15. ACCEPT GRANT AND EXCEPTION TO TECHNOLOGY FINANCE PROGRAM Accept a FY 2009-10 grant (through the State of Arizona’s Governor’s Office for Children, Youth and Families) and associated revenue from the Office of Juvenile Justice Delinquency Prevention (OJJDP) – Title II Formula Grant for the Juvenile Court of the Superior Court of Arizona in Maricopa County (Court) in the amount of $54,960. The Departments indirect rate for FY10 is 40.7%. The grantor limits indirect cost recovery to 10% of salary costs. Total indirect costs are estimated at $19,603 of which 4,816 are recoverable and 14,786 are unrecoverable. The term of the OJJDP grant will be from March 31, 2010 through February 28, 2011. In addition, approve an exception to the Technology Finance Program (TFP) to allow the Court to purchase one lap top computer through the approval of the OJJDP grant. Total cost is estimated not-to-exceed $1,700. In compliance with OJJDP, the Court has requested funding through the Governor’s Office for a part-time contract attorney to represent juveniles charged with status offenses only, namely those acts that are specific to youth under the age of 18. (For example, curfew, truancy, runaway, tobacco possession, alcohol consumption or possession, defiant behaviors or disobedience.) Before a status offender can be detained, they need to be fully advised of their rights and the result of their consequences. The goal is to deinstitutionalize status offenders and provide due process. Accordingly, a senior contract attorney will supervise, pursuant to Supreme Court Rule 38, law students to represent this specific category of juveniles through the court process. (C-80-10-017-2-00)

16. APPLY AND ACCEPT FUNDS FROM GOVERNOR'S OFFICE FOR CHILDREN, YOUTH AND FAMILIES Approve to apply for and accept funds in an amount not-to-exceed $152,000, from the Governor’s Office for Children, Youth and Families, that administers the Office of Juvenile Justice Delinquency Prevention Title II Grant, for the purpose of funding family support services for juveniles participating in current County-funded prevention and intervention programs in the South Mountain neighborhoods of Phoenix. Family support services will add a needed component to the range of wrap around services being developed for this target population. Evidence based practice demonstrates that provision of family support to at-risk youth significantly reduces risk factors contributing to juvenile contact with the criminal justice system. The grant does not require matching funds and limits indirect cost recovery to 10%. The department’s indirect rate for FY10 is 16.4%. Therefore, full indirect costs are estimated at 22,662 of which, 13,818 is allowed and 8,844 is un-allowed. A Juvenile Crime Prevention Plan focusing on South Mountain at-risk youth was approved by the Board of Supervisors in the spring of 2008. The plan recognizes the value of a full complement of wrap around services to address the complex needs of the target population. Since the Plan’s adoption, prevention and intervention programs have been initiated with community based organizations including Childhelp/Keys, the South Mountain YMCA and the South Mountain Boys and Girls club. The programs provide some of the needed services, such as educational support, life skills training and community engagement opportunities. Feedback from our community providers and the Juvenile Probation Department, coupled with recommendations from evidence based practice, indicate a need to add family support to the mix of services available to at-risk youth and their families. Family support will contribute to the prevention of first-time contact with the criminal justice system or reduction in recidivism rates among youth engaged with the system. (C-20-10-029-G-00)

43. AGREEMENT WITH MARICOPA ASSOCIATION OF GOVERNMENTS FOR EL MIRAGE ROAD, BELL ROAD TO DEER VALLEY DRIVE Approve a Revenue Agreement (#10-ELM-10-03-A) between Maricopa Association of Governments (MAG) and Maricopa County acting through Maricopa County Department of Transportation, in the amount not-to-exceed $9,516,868. The purpose is to approve the Project Agreement between the Maricopa Association of Governments (MAG) and Maricopa County, acting through the Maricopa County Department of Transportation (MCDOT) for regional reimbursements associated with the design, right-of-way and construction costs of roadway improvements to El Mirage Road from Bell Road to Deer Valley Drive, MAG ALCP Project Number T103. The total amount of reimbursements expected to be received from MAG for this Project is $9.52 million. This Revenue Agreement is effective from MAG approval date until completion of reimbursements. In November 2004, voters of Maricopa County approved a transportation excise tax for the purpose of implementing the Regional Transportation Plan (RTP). Maricopa Association of Governments (MAG) was required by law to adopt a program that provided for life cycle management for the funding and programming of the Arterial Life Cycle Program (ALCP), as part of the RTP. ALCP Project Number T103, El Mirage Road from Bell Road to Deer Valley Drive is included in the RTP and is eligible for regional funding on a reimbursement basis. Under the approved FY2010 MAG RTP update, $9.52 million has been programmed for reimbursement between FY2017 and FY2019. However, in the event of the availability of ALCP Closeout Funds during FY2011, the reimbursements for this project could be received earlier than anticipated. As the lead agency, MCDOT has submitted the required MAG Project Overview and must also submit an approved Project Agreement to Maricopa Association of Governments for execution. Reimbursements will be sent to the Maricopa County Department of Transportation as part of the Arterial Life Cycle Program (ALCP). Supervisory District No: 4 (C-91-10-141-M-00)

44. BID AND AWARD FOR THE INSTALLATION OF FIBER OPTICS ALONG 99TH AVENUE FROM OLIVE AVENUE TO BELL ROAD Approve the solicitation of bids for the installation of fiber optics along 99th Avenue from Olive Avenue to Bell Road, Maricopa County Department of Transportation’s Intelligent Transportation System (ITS) Project No. T287. Award the contract to the lowest responsive bidder, provided that the lowest responsive bidder does not exceed the Engineer’s estimate by more than ten percent. The purpose of this project is to install fiber optic conduit and cable for approximately 5 miles along 99th Avenue from Olive Avenue to Bell Road. Ten traffic signals along this entire length will be connected and data from the signals will be integrated into MCDOT’s Traffic Management System. This installation and integration will permit coordinated signal timing which can be adjusted remotely as necessary---based on traffic flow. In addition, providing fiber optic connections to this travel corridor implements a key recommendation of MCDOT’s comprehensive ITS telecommunications plan, and enables MCDOT to release costly leased lines in favor of an agency-owned communication link. The project is nearing completion of design. A portion of the cost of this project is available for federal funding on a reimbursable basis through MAG. The federal funding available for the project is $492,962. The Department of Transportation’s indirect cost rate is 19.7%. The total grant amount is for capital expenditures which are not subject to indirect cost recovery. Supervisory District No. 4 (C-91-10-144-M-00)

45. AMENDMENT TO IGA WITH THE TOWN OF QUEEN CREEK AND PINAL COUNTY FOR ROADWAY IMPROVEMENTS TO ELLSWORTH ROAD Approve Amendment No. 1 to the Intergovernmental Agreement (IGA) between Maricopa County, acting through the Maricopa County Department of Transportation (Maricopa County), the Town of Queen Creek (Town), a municipal corporation, and Pinal County, acting through the Pinal County Department of Public Works (Pinal County), for roadway improvements to Ellsworth Road from Empire Boulevard to Cloud Road and Intersection Improvements at Empire Boulevard/Hunt Highway. The total revised estimated cost for the project is $18.9 million. Maricopa County’s Cost share responsibility is not-to-exceed $7.75 million. Funds are budgeted in the Public Works (910) Transportation Capital Projects Fund (234) County Arterial (ARTS) Project Number T178, Ellsworth Road: Hunt Highway to Riggs Road. The purpose of this amendment is to add the installation and associated costs of a Town sewer system and appurtenant infrastructure (Ellsworth Sewer Improvements), approximately 1,200’ north of Empire to approximately 400’ south of Cloud Road, to the Ellsworth Road Improvements project. The Parties previously entered into an IGA regarding the design and construction of roadway improvements to Ellsworth Road, Empire Boulevard to Cloud Road and intersection improvements at Ellsworth Road and Empire Boulevard /Hunt Highway. Subsequently, the Town has requested that this work be included as part of the roadway improvements to Ellsworth Road. The costs for the Ellsworth Sewer Improvements will be the sole responsibility of the Town and the installation will be completed by the approved construction contractor retained for the project. The project is scheduled to begin in early spring 2010. Out of the $18.9 million total project cost, Maricopa County will spend $17.48 million as part of being the lead for this project. Pinal County and the Town will spend $1.42 million of their own funds for the roadway improvements and water and irrigation line installation mentioned above. Pinal County and the Town will also reimburse Maricopa County the amount of $10.24 million in FY 2010-11. The reimbursement from Pinal County and the Town will result to net share contribution of $7.24 million for Maricopa County. Supervisory District No: 1 (C-91-10-094-M-01)

F-4. WATERSHED AGREEMENT FOR BUCKEYE FLOOD RETARDING STRUCTURE REHABILITATION PROJECT Approve the Watershed Agreement for the Supplemental Watershed Plan for the Buckeye Flood Retarding Structure (FRS) No. 1 Project (the PROJECT [#207]). A Watershed Agreement is required by the Natural Resources Conservation Service (NRCS) project authorization process at the end of the planning phase of dam rehabilitation projects. The Watershed Agreement is an agreement between NRCS and the District for the specific dam rehabilitation alternative that has been selected to move forward to final design and construction. In addition, the Watershed Agreement outlines the intended project cost share participation by NRCS and the District, authorizes NRCS to seek federal funding for the project and provides formal notification that the District is ready, willing and able to proceed with the project. The Watershed Agreement is not, however, a cost share agreement. Several non-emergency dam safety deficiencies have been identified at Buckeye FRS No.1, and the District has completed a planning study which analyzed alternatives to correct the deficiencies, maintain the flood control benefits to downstream properties, and comply with state dam safety requirements. The District has also coordinated with and obtained input on the PROJECT from the Town of Buckeye, local stakeholders and the public. The selected alternative, which best meets project goals and objectives, involves the overall rehabilitation of the dam. This item impacts Supervisory District 4. (C-69-10-058-3-00)
