22. APPLY AND ACCEPT GRANT FUNDS FROM EDWARD J. BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT/DRUG ENFOREMENT ACCOUNT (DEA) Approve the application and acceptance of grant funds from the Edward J. Byrne Memorial Justice Assistance Grant/ Drug Enforcement Account (DEA) in an amount not-to-exceed $400,000 for the portion allocated to the Office of the Public Defender (520). This grant is a recurring grant administered by the Arizona Supreme Court, Administrative Office of the Courts (AOC). The Office of the Public Defender applies for this grant jointly with Adult Probation, Clerk of the Superior Court, and Superior Court. These funds support the justice system by providing staff in all of these departments. In FY 2012-13, this grant funds 14.00 full-time equivalent positions Countywide. The Office of the Public Defender is requesting authorization to again apply for the DEA Grant for FY2013-14. The new grant period will begin on July 1, 2013 and end on June 30, 2014. The grant does not currently allow for the recovery of indirect costs in FY 2012-13, and no change is anticipated in future years. Therefore, the Office of the Public Defender and Maricopa County may receive no administrative cost recovery for this grant in FY 2013-14. The Maricopa County Department of Finance has calculated the Office of the Public Defender's composite indirect cost rate at 8.3%. The non-recoverable indirect cost will not exceed $33,200. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditures of these revenues are not prohibited by the budget law. The grant award will begin on July 1, 2013 and end on June 30, 2014. However, the application for funding has historically been received late and submitted even after the start of the applicable fiscal year. The application turnaround involves tight time constraints, therefore, the Office of the Public Defender is requesting advance approval to apply for the departmental share of these funds through a joint application with the Superior Court, Clerk of the Superior Court, and Adult Probation. The FY 2013-14 budgeted amount for this grant is $303,237 as developed through the normal annual budget process. If funding is awarded in excess of that amount, a budget adjustment will be requested. We also anticipate we will be required to provide an in-kind match of 25%. We have a General Fund position which is being used to fulfill the match requirement in the current year, and that position is funded in the following year as well. Therefore, there is no additional burden to the General Fund as a result of the in-kind match requirement. (C-56-13-012-G-00)

26. AMENDMENT TO FIVE-YEAR TECHNOLOGY CAPITAL IMPROVEMENT PLAN In accordance with A.R.S. 42-17106(B), authorize the following amendment to the FY 2013 Non Departmental (470) Technology Capital Improvement Fund (460): a) Decrease the expenditure authority for the Public Safety Radio Project by $5,000,000 from $47,554,380 to $42,554,380. The total project budget remains $131,351,230 over the life of the project. b) Increase the expenditure authority for the Enterprise Data Center Project by $5,000,000 from $10,286,400 to $15,286,400. The total project budget remains $48,088,722. These actions will have a County-wide net impact of zero and they do not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. Approval of this action allows the Office of Enterprise Technology (OET) to replace the County's existing data storage environment with a new 3PAR storage solution. Through this effort OET will be able to consolidate various storage devices onto a new platform while reducing complexities, decreasing the total cost of ownership, and providing the expected level of enterprise storage services County customers require. Total cost savings to the County over a five-year period are expected to be over $4,000,000 by moving to the 3PAR storage solution. Fewer expenditures are anticipated in FY 2013 for the Public Safety Radio Project, thus allowing for the transfer of expenditure authority to the Enterprise Data Center Project. (C-41-13-008-M-00)

33. IGA WITH THE ARIZONA DEPARTMENT OF HEALTH SERVICES FOR BEHAVIORAL HEALTH SERVICES TO THE SERIOUSLY MENTALLY ILL AND REMANDED JUVENILES FOR FISCAL YEAR 2013/2014 Approve an Intergovernmental Agreement (IGA) between Maricopa County (the County) and the Arizona Department of Health Services (ADHS) which in effect extends the existing arrangement for the County's funding of behavioral health services for a term of one year. County funding for services to the seriously mentally ill (SMI) under this IGA will be $45,707,084 for FY2013-14. This increases the level of County funding based on medical inflation for services to the seriously mentally ill by $2,176,528 over the funding paid under the previous IGA in FY2012-13. The FY2013-14 IGA also requires the County to fund non-SMI services in the amount of $3,366,705 and substance abuse services in the amount of $1,489,871 (LARC) for the one-year term which is equal to the FY2012-13 level. The IGA will be in effect upon signature of the last party and shall remain in effect until June 30, 2014. The IGA may be amended, further extended or terminated pursuant to the IGA provisions, including a 90-day termination without cause provision. Total County funding for behavioral health services in FY2013-14 under the IGA will be $50,563,660 for a one-year term. Approve an Intergovernmental Agreement (IGA) between Maricopa County and the Arizona Department of Health Services (ADHS) authorizing ADHS or its contracted Regional Behavioral Health Authority (RBHA) to provide mental health services to remanded juveniles (of a screening agency, an evaluation agency and mental health treatment agency) when evaluation is ordered by the Maricopa County Superior Court pursuant to Arizona Revised Statutes, (A.R.S.) Title 36, Chapter 5, Article 4 and treatment is ordered by the Superior Court pursuant to Arizona Revised Statutes, Title 36, Chapter 5, Article 5. Pursuant to the judgment in Arnold v Sarn and the subsequent March 10, 1994 court order, the County is required to enter into an Intergovernmental Agreement (IGA) between Maricopa County and the Arizona Department of Health Services (ADHS) under which the County contributes funding for behavioral health services for seriously mentally ill (SMI) indigent residents of the County. The County also contributes funding for non-SMI services under the IGA in order to integrate the behavioral health system in Maricopa County. The IGA requires the County to adjust its SMI contribution annually. Through FY04, the adjustment was calculated by using a base amount established in the FY96 IGA, as adjusted in subsequent IGA's. Since FY01, the amount has been determined by multiplying the base amount for each year by an inflation factor derived from the Bureau of Labor Statistics medical market basket cost index. Program: State Withholdings and Contract Management Activity: State Mental Health Programs Activity. This IGA will provide financial management and oversight for County Administration of funds that are paid to, or withheld by, the State and/or the Maricopa Integrated Health System so they can ensure accurate and proper distribution of funds to health programs. The activity will provide financial oversight of funds that are paid to the State under court order for mental health programs for County Administration so that they can limit their liability while ensuring that their court-ordered obligations are met in an efficient and effective manner. This IGA also authorizes ADHS or its RBHA to expend up to $200,000 from the “Non-SMI” payment funds for remanded juveniles. The Department of Health Care Mandates and ADHS, in conjunction with the Superior Court, previously negotiated to provide evaluation services for remanded juveniles using funds that are not part of the County’s mandated obligations under Arnold v. Sarn. A “remanded juvenile” means a person under the age of eighteen who has been transferred to the criminal division of the Superior Court pursuant to A.R.S. § 8-327 or who has been charged with an offense pursuant to A.R.S. § 13-501; and has not been sentenced, pursuant to A.R.S. § 13-701 on the charges pending against the juvenile in the criminal division of the Maricopa County Superior Court pursuant to A.R.S. § 8-327 or A.R.S. § 13-501. A-2. APPOINT ATTORNEY AS SUPERIOR COURT JUDGES PRO TEMPORE Approve the appointment of Court Commissioners Kerstin LeMaire, Julie Mata and Annielaurie Van Wie as Superior Court Judges Pro Tempore in accordance with Arizona Revised Statutes § 12-141. The appointment will be for the period commencing June 1, 2013 through June 30, 2013. In order to obtain greater flexibility in the use of Court Commissioners, the Superior Court customarily has all Court Commissioners appointed as Superior Court Judges Pro Tempore so they may, on occasion, hear contested matters. A-5. IRREVOCABLE STANDBY LETTER OF CREDIT WITH JPMORGAN CHASE BANK Approve amendment to the Irrevocable Standby Letter of Credit. The original Irrevocable Standby Letter of Credit with Chase/Bank One, Arizona was approved by the Board of Supervisors July 24, 2002; agenda number C-75-03-001-1-00. Subsequently, each year the Board of Supervisors has approved amendments as the projected liability amounts for workers’ compensation claims have changed. The previous Letter of Credit was with the JPMorgan Chase Bank for $6,482,298 and was extended through December 31, 2012 (C-75-09-006-2-05). An amendment is now required for the new worker’s compensation liability amount which is $15,239,045. This amount will fluctuate annually as it is based on claims and reserves, with older claims closing and new claims opening. The Letter of Credit serves as security for the County’s projected liability for workers’ compensation claims. It is not expected that there will be reason for the Letter of credit to be drawn on; however, the Industrial Commission of Arizona requires the negotiable security. (C-75-09-006-2-06)

F-1. IGA WITH MARICOPA COUNTY DEPARTMENT OF TRANSPORTATION FOR THE AUTOMATED FLOODED ROADWAY WARNING ASSEMBLY PROGRAM Approve Intergovernmental Agreement (IGA) FCD 2010A017 to identify and define the responsibilities for an Automated Flooded Roadway Warning Assembly Program (Program) between the Flood Control District of Maricopa County (District) and Maricopa County (County). The Program is funded by the District through secondary property tax monies and the County through Highway User Revenue Fund (HURF) monies. The estimated cost of this program to the District in FY 2013/2014 is $40,000.00 for the procurement, design and installation of the flood warning components and associated electronics for two demonstration projects. Implementation of flood warning assemblies at other locations in the future would require budgeting of additional funds toward the Program. Under a demonstration program, the District and the County will install two flood warning assemblies and conduct up to two years of equipment testing. The County will monitor for effectiveness each pilot location using installed video surveillance systems. The decision to expand the Program will be based on the success of the demonstration sites. This Agenda Item impacts all Supervisorial Districts. (C-69-13-056-3-00)

F-3. AMENDMENT TO IGA FOR DETAILED PRE-APPLICATION REVIEWS BY ARIZONA DEPARTMENT OF WATER RESOURCES Approve Amendment No. 2 to Intergovernmental Agreement (IGA) FCD 2010A006 for detailed pre-application reviews by the Arizona Department of Water Resources (ADWR) of Flood Control District of Maricopa County (District) dam safety rehabilitation and modification projects. This IGA is currently effective and funding through June 30, 2013. Amendment No. 2 will extended the Agreement through FY 2014 (through June 30, 2014) at $96,000 for FY 2014 with options for up to four one-year extensions (not to exceed $96,000 each) by mutual written consent between the District and ADWR. ADWR is the jurisdictional agency for the 22 flood control dams managed by the District. Seven projects are currently in various stages of design for overall rehabilitation or modification. These projects are traditionally funded by the District and, where applicable, federal partners. By law the District must obtain “a permit to construct” from ADWR for any rehabilitation, repair, alternation or modification of the flood control dams managed by the District. Also by law, the District must provide 100% complete construction plans and specifications and supporting design documents for formal application of the ADWR “permit to construct”. This IGA was implemented to minimize schedule delays and increased dam rehabilitation and dam modification re-design costs due to revised design requirements by ADWR after designs are completed. The third year of the IGA is nearing completion and the IGA is fully serving its intended purposes. Amendment No. 2 is needed in order to extend the agreement as indicated. The “not to exceed” total funding under the agreement would be revised to: $768,000 = $288,000 (Actual FY 2011, 2012, 2013) + 5 X $96,000 (FY 2014 through FY 2018). This Agenda Item impacts Supervisorial Districts 1, 3, 4 and 5. (C-69-10-071-3-02)

F-4. IGA WITH THE US ARMY CORPS OF ENGINEERS FOR THE CAVE BUTTES DAM REHABILITATION PROJECT Approve Intergovernmental Agreement FCD IGA2012A018 for the Cave Buttes Dam Modification Project between the US Army Corps of Engineers (USACE) and the Flood Control District of Maricopa County (District). The total estimated IGA cost is $499,000 including approximately 25 percent of optional funds that require District approval before being eligible for expenditure. The USACE has determined that there is no federal funding available for the foreseeable future. This IGA funds the review, approval, and oversight of a required 408 permit with the USACE in accordance with the 221 agreement between the USACE and the District. Without this IGA the USACE review and issuance of the 408 permit would take several years due to lack of Federal funding. This delay would hamper the District’s ability to improve public safety. The IGA shall become effective when signed by the USACE and shall expire with the Federal Fiscal Year 2016. The Cave Buttes Dam Modification Project best meets District goals and objectives related to dam and public safety. The modifications to Cave Buttes Dam include an additional outlet to reduce the maximum drawdown time from 50 to less than 25 days and to implement a seepage control and monitoring system. These modifications will significantly improve the operational safety of Cave Buttes Dam and insure that the operational life of this structure will be significantly increased. The District is nearing the completion of the 30 percent design for the new outlet. Without this agreement the USACE has stated their review of the 30 percent design may take 3 to 4 years. With District funding the USACE review time will be expedited. This item impacts All Supervisorial Districts. (C-69-13-058-3-00)
