8. LEASE AGREEMENT WITH APS FOR USE OF PARKING SPACE Approve and authorize the Chairman to execute Lease Agreement L-7486 (Lease) with Arizona Public Service Company (APS), for use of parking space on parcel APN 112-18-116 located at 702 South Montezuma Ave, Phoenix, Arizona, 85003. This Lease is to provide an additional parking area near Maricopa County Elections’ MCTEC Office to meet a portion of the parking demands for staff and volunteers working the upcoming Primary and General election which are scheduled from March 2020 through November 2022. The term of the Lease will commence upon full execution of the Lease and expire on February 28, 2021 and will automatically extend in month-to-month periods upon the same terms and conditions set forth in the Lease. The County will be responsible for ensuring the parking area is in compliance with applicable air quality rules and regulations. As consideration, the County will pay an annual rental fee of $12,000.00 ($1,000.00 per month) plus any applicable taxes, within thirty (30) days of the Commencement Date. If County continues to occupy the premises after February 28, 2021, County will be invoiced for monthly payments of $1,000.00 plus any applicable taxes. In addition to rent, County will be responsible to pay APS for two Phase I inspections of the property, the first within thirty (30) days of the Commencement Date of the Lease and the other, if required by APS, upon Lease termination. This Lease is subject to A.R.S. § 38-511 and may be terminated by either party at any time after expiration of the Initial Term upon thirty (30) days’ prior written notice to the other party. County may also terminate this Lease at the end of any fiscal year due to non-appropriation of funds without any penalty or liability to County. This is located in Supervisory District 5. 9. SUPPLEMENT TO THE AGREEMENT WITH THE OFFICE OF NATIONAL DRUG CONTROL POLICY FOR THE HIGH INTENSITY DRUG TRAFFICKING AREA PROGRAM – INITIATIVE XXIX Approve acceptance of Supplement #2 in the amount of $1,654.00 to the Grant Award with the Office of National Drug Control Policy (ONDCP) Award Number G19SA0005A, for the High Intensity Drug Trafficking Area (HIDTA) Program. This supplement is an increase of $1,654.00 increasing the agreement amount from $654,949.30 to $656,603.30. The term of this funding is unchanged January 1, 2019 to December 31, 2020. The Maricopa County Sheriff’s Office will receive an additional $1,654 (increasing its current portion of the award from $466,533.60 to $468,187.60). The Sheriff’s Office indirect cost rate for FY20 is 16.3%. The total unrecoverable indirect cost amount is $269.60. The unrecoverable indirect cost of $269.60 will be covered by the department General Fund. HIDTA funding is recurring, and there is no match requirement. The original funding was approved by the Board of Supervisors on May 22, 2019 (C-50-19-079-G-00). Supplement 1 was approved on 7/31/2019 (C-50-19-079-G-01). Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. The HIDTA Program is sponsored/funded by the Office o National Drug Control Policy (ONDCP). These grant funds are to support and enhance activities in accordance with the approved ONDCP HIDTA Program Policy and Budget Guidance (PPBG). There has been participation in the HIDTA program since approximately 1998. (C-50-19-079-G-02)

10. APPOINTMENT OF MARICOPA COUNTY WORKFORCE DEVELOPMENT BOARD MEMBER Appoint the following individual to represent the Business Category for the term effective upon approval until June 30, 2020 and the subsequent term effective July 1, 2020 until June 30, 2023: Matthew McGuire, Dignity Health/Arizona Health Collaborative The MCWDB is established and receives its authority in accordance with the Workforce Innovation and Opportunity Act (WIOA), which was signed into law on July 22, 2014 as Public Law 113-128. 11. FIRST AMENDMENT TO NEW HOPE AGREEMENT WITH AMERICA'S FREEDOM PAWS RESCUE, INC. Approve and execute the First Amendment to the General Services Contract - New Hope General Program Agreement ("New Hope Agreement") between Maricopa County, administered through Animal Care and Control, and America's Freedom Paws Rescue, Inc. The First Amendment will extend the New Hope Agreement for a three (3) year term, effective January 1, 2020 through December 31, 2022, as well as replace and supersede Section XVI - Israel Boycott to reflect current policy language. All other terms and conditions of the Agreement shall remain in full force and effect. Animal Care and Control estimates eighteen (18) New Hope transfers to America's Freedom Paws Rescue over the three (3) year term of the amended Agreement. The cost per transfer is $52/animal in FY2020 and thereafter, for a total of $936. (C-79-19-068-3-01)

12. KENNEL PERMIT RENEWAL (MULTIPLE DOG LICENSE) FOR YERBRIER KENNELS Approve kennel permit renewal K20-000005 pursuant to A.R.S. §11-1009 for Yerbrier Kennels, LLC, 5447 S. El Mirage Road, Tolleson, AZ 85353 in District 5 for a one-year period beginning on the date of the Board's approval. The cost of a kennel permit is $350. 13. 14. DONATIONS ABOVE $250 FOR JANUARY 2020 Accept the unrestricted monetary donations of anonymous lock box donations ($271), Nationwide Foundation ($731), William Seitter ($1,000), Oakwood Ladies Golf League ($2.535), Geraldine McCuan ($4,904), totaling $9,441 for the care of the animals. Donation funds are not local revenues for the purpose of the constitutional expenditure limitations and therefore expenditures of these revenues are not prohibited by the budget law. 15. RESTRICTED DONATIONS FOR JANUARY 2020 Accept the following restricted cash donations for January 2020: *$570 from Canine Community Project for the purchase of microchips to be used for stray animals that are returned to their owners, providing an important piece of identification. *$1,000 from Hope Emergency Animal Rescue (H.E.A.R.) for the testing and treatment of MCACC shelter animals suspected to have Valley Fever and/or Tick Fever, as set forth in the Memorandum of Understanding approved by the Board of Supervisors on January 9, 2019 (C-79-19-062-M-00). *$6,505 from the Petco Foundation for payment of cancer related medical expenses for shelter animals, foster animals, and recently adopted animals, which treatment cannot be provided by MCACC. *11,800 from the Bissell Pet Foundation in payment of adoption fees for 108 dogs and 20 cats during a sponsored event. *$13,974 from the Love Pup Foundation for the purchase of microchips for adopted shelter animals, allowing them to receive this important piece of identification. *15,000 from Two Pups Wellness Fund, through the Arizona Community Foundation, for the medical treatment of shelter animals whose needs require additional or supplemental medications, testing, and/or veterinary care that cannot be provided by MCACC. 16. DONATIONS IN EXCESS OF $1,000 FOR JANUARY 2020 Accept the following non-cash donations in excess of $1,000 for January 2020: *1 pallet of pet food, valued at $1,050, from an anonymous donor. *62 cases of dog treats, valued at $2,600, from Bissell Pet Foundation. *216 cases of dog treats, valued at $6,169, from Tyson Pet Treats. Donation funds are not local revenues for the purpose of the constitutional expenditure limitations and therefore expenditures of these revenues are not prohibited by the budget law. 17. DONATION FROM 4 PAWS AND FRIENDS Accept the non-cash donation from 4 Paws and Friends of high value treats, dog food, and enrichment items benefitting the animals at the West shelter. This donation is valued at $4,657. Donation funds are not local revenues for the purpose of the constitutional expenditure limitations and therefore expenditures of these revenues are not prohibited by the budget law. 18. ULTIS PROJECT BUDGET ADJUSTMENT Pursuant to A.R.S. §42-17106B, authorize the following: 1. Approve the final transfer of FY2020 expenditure authority in the amount of $491,003 from Non Departmental (D470) Technology Capital Improvement Fund (460) ULTIS Project Reserve (PRSC) to the Non Departmental (D470) Technology Capital Improvement Fund (460) Treasurer Technology System Upgrade (TTSU) in the Treasurer Technology Improvements (TTS1) budget. This action will have a net zero impact on the overall County budget. The FY 2020 budget includes a project reserve for the Treasurer Technology Project available to be appropriated to the project after quarterly project health checks. The project health check was delivered by the County's CIO in February. (C-49-20-019-2-00)

19. TRADE-IN OF WEAPONS FOR CREDIT TOWARD PURCHASE OF REPLACEMENT WEAPONS Pursuant to the Maricopa County Procurement Code, MC1-803, approve the trade-in of specialized weapons for a credit of $4,810.00 to be used toward the purchase of new specialized weapons. The list of items to be traded with the corresponding trade-in value is attached to this agenda item. The Maricopa County Office of Procurement Services and Maricopa County Security Services is working with PROFORCE Law Enforcement, County Contract 190291-C, and section 4.12 TRADE-INS to facilitate this trade in and subsequent Procurement. Approval of this item allows Maricopa County Security Services to dispose of worn, old, and in some cases obsolete weapons with the benefit of applying credit toward the purchase of replacement items. Replacement items and costs are included along with the trade in credit and attached with this agenda item. (C-15-20-005-3-00)

20. RENEWAL OF VEHICLE EXEMPTIONS FROM MARKINGS Pursuant to A.R.S. § 38-538-03, approve the continuation of an exemption from County markings for vehicles belonging to the following departments; Adult Probation, County Attorney, Juvenile Probation, Sheriff's Office, Public Defender, Legal Defender, Office of Public Advocate, Superior Court Security. This is the annual renewal of exemptions that were previously approved by the Board of Supervisors. The exemption from markings is requested due to the vehicles being used for felony investigations, activities of a confidential or sensitive nature and social service work. (C-74-20-002-V-00)

21. FUNDS TRANSFERS; WARRANTS - TRANSFERENCIAS DE FONDOS; WARRANTS Approve regular and routine fund transfers, warrant reports 01/24/2020 through 02/06/2020, from the operating funds to clearing funds including payroll, journal entries, allocations, loans, and paid claims and authorize the issuance of the appropriate related warrants. Pursuant to A.R.S. §11-217(D) and A.R.S. §11-623, said warrants and claims are on file in the Clerk of the Board’s office and retained in accordance with LAPR approved retention schedule. 22. ACCEPTANCE OF GRANT FUNDS FROM U.S. DEPARTMENT OF HEALTH AND HUMAN SERVICES FOR EARLY HEAD START PROGRAM Approve the receipt of reprogrammed, unobligated funds from the U.S. Department of Health and Human Services (DHHS)/Administration for Children and Families (ACF), Office of Head Start (OHS), Grant No. 09CH010385-04-01, from Program Year 03 to Program Year 04. OHS provided a Notice of Award (NOA) for $138,673 for completion of approved program activities for the Maricopa County Head Start program. The County is a current recipient of the stated grant and funds provided under this NOA are one-time funding. Receipt of reprogramed, unobligated funds in the amount of $138,678 are for the budget period of July 1, 2019 thru June 30, 2020. The funds will be utilized for the following projects: • Classroom start up supplies, printers and hearing screening supplies • Facilities Improvements to Valor Center program site Funding for Grant No. 09CH010385 was competitive and was awarded to Maricopa County in July 2017. The purpose of the grant is for the County to provide Head Start and Early Head Start program services to children ages 0 to 5, supporting families to promote healthy development and to promote school readiness. On October 2019, the Head Start program submitted to OHS a request to reprogram funds from Program Year 03 to Program Year 04 for the completion of program projects. The grant requires a 20% non-federal share (NFS) match of the total approved project costs. The total NFS is increased by $34,740 from $3,557,097 to $3,591,837 for the budget period of July 1, 2019 thru June 30, 2020. NFS is generated through in-kind donations of goods and services as well as parent volunteering. Upon approval of receipt of funds, the grant amount for the budget period shall be $14,367,061 and the total amount for the project period shall be increased to $54,967,229. The Human Services Department is utilizing the provisional indirect rate of 22.2% approved by the U.S. Department of Health and Human Services for FY2020 for salaries and employee related expenses. The total carry over funds are $138,673 of which $0 is for salaries and benefits. The total estimated indirect costs are $0. Receipt of the carry over funds does not require future or ongoing contributions by the County at the end of the project period. The services provided under this grant are not a mandated function but provides a benefit to the citizens by providing eligible children with high quality care and education by integrating Head Start performance measures. The approved Head Start enrollment is 807 for 3 to 5 year olds and Early Head Start enrollment is 182 for 0 to 3 year olds. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and Therefore, expenditure of the revenues is not prohibited by the budget law. This Agreement does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall budget will be adjusted as necessary to accommodate the grant funding through a future reconciliation. Acceptance of the grant funds will not impact the County General Fund. 23. AMENDMENT TO IGA WITH CITY OF SURPRISE FOR HOME INVESTMENT PARTNERSHIPS ACTIVITIES The purpose of the Agreement is for the City to provide owner occupied, single family housing rehabilitation and Tenant Based Rental Assistance to eligible residents. The County provided the City with U.S. Department of Housing and Urban Development (HUD) for HOME Investment Partnerships Program (HOME) activities. The Purpose of Amendment No. 3 is to amend Section III (Work Statement) as follows: A. Remove and replace “2017a Work Statement” activities: 1. Replace with “2017 Work Statement A” which reduces the funding for single-family, owner occupied housing rehabilitation assistance from $145,126 to $54,526.22. The remaining fund balance of $90,599.78 shall be utilized to complete the activities listed in Subsection A.2. All work performed, or costs incurred, shall expire on September 30, 2021. 2. Add “2017 Work Statement B” which allows the City to provide tenant-based rental assistance to five households. The City shall utilize $90,599.78 from the previously approved “2017a Work Statement” to complete the “2017 Work Statement B” activities. All work performed, or costs incurred, shall expire on September 30, 2021. B. Remove the “2018 Work Statement,” which was added by Amendment No. 2, and replace it with the attached “2018 Work Statement A,” which allows for the City to provide tenant-based rental assistance to eleven households. Funds from the previously approved Amendment No. 2, which totaled $193,749 for the “2018 Work Statement” activities, will be utilized to address the activities in the “2018 Work Statement A.” All work performed, or costs incurred, shall expire on September 30, 2022. C. Add an additional Work Statement, referred to as the “2019 Work Statement.” Through the ”2019 Work Statement”, the City shall provide tenant-based rental assistance to eleven households. The County shall provide the City with $181,777.64 for the “2019 Work Statement” activities. The City shall contribute $9,136.80 in HOME Recapture funds for the “2019 Work Statement” activities. All work performed, or costs incurred, shall expire on September 30, 2023. D. Upon approval of Amendment No. 3, the Agreement funding amount shall be increased from $475,567 to $657,344.64, an increase of $181,777.64. E. Section IV, Compensation, Subsection D, Reimbursement shall be amended to reference total funding of $657,344.64. F. The County shall reimburse the City on a Net 0 payment standard. G. This Amendment No. 3 is subject to A.R.S. § 38-511. H. The above sections contain all the changes made by this Amendment No. 3 to the Agreement and Amendment Nos. 1 and 2. All other terms and conditions of the Agreement and Amendments Nos. 1 and 2 shall remain in full force and effect as executed by the Parties. I. This Amendment No. 3 is effective upon approval and signature by both Parties. The purpose of the Agreement with the City is to ensure affordable housing is available in the City of Surprise. Funding for the Agreement is provided by grant funds from the U. S. Department of Housing and Urban Development (HUD), (C-22-17-028-3-00). The housing activities meet all HOME Investment Partnerships Program requirements for the required period of affordability. Maricopa County is the lead agency for the Maricopa HOME Consortium. The FY 2019-2020 Annual Action Plan contains specific projects for funding to implement the goals of FY2015-2020 Five-Year Consolidated Plan and serve as guides for the expenditure of HUD funds allocated to Maricopa County. The FY2019-2020 Annual Action Plan was approved by the Board of Supervisors on May 22, 2019. The proposed project for the City of Surprise was listed in the FY2019-2020 Annual Action Plan submitted to HUD. The FY2015-2020 Five Year Consolidated Plan (C-22-15-056-3-00) identifies housing and non-housing community development needs of low and moderate-income people in the Maricopa County service area (Urban County and HOME Consortium). The Five Year Plan establishes goals; and describes performance measures for meeting the goals. The Board of Supervisors approved the Five-Year Consolidated Plan on May 6, 2015. Funding is included in the FY2020 budget and does not impact the General Fund. Supervisor District: 4 (C-22-17-046-3-03)

24. AMENDMENT TO THE IGA WITH THE CITY OF EL MIRAGE FOR COMMUNITY DEVELOPMENT BLOCK GRANT ACTIVITIES Approve Amendment No. 1 to the Intergovernmental Agreement (“Agreement”) between the City of El Mirage (hereinafter referred to as the “Subrecipient”) and Maricopa County (the “County”) administered by its Human Services Department. The purpose of the Amendment is to increase the Agreement funding amount for the project. Through this Amendment, the County will provide the Subrecipient with $75,000 of U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) funds for project activities. The Agreement funding amount will increase from $425,000 to a not-to-exceed amount of $500,000. The Budget and Compensation sections of the Agreement will change to accommodate the Amendment funding. All other terms and conditions of the Agreement remain unchanged. This Agreement is funded by a grant from the U. S. Department of Housing and Urban Development (HUD), (C-22-16-032-G) and does not impact the General Fund. New water lines will improve the public water supply and provide the residents with a sustained and suitable living environment. Supervisory District 4 (C-22-20-011-3-01)

25. AMENDMENT TO THE IGA WITH REGIONAL PUBLIC TRANSPORTATION AUTHORITY Approve Amendment No. 1 to the Intergovernmental Agreement “Agreement” with Regional Public Transportation Authority (RPTA/Valley Metro). The purpose of the Amendment is to extend the Master Intergovernmental Agreement and the Annual Service Agreement term and increase the funding available for services. This amendment changes the term of the Master Intergovernmental Agreement as addressed in Section 3 to be effective until June 30, 2020. The amendment modifies the following in Attachment A (Annual Service Agreement): • The Annual Service Agreement program schedule is amended to end June 30, 2020. • Section 3.1 of the Annual Service Agreement is amended to “The County shall provide up to $1,189,609 transportation costs for services provided in the unincorporated areas of the County to individuals for paratransit and RideChoice services.” • Section 3.2 of the Annual Service Agreement is amended to “Funding availability shall be from July 1, 2019 to June 30, 2020.” • Section 3.6.1 of the Annual Service Agreement is amended to “RPTA shall submit a final invoice no later than August 15, 2020.” • The attached Schedule A amends and adds to Schedule A entered into October 1, 2019. • The attached Schedule B amends and adds to Schedule B entered into October 1, 2019. The Amendment shall be effective upon approval and signature by the Parties. The purpose of the Agreement is for the provision of transportation service delivery for eligible Americans with Disabilities Act (ADA) individuals that reside in unincorporated areas of the County. The County shall reimburse RPTA for transportation services provided to eligible residents. Funding for this Agreement shall be provided by the Human Services Department appropriated General Funds. 26. SUBMIT APPLICATION FOR GRANT FUNDING TO ARIZONA LOTTERY FUNDS FOR TRANSPORTATION SERVICES Request approval to submit a grant application on behalf of Maricopa County to the Arizona Lottery Funds (ALF) for FY2020 transportation services for individuals with Americans with Disabilities Act (ADA) certifications. Transportation services shall be provided by Valley Metro and administered by Public Transportation Authority (RPTA). Grant application requested amount is $818,075, all funds shall be utilized for the provision of transportation services and do not contain Administrative or Indirect funds. Also request authorization for the Chairman to sign all documents related to the grant funding and authorize the Chief Financial Officer to sign financial documents related to this grant. The Human Services Department shall submit the grant application on behalf of the County. If the grant application is approved and Maricopa County is awarded the ALF grant, funds shall be held in trust and RPTA shall administer the grant funds on behalf of the County as they oversee the delivery of transportation services provided by Valley Metro. Valley Metro (VM) has traditionally provided supplemental funds from ADA Public Transportation Funds (PTF) and Maricopa Association of Governments (MAG) 5310 funds. 27. IGA WITH THE UNIVERSITY OF ALABAMA FOR DATA SHARING Approve an Intergovernmental Agreement between The Board of Trustees of the University of Alabama (for and on behalf of its constituent institution, The University of Alabama) and Maricopa County through the Office of the Medical Examiner. This agreement is non-financial. It is effective when signed by the Board of Supervisors and expires five years later. The IGA allows MCOME to share information with University of Alabama for purposes of contributing to understanding risk factors for suicide of veterans. (C-29-20-006-3-00)

28. ONLINE PUBLIC RECORDS AND LEGAL RESEARCH SERVICES (14077-CI) Approve the renewal of the following contracts for legal research services. The County Attorney, Public Defender’s Office, Office of Legal Defender, Office of Legal Advocacy, Sheriff’s Office, Public Health and other County departments use this contract for legal searches. This Contract contains options for contract renewals and is being renewed for a term of five years, thru February 28, 2025. The remaining MA balance in Advantage 3x of $495,992.08 is not sufficient to cover anticipated spend thru the end of this new term, therefore requesting an additional $1,500,000.00 be added to the Contract award value. 29. AFFILIATION AGREEMENT WITH ROSEWOOD CENTERS FOR EATING DISORDERS Approve the Affiliation Agreement with Rosewood Centers for Eating Disorders to provide clinical nutrition training experience for graduate students in the dietetic internship. The agreement is non-financial, and the term is to be from November 1, 2019 through June 30, 2024. NOTICE OF AWARD FOR GRANT FUNDS FROM ARIZONA BOARD OF REGENTS ON BEHALF OF UNIVERSITY OF ARIZONA FOR THE ARIZONA PREVENTION RESEARCH CENTER PROJECT Accept and approve a Notice of Award of grant funds from the Arizona Board of Regents for and on behalf of the University of Arizona (U of A) and Maricopa County by and through its Department of Public Health (MCDPH). The purpose of this grant is to provide funding for applied public health research to address chronic disease health disparities. By engaging in and implementing community clinical linkages to ensure that people with or at high risk of chronic diseases have access to the resources they need to prevent, delay, or manage chronic conditions once they occur. The budget period for this award is September 30, 2019 through September 29, 2020 for the total not to exceed amount of $146,000. The term of the agreement retroactively begins September 30, 2019 through September 29, 2024. This is a new grant and its reoccurrence is not known. It was a competitive grant opportunity and there is no cash or in-kind match required. Should the grant cease, on-going contributions should not be required. This is not a mandated service but provides a benefit to our citizens by providing connections between community and clinical sectors to prevent chronic disease and improve population health. The grant allows for the full indirect rate of 19.2%. Indirect cost is estimated to be $23,517 all of which is recoverable. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. Approval of this action does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. (C-86-20-034-G-00)

32. NEW TRAFFIC CONTROLS ON WOODSIDE DRIVE Approve new traffic controls (All Way Stop) on unincorporated right of way at the following location. 1. An All Way Stop (from a Two Way north / south Stop) at Woodside Drive and 138th Avenue. (This Partially rescinds the Through Street Resolution on Woodside Drive dated April 05, 1995). This agenda item is the result of a Traffic Engineering safety study conducted by MCDOT. 33. NEW TRAFFIC CONTROLS ON BRUNER ROAD Approve new traffic controls (Stop Signs) on unincorporated right of way at the following location. 1. All Traffic to stop before entering or crossing a THROUGH STREET within the prescribed limits of: Bruner Road from 100’ north of Old US Highway 80 to 100’ south of Lower River Road. This new traffic control is the result of an engineering study conducted to identify locations warranting the installation of Stop Signs on county roadways. 34. IGA WITH THE TOWN OF GILBERT FOR IMPROVEMENTS FOR LINDSAY ROAD FROM SPUR ROAD TO LAYTON LAKES BOULEVARD SOUTH Approve the Intergovernmental Agreement between Maricopa County and the Town of Gilbert for the design and construction of Lindsay Road from Spur Road to Layton Lakes Boulevard South. Under this Intergovernmental Agreement, Maricopa County and the Town of Gilbert will widen Lindsay Road to four lanes with a striped median, sidewalk, and drainage improvements and install a traffic signal. The road is currently owned and operated by Maricopa County. The Town of Gilbert will lead the Project and annex the Project prior to the start of construction of the Project. The estimated cost to complete construction of the Project is $2,820,500 with the County’s cost share contribution is estimated to be $1,410,250. Funds will be budgeted in FY2020 Transportation Department (640) Transportation Capital Project Fund (234) Transportation System Management Project, Sub-Project TT0630. The terms of the agreement are in effect as of Board of Supervisors approval and shall remain in full force and effect until all stipulations have been satisfied, except that it may be amended upon written agreement by all parties. 35. CHANGE ORDER TO CONTRACT WITH COMBS CONSTRUCTION COMPANY, INC. FOR CONSTRUCTION OF ROADWAY WIDENING Approve Change Order No. 9 to delete those items and quantities of work in Contract No. 2018-034 with Combs Construction, Inc. that are located on MC 85 west of 91st Ave., and on 91st Ave., both north and south of MC 85. These items of work in the quantities to be deleted represent $4,670,670.77 (Four Million, Six Hundred and Seventy Thousand, Six Hundred and Seventy Dollars, and Seventy-Seven Cents). This deletion results in a substantial change in the scope of work and therefore requires Board of Supervisors approval. Contract No. 2018-034 was executed on September 12, 2018 in the amount of $20,069,707.53 for improvement on MC 85 between 75th Ave. and the 95th Ave. alignment, and along 83rd and 91st Aves., both north and south of their intersection with MC 85. The work being requested for removal from this contract were contingent upon the completion of the USA Fee Land/Easement land exchange with the Bureau of Reclamation (BOR) necessary for relocation of Salt River Project (SRP) irrigation pipeline infrastructure that is included in the contract. This was anticipated to be no later than December 31, 2018, but is not completed to date, nor will it be prior to expiration of the Contract in July 2020. 36. CHANGE ORDER TO CONTRACT 2018-034 WITH COMBS CONSTRUCTION COMPANY, INC. Approve Change Order No. 10 to Contract 2018-034 with Combs Construction Company, Inc. in the amount of $667,717 to allow MCDOT to compensate Contractor for inefficiencies and other financial damages incurred during the first 10 months (through 11/18/2019) of contract time due to unanticipated utility conflicts. Contract No. 2018-034 was executed on September 12, 2018 in the amount of $20,069,707.53 for improvement on MC 85 between 75th Ave. and the 95th Ave. alignment, and along 83rd and 91st Aves., both north and south of their intersection with MC 85. The majority of the roadway work during this time period was predicated on the successful relocation of SRP Irrigation improvements within the Right-of-Way and dedicated easements. During the replacement of the existing SRPI infrastructure to the new locations, numerous conflicts with other utilities were encountered which were unexpected at the locations and depths encountered, and subsequently brought about delays and/or less efficient production while these conflicts were mitigated. The Contractor itemized their losses, presented to MCDOT prior to and at a 12/18/2019 meeting, concluding with MCDOT management offering this settlement.
