9. SOUTHWEST BORDER PROSECUTION FUNDS FROM U.S. DEPARTMENT OF JUSTICE Approve the acceptance of grant funds from U. S. Department of Justice, for the Southwest Border Prosecution Initiative Program in the amount of $484,765.00. These grant funds are for the reimbursement of the County Attorney for prosecution of federally declined criminal cases. The grant award begins on October 1, 2012 and ends on September 30, 2016. Authorize the Chairman to sign all documents related to these grant funds, as applicable. The grant allows a 0% rate for indirect costs, or $0 that may be incurred by the County Attorney's Office or Maricopa County for the administration of this grant. The Maricopa County Department of Finance has calculated the County Attorney's Office composite indirect cost rate at 14.2%, or $68,837. The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect cost is $68,837. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, budget law does not prohibit expenditure of the funds. These funds are for cases that were investigated by federal law enforcement agencies, declined for prosecution by the U.S. Attorney, and were subsequently prosecuted by the Maricopa County Attorney's Office under state law because the crimes were committed in Maricopa County. These cases are already prosecuted and therefore there are no indirect costs to accepting this grant money. The Federal government has funded this program under 2010 Public Laws 111-117 H.R. 3288: Div B. Title II. There are no agreements and therefore, no signatures are required. (C-19-13-011-G-00)

14. ACCEPT FY2012 STATE CRIMINAL ALIEN ASSISTANCE (SCAAP) FUNDS Approve acceptance of $1,281,403 Federal FY2012 reimbursement funding from the Bureau of Justice Assistance, State Criminal Alien Assistance Program (SCAAP). The corresponding application was approved by the Board of Supervisors (Agenda C-50-12-080-G-00), on June 20, 2012. The Bureau of Justice Assistance allows these funds to be used for corrections purposes only. The specific planned use, as determined by the Office of Management and Budget, will be stated in the electronic request to drawdown the funds. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditures of these revenues are not prohibited by the budget law The Sheriff's Office has applied for this formula-based reimbursement on behalf of the County for many years. SCAAP reimburses state and local government agencies a portion of the costs to incarcerate undocumented criminal aliens who are convicted of felony offenses. Indirect costs are not recoverable since only staff whose primary responsibility is the care, custody, or supervision of persons detained (pre-trial detention) and incarcerated (convicted and sentenced) inmates are allowable in the calculation. 19. APPROPRIATED BUDGET ADJUSTMENTS Approve increases in the appropriated budget for the County Manager's Office (200) Non-Departmental Grant Fund (249) Non-Recurring, Non-Project (0001) in the amount of $22,048 in revenues and expenditures. This appropriation adjustment brings the County Manager's Office grant budget to the amount of $312,023. 23. AMENDMENT TO IGA WITH THE TOWN OF CAVE CREEK FOR THE EXCHANGE OF SERVICES (ENTENTE) Approve the second amendment to the Intergovernmental Agreement (Agreement) between Maricopa County (County) and the Town of Cave Creek (Town) for the exchange of services or reimbursement of services (Entente). The Agreement will not exceed five (5) years unless extended by appropriate actions by the County and the Town. Either party may terminate this Agreement at any time prior to the end of its duration by furnishing the other party with a thirty (30) day written notice. The purpose of this Agreement is to identify and define both Parties’ respective roles in the execution of the responsibilities of specific maintenance tasks in areas that cross jurisdictional boundaries. The Agreement provides the opportunity to focus on specific maintenance tasks and the availability of the most economical resources by extending beyond jurisdictional or geographical boundaries. The application of the Agreement will benefit areas in the County and the Town where certain types of routine or emergency maintenance activities could be completed by the other party based on scheduled work within the area. Individual maintenance tasks performed by either party will be executed upon the completion of a “Letter of Agreement” (LOA) approved and signed by the Department of Transportation Director and the Town Manager or their designee. If the value of the goods or services exchanged by the Parties is not of equal value, the total aggregate reimbursement to the respective Party will not exceed $200,000 per fiscal year. If no services are exchanged, there is no financial impact. An accounting mechanism will be utilized to track each LOA, as applicable, to identify specific tasks and services and to ensure the exchange of these services are of similar value. 24. PROPOSED AMENDMENT TO THE MARICOPA ASSOCIATION OF GOVERNMENTS (MAG) REGIONAL TRANSPORTATION PLAN (RTP) FOR USE OF A LIGHT RAIL EXTENSION IN THE CITY OF MESA Approve a written recommendation of the Maricopa County Board of Supervisors (BOS) to the MAG Transportation Policy Committee (TPC) regarding the proposed amendments to the Regional Transportation Plan (RTP) to transfer funds from the MAG RTP Arterial Life Cycle Program (ALCP) to the Transit Life Cycle Program (TLCP) for the City of Mesa to extend the Light Rail Transit on Main Street from Mesa Drive to Gilbert Road. The City of Mesa is asking for approval to remove federal Surface Transportation Program (STP) funds in the amount of $153,366,043 from sixteen (16) ALCP projects and to use the funding to reimburse costs associated with the design, right-of-way acquisitions, and construction of a 1.9 mile light rail transit extension on Main Street from Mesa Drive to Gilbert Road. The proposed request is a major amendment to the RTP because there is more than one-mile of fixed transit being added. However, the deletion of the projects from the ALCP is not subject to the major amendment requirements in state law for the RTP. In addition, the transfer of Proposition 400 sales tax funds from arterial roads to the transit mode is prohibited under the terms of the proposition and state law, but the transfer of federal highway funds is not subject to the same restriction. Pursuant to Arizona Revised Statutes Section 28-6353, the amendment requires that consultation by MAG be made with the BOS, the State Transportation Board, and the Regional Public Transportation Authority. Each entity shall submit a written recommendation to the MAG Transportation Policy Committee (TPC) within thirty (30) days after receiving the proposed amendment. The term of this grant began on July 1, 2010 and ends on June 30, 2015. The term of Amendment #6 remains from July 1, 2012 to June 30, 2013. The purpose of Amendment #6 is to decrease the reimbursement ceiling for Case Management contract service by $4,016, and also increase the reimbursement ceiling for Community Services contract service by $340,677, which is carryforward funding. With Amendment #6, the cumulative reimbursement ceiling for this Agreement over the grant period is now adjusted to $15,550,683. Amendment #6 also revises: 1) Terms and Conditions, Section 16.0 to amend the “Background Checks for Employment Through the Central Registry” clause and Section 19.2 to add language pertaining to the Arizona Address Confidentiality Program to this Confidentiality section; and 2) includes revised Itemized Service Budget Attachments A & B for Case Management and Community Services, respectively; and finally 3) replaces the existing Service Methodology and Facility Location Chart with revised, updated documents. The FY 2013 Human Services Department negotiated U.S. Department of Health and Human Services approved indirect cost rate is 17.8% of salaries and employee related expenses. The total grant funds for this mid-year increase are $336,661, of which $214,100 is for direct payment vouchers and not subject to indirect cost recovery. Although Salaries/ERE has a net decrease of $53,640 for this Amendment, an increase in indirect recovery is due to the indirect rate increase since receiving the SFY13 funding. The total estimated indirect cost is $1,656 and is recoverable. Funding for this Amendment does not impact the County General Fund. The overall grant budget will be adjusted as necessary to accommodate this Amendment through a future reconciliation. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of these revenues by Maricopa County is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. (C-22-10-083-3-06)

SETTING OF HEARING FOR SELF SERVICE CENTER FEES Pursuant to A.R.S. §11-251.08, set a public hearing for January 23, 2013 to solicit comments and consider adopting an increase to the existing fee structure for copying and printing fees for the Maricopa County Superior Court Self Service Center and Court Law Library. Also, authorize the Court Law Library to waive library fines assessed in error. Upon Board approval, these items will become effective January 23, 2013. A.R.S. § 11-251.08 authorizes the Board of Supervisors to adopt fees for any specific service the County provides to the public as long as that fee is attributable to and defrays the expense of the service for which the fee is assessed and the fee does not exceed the actual cost of that service. The formal establishment of the revised fees proposed below is essential to the Court’s continued success in providing high-quality judicial services to litigants, other government agencies, and the citizens of Maricopa County. The proposed fees proceeds will be deposited into the Superior Court Special Revenue Fund (259) and the Law Library Fund (261) for disbursement as appropriate. Proposed Fees, current to new: EzCourtForms Printing Fee - $0.10 to $0.20 per page, (estimated annual revenue of $12,700, estimated FY13 revenue of $6,350); Library Photocopy While-You-Wait Service and Copy Fee for any library-staffed copy service - $0.20 to $0.50 per page, (estimated annual revenue of $385.20, estimated FY13 revenue of $192.60); Library and Self Service Center Photocopier and Print Release Fee - $0.10 to $0.20 per page, (estimated annual revenue of $11,342, estimated FY13 revenue of $5,671). The latter fee is collected by vendors and offset against library photocopier invoices. Upon determination by library management that library fines and/or fees were assessed in error, the Law Library may waive those incorrectly assessed fines and/or fees. (C-80-13-005-2-00)
