License and Bar Use and Live Entertainment Use Permits.
– Applicant Representative Attorney Cameron Morgan gave a presentation on the Old Town Tavern
Liquor License and Bar Use and Live Entertainment Use Permits.
– There was no public comment on these items.
– Councilman Graham made a motion to continue Item No. 3 and Item No. 5 to a future City Council
Meeting date. Councilwoman Dubauskas seconded the motion, which carried 6/1, with Mayor
Borowsky; Vice Mayor Kwasman; and Councilmembers Dubauskas, Graham, Littlefield, and
Whitehead voting in the affirmative and Councilwoman McAllen dissenting.

Request: Adopt the following resolutions related to the applicant’s requests to operate a new bar with
live entertainment on a ±6,000 square foot site, zoned Central Business Downtown Overlay (C-2 DO),
and to seek Council approval of 41 In-Lieu Parking Credits necessary to meet parking requirements
due to the proposed increase in land use density:
1. Resolution No. 13592 for a Bar Conditional Use Permit.
2. Resolution No. 13593 for a Live Entertainment Conditional Use Permit.
3. Resolution No. 13600 approving a request to participate in the In-Lieu Parking Program for 41
Parking Credits to be paid monthly for a new bar with live entertainment.

No. 455) regarding certain provisions of Article VII, Sections 7.1300. through 7.1304.(Multifamily
Conversion Developments), and any associated sections for the purpose of addressing State of
Arizona legislation of House Bill 2110 intended to allow for the adaptive reuse or redevelopment of
existing commercial, office, or mixed-use parcels for multifamily residential use.

Request: Adopt Resolution No. 13598 authorizing settlement in Keith Lanning v. City of Scottsdale,
ICA Claim No. 20192000422, currently pending at the Industrial Commission of Arizona, in the
amount of $135,000, bringing Mr. Lanning’s lifetime disability award to a close and authorizing a
credit of $135,000 against any future disability benefit to Mr. Lanning in the event that his case is ever
reopened.

PUBLIC COMMENT
Public Comment time is reserved for Scottsdale citizens, business owners, and/or property owners to
comment on non-agendized items that are within the Council’s jurisdiction. No official Council action can be
taken on these items. Advocacy for or against a candidate or ballot measure during a Council meeting is not
allowed pursuant to State law and is therefore not deemed to be within the Council’s jurisdiction.
Public Comment is limited to a maximum of 12 speakers and a total of 36 minutes. Speakers are limited
to three minutes to address the Council during “Public Comment.” A Request to Speak form must
be submitted before the Mayor announces the Public Comment period.
– Melissa Kemp, Scottsdale resident, discussed how open public comment allows residents to be
heard and discussed recent change to the public comment process.
– Steve Sutton, Scottsdale resident, discussed the Corral Parking Garage spaces, the cost to build a
new garage, and requested a new parking study.
– Steven Cross and Christa Cross, Scottsdale residents, discussed the new Montessori school they
are building in north Scottsdale.
– Michael Fernandez, Pottery Paradise owner, discussed the need to create a downtown task force
and the existing parking garage in Old Town.
CITIZEN PETITIONS ITEM 10
Citizen Petitions: This portion of the agenda is reserved for the submission, presentation, and
consideration of citizen petitions. There is no limit on the number of petitions a citizen may submit;
however, each citizen is limited to a total time of three minutes to speak to his/her petition(s). A

Request to Speak form must be submitted, together with the petition(s), to the City Clerk’s Office at least
two business days before the requested Council Meeting date.
***10. Receipt of Citizen Petitions
Request: Accept and acknowledge receipt of citizen petitions. Michael Fernandez submitted the
following citizen petitions:
1. The first petition requests the City Council to reenact its ban on electronic devices from the dais
during Council Meetings.
2. The second petition requests that City employees and the public be made aware of the specifics
of any allegation made against the employee before the employee is placed on any type of
suspension.
Note: Any member of the Council may make a motion, to be voted on by the Council, to: (1) Direct
the City Manager or responsible Charter Officer to agendize the petition for further discussion; (2)
Direct the City Manager or responsible Charter Officer to investigate the matter and prepare a written
response to the Council, with a copy to the petitioner; or (3) Take no action.

– A citizen petition presented by Michael Fernandez regarding the City Council reenacting its ban on

Kwasman seconded the motion, which carried 6/1, with Mayor Borowsky; Vice Mayor Kwasman; and

Councilwoman McAllen dissenting.

Appointee: Monica Boyd – Head of the Merit System
Request: Seeking Council approval of the Head of the Merit System.
– Mayor Borowsky made a motion to approve the appointment of Monica Boyd to the Public Safety
Personnel Retirement System Police and Fire Boards as the Head of the Merit System.
Councilwoman Whitehead seconded the motion, which carried 7/0, with Mayor Borowsky; Vice Mayor
Kwasman; and Councilmembers Dubauskas, Graham, Littlefield, McAllen, and Whitehead voting in
the affirmative.

Work Study Sessions: Work Study Sessions provide a less formal setting for the Mayor and Council to
discuss specific topics, at length, with each other and City staff. Work Study Sessions provide an opportunity
for staff to receive direction from the Council and for the public to observe these discussions.

available for the Council to have focused discussions, spoken comment (maximum of 5 speakers and a

– French Thompson, Scottsdale resident, discussed the tourism plan promotion of Old Town and the
need for inclusion of actionable and deliverable strategies.
– Bob Pejman, Scottsdale resident, discussed the tourism and events strategic plan and the need for
inclusion of actionable items; noted concerns with the exclusion of art galleries; and discussed the
Keen Survey and the need to prioritize core assets.
– David Smith, former Scottsdale City Councilmember, discussed the tourism and events strategic
plan actionable items with deliverables and metrics, such as impact on tourism, and the promotion
of performing arts and the need to involve interested parties in this process.
– Mayor Borowsky closed public comment on this item.
