5. PROCLAMATION PUBLIC DEFENSE RECOGNITION WEEK MARCH 2026 WHEREAS, March 18, 2026, marks the 63rd anniversary of the United States Supreme Court’s decision in Gideon v. Wainwright, in which the United States Supreme Court ruled that the United States Constitution’s Sixth Amendment right to the assistance of counsel is essential to a fair trial and requires the appointment of counsel for indigent defendants accused of felonies in state court; and WHEREAS, the Supreme Court recognized in Gideon that “. . . lawyers in criminal courts are necessities, not luxuries;” and WHEREAS, Maricopa County has long upheld and affirmed the guarantee of the Sixth Amendment’s right to counsel, recognizing counsel as essential to the fairness of criminal proceedings; and WHEREAS, Maricopa County established the Office of Public Defense Services, comprised of five separate legal offices: the Office of the Public Defender, Office of the Legal Defender, Office of the Legal Advocate, Office of the Public Advocate, and Office of Contract Counsel; and WHEREAS, Maricopa County Public Defense Services' attorneys and support staff continue to work tirelessly to represent their clients and uphold the rights set forth in the United States Constitution by providing essential, constitutionally-guaranteed legal services to those who would not otherwise have access to representation; and NOW, THEREFORE, BE IT RESOLVED that the Maricopa County Board of Supervisors does hereby proclaim that the week of March 16, 2026, shall be recognized as “Public Defense Recognition Week” in appreciation of the essential role played by the attorneys and staff of Public Defense Services and in upholding the Sixth Amendment guarantee of counsel and protecting the fundamental right to a fair trial. JOMAX RV & BOAT STORAGE FACILITY (Supervisorial District: 4) Case #: MCP2022002 Applicant and Owner: Taylor Earl, Earl & Curley, P.C. / Synergy Funding LLC Request: Military Compatibility Permit (MCP) with a precise Plan of Development for a RV, boat, vehicle and self-storage facility in the Rural-43 MAAMF WHSC zoning district. Site Location: Generally located 975’ south of the SWC of 195th Ave. & Jomax Rd. in the Surprise area. Commission Recommendation: On 02/05/26, the Commission voted 6-0 (motion by Commissioner Hernandez D4, seconded by Commissioner Leighton D4) to adopt a motion recommending the Board of Supervisors approve MCP2022002 subject to conditions ‘a’ – ‘j’: a. Development of the site shall be in general conformance with the Site Plan entitled “Jomax Storage Facility”, consisting of 8 full-size sheets, dated revised November 4, 2025, and stamped received December 16, 2025, except as modified by the following conditions. b. Development of the site shall be in general conformance with the Narrative Report entitled “Jomax RV & Boat Storage Facility”, consisting of 13 pages, dated revised December 16, 2025, and stamped received December 16, 2025 except as modified by the following conditions. c. The following Planning Engineering conditions shall apply: 1. Detailed grading and drainage (site infrastructure) plans must be submitted with the application for building permits. 2. Hydraulic calculations required at the time of final engineering design to show how the existing offsite flows are being routed across and/or along the west side of 195th Ave. Analysis to include the impact of the proposed improvements at the northeast corner of the property, driveways and 195th Avenue roadway improvements. 3. Hydraulic calculations required at the time of final engineering design to show that proposed fencing along the north property line shall have no adverse impact on the upstream neighboring properties upstream. 4. All disturbed or developed portions of the entire site shall be retained onsite. 5. Retention basins must drain within 36 hours. 6. Site is in a Special Flood Hazard Areas (SFHAs) and will require a flood use permit when submitting for a building permit. 7. All historic flows exiting the site shall exit after development in the same location and manner in which they exited before, or with less flow depth, quantity, or velocity than before. 8. A separate topographic plan sheet showing the existing conditions including the Right of Way limits of 195th Avenue along the site frontage must be submitted at the time of building permits for the purpose of evaluating current drainage conditions. 9. Storage of materials, walls/fence, parking and storm water retention are prohibited in the right-of-way. 10. Driveway access to County road(s) must be paved and will require a permit from MCDOT issued concurrent with building permit(s) required for site development. Drainage flow along the roadway must be maintained. 11. All adjacent roadway improvements required by MCDOT in the Traffic Study approval shall be permitted with building permits and in accordance with the current RDM standards. 12. Developer to provide improvements that include one through lane in each direction and a two-way left turn lane along the site frontage. 13. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 14. Based on the conceptual design nature of the information submitted, changes to the site layout and/or a reduction in the number of building lots may be necessitated by the final engineering design of the site drainage infrastructure. d. The following MCP standards shall apply: 1. Minimum Front Yard Setback: 10’ 2. Minimum Side Yard Setback: 10’ 3. Minimum Street-Side Yard Setback: 0’ 4. Maximum Lot Coverage: 65% 5. Parking spaces: 1:250 ratio for office use, 5% accessible. 3 visitor parking spaces and 1 ADA parking space outside the gate, and 3 visitor parking spaces and 1 ADA parking space to be located inside the gate shall be permitted as noted on the plan. 6. Screening: Adjacent to rural or residential zoning districts automobile parking shall be screened from view. Solid masonry wall, 6’ in height adjacent to any side or rear property line abutting any rural or residential zoning district except chain link fence up to 8’ in height shall be permitted where noted on the plan. View obscuring wall or fence, up to 8’ in height, on perimeter of site with outdoor industrial use adjacent to district other than rural or residential. 7. Wall sign: Shall not exceed 36 sq. ft. in area and shall not exceed 20’ in height. 8. Freestanding Signage: 1 freestanding sign and shall not exceed 26’ in height. 9. Landscaping: 5’ landscaping strip along right-of-way along eastern property line adjacent to 195th Ave. Landscaping is not required along western parcel along 199th Ave. alignment. 10. Paving: Pavement or approved dust proof material required for all driveways, parking spaces, and access points. 11. Use: Limited to outdoor storage of personal and commercial vehicles and self-storage with ancillary uses. e. There shall not be any overnight stays that would include permanent, mobile or habitual structures, and overnight RVs. These uses are deemed as ‘incompatible’ and prohibited with MCP2022002. f. The following Maricopa County Environmental Services Department (MCESD) conditions shall apply: 1. A Notice of Intent to Discharge application for an onsite wastewater treatment (septic) system is required for any construction. Application must be submitted to the MCESD Onsite Wastewater Program. 2. Wastewater is not permitted to discharge to an adjacent parcel’s septic system. Setback requirements must be maintained per Arizona Administrative Code, Title 18, Chapter 9, Article 312, C (Features Requiring Setbacks). g. All buildings subject to noise attenuation as per ARS § 28-8482(B). h. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. i. The property owners and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. j. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property may be considered for revocation to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Military Compatibility Permit. The Military Compatibility Permit enhances the value of the property above its value as of the date the Military Compatibility Permit is granted and reverting to the prior zoning results in the same value of the property as if the Military Compatibility Permit had never been granted. ONE-TIME ADDITIONS TO THE RICO FLEET Approve five one-time additions to the Sheriff’s Office RICO fleet, of three (3) full-size SUV’s all wheel/four-wheel drive and two (2) full-size ½-ton crew cab pickup trucks all wheel/four-wheel drive to replace current RICO vehicles. Cost Estimates: • Purchase Cost: $80,000 per vehicle • Upfit Cost: $5000 per vehicle • Total Estimated Cost: $80,000 +$5000 per vehicle a total of $425,000 (5 vehicles) • Estimated Annual Operating Expense: $6,500 per vehicle a total of $32,500 (5 vehicles) The annual operating and maintenance expense is estimated to be $6,500 each and will be supported by RICO funds (212). The vehicle will be inspected for necessary repairs and preventative maintenance prior to being placed in the fleet by a contracted vendor. County Equipment Services will be authorized to manage the required vehicle emissions inspection. OPERATING AND FINANCIAL PLAN AND COOPERATIVE LAW ENFORCEMENT AGREEMENT WITH THE U.S. DEPARTMENT OF AGRICULTURE, FOREST SERVICE, TONTO NATIONAL FOREST Approve and accept the Operating and Financial Plan (Exhibit A) and the CY26 Cooperative Law Enforcement Agreement between Maricopa County on behalf of the Maricopa County Sheriff’s Office and the U.S. Department of Agriculture, Forest Service, Tonto National Forest. Approve the acceptance of funding of $44,400 for CY 2026. The reimbursement period will be retroactive to January 1, 2026, through December 31, 2026. This Operating and Financial Plan is made and agreed to as of the last signature date on the Cooperative Law Enforcement Agreement and is in effect through December 31, 2030, unless modified during the annual review. Also approve an estimated amount of $20,000 that is allowed for in the agreement for special enforcement situations that include but are not limited to fire emergencies, drug enforcement, and certain group gatherings. The MCSO Indirect Cost Rate is 27.66%, applicable to the award amount of $64,400 less capital expenses of $24,500 for an indirect cost base of $39,900 and indirect costs of $11,036.34. Indirect costs are unallowable and $11,036.34 in indirect costs will be absorbed by the General Fund. This grant award is multi-year and recurring. The Sheriff’s Office has been providing these services for more than 30 years. The award does not require a cash contribution, nor an in-kind contribution, and there are no future or ongoing contributions required following the grant period. This service is not mandated; however, it furthers the Sheriff’s public safety mandate. Funding is used to pay deputy overtime, the leases on two vehicles, monthly charges for cell phones, and other supplies related to this grant agreement for MCSO to assist in patrolling portions of the Tonto National Forest, located in Maricopa County. The purpose of the Agreement is for the Subrecipient to provide housing stabilization services, short-term and/or medium-term rental assistance and case management services to assist individuals and families at risk of or experiencing homelessness (Rapid Rehousing or Program). The primary goal of the Program is to offer safe housing and supportive services to those who would otherwise be unhoused. The County provided the Subrecipient with $385,658 in Fiscal Year 2026 Emergency Solutions Grant (ESG) funding for Program activities, under Assistance Listing Number (ALN) 14.231 provided to the County through an Intergovernmental Agreement (IGA) with Arizona Department of Economic Security (ADES) under IGA #DI23-002395/ C-22-23-107-X-00. The Agreement expires June 30, 2026. The Purpose of the Amendment is to address the following: 1. The PO was issued by ADHS on February 17, 2026. The total not-to-exceed amount is $1,127,430.76 for the period October 1, 2025, through September 30, 2026. The period of performance for the grant award is January 14, 2022, through January 13, 2027. The Department of Public Health FY26 indirect rate is 16.69%; therefore, indirect costs are estimated at $161,254.77 all of which are recoverable. Departmental indirect rates are re-established at the beginning of each fiscal year, and the future indirect rates will be collected at the corresponding rates. This is a competitive grant award and it is unknown if it will be awarded in the future. There is no cash or in-kind match required. Should the grant cease, future ongoing cash contributions are not required. The grant award is not a mandated function but provides a benefit to Maricopa County by providing evidence-based home visiting models to communities identified to be at risk. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. 45. TRANSFER OWNERSHIP OF RETIRING K-9 JOKER Approve the transfer of ownership of retiring K-9, Joker #K174, to Steve Leitzell (Owner/Operator of Spectrum K9). K-9 Joker was originally purchased in February 2024 and is a dual-purpose, EOD detection and patrol apprehension canine. After completing MCSO basic canine academy he was assigned to Sergeant Russell. Working alongside of Sgt. Russell on duty, several incidents were documented where Joker has redirected aggression back to his handler creating injury and unsafe working situation. After several attempts of re-training and advanced training it is recommended that Joker be retired for the safety of the public and his handler. After assessment and exhausted efforts of additional training with Spectrum K9, in January 2026 it was determined that K9 Joker is too much of a liability to be placed as a dual-purpose canine for law enforcement. Steve Leitzell, Owner/Operator Of Spectrum K9, whom provided additional training and assessment of K9 Joker, will accept full care and financial responsibility for Joker upon adoption and will be asked to sign the Canine Release and Indemnification. Yavi has shown signs of stress in high conflict situations which involve skittishness, breaking down to back away from conflict, seeking constant reassurance, and complete avoidance of conflict during real life deployments, etc. Due to the list of failures and lack of confidence, for the health and safety of Yavi and his handler Godinez and the public we ask that Yavi be retired. Lt. Garcia, as his original handler, has a bond with Yavi will accept full care and financial responsibility for Yavi upon adoption. He will be asked to sign the Canine Release and Indemnification.
