TRADE-IN ITEMS FOR CREDIT ON TWO PURCHASES Approve per MC1-803 of the County Procurement Code the following: 1) The trade-in of five (5) LX4000 soon-to-be surplus polygraph Systems for credit of $2,000 each for a total of $10,000 on the purchase of a replacement polygraph system from the lowest responsible bidder, Lafayette Instrument Company, Inc. The overall benefit to the County for disposal of these items in this manner is expected to exceed the auction value. 2) The trade-in of fifty-three (53) surplus Preliminary Breath Test (PBT) units for credit of $40 each for a total of $2,120 from Lifeloc, Inc. to be credited toward the repair of twenty-three (23) separate units, for which the repair cost has been quoted at $100 each. Disposal of these items in this manner has been authorized by the Grantor (Governors Office of Highway Safety) and the value of this transaction is expected to be exceed the auction value. ONE TIME ADDITION TO SHERIFF’S FLEET Approve a one-time addition to Sheriff’s Fleet of red-lined vehicle #311354, a black 2013 Ford F150 4 x 4 pickup with 106,779 miles, valued at $21,092 to be used at District IV. Annual operating costs, which will be funded through the General Fund (100), are anticipated to be $5,000. This vehicle will have regular markings and be equipped as a patrol vehicle. It will be retired at the end of its useful life with no funding from the General Fund for a replacement. MCSO District IV is experiencing a vehicle shortfall and its removal from service will cause an operational hardship. This is the only large vehicle remaining that can haul large items that don't fit in Patrol Vehicles and has sufficient clearance to cross washes and rough areas. (C-50-20-035-V-00)

SUPPLEMENT TO AGREEMENT WITH THE OFFICE OF NATIONAL DRUG CONTROL POLICY FOR THE HIGH INTENSITY DRUG TRAFFICKING AREA PROGRAM – INITIATIVE XXVIII Approve retroactively supplement #3 to the Agreement with the Office of National Drug Control Policy (ONDCP) Award Number G18SA0005A, for the High Intensity Drug Trafficking Area (HIDTA) Program. This supplement is an increase of $25,000.00 to the agreement amount from $620,151.60 for a total of $645,151.60. The term of this funding is unchanged January 1, 2018 to December 31, 2019. This amount will be applied to the Maricopa County Sheriff’s Office allocation, increasing it from $461,504.60 to $486,504.60. The HIDTA Program is sponsored/funded by the Office of National Drug Control Policy (ONDCP). This funding is recurring and has been awarded to the Sheriff’s Office since 1998. The Sheriff’s Office indirect cost rate for FY20 is 16.3%. The total unrecoverable indirect cost amount is $4,075. The unrecoverable indirect cost of $4,075 will be covered by the department General Fund. This supplement will be used for overtime costs worked by MCSO detectives on HIDTA cases. This funding supports of the Sheriff’s public safety mandate through efforts to reduce illegal drug use with the interruption of drug trafficking. There is no matching requirement and there are no future or ongoing contributions required after the grant period ends. This is a non-competitive award. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. 13. COMPETITION IMPRACTICABLE WITH MJ MARTIN, INC. Approve a Competition Impracticable with MJ Martin, Inc. in the amount not to exceed $146,910 for additional training and coaching of MCSO Custody Bureau staff to completely transition to a new method of inmate supervision and management. This will be funded from the Sheriff’s Jail Enhancement Fund (214). MCSO has received technical assistance and coaching from facilitators of the National Institute of Corrections (NIC) since May in preparation for the transition in 2020 to a new jail facility that will be managed in a totally new way. In September, MCSO hosted National Institute of Corrections training by MJ Martin at a cost of $23,000. Those that attended the training recommended additional training and expansion to the approximately 400+ officers and supervisors that will soon transition to the new jail facility. Another CI for $77,000 was approved in December to continue the training in January. It is essential for the Sheriff’s Office continue and complete the training with this company that is certified by the NIC and familiar with MCSO’s current operations and transition requirements. The projected total expenditure year to date is not expected to exceed $246,910. This training is crucial to the successful transitioning of staff to the new inmate management system at the new facility. (C-50-20-036-M-00)

ANNUAL RENEWAL OF DEEP UNDERCOVER VEHICLE REGISTRATIONS Approve renewal of deep undercover registrations and exemptions from markings which includes non-government license plates, per A.R.S. 38-538-03, for Sheriff’s RICO vehicles that are used for conducting investigations into major felony crimes, narcotics operations, and organized crime activity throughout Maricopa County. The Sheriff’s Office maintains a fleet of RICO deep undercover vehicles that are approved by the Board on a case by case basis as one-time additions to fleet with exemptions from markings and non-governmental plate registrations. IGA WITH CITY OF TEMPE FOR SWORN TRAINING ACADEMY Approve an Intergovernmental Agreement (IGA) between Maricopa County on behalf of the Sheriff’s Office and City of Tempe regarding the Maricopa County Sheriff’s Office Sworn Basic Training Academy. This Agreement allows City of Tempe law Enforcement recruits to participate in scheduled MCSO Sworn Basic Training Academies at a cost of $500 per registrant January 1, 2020 through June 30, 2020 and $750 per registrant beginning July 1, 2020. The term of this Agreement is January 1, 2020 to June 30, 2021 and it is effective when signed by the parties. This agreement can be terminated at any time with two months written notice. City of Tempe does not have its own training academy and this Agreement will allow MCSO to provide training space, when available, to the City’s Law Enforcement recruits in MCSO scheduled sworn training academies. City of Tempe is responsible for providing worker’s compensation insurance, salary, benefits, weapons, ammunition and uniforms for its recruit participants. (C-50-20-038-3-00)

19. ANNUAL ADJUSTMENT TO INMATE BOOKING AND HOUSING FEES Approve the annual adjustment to the inmate booking and housing fees charged to other jurisdictions for the use of Maricopa County jails. The effective date of this adjustment will be July 1, 2020. The inmate booking fee will increase from $366.51 to $396.98 per inmate booked; the inmate housing fee will decrease from $105.15 to $102.55 per day. As directed by the Board of Supervisors, the Department of Finance, in conjunction with the Sheriff’s Office and Correctional Health Services, has completed the annual fee review for adult detention services and has developed new per diem rates for Board approval. The new per diem rates will be effective July 1, 2020. These per diem rates help cover the County’s cost of operating and maintaining the jail system. EMPLOYEE BENEFITS PLAN AND ADMINISTRATIVE CHANGES FOR FY 2020-21 Approve the Maricopa County Benefits Plan (Tenth Amendment and Restatement) document effective July 1, 2020, attached as Exhibit A. The plan document governs how employee health and welfare benefits (such as medical, prescription, behavioral health, etc.) are administered. These documents supersede all previous plan documents. New or amended features are shown redlined with tracked changes attached for convenience as Exhibits A and B. The following is a summary of the substantive changes: Tenth Amendment - Effective July 1, 2020 • 2.16 - Change definition of employee eligibility for benefits from 19 hours to 20 hours • 4.12(b) – Amend "Change in Status" to include compliance with HIPAA Special Enrollment rules and to update provision language to be more user-friendly and consistent with the Plan's design and permitted election change events provided under Section 125 of the Internal Revenue Code. The Maricopa County Benefits Plan document governs basic issues of plan eligibility, participation (enrollment), coverage, payroll withholding, and funding accounts pursuant to the Internal Revenue Code. The document does not define specific benefit programs, which are adopted by the Board of Supervisors in separate actions. Part-time eligibility for benefits at the County (medical, dental, vision, life, etc.) is currently below the industry norm at 19 hours. 23. AMENDMENT TO THE AGREEMENT WITH WILDFIRE FOR UTILITY REPAIR REPLACEMENT AND DEPOSIT PROGRAM Approve financial Amendment No. 2 to the Agreement between Arizona Community Action Association dba Wildfire (hereinafter referred to as “Wildfire”) and Maricopa County administered by its Human Services Department, Housing and Community Development Division. The purpose of this Amendment is for Wildfire to provide an increase in funds for the Utility Repair Replacement Deposit (URRD) Program. Wildfire will provide the County with an additional $150,000 ($136,364 for Direct Service and $13,636 for Program Delivery) The total URRD expenditure shall be increased from $350,480 to $500,480 and the overall Agreement amount shall be $515,480. The funding period of availability is July 1, 2019 to June 30, 2020. Wildfire contracts with the County on an annual reoccurring, non-competitive basis to administer the URRD program outside of the City of Phoenix and the City of Mesa. The URRD services are utilized along with Weatherization program funding to assist persons who are elderly, persons with disabilities, families with children, and households with high-energy burdens to reduce energy costs and improve health and safety issues in the home. The Human Services Department is utilizing the provisional indirect rate of 22.2% by the U.S. Department of Health and Human Services for FY2020 for salaries and employee related expenses. The total Amendment amount is $150,000 of which $11,159 is for salaries and benefits. The total estimated indirect costs are $2,477 and fully recoverable. Budget adjustments will be made when the Indirect rate costs has been fully negotiated and shall be effective as of July 1, 2019. Receipt of the funds from Wildfire does not require in-kind or match funds and no future or ongoing contributions by the County at the end of the Agreement term. The services provided under this Agreement are not a mandated function but provides a benefit to the Maricopa County citizens by providing URRD measures in dwellings occupied by low-income residents, which will assist in reducing energy burdens. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. The approval of this funding does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through future budget reconciliation. This Amendment does not impact the County General funds. AMENDMENT TO IGA FOR TUBERCULOSIS CONTROL PROGRAM WITH ARIZONA DEPARTMENT OF HEALTH SERVICES Approve a retro-active Purchase Order (PO) for the TB State IGA ADHS19-206652 between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health (MCDPH) for the Tuberculosis Control Program. The not-to-exceed amount of $281,650.00 is for the budget period July 1, 2019 through June 30, 2020. The IGA term is July 1, 2018 through June 30, 2023. This is a Cost Reimbursement Contract. This grant award is reoccurring and has been awarded to the department for many years. There is no cash or in-kind match requirement. TB services are mandated; should the grant cease, on-going contributions may be required. The grant award is not competitively bid. Maricopa County Department of Public Health’s indirect rate for FY20 is 19.2%. This grant allows for full indirect, therefore the estimated amount of $45,366 is fully recoverable. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. There is no cost to the MCDPH operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Agreement does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. This IGA will provide reimbursement to ADHS for the provision of additional questionnaire data in an amount not-to-exceed $103,500 for the budget period January 2, 2020 through December 31, 2020. The IGA also includes the option of renegotiating the Scope of Work and Pricing through-out the possible 5 year term of this agreement, beginning January 1, 2020 and expires December 31, 2024. The Arizona Behavioral Risk Factor Surveillance System (BRFSS) telephone survey has been in existence since 1984 and is partially funded by the Center of Disease Control and Prevention (CDC). The current lease will expire January 31, 2020. This Fourth Amendment will extend the term of the Lease by two (2) years commencing February 1, 2020 through January 31, 2022 and will have one (1) remaining option to renew for two (2) additional years. This item is located in Supervisory District Five. THIS ITEM REQUIRES THE UNANIMOUS CONSENT OF THE BOARD. This easement is necessary to memorialize the location of the existing gas line located within the former 6th Avenue alignment, south of Jefferson Street and north of Madison Street alignment, which was discovered during the construction of the new County parking lot. This easement also includes the right of ingress and egress to and from the said easement and the right to use the existing roads for the purpose of constructing, inspecting, repairing and maintaining said pipeline or pipelines and appurtenances and the removal or replacement of the same, in whole or in part, at will.
