Statement of Participation
Anyone wishing to address the Council regarding items listed on the agenda or during Call to the Public must completely fill out a Request to Comment card located in the back of the Council Chambers and hand it to the Town Clerk prior to the start of the meeting. Once the meeting has started, late requests to speak cannot be accepted. When your name is called, please approach the podium, speak into the microphone, and state your name and if you are a resident for the public record. Comments may not exceed three minutes. It is the policy of the Mayor and Council not to comment on items brought forth under "Call to the Public." However, staff can be directed to report back to the Council at a future date or to schedule items raised for a future Council agenda. To avoid disruption of the meeting, to maintain decorum, and provide for an equal and uninterrupted presentation, applause is not permitted, except during Proclamations, Awards, and Recognitions. All meeting participants must maintain proper decorum as specified in Section 6 of the Council Rules of Procedure.

PROCLAMATION: October 17th as Arbor Day in conjunction with Make a Difference Day
The Town of Fountain Hills recognizes the importance of trees and their many environmental, economic, and community benefits, including improving air quality, supporting wildlife, conserving energy, enhancing property values, and beautifying the community. Mayor Gerry M. Friedel hereby proclaims October 17, 2026, as Arbor Day in the Town of Fountain Hills, Arizona.

PROCLAMATION: October as Breast Cancer Awareness Month
The Mayor and Town Council of Fountain Hills proclaim October 2026 as Breast Cancer Awareness Month—a time dedicated to promoting education, early detection, research, and support for those impacted by breast cancer. With 1 in 8 women in the U.S. expected to be diagnosed in their lifetime and over 320,000 new cases anticipated in 2026, raising awareness remains essential. Though less common, men are also affected by the disease. Early screening and timely treatment significantly improve survival rates, and today, more than 4 million breast cancer survivors live in the United States. This month brings communities together to honor those lost, stand with those currently facing the disease, celebrate survivors, and recognize the vital work of healthcare professionals and researchers. The Mayor and Town Council urge all residents to join in supporting the continued fight against breast cancer.

PROCLAMATION: October as Domestic Violence Awareness Month
The Mayor and Town Council proclaim October 2026 as Domestic Violence Awareness Month. While home should be a place of love, safety, and peace, for many it is marked by violence and fear. Domestic violence impacts individuals of all ages and backgrounds and is a leading cause of homelessness, particularly among women and children. Its effects are often devastating and long-lasting. We acknowledge and commend those who support survivors and work to prevent abuse, and we urge all citizens to raise awareness and support efforts to end domestic violence.

Consent Agenda
All items listed are considered to be routine, non-controversial matters and will be enacted by one motion and vote of the Council. All motions and subsequent approvals of consent items will include all recommended staff stipulations unless otherwise stated. There will be no separate discussion of these items unless a Councilmember or member of the public so requests. If a Councilmember or member of the public wishes to discuss an item on the Consent Agenda, he/she may request so prior to the motion to accept the Consent Agenda or with notification to the Town Manager or Mayor prior to the date of the meeting for which the item was scheduled. The item will be removed from the Consent Agenda and considered as the first item on the Regular Agenda. The remaining items on the Consent Agenda will be enacted by one motion and vote of the Council.

CONSIDERATION AND POSSIBLE ACTION: Regarding Ordinance 26-05, amending Town Code Sections 10-2-1, 10-2-8, and 10-2-9 as related to the distribution of handbills.
At the September 1, 2026, Council meeting the Council reviewed the existing ordinances regarding handbills and provided direction to staff on changes that should be made to address legal concerns and maintain freedom in distribution of materials.  In response to the Council direction, staff has prepared the following amendments to the existing ordinance.Section 10-2-1 DefinitionsAdd a definition of handbill as follows: "Handbill" means any type of commercial or noncommercial handbill as defined herein.This simple addition allows the change to the rest of the ordinance to use the term handbill and still cover all commercial and noncommercial handbills.Section 10-2-8 Deposit of Handbills on Public Property.The changes remove the distinction between commercial and noncommercial handbills and makes it legal to hand out any type of handbill on public property.Section 10-2-9 Handbills.The main change throughout this section is to remove the use of commercial and noncommercial in describing the ordinance provisions.The main change is in D in response to the direction received by the Council.  It was the consensus of the Council to allow all types of handbills to be left on inhabited properties provided they were secured in some manner and not readily visible from the adjacent public way.  This language would still prohibit such things as the casual throwing of bags with rocks in them along with a card in someone's driveway or leaving something on a door that is visible from the street.Given the additional way mail and packages are distributed today, the section allowing continued distribution of mail by the United Postal Service was expanded to include other similar carriers.  Staff also added a provision to clarify that notices posted by government entities are also exempt.  These notices include things such as notifying residents of upcoming street paving projects, utility projects, or code violations.

CONSIDERATION AND POSSIBLE ACTION: Regarding Ordinance No. 26–17, amending the Fountain Hills Town Code, Chapter 16 (Streets and Sidewalks), by adding Article 16-4, Automated License Plate Readers.  (Presented at the request of Councilmember Skillicorn with the support of Councilmembers Larrabee and Watts).
At the Council's regular meeting on September 15, 2026, Councilmember Skillicorn requested (with the support of Councilmembers Watts and Larrabee) to work with the Town Attorney to prepare an ordinance regulating the use of automated license plate readers and return the draft ordinance to the Council for consideration. Ordinance No. 26-17, was drafted with the support of the Town Attorney; the finalized copy was provided by Councilmember Skillicorn.
