PZ-3. CRISMON PEAKS ASSISTED LIVING Case #: Z2014035 Supervisor District: 2 Applicant/Owner: Mills Engineering, LLC. / Joseph Rubanow & Matthew Schmitz Request: Special Use Permit (SUP) for Group Care facility in the R1-35 zoning district – Crismon Peaks Assisted Living. Site Location: Located at the northeast corner of Crismon Rd. and Hillview St. in the Mesa area. Site Size: Approximately 3.20 acres. Commission Recommendation: On 7/23/15, the Commission voted 6-0 to recommend approval of Z2014035 subject to conditions ‘a’ – ‘g’. a. Development of the site shall comply with the site plan entitled “Assisted Living Care Special Use Permit”, received April 2, 2015 and consisting of one (1) page, except as modified by the following conditions. b. Development of the site shall comply with the narrative report entitled “Narrative for Special Use Permit for Crismon Peaks Assisted Living Care Homes”, received November 14, 2014 consisting of seven (7) pages and “Addendum to Narrative” received April 2, 2015 consisting of four (4), except as modified by the following conditions. c. The following Engineering Plan Review (Drainage, Flood Control District & MCDOT) conditions shall apply: 1. At the time of obtaining the building permit, a letter with an Engineer’s seal, must be submitted stating that the existing garage finished floor elevations are free of inundation during a 100-year peak runoff event or the garage floor of the existing residences (10035 E. Hillview St. Mesa, AZ 85207 & 10010 E. Hillview St., Mesa, AZ 85207) must be elevated to match the existing finished floor elevations. 2. Maricopa County Assessor’s Parcel Number 220-01-001U (10035 E. Hillview St., Mesa, AZ 85207) has a FCDMC Drainage Easement associated with the Signal Butte Floodway. Prior to any development on the subject parcel, a right-of-way permit must be obtained from the Flood Control District of Maricopa County (the District). 3. If the garage floors are free from the inundation from the 100-year peak runoff, an Engineer’s sealed letter, as specified above, with the Site Plan will suffice. If the garage floors are elevated to match the existing finished floors of the respective residences, Plans showing the new site improvements must be submitted for the acquisition of building permits. d. The following Maricopa County Environmental Services Department (MCESD) conditions shall apply: 1. Contact the MCESD Drinking Water Program to determine if water well(s) must be permitted as Public Water System(s). 2. Contact the MCESD Onsite Program to determine if the existing septic systems must be re-permitted for commercial use and to confirm that they have adequate capacity for the anticipated use. e. Prior to occupying the existing residences or any portion thereof for any use associated with the Special Use Permit, the applicant shall obtain a Building Permit to retrofit the existing residence to meet current commercial building code requirements as applicable and shall obtain a Certificate of Occupancy for the retrofitted building prior to occupancy. f. The applicant/property owner shall submit a ‘will serve’ letter from Rural Metro Fire District for fire protection services for the project sites. A copy of the ‘will serve’ letter shall be required as part of the construction permit submittal. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted.
