2. ESTABLISHMENT OF NEW VOTING PRECINCTS AND PRECINCT BOUNDARY LINES Pursuant to A.R.S. 16-411, approve establishment of new voting precincts and new precinct boundary lines as shown on the maps on file with the Clerk of the Board of Supervisors and accompanying legal descriptions, incorporated herein by reference. This action of the Board of Supervisors shall become effective on January 2, 2022 for the 2022 elections. State law requires the County Board of Supervisors to establish and set the boundaries of voting precincts on or before October 1 of each year preceding the year of a general election (ARS 16-411). Candidates, the County Recorder, and the Elections Department will rely on these voting precinct boundaries for election-related activities. Changes made to the precinct boundaries reflected in the proposed map are necessary to address voter population concentrations, adjust boundaries that split homes or buildings, and adjust for changes made to the Judicial Court precincts. The final boundary lines considered input from virtual public comment meetings and the Elections Department’s Reprecincting website. The attached maps and exhibits provide further details. 3. CHANGE TO JUSTICE PRECINCTS BOUNDARY LINES Pursuant to A.R.S. § 22-101, approve changes to the justice precincts as shown on the maps on file with the Clerk of the Board of Supervisors and accompanying legal descriptions, incorporated herein by reference. This action of the Board of Supervisors shall become effective on January 2, 2022 for the 2022 elections, and then become effective for purposes of the justice courts’ jurisdiction on January 1, 2023. State law requires the County Board of Supervisors to create or redraw the justice court precinct boundaries in order to reduce the judicial productivity credits for any precinct which exceeds twelve hundred credits. A.R.S. § 22-125(H). Two precincts exceeded this threshold in recent years. Changes made to the precinct boundaries reflected in the proposed maps address this statutory requirement with respect to these two precincts and shift credits out of other precincts approaching this threshold. This was accomplished by shifts into neighboring precincts with lower credits. Litigants, Justices of the Peace, and Constables will benefit from changes that achieve better balance of workloads. In addition to the consensus reached by the Justices of the Peace and Constables, the final boundary lines considered input from virtual public comment meetings and the Elections Department’s Reprecincting website. IGA WITH TOWN OF GILA BEND FOR GILA BEND FLOODED PROPERTIES ACQUISITION PROJECT Approve the Intergovernmental Agreement (IGA) FCD 2021A013 for the Gila Bend Flooded Properties Acquisition Project between the Town of Gila Bend (Town) and the Flood Control District (District). The estimated total Project cost is $3.6M and the Town will operate and maintain the Project as open space and/or for recreation purposes. This IGA shall become effective as of the date it has been executed by all Project Partners and shall expire two years from that date, or upon Project completion, whichever occurs first. The Project executed through this voluntary program may remove up to nine (9) homes from the floodway that have experienced severe flooding. This Agenda item impacts Supervisorial District 5.
