015 8-HOUR OZONE NATIONAL AMBIENT AIR QUALITY 
STANDARD
Convene a public hearing to solicit comments on the Reasonably Available Control 
Technology State Implementation Plan (RACT SIP) for the 2015 8-Hour Ozone National
Ambient Air Quality Standard and submittal of the RACT SIP to the U.S. Environmental 
Protection Agency (EPA) for approval into the Arizona State Implementation Plan. Following
the public hearing, the Board is requested to approve submittal of the RACT SIP to the EPA.
On November 7, 2022, portions of Maricopa County were reclassified to a moderate 
nonattainment area with respect to the 2015 8-hour ozone national ambient air quality
standard. Sections 182(b)(2) and (f) of the Clean Air Act require jurisdictions that are 
classified as “moderate” or higher nonattainment for ozone to implement reasonably 
available control technology (RACT) for all sources subject to a Control Techniques 
Guideline (CTG) as well as for all non-CTG major sources of volatile organic compounds 
(VOCs) or nitrogen oxides (NOx). Non-CTG major sources of VOCs or NOx are those
sources that emit, or have the potential to emit, 100 tons per year of VOCs or NOx.
In response to the reclassification, the Maricopa County Air Quality Department (MCAQD) 
evaluated all local controls (rules and permit conditions) associated with CTG source
categories and non-CTG major sources of VOCs or NOx to determine if the controls 
implemented RACT. The results of the evaluation are detailed in the RACT SIP which 
MCAQD will submit to the EPA upon approval from the Board.

Blue Crowley, resident, spoke about a potential air-quality violation being issued in the 
next three days due to the rising temperatures and the increased tailpipe emissions. 
Mr. Crowley said the County transit system needs additional focus on the “transit 
desert” in the east valley that includes new buses, bus shelters, curb cuts and bike 
lanes. He says there is a need for more cooperation for the transit system.

AMENDMENT TO OPERATING AND FINANCIAL PLAN BETWEEN THE MARICOPA 
COUNTY AND THE U.S. DEPARTMENT OF AGRICULTURE, FOREST SERVICE, 
TONTO NATIONAL FOREST
Approve “Amendment of Grant or Agreement” #2 to accept funding in the amount of 
$100,400 for the CY 2023 Operating and Financial Plan (Exhibit A) between Maricopa 
County on behalf of the Maricopa County Sheriff’s Office and the U.S. Department of 
Agriculture, Forest Service, Tonto National Forest. The reimbursement period will be 
retroactive to January 1, 2023, through December 31, 2023.  Also approve a rollover amount
of $43,078.99 from the CY 2022 Agreement. Also approve an estimated amount of $30,000
that is allowed for in the agreement for special enforcement situations that include but are 
not limited to fire emergencies, drug enforcement, and certain group gatherings for a total of
$173,478.99.
The MCSO Indirect Rate is 12.30%. Total grant indirect costs are estimated to be 
$21,337.92, and none of this amount is recoverable.  The unrecoverable amount of 
$21,337.92 will be absorbed within the Sheriff’s General Fund operations.
This grant award is multi-year and recurring. The Sheriff’s Office has been providing these 
services for more than 30 years. The award does not require a cash contribution, nor an in-
kind contribution, and there are no future or ongoing contributions required following the 
grant period. This service is not mandated; however, it furthers the Sheriff’s public safety 
mandate. Funding is used to pay deputy overtime, the leases on two vehicles, monthly 
charges for cell phones, and other supplies related to this grant agreement for MCSO to 
assist in patrolling portions of the Tonto National Forest, located in Maricopa County.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditure of the funds is not prohibited by the budget law.

ADDITION TO FLEET - RICO FORFEITURE
Approve a one-time addition to the Sheriff's RICO vehicle fleet. This vehicle was seized 
during an MCSO investigation and has been forfeited to the State under Order of Forfeiture 
(CV2022-001331), filed 5/10/2022. It is valued at approximately $16,246 and will be used by
MCSO for special investigative purposes. This vehicle will be retired from the fleet when it is 
no longer useful and disposed of according to RICO guidelines with no funding from the 
General Fund for replacement. Annual operations to be supported by the RICO Fund (212).

COMPETITION IMPRACTICABLE WITH BELL HELICOPTER CO.
Approve a Competition Impracticable with Bell Helicopter Co. in the amount of $123,000 for 
5 MCSO employees assigned to aviation to attend flight school training May 30, 2023 - June
2, 2023.
Bell helicopter pilots are required to attend the manufacturer’s school on an annual basis. 
This allows the pilot to remain licensed with the specific aircraft the pilot operates. The 
insurance carrier requires regular/yearly emergency flight training in order to retain preferred
status and provide the lowest possible rates. Bell Helicopter Co. is specific helicopter 
emergency flight training, done at the factory, with factory flight instructors, in factory owned 
aircraft. This training includes ground school, and simulator training. It allows pilots to 
conduct, and be trained in, simulated in-flight and on the ground emergency situations, and 
maneuvers. Attending the training, at the factory, in the factory, in factory owned equipment,
with factory flight instructors, eliminates the risk and possible damage to the County's aircraft.

COMPETITION IMPRACTICABLE WITH ASSET SECURITY TRACKING AND 
RECOVERY
Approve a Competition Impracticable with Asset Security Tracking and Recovery (ASTR) in 
the amount of $131,611.75 for the purchase of covert surveillance systems used for various 
criminal investigations.
These tactical camera systems are placed on streetlight poles and continuously record 
activities and stream those activities to web-based computers which record the event for 
investigator to watch and document activities as evidence. This equipment allows detectives 
to observe criminal activities from afar and record without compromising the investigation 
during surveillance.
ASTR is the sole provider of this equipment and technology being utilized by the government
to combat the criminal organizations in the metro Phoenix area with a patent pending on this 
exclusive design.  MCSO has been purchasing from them since FY2017.  It is critical to 
remain consistent with inventory and operational familiarity as well as being the only covert 
camera system approved by cities they are used within.

DELEGATION OF AUTHORITY FOR FY 2023 SCAAP APPLICATION PROCESS
Approve delegation of authority to the Sheriff to apply for FY 2023 SCAAP (State Criminal 
Alien Assistance Program) reimbursement funds, per Part I:  SCAAP Guidelines issued by
the Bureau of Justice Assistance, Office of Justice Programs, U.S. Department of Justice.
SCAAP provides federal payments to states and localities that incurred correctional officer 
salary costs for incarcerating undocumented criminal aliens who have at least one felony 
and two misdemeanor convictions for violations of state or local law and who are 
incarcerated for at least 4 consecutive days.  
The reporting period is July 1, 2021 through June 30, 2022. The application deadline is May 
31, 2023. Approval of this action allows the application process to continue. MCSO has 
applied for this funding on behalf of Maricopa County for approximately 21 years.  The actual 
award amount is formulaic using reporting period jail system inmate data downloads and 
payroll data.  Award amounts have declined in recent years. MCSO will return to the Board 
for authorization to accept any funding awarded that is pursuant to this application.

MOU WITH THE ARIZONA DEPARTMENT OF PUBLIC SAFETY REGARDING 
COMMERCIAL VEHICLE ENFORCEMENT MATTERS
Approve a Memorandum of Understanding (MOU) between the Arizona Department of 
Public Safety (DPS) and Maricopa County Sheriff's Office (MCSO) regarding commercial 
vehicle enforcement matters.   This is a non-financial MOU and becomes effective upon the
date of signature and will remain in effect for five (5) years or until MCSO disbands or 
suspends its commercial vehicle enforcement program. The parties may renew this 
Agreement for an additional five year period by written amendment. 
This MOU allows for DPS to assist MCSO in establishing procedures for using Commercial 
Vehicle Safety Alliance (CVSA) decals and using the ASPEN software program used for 
conducting motor carrier inspections.  DPS will provide the CVSA decals at no cost to MCSO.
DPS will also conduct training on the ASPEN software at no cost for MCSO Deputies. While
there are no immediate costs, MCSO will be responsible for any future purchasing and 
maintaining all hardware and software necessary to run ASPEN. 
This MOU supersedes all previous agreements on this matter.   Either party may cancel this
MOU with thirty (30) days written notice to the other party.

AGREEMENT WITH THE ARIZONA DEPARTMENT OF EMERGENCY AND MILITARY 
AFFAIRS FOR ANTI HUMAN TRAFFICKING (50ANTITRFK) - FFY2023 FUNDING
Approve the Agreement and acceptance of grant funds to the Sheriff’s Office from the 
Arizona Department of Emergency and Military Affairs (ADEMA), Anti Human Trafficking 
(50ANTITRFK) under Agreement Number M23-0021 in the amount of $495,681 for the 
award period that is retroactive to October 1, 2022, and terminates December 31, 2025. This
Agreement can be terminated by any of the parties by written notice to the other parties thirty 
(30) business days prior to termination.

This is the first time this funding has been awarded to the Sheriff’s Office. There is no match
requirement. The Sheriff’s Office indirect cost rate for FY23 is 12.30% which is applicable to
the award amount of $240,742 that will stay with MCSO. The calculated indirect costs of 
$29,611.27 will be absorbed by the General Fund. The remainder of the funding, $254,939, 
will be paid to Arizona State University for related services. These funds are not included in 
MCSO’s Indirect Cost Calculation. There are no future or ongoing contributions required after
the grant period ends. 
This is not a mandated function although it supports the MCSO public safety mandate and 
provides a benefit to the citizens by furthering anti-trafficking efforts and increasing law 
enforcement response to human sex trafficking incidents. This is a competitive award. The 
Maricopa County Sheriff’s Office is one of several local law enforcement agencies in the 
Phoenix metro area that participate in this effort.
These revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditures of these revenues are not prohibited by the budget 
law.

SPACE LEASE AGREEMENT WITH PEPPER PLAZA, LLC
Approve a lease agreement between PEPPER PLAZA, LLC, an Arizona limited liability 
company (“Landlord”) and Maricopa County, a political subdivision of the State of Arizona
(“Tenant”) concerning 3,025 gross sq. ft., located in an office building that is situated at 40 N 
CENTER ST MESA, AZ  85201. The term of this lease will be for five (5) years and will 
commence on the date of Substantial Completion of the Landlord Improvements or April 1, 
2023, whichever is later and will expire on March 31, 2028. 
The monthly base rent schedule, not including rental tax, is as follows: Year One, $5,924
plus tax; Year Two, $6,102 plus tax; Year Three, $6,285 plus tax; Year Four, $6,473 plus 
tax; and Year Five, $6,677. The cost of this lease is funded with special revenue funds 
granted in an award by the Arizona Department of Emergency and Military Affairs specified 
in Agreement M23-0021. 
This lease will enable a County facility for the east side to be shared by multiple agencies 
that is similar to the Southwest Family Advocacy Center on the County’s west side. The 
primary focus will be Human Trafficking.  
This lease can be cancelled at the end of any fiscal year for non-appropriation of funds.

Civic Center Drive, Gilbert, Arizona. Maricopa County utilizes approximately 1,793 square 
feet of building space on said property for a Justice Court Facility. The parties agree to

The purpose of this amendment is Extend services through June 30, 2024.
This agreement is for third party claims payment services provided by AHCCCS to CHS.
AHCCCS processes all outside provider claims incurred due to the incarcerated patient 
population needing medical services from a health care provider outside of the jail system. 
These patients are currently booked into the jail and under the care of CHS. Although, CHS 
provides many services on site, it does not provide inpatient acute hospitalization, certain
specialty care services, or emergency and urgent care services.

YAVAPAI NATION
Pursuant to the Board’s Resolution, regarding Processing of Tribal Gaming Fund 
Applications, dated May 31, 2016 (“Gaming Resolution”), Maricopa County is the 
administrative pass-through for tribal gaming applications (“Applications”) received pursuant 
to the State of Arizona Department of Gaming Compact (“Compact”). The Applications seek
funds for government services that benefit the general public, including public safety,
mitigation of the impacts of gaming, or promotion of commerce and economic development. 
Pursuant to the Board’s Gaming Resolution, Maricopa County defers substantive review of 
the Applications to the Tribal authorities and place these matters on the consent agenda. 
Pursuant to the Compact, Sections 12 (b) and (d), the Tribe shall perform the substantive 
review of applications and ensure 12% of its contributions under the Compact go to services
that benefit the general public. Accordingly, authorize Maricopa County to accept and pass-
through applications received pursuant to the Fort McDowell Yavapai Nation compact

AGREEMENT WITH TOOTH BUDDS, INC FOR ORAL HEALTH SERVICES FOR HEAD 
START PROGRAM PARTICIPANTS
Approve a non-financial Agreement between Tooth BUDDS, Inc., (“Contractor”) and 
Maricopa Count administered by its Human Services Department. The purpose of the 
Contract is for Contractor to provide Oral Health Services to Head Start Program participants
by conducting onsite oral health services to Head Start program participants at Head Start 
program locations to include exams/screenings, prophylaxis (cleaning), possible x-rays and 
restorative care, fluoride treatments, dental sealants as needed, along with providing dental 
outreach to students and their families to encourage preventative oral health activities.
The Agreement term will begin May 1, 2023, through May 1, 2025. This non-financial

Approve Amendment No. 9 to the Intergovernmental Agreement (Agreement) between 
Arizona Department of Economic Security (DES) and Maricopa County, administered by its 
Human Services Department (County). 
The purpose of Amendment No. 9 is to addresses the following:
1. To revise the Itemized Service Budget for the period of July 1, 2022, through June 30, 
2023.
2. In accordance with the Alert issued on 2/15/2023, the revised allocations are as follows:
a. The total value of the budget is revised from $5,848,478.25 to $5,123,311.00, a reduction
of $725,167. 
b. The following funding allocations ended on September 30, 2022: LIHEAP, LIHEAP 
American Rescue Plan Act (ARPA), and CSBG Coronavirus Aid, Relief, and Economic
Security (CARES).
c. The itemized service budget is revised and attached.

between May and September 2023. 
The County shall provide the Subrecipient with $1,015,000 in American Rescue Plan Act
Coronavirus State and Local Fiscal Recovery (ARPA) Funds under the Assistance Listing

Division Policy Council Bylaws for the Maricopa County Head Start Policy Council. The

Terms, Meeting Location, Officers, and removes Article 6 (Committees). 
The purpose of the Policy Council is to promote the objectives of the Maricopa County Head
Start Program. The Head Start program must establish and maintain a formal structure for 
program governance that includes a governing body at the County level and a policy council

grantees to be used to provide emergency rental assistance. 
The funding will be utilized to assist eligible renter households impacted by the COVID-19

Health Officials (NACCHO) in the not-to-exceed amount of $10,000.00 for the 2023 Medical
Reserve Corps (MRC) Respond, Innovate, Sustain, and Equip (RISE) program. 
The project and budget period for this award is from April 26, 2023, through September 29, 
2023.  The Term of the Agreement shall begin from the Effective Date and shall continue 
until September 29, 2023.
This is the fourth award time the program has been granted the RISE Award and if a new 
round occurs, the Program will most likely apply. It was a competitive grant opportunity. 
There are no cash or in-kind match requirements, and on-going contributions will not be 
required. This is not a mandated service but provides a benefit to our citizens by improving 
upon the capacity building of our MRC volunteers to meet emergency management and 
response needs; currently COVID-19 and the increase in needed volunteers and trainings. 
MCDPH indirect rate for FY23 is 17.24%.  The full indirect costs are estimated at $1,470.49

health related and support services for up to 4500 People Living with HIV/AIDS.  Should the
grant cease, on-going contributions should not be required.

for graduate students in the dietetic internship. The agreement is non-financial, and the term

As a part of its established accredited dietetic internship program, the Department of Public

certain confidential patient identifiable information available electronically.  HH will allow 
MCDPH access, and permit its physicians, healthcare providers, and employees to access
patient information to provide patient care, disease control services, review of suicide records
and review of opioid fatality records.  The effective date of the Agreement shall be upon HH’s 
signature.  
The Division of Epidemiology and Informatics of MCDPH routinely requests and receives 
medical records from hospitals and healthcare providers in the course of disease 
investigations mandated under the AZ Administrative Code Title 9, Chapter 6.  MCDPH is 
also charged with reviewing all records related to suicide per A.R.S. 36-199.01 and opioid 
fatalities per A.R.S. Title 36, Chapter 1, Article 6 as part of its responsibility for leading the 
Suicide Mortality Review Board and a county requirement to lead the Opioid Fatality Review

Health (MCDPH), Office of Oral Health (OOH) to provide services for the Dental Sealant 
Program.  The Dental Sealant Program will promote oral health and provide ADHS
authorized preventive dental services.  The price sheet is broken down into the following 
costs per service:  sealant applied per child $80; per fluoride application $8; dental hygienist
per provider $30; dental assistant per provider $18; training-dental hygienist, per hour per 
provider $30; training-dental assistant/coordinator, per hour per provider $18; and program 
outreach $18 per hour.  The not-to-exceed amount is $200,000.00 for the budget period 
January 01, 2023-June 30, 2023.  The term for the IGA is January 01, 2023 through 
December 31, 2028.
MCDPH’s indirect rate for FY23 is 17.24%.  Indirect costs are estimated at $29,409.76 all of
which is recoverable.  Departmental indirect rates are re-established at the beginning of each
fiscal year and future indirect costs will be collected at the corresponding rate.  
The Dental Sealant grant award is reoccurring and has been awarded to MCDPH in previous
years.  This grant does not require in-kind match, indirect costs are fully recoverable, and

provides a benefit to the citizens by providing the dental sealant services necessary to

RFP CONTRACT FOR NALOXONE PHARMACY DISTRIBUTION PROGRAM
Pursuant to MC1-329 of the Maricopa County Procurement Code, authorize the Chairman 
of the Board of Supervisors to execute a Public Health Request for Proposal (PH RFP) 
contract, in a form approved by the County Attorney’s Office, to the successful bidder in 
response to PH RFP 230144, Naloxone Pharmacy Distribution Program.   
The RFP was released on February 25, 2023, and responses were due by 2:00pm on March
24, 2023.  A Public Health Evaluation Committee will review all responses received utilizing 
evaluation criteria included in the RFP and select those most advantageous to Maricopa 
County.  The anticipated amount to be spent is approximately $1M. The anticipated start 
date of the contract is May 01, 2023 and will end December 31, 2024.  If additional funds 
become available, awards resulting from this solicitation may be amended and/or extended 
based on the need for continuous services as well as satisfactory Contractor performance.  
These agreements will be funded through the American Rescue Plan grant. Should the
funding source cease and alternate funding not be available, Section 4.0 of the RFP, 
Availability of Funds, will apply allowing for a change or termination of the agreement.

SOLE SOURCE ACQUISITION FOR BIOMERIEUX VITEK MS PRIME
Approve a Sole Source Acquisition between Maricopa County by and through its Department 
of Public Health (MCDPH) and Biomerieux, the manufacturer of the Vitek MS Prime mass 
spectrometry instrument, used for rapid identification of Mycobacterium and other bacterial 
organisms for the MCDPH Laboratory Division at an approximate cost of $268,548.11 plus 
tax.  Additionally, it should be noted that the first year of maintenance with the instrument is 
included; however, thereafter, there will be a cost of approximately $22,000 per year for a 
maintenance service agreement, and approximately $20,000 per year for associated reagent
consumable costs.  A Sole Source Acquisition is necessary because Biomerieux is the only 
manufacturer that offers an instrument that has Food and Drug Administration (FDA) 
approval for the specific tests we need to have completed.  
The MCDPH Laboratory must have an FDA approved methodology for identifying 
Mycobaterium species.  The lab’s current system, the Accuprobe, has been discontinued. 
Mass spectrometry is the fastest and most accurate method of identifying mycobacterium.

A search for instruments and their associated tests was conducted using market research 
and it was determined that there were no alternatives that were deemed acceptable.  This is 
because no other vendor offered an FDA approved library of organisms that includes 
Mycobacterium.

MARICOPA ASSOCIATION OF GOVERNMENTS (MAG) FOR AZTECH INTELLIGENT 
TRANSIT AND FREIGHT SIGNAL
Authorize the Maricopa County Department of Transportation (MCDOT) to accept federal 
funding reimbursements as approved by the Maricopa Association of Governments (MAG) 
and expend the grant funds for the Department of Transportation: Transportation System 
Management Project, sub-project TE073 Intelligent Transit and Freight Signal up to the total 
cost of the project.
Estimated construction cost of the project is $858,700.  MAG has authorized $800,324 in
federal reimbursement funds available in FY 2023. MCDOT’s local 5.7% match portion is 
$58,376 and will be absorbed by the department’s operating budget from HURF funds.

The grant awarded is a one-time award.  There are no future or ongoing contributions 
required after the grant period ends. The grant fulfills a mandated service that the department
is required to perform. The grant award is a competitively bid, and other eligible agencies
may or may not bid on this grant award.  
The MCDOT’s FY 2023 indirect cost rate is 14.84%. All costs under this agreement are for 
capital expenditures not subject to indirect cost recovery.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditure of the funds is not prohibited by the budget law. This 
budget adjustment does not alter the budget constraining the expenditure of local revenues

authorized to offer up to a 3% brokerage fee pursuant to Resolution 2007R012. Interested 
buyers procured by ROI will be required to bid at public auction pursuant to A.R.S. § 11-251.
The County utilizes its disposition program on all excess properties to evaluate them for the 
best potential of sales or leasing, depending on current market information. The properties 
would be sold at public auction with the minimum bid being market value as determined by 
appraisal, unless to another agency for public purposes, at market value without auction.

The Clerk handed the in-room speaker slips to the Chairman. Andrea Cummings, Legal 
Counsel, read the admonishment regarding the Call to the Public protocol based on 
Open Meeting Law.
Supervisor Hickman said he had eight speaker slips. The speakers listed regarding 
Legislative District 13 appointment were generally critical of the Board and wanted the 
Board to appoint Liz Harris.
Christina Tyler, resident, spoke about the vendors at Chase Field not receiving their 
portion of tip money from events. She said she had exhausted all avenues to resolve 
this and was there to ask the Board of Supervisors for assistance because they serve 
as the Board of Directors for the Stadium District.
Brittany Conklin, resident, expressed her concern for the death of animals at Animal 
Care and Control, differing from the euthanasia of animals due to overcrowding or 
behavioral problems. She was there to talk about the culture of incompetence that has 
led to deaths of animals at the shelter. She cited a recent case of miscommunication 
and was demanding an investigation into the deaths of innocent animals.
 
Chris Hamlet, Mesa resident, was present to talk about the Legislative 13 appointment. 
He said he wants that decision to be the will of the people and that would be Liz Harris. 
Lezley Shepherd, resident. spoke about Legislative District 13 and the wrongful 
expulsion of Liz Harris.
James Urton, resident, and an elected Precinct Committeeman (PC) for Legislative 
District 13. He was there to request the Board expedite the process and appoint Liz 
Harris. The PC’s put three names forward and the Board needs to make the selection. 
He respectfully requested the Board reinstate Liz Harris as the representative.
 
Cynthia Sullivan, resident of Cave Creek, reviewed how the Board represents the 
people of Maricopa County. She talked about the Constitution and how the people elect 
the representatives they want to represent them. She concluded that Liz Harris was 
elected by the people, and therefore, should be reappointed. 
Denise Babayon, resident of Phoenix, said the Board has sworn to uphold the 
constitution and the will of the people. She concluded that Liz Harris is a servant of the 
people, duly elected by the people, and needs to be appointed back into the seat she 
was elected to.
William Charles Blue Crowley III, resident, son of late Senator William Charles Crowley 
Jr. He said according to the legislation, there is no hurry for the Board to make this 
appointment, but to do their due diligence. Mr. Crowley stated the accusations made 
by the representative that was expelled were serious and should have repercussions.

Supervisor Gates thanked everyone who came today to exercise their first amendment 
rights. He said he would exercise his first amendment right and standup for Councilman 
Robinson who served the City of Phoenix for 36 years, is a man of God, and is a man

Veterans Standdown at the County fairgrounds from 7:00 a.m. to 4:00 p.m. This annual 
event offers Veterans services including housing, medical and pet services. He said on 
May 5, 2023, will be the annual Memorial Tribute for the Sheriff’s department, honoring 
the many fallen officers. Supervisor Gates thanked Chairman Hickman for his work in 
the partnership with City of Phoenix and the Flood Control District, working toward a 
flood hazard mitigation project. He congratulated the Phoenix Suns for their victory in 
game one of the playoffs.
Supervisor Sellers attended the East Valley mayors’ breakfast last week.  He also 
attended the Valley Metro Board of Directors meeting with the emphasis on the 
proposition 400 extension. He addressed the Chandler Chamber of Commerce 
leadership class that was offered and said he was pleased to see the number of people 
who continue to be interested in leadership. He concluded with comments regarding 
the need for prop 400  to be supported the coming economic growth.
Supervisor Galvin acknowledged the Sheriff’s Memorial Tribute coming up on May 5th 
and the Veterans Standdown on April 28. 
Chairman Hickman echoed Supervisor Gates’ comments regarding Councilman 
Robinson and said the Board does not tell anyone how to give prayer to the Lord. He 
also stated that the Pledge of Allegiance is a part of each meeting and the Board takes 
the pledge seriously. To be called “smug” while an audience member kept their hat on 
their head and videotaped the Board during the Pledge concerned him. Chairman 
Hickman said there were two videos he wanted to share. One regarding the Spur Cross 
Ranch Conservation area, adding 30 additional acres of recreation area to the valley. 
The other video featured a recent change in the way Procurement Services attracts 
vendors, specifically wanting to attract smaller businesses to do business with Maricopa 
County.
