10. DELEGATE AUTHORITY TO APPLY FOR 2010 SCAAP REIMBURSEMENT FUNDS ON BEHALF OF MARICOPA COUNTY Approve delegation of authority to the Sheriff to apply for FY2010 SCAAP reimbursement funds, per Part I: SCAAP Guidelines issued by the Bureau of Justice Assistance, Office of Justice Programs, U.S. Department of Justice. SCAAP provides federal payments to states and localities that incurred correctional officer salary costs for incarcerating undocumented criminal aliens who have at least one felony and two misdemeanor convictions for violations of state or local law and who are incarcerated for at least 4 consecutive days during the reporting period (July 1, 2008 through June 30, 2009). The specific award amount is unknown and it is based on a formula. The size of the award is ultimately dependent on the total amount appropriated by Congress and the number of applicants. The Sheriff's Office submitted application information and has secured approximately $20 million dollars in SCAAP awards for Maricopa County over the past decade. Last year's award (2009) was over $4 million dollars. Subsequent Board action is required to accept any funds awarded that result from this application. (C-50-10-107-G-00)

18. APPROPRIATION TRANSFER FOR MANDATED PAYMENT TO THE STATE OF ARIZONA FOR COMMITMENT OF SEXUALLY VIOLENT PERSONS In accordance with A.R.S. Section 42-17106 (B), approve the transfer of appropriated expenditure authority of $700,000 from Non Departmental (470) General Fund (100) Operating (0000), from the amount budgeted for "State Contribution," to Health Care Programs (390) General Fund (100) Operating (0000). The purpose of this appropriation transfer is to expand the funding of the newly mandated payment to the State of Arizona for commitment of sexually violent persons per Laws 2009, Chapter 10, Section 32. This action has no net impact on the overall County budget as adopted by the Board of Supervisors. Laws 2009, Chapter 10, Section 32 requires cities and counties to reimburse the Arizona Department of Health Services for twenty-five per cent of the cost of commitment to the Arizona State Hospital of individuals determined to be sexually violent by the court. Payments are to be made upon request by the Department of Health Services. If payments are not received within thirty days, the State Treasurer shall withhold the amounts due from the county's or city's distribution of transaction privilege (sales) taxes. Counties are authorized to make the required payments from any source of county funds, including funds of a county-wide special taxing district. Of the initial requested amount of $1,500,00, $1,250,635 has been expended to cover payments for the months of July 2009 through February 2010; these additional funds are necessary to cover the estimated payments for the remainder of FY 2009-10. 31. REVISIONS TO HEAD START ZERO-FIVE POLICY COUNCIL BY-LAWS Approve revisions to the Maricopa County Head Start Zero-Five Policy Council Bylaws. This revision modifies Section 3.1.A, Membership, of the By-Laws by: 1) explaining that parents are elected to represent clusters of program sites or program options, and 2) eliminating a fixed number of representatives for each cluster of sites or program options and replacing with a number based on numbers of children served in each cluster. This revision to the By-Laws will be implemented in July 2010 with the election of parents to the FY 2010-11 Policy Council. This revision to the By-Laws was the result of receiving Early Head Start ARRA Expansion funds, which increased the number of children directly served in the County’s Early Head Start program by 72% and which required an increase in the number of Early Head Start parent representatives on the Policy Council. Both the Board of Supervisors and the Head Start Policy Council must approve the Policy Council Bylaws as required by the Head Start Act Section 642.c(1)(E)(iv)(VI). The Maricopa County Head Start Zero-Five Program Policy Council approved this revision to the By-Laws on February 26, 2010. (C-22-09-080-M-02)
