Revised applications shall be in accordance with the applicable Development Master Plan Guidelines, subdivision regulations, and zoning ordinance in effect at the time of application(s) submission. The Maricopa County Planning and Development Department may approve minor changes administratively as outlined in the Maricopa County Development Master Plan Guidelines in effect at the time of amendment. Up to a 5% variation to the proposed number of dwelling units within any development parcel will be allowed without an amendment to the DMP being required, as long as the subtotal within the applicable Area (A, B or C) in which it is located is not exceeded, and the change does not result in a change of land use category. However, Maricopa County may still require an amendment for a 5-10% variation depending on the particular circumstances of the proposed change. Any change greater than 10% in the number of proposed units for a parcel will require a major amendment subject to approval by the Board of Supervisors upon recommendation by the Planning and Zoning Commission. The status report shall be reviewed by staff to determine whether the project remains in compliance with the approved conditions, or whether to schedule the matter for review by the Commission for recommendation to the Board. This condition shall remain in effect until all final plats have been approved for this development. e. Prior to approval of the first final plat, the master developer shall enter into a development agreement with Maricopa County that addresses short- and long-term service, infrastructure, operation, maintenance, and financial assurance needs of Maricopa County agencies necessary to provide adequate services and infrastructure to future residents of the Broadstone Ranch Development Master Plan. Further, prior to approval of any final plat, said development agreement shall be signed by both the master developer and the designated Maricopa County representative(s), recorded with the Maricopa County Recorder’s Office, and a copy provided to the Maricopa County Planning and Development Department for public record. Maricopa County reserves the right to modify the development agreement if it is determined that such changes are necessary due to changing circumstances or conditions, although such modifications are subject to approval by the Board of Supervisors. The master developer may also petition for modifications, which are also subject to Maricopa County Board of Supervisors approval. f. Noise will be more noticeable during overcast sky conditions due to noise reflections off the clouds. Luke Air Force Base's normal flying hours extend from 7:00 a.m. until approximately midnight, Monday through Friday, but some limited flying will occur outside these hours and during most weekends. Luke Air Force Base Auxiliary Field 1, located approximately 15 miles to the northwest of Luke Air Force Base is a site of intense instrument procedure landing approaches, with approximately 12,000 flight operations per year. Aircraft will descend down to 200 feet above the ground over the Auxiliary Airfield and will create severe noise in that area. For further information, please check the Luke Air Force Base website at www.luke.af.mil/urbandevelopment or contact the Maricopa County Planning and Development Department.” Such notification shall be recorded on all final plats, be permanently posted on not less than a 3 foot by 5 foot sign in front of all home sales offices, be permanently posted on the front door of all home sales offices on not less than an 8½ inch by 11 inch sign, and be included in all covenants, conditions, and restrictions (CC&Rs) as well as the Public Report and conveyance documents. l. 8. EXPENDITURE BUDGET TRANSFER Per A.R.S. §42-17106, approve an expenditure budget transfer of $40,667 for FY 2014-15 ($40,667 annualized) from Clerk of the Superior Court (160) General Fund (100) Operating (0000) to Superior Court (800) General Fund (100) Operating (0000), representing the salary and benefits of one FTE Justice System Clerk (Court Operations Representative – Juvenile) position. DESIGNATION AND CANCELLATION OF FIRE DISTRICT ELECTIONS AND APPOINTMENT TO OFFICE Designate special districts as defined under Title 48 within Maricopa County which qualify for alternate procedure for electing the district governing board members for terms of office beginning December 1, 2014 for fire districts. 52. ADULT ADOPTION FEE Pursuant to A.R.S. §11-251.08, set a public hearing for November 5, 2014 to solicit comments and consider the adoption of ADULT ADOPTION FEE. Upon Board approval, this item will become effective November 5, 2014. Several years ago adult adoption case processing was transferred from Juvenile Court to Probate and Mental Health Court. When this change in responsibility occurred, the Probate and Mental Health Court continued the practice of assessing a $150 filing fee and $150 investigation fee. This fee was assessed in order to recoup expenses billed by outside contractor services that performed the adult adoption case processing. Since statutory authority for these assessments could not be identified, the Clerk of Court discontinued accepting these fees for adult adoption cases on November 1, 2013. Probate and Mental Health Court is now seeking to have the Board of Supervisors approve the assessment of a $140 filing fee and a $140 investigation fee ($280 total per case) for adult adoption cases. The assessment will recoup the expense of providing the service for which the fee is assessed. As noted in table below, as part of processing these case types, there is a substantial amount of staff time dedicated to conducting the investigation and drafting the report mandated by A.R.S. § 14-8101(D). From FY2010 through FY2013, there was an average of 30 adult adoption cases filed with the Court annually. It is projected that this trend will continue over the next several years. These fees, therefore, will generate approximately $8,400 in revenue. Monies collected will offset expenses for personal services costs. This fee does not require approval from the Arizona Supreme Court Administrative Office of Courts. The assessment of the fee would commence following BOS approval of the fee. The Court is seeking for the fee to be deposited into the Superior Court Special Revenue Fund 259 and used to offset the costs associated with Adult Adoptions. The proposed fee is intended to recover (but not exceed) the full cost of the service. Parties may request a waiver or deferral of fees using the established process. (C-80-15-002-2-00)

F-4. IGA WITH U.S. DEPARTMENT OF AGRICULTURE NATURAL RESOURCES CONSERVATION SERVICE FOR POWERLINE FLOOD RETARDING STRUCTURE DECOMMISSIONING Approve Intergovernmental Agreement (IGA) FCD 2014A008 for the Powerline Flood Retarding Structure (FRS) Decommissioning with Channel Replacement Project (Project) between the U.S. Department of Agriculture Natural Resources Conservation Service (NRCS) and the Flood Control District of Maricopa County (District). This IGA establishes a cost share for the Project and establishes responsibilities with respect to project design, right-of-way acquisition, construction, construction management, and operations and maintenance. The cost share will be District $10,234,500 (35%) and NRCS $19,007,000 (65%). Project costs that NRCS does not cost share in will add an additional estimated $1,521,000 to the District’s Project cost for a Total Project Cost of $30,762,500. The IGA shall become effective the date it is fully executed by all parties to this IGA and shall expire 5 years after the effective date. Powerline FRS is one of three earthen flood retarding structures (Vineyard Road FRS and Rittenhouse FRS are the other two) located in northwestern Pinal County, east of the Central Arizona Project (CAP) canal and south of Baseline Road. The Powerline, Vineyard Road, and Rittenhouse FRSs Rehabilitation or Replacement Project was a District sponsored planning study which analyzed alternatives and selected a preferred alternative that would correct the dam deficiencies, maintain the flood control benefits to downstream properties, and comply with NRCS and state dam safety requirements. The selected alternative for Powerline FRS involves replacing Powerline FRS with a channel system that discharges into the Vineyard Road FRS flood pool. This Project has been selected by NRCS to be fully cost share funded from planning through construction. Per NRCS funding authorization requirements the Project must be constructed by September 30, 2018. Currently the Project is in the design phase. This IGA obligates NRCS funds for the project. In addition, this IGA requires that FCDMC reimburse NRCS for all assistance for this project. Terms of reimbursement will be established by a separate agreement. This item impacts Supervisorial Districts 1 and 2. (C-69-15-002-3-00)

F-5. IGA WITH U.S. DEPARTMENT OF AGRICULTURE NATURAL RESOURCES CONSERVATION SERVICE FOR VINEYARD ROAD FLOOD RETARDING STRUCTURE REHABILITATION PROJECT AND RITTENHOUSE LEVEE PROJECT Approve Intergovernmental Agreement (IGA) FCD 2014A009 for the Vineyard Road Flood Retarding Structure (FRS) Rehabilitation Project and Rittenhouse Levee Project between the U.S. Department of Agriculture Natural Resources Conservation Service (NRCS) and the Flood Control District of Maricopa County (District). This IGA establishes a cost share for both Projects and establishes responsibilities with respect to project design, right-of-way acquisition, construction, construction management, and operations and maintenance. The estimated eligible cost share for both Projects will be District $22,157,600 (35%) and NRCS $41,149,800 (65%). NRCS currently has funds obligated for the Vineyard Road FRS Rehabilitation Project (Vineyard Project) in the amount of $34,503,000 (65%) with the District cost share being $18,578,500, (35%). The non-eligible costs, such as permits, gravel mulch, and landscape aesthetics, that NRCS does not cost share in will add an additional estimated $5,037,000 to the District’s Vineyard Project cost for a Total Vineyard estimated Project Cost of $58,118,500. The District’s estimated cost share including non-eligible costs for the Vineyard Project is $23,615,500. The Rittenhouse Levee Project (Rittenhouse Project) will be implemented when future NRCS funding becomes available. This IGA is effective the date it is fully executed by all parties. The end date of this IGA will be 5-years after the effective date. Vineyard Road FRS and Rittenhouse FRS are two of three earthen FRSs located in northwestern Pinal County, east of the Central Arizona Project (CAP) canal and south of Baseline Road. The selected alternative for Vineyard Road FRS involves raising and rehabilitating the structure, and for Rittenhouse FRS, it involves converting the dam into a levee. Since both of these structures are part of the Williams-Chandler Watershed Agreement, both are part of this IGA. This IGA identifies the cost share responsibility for both the Vineyard Project and Rittenhouse Project. Currently only the Vineyard Project has been selected by NRCS to be fully cost share funded from planning through construction. Per NRCS funding authorization requirements, the Vineyard Project must be constructed by September 30, 2018. Currently the Vineyard Project is in the design phase. The Rittenhouse Project will be constructed when NRCS funds become available in the future. This IGA obligates NRCS funds for the project. In addition, this IGA requires that FCDMC reimburse NRCS for all assistance for this project. Terms of reimbursement will be established by a separate agreement. This item impacts Supervisorial District 1 and 2. (C-69-15-004-3-00)

The Maricopa County Library District has many items which the Maricopa County Surplus Program has deemed to have no resale value and can be liquidated. These items include tables, chairs and other office equipment. Rather than dispose of these items in the County landfill, the Library District and the Maricopa County Green Government Program respectfully request approval to donate these items to a local charity - Society of St. Vincent de Paul. Society of St. Vincent de Paul is willing to take the items. Donating these items to Society of St. Vincent de Paul will result in less waste and will help the residents of Maricopa County.
