33. CENTRAL SERVICE COST ALLOCATION CORRECTION Approve a reduction of $114,127 in the budgeted fund transfer for Central Service Cost Allocation from the Human Services Grant Fund (222) to the General Fund (100). The reduction is necessary as it has been determined that the fiscal year 2009-10 Human Service Central Service Cost Allocation included utilities for two buildings that are not part of the Human Services Department. These utility costs should not be charged to the Human Services grants. In accordance with the adjustment in the fund transfer, approve a reduction in the revenue and expenditure appropriations of $114,127 for Non Departmental (470) General Fund (100) Operating (0000), with offsetting adjustments in Eliminations (980) Eliminations Fund (900) Operating (0000). Expenditure authority within the Non Departmental appropriated expenditure budget will be reduced in General Contingency. Within the appropriated expenditure budget for Human Services (220) Human Services Grant Fund (222) Operating (0000), the amount budgeted for the fund transfer will be reallocated to grant-funded program expenditures. These adjustments results in a net change of zero in the FY 2009-10 County budget. (C-18-10-045-2-00) CHIEF PROCUREMENT OFFICER

46. AMENDMENT TO ARIZONA OPERATIONS ACADEMY TO INCREASE FUNDS Approve Amendment No. 1 to the Arizona Operations Academy for the grant to increase federal funding by $10,500. The grant amount is 100% reimbursable by the Federal Highway Administration (FHWA). With the previously-approved grant amount of $16,790, the total revised amount for the Arizona Operations Academy grant is $27,290. The grant is valid for 36 months, beginning September 3, 2009 until September 3, 2012. Also, approve the revenue and expenditure appropriation increase in the amount of $10,500 in FY 2009-10 to the Public Works (910) Transportation Grants Fund (223) Non-Recurring Non-Project (0001). Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. The approval of this action requested does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. On November 18, 2009, the Board approved agenda item number C-91-10-058-M-00 for the acceptance of federal funds in the amount of $16,790 to conduct an Arizona Operations Academy for advancement of transportation operations knowledge and skills for transportation executives, engineers and technicians. FHWA is providing an additional $10,500 to cover the cost of the speakers for Academy. FHWA has identified Arizona as one of the ten “Opportunity States” for leveraging operations. AZTech Operations Committee is focusing on developing an Operations Action Plan for Maricopa County region. These efforts have identified education and training of the executives and managers in transportation operations and management as a critical need to advanced operations. A project funded by FHWA is proposed to design and organize an Arizona Operations Academy in Maricopa County. The Academy will be based on the concept of total immersion in the subject of transportation management and operations, using a mix of classroom instruction, workshops, and analysis of existing systems to ensure the retention of the principles being presented. The Academy will provide opportunities to practice and internalize the principles learned which is not possible in traditional classes and short courses. This program is intended for surface transportation operations managers and supervisors seeking to advance their knowledge and skills in transportation management and operations. The total cost of the Academy is $31,487.06. A local match of 20% or $4,197.41 is required for $16,790. Funding is available on a reimbursement basis for the cost of $27,289.65. The Department of Transportation's indirect cost rate of 19.7% is unrecoverable. The department’s non-recoverable indirect cost is $5,376.06. Supervisory Districts: All (C-91-10-058-M-01)

47. CONTRACT WITH M.R. TANNER FOR ASPHALT RUBBER OVERLAY PROJECT Authorize the Maricopa Department of Transportation to award the contract for the Asphalt-Rubber Overlay 2010 Project (ARRA) to M.R. Tanner, the lowest, responsive, responsible bidder for the project. M.R. Tanner’s bid of $7,833,000 exceeded the Engineer’s estimate by more than 10% so Board approval is being requested to allow MCDOT to award the contract to this vendor. Funding for the project is available in the Public Works (910) Transportation Capital Projects Fund (234) Pavement Preservation (PAVE) Project Number T322. On November 18, 2009, the Board approved Agenda Item C-91-10-068-5-00 for the solicitation of bids for the Asphalt-Rubber Overlay 2010 (ARRA) Project. The Board also approved the award of the contract to the lowest, responsive, respon sible bidder provided that the lowest, responsive, responsible bidder does not exceed the Engineer’s estimate by more than 10%. The lowest bid for the Asphalt-Rubber Overlay 2010 Project (ARRA) came in at 17 percent higher than the Engineer’s estimate of $6,700,499.55. The cost of asphalt-rubber climbed from approximately $55 per ton in December to $70 per ton. This increase was unexpected in so short a time period. This increase in costs is not considered unreasonable given the fact that the seven companies which bid on this project were all within nine percent from lowest bidder to the highest bidder.
