10. DONATIONS OF BOOKS AND LIBRARY MATERIALS FOR THE JAIL INMATE LIBRARY Approve acceptance of books and library materials of any value from any source, including other libraries, for-profit and not-for-profit organizations and private citizens. The number and volume of items accepted will be limited to the amount that the Sheriff's Office has the capacity to accept, process, and store given its current resources. The distribution of reading materials to inmates is part of Graves v. Arpaio. The Sheriff's Office Inmate Library receives donations of approximately 2,000 new and used books a week from a variety of sources. These materials generally have no salvage value and short life cycles in the jail environment. Last month, 12,000 books were distributed to inmates. Books that can't be used in the jails but that are otherwise useful are re-donated per agenda item C-50-08-044-M-01, previously approved by the Board of Supervisors. (C-50-11-058-M-00)

17. ACCEPT GRANTS AND OTHER ASSOCIATED REVENUES FOR THE ADULT PROBATION DEPARTMENT FOR FY 2010-11 Accept the FY 2010-11 grants and other associated revenues for the Adult Probation Department of the Judicial Branch. The indirect cost rate as of July 2010 is 10.8% as approved by the Department of Finance. Some of the grants for FY 2010-11 do not allow indirect cost recovery as reflected in the attached funding agreements. The status of indirect costs for each grant is noted on the attached summary sheets. For FY 2010-11 we anticipate accepting sixteen new awards for Grant Fund revenue of $4,013,072 and carrying over Grant Fund revenue balance of $2,734,598 on ten previously accepted awards. On the new awards, indirect costs on eligible expenditures are estimated to be $382,621 with $53,691 recoverable and $328,930 unrecoverable. In addition, approve an increase to the FY 2010-11 Adult Probation (110) Adult Probation Grants Fund (211) Operating (0000) revenue and expenditure appropriation in the amount of $628,031. This increase is necessary because actual grant funding to be received is more than anticipated and budgeted. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation and, therefore, expenditures of these revenues are not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. Administrative Order #95-50, approved by Presiding Judge Robert D. Myers on June 29.1995 adopted for the Judicial Branch a policy for the administration of grant funding. The policy is identical in form and substance to policy A2502 "Policy for Administering Grants" and all revisions adopted by the Board of Supervisors for all County departments. The policy states that the Presiding Judge will make a presentation to the Board of Supervisors on an annual basis of the Judicial Branch's grants. A summary of each grant has been prepared in accordance with the provisions of the policy. (C-11-11-004-G-00)

The indirect cost rate as of July 2010 is 32.80% as approved by the Department of Finance. Some of the grants for FY 2011 do not allow indirect cost recovery as reflected in the attached funding agreements. The status of indirect costs for each grant is noted on the attached summary sheets. For FY 2011 we anticipate accepting sixteen new awards for Grant Fund revenue of $4,488,900 and carrying over Grant Fund revenue balance of $904,596 on nine previously accepted awards. On the new awards, indirect costs on eligible expenditures are estimated to be $1,311,625 with $103,919 recoverable and $1,207,706 unrecoverable. In addition, approve an increase to the FY 2011 Juvenile Probation (270) Juvenile Probation Grants Fund (227) Operating (0000) revenue and expenditure appropriation in the amount of $97,019. This increase is necessary because actual grant funding to be received is more than anticipated and budgeted. Some of the grants for FY 2011 do not allow indirect cost recovery as reflected in the attached funding agreements. The status of indirect costs for each grant is noted on the attached summary sheets. The amounts of indirect costs on eligible expenditures are estimated to be $943,276 with $651,719 unrecoverable and $291,557 recoverable. A-8. IGA WITH PINAL COUNTY Approve an Intergovernmental Agreement (IGA) with Pinal County establishing a process for the referral between the two jurisdictions of internal investigations, personnel matters, and other matters involving actual or potential conflicts of interest. Costs for investigations, personnel matters, and other matters will be covered on a reimbursement basis. This Agreement will expire on June 30, 2016. This Agreement may be extended for additional five (5) year terms based on mutual agreement of the Parties. Periodically, county governments require investigations that cannot be performed internally due to actual or potential conflicts of interest. The proposed agreement with Pinal County establishes a process by which Maricopa County and Pinal County can refer conflict matters to each other and provides a mechanism for the county to which an investigation is referred to incur the costs associated with the investigation and be reimbursed. A-10. SOLE SOURCE PROCUREMENT OF LEGAL SERVICES - STEPHEN M. WEISS AND TERRENCE P. WOODS In accordance with Article 3, Sections MC1-343 and MC1-344 of the Maricopa County Procurement Code, approve a Sole Source procurement of Stephen M. Weiss, Esq. of the law firm Karp & Weiss, P.C. and Terrence P. Woods, Esq., of the law firm Broening, Oberg Woods & Wilson, to provide legal representation to Lisa M. Aubuchon and Andrew P. Thomas, respectively, for the defense of Arizona State Bar Complaints. The representation shall not exceed $100,000 per law firm, or $200,000 in total and is subject to the terms and conditions of Serial 10009-S, Legal Service Providers. Services shall be retroactive to January 3, 2011 and will terminate upon completion of the cases, depletion of the not-to-exceed dollar limit per firm, or accordance with the terms of Serial 10009-S. Discussed in Executive Session January 24, 2011, January 26, 2011, and February 7, 2011. Pursuant to A.R.S. § 42-17106(B), transfer FY 2010-11 expenditure appropriation of $100,000 from Non-Departmental (470) General Fund (100) Non-Recurring/Non-Project (0001) to County Attorney Civil (280) General Fund (100) Non-Recurring/Non-Project (0001). This action results in a net impact of zero to the total County General Fund budget. Within the appropriated budget for Non-Departmental, the amount to be transferred will be deducted from Unreserved Contingency. The Maricopa County Attorney, and agents working on his behalf, have conducted a reasonable effort to identify suitable representation through the existing contract Bid Serial 10009-S, Legal Service Providers. Finding no providers on the contract that were responsive, not ethically conflicted, or possessed the necessary qualifications, the Maricopa County Attorney has concluded that it is advantageous to Maricopa County to enter into a sole source contract with the two law firms described herein for the purpose of representing the individuals named. The Maricopa County Attorney’s Office will be responsible for administering the sole source contracts for compliance with the terms, conditions and pricing of Serial 10009-S, and assure the scope of representation is limited to the defense of the Arizona State Bar Complaints. The expenditure budget request is necessary due to unanticipated and unbudgeted costs associated with bar complaints and special action matters that are outside the scope of the current appropriated budget for the County Attorney’s Civil Division.
