1. INFRASTRUCTURE FUNDING AGREEMENT AND MOU WITH MARICOPA COUNTY WORKFORCE DEVELOPMENT BOARD AND ITS WORKFORCE INNOVATION & OPPORTUNITY ACT PARTNERS Request approval for the following actions: 1. Approve a Infrastructure Funding Agreement (IFA) and Memorandum of Understanding (MOU), (the “Agreement”) between Maricopa County of Supervisors, the Maricopa County Workforce Development Board and Workforce Innovation and Opportunity Act (WIOA) mandated Partners. The purpose of the Agreement and MOU is to identify roles, responsibilities, and costs contributed by WIOA mandated Partners to the operation of the Maricopa County Workforce Development One-Stop system. 2. Request authorization for the Chairman to sign all documents related to the IFA and MOU. 3. Request authorization for the Human Services Department (D220) Director to sign the IFA and MOU as the representative for the Human Services Department for any Department programs or services. Maricopa County operates two Comprehensive One-Stop Career Centers (ARIZONA@WORK-Maricopa County) to conduct WIOA activities. Partners located in the Career Centers contribute to the operating costs of the Career Centers. Partners not located in the Career Centers, contribute to the Maricopa County Workforce Development One-Stop system by identifying the costs associated in providing WIOA activities. Through this action, the approved Agreement shall supersede the previously approved IFA and MOU. The Agreement is retroactive to July 1, 2020 and effective until June 30, 2023. 2. RESCIND AND REPLACE AGREEMENTS BETWEEN MARICOPA COUNTY BOARD OF SUPERVISORS AND MARICOPA COUNTY WORKFORCE DEVELOPMENT BOARD Request the Board of Supervisors approve the following actions: 1. Rescind the actions taken by Board of Supervisors on September 29, 2020 to approve the Shared Governance Agreement between Maricopa County and its Maricopa County Board of Supervisors (BOS), the Chief Elected Officials (CEOs) under the Workforce Innovation and Opportunity Act (WIOA), and the Maricopa County Workforce Development Board (WDB), and specific designations and responsibilities assigned to the Human Services Department. Changes to the Agreement are required. 2. Approve the revised Shared Governance Agreement between Maricopa County and its Maricopa County Board of Supervisors (BOS), the Chief Elected Officials (CEOs) under the Workforce Innovation and Opportunity Act (WIOA), and the Maricopa County Workforce Development Board (WDB), the local workforce development board as designated by the Governor of Arizona will be replaced in its entirety with a new Shared Governance Agreement. a. Through the Shared Governance Agreement, the roles and responsibilities of the BOS and WDB are defined and detail the functions of the required roles to provide workforce investment activities, including the role of the fiscal agent: i . Approve the designation of the Maricopa County Human Services Department (HSD) to serve as WIOA Fiscal Agent. ii. Delegate signatory capacity to the Chairman of the BOS for the Shared Governance Agreement. b. The Shared Governance Agreement shall be effective July 1, 2020 through June 30, 2023 unless terminated as provided therein. WIOA requires that a shared governance agreement and service contract be entered into to delineate the role and responsibilities of the BOS, WDB (and its staff), Fiscal Agent, and the Service Provider when one entity is performing multiple roles. 3. REPLACE THE MARICOPA COUNTY WORKFORCE DEVELOPMENT BOARD BYLAWS Approve the replacement of the Maricopa County Workforce Development Board Bylaws. The Bylaws have been revised to identify roles and responsibilities of the Maricopa County Workforce Development Board (MCWDB) members. The approved Bylaws supersede the previously approved Bylaws. Maricopa County is the designated a Local Workforce Development Area in compliance with Section 106 (b)(1)(A) of the Workforce Innovation and Opportunity Act (WIOA), signed into federal law on July 22, 2014 as Public Law 113-128. The MCWDB shall act as the Workforce Development Board (“WDB”) for the Maricopa County Local Workforce Development Area. In execution of its business, the MCWDB must comply with the Workforce Innovation and Opportunity Act (hereinafter referred to as "WIOA"), and its regulations, applicable Federal and State Laws, rules and regulations, and State policies and procedures. The MCWDB and its committees derive their authority from Section 107 of the WIOA. The Maricopa County Board of Supervisors (BOS) shares governance responsibilities with the MCWDB and is responsible for all WIOA funds. As such, the MCWDB must follow all County policies and procedures with regard to making payments, entering into contracts, hiring staff, and any other action that obligate funding. 4. MARICOPA COUNTY WIOA LOCAL PLAN FOR PROGRAM YEARS 2020-2023 Approve the Maricopa County Workforce Innovation & Opportunity Act (WIOA) Local Plan for 2020-2023. Maricopa County, excluding the City of Phoenix, is the Local Workforce Development Area (LWDA) ARIZONA@WORK – Maricopa County, the workforce network of business and employment-related service providers for the Maricopa County. In accordance with WIOA, the Local Plan must be approved by the Chief Elected Officials. The Maricopa County Local Plan is for the period of July 1, 2020 through June 30, 2023. The Maricopa County Local Plan must be in place reflecting current and projected needs of the workforce system consistent with the State plan. CONTRACT AMENDMENT NO. 3 FOR THE SMALL BUSINESS SUPPORT PROGRAM Authorize and approve the Arizona Community Foundation (ACF) contract amendment No. 3 to increase the contract value from $61.5 to $71.5 million to fund a $10 million increase for the continued small business and new small business programs. The initial program contract was approved by the Board on June 30, 2020 (C-06-20-573-M-00), for $22.5 million. On September 29, 2020 (C-06-20-573-M-00), the Board approved the contract amendment No. 1 to add $40 million to the contract for the continued small business program along with changes to the scope of work. On October 21, 2020, the Board approved amendment No. 2 which allowed for ACF to manage the New Business Support Program in the amount of $5 million which was allocated from the $40 million contract increase (Amendment No. 1). This amendment also reduced the $40m to $39.5m. The Statement of Work for the New Business Support Program will be changed so that the $5 million can be used by either the small business or the new small business program.
